1 FROM THE PRESIDENT’S DESK

Dear friends,

At the outset, I am overwhelmed with the zenith of mirth and exultation for the compassion extended and the trust reposed in me by illuminating stars of FPBAI galaxy, by way of re-electing me and my debonair office bearers for the smooth functioning of prestigious apex body of publishers and book-sellers.

I express my heart-felt gratitude to each and every brother/sister member for bestowing upon me this honour and opportunity to serve the august fraternity, which I assure and undertake to perform with entire sincerity, dedication and inner-urge. I would also like to annunciate that I shall strive hard for commonweal and probono publico with the ultimate aim to yield solubrious results for the Federation and to deliver subserviently, thereby eradicating the equivocation.

I also resolve that the infelicitous situations enveloping the giant trade shall be enucleated and the ambiguities shall be addressed. I guarantee a close juxtaposition with each one of you on one to one basis and you will find me and my fellow office bearers ubiquitous, accessible and serviceable, “for you, with you, always“. In view of the above, you all are welcome to reveal to us any macro or micro problem whatsoever faced by you, so that together we search out ways and means to eliminate the same.

Mahatma Gandhi used to recite the famous hymn, “Vaishnav jan to tey nay kahiye, jo peerh parai jaane ray!“ (He only is the servant of God, who can feel the pain of others). In the true spirit of this hymn, we at FPBAI, during our first Executive Committee Meeting (ECM), held on January 16, 2013, at Federation office had unanimously resolved to expand the horizon of fellow-feeling, compassion for down-trodden and accelerate the philanthropic activities, thereby to exhaust the Federation fund of almost seven lakh rupees latest by March 31, 2013, on sustainable and charitable issues.

With this view, out of commiseration, an inchoation was made with the disbursement of 400 blankets to the poorest of the poor, wriggling at roadsides or otherwise under extreme weather of inclement and incessant cold, very recently.

In the current year, we are determined to focus our specific attention towards effecting the GOC terms of supply for the to various educational institutions in India. All out efforts are being made to convey the message to entire educational institutions to buy the books on GOC terms and that the practice of tender should come to an standstill forthwith. With this aim in sight, we are in the process of planning to organise seminars in different parts of the country and are also trying to meet the vice chancellors of various universities and directors of the institutes, to convince them to purchase the books from the bonafide members of the Federation and the affiliated associations in the states.

It may be pertinent to apprise you that last year a delegation consisting myself, as GOC Chairman; Mr. J.L. Kumar, Secretary, GOC and Mr. Kailash Balani, President FPBAI, had ...(Cont. on Page 3)

2 visited Srinagar to meet the senior functionaries of the Government of Jammu & Kashmir, at Srinagar, on September 26, 2012, with the view to convey to them, not to float government‘s orders for purchase of books through the medium of tenders, but to stick firmly to GOC norms. I feel delighted to further enunciate that in the result of the aforesaid interaction, Director of Higher Education; Director of School Education and Director of Libraries, J&K, while accepting our plea had agreed to buy the required number of books exclusively through the FPBAI members.

It is also a matter of mirth and satisfaction that the GOC terms are gradually being accepted by most of the universities across the country and they are also insisting the suppliers to get fallen under the flag of Federation.

For the pleasure of of our esteemed readers, we have started a series of columns in our Newsletter under caption, “The Great Thought on Self-Improvement”, covering subjects pertaining to Relationship, Friendship, Happiness, Success, Marriage and Life. We will look forward your comments and suggestions.

We are delighted to place before you the issue of FPBAI Newsletter (Jan-March ’2013).

As you know that the 21st New Delhi World Book Fair held at Pragati Maidan, New Delhi from 4th to 10th February 2013, was largely participated by the FPBAI members. It is one of the biggest book fairs in the Afro-Asia region. The organizers, National Book Trust in collaboration with India Trade Promotion Organization (ITPO) tried their best in providing their services and to give an International look to this fair. This year France was the Guest of Honour Country.

The FPBAI Newsletter has gained more popularity with the enormous growth in its readership. We have tried our level best to provide more and more useful information in this FPBAI Newsletter about the book trade.

In addition to the complete list of International book Fair to be held in 2013, the new column “National and International news” is an added attraction to the readers.

List of World’s largest Book Publishers 2012 with a data of 54 companies is also of great interest to the book trade.

The feature ‘success story’ which is highly appreciated by our members, and provides an inspiration to the present and future generation “ad role models” in the book industry. This issue contains the ‘Success story’ of Mr Manas Saikia, Managing Director of M/s Cambridge University Press India Pvt Ltd., New Delhi. Mr Manas Saikia was conferred with honorary M.A. degree by the Vice Chancellor of Cambridge University.

As far as the issue of banning the polythene bags in Delhi is concerned, a copy of the order of the government on the use of polythene is also reproduced in this issue for the information of the book traders at large.

We are highly thankful to all those who have extended their support by contributing their advertisements in the FPBAI Newsletter. Lastly but not the least I am grateful to Shri S. C. Sethi, our President for his co-operation, guidance and support in timely bringing this Newsletter.

4 58TH ANNUAL GENERAL MEETING OF FPBAI

The meeting was attended by more than 150 members.

5 Taking-up the Presidential Address, Mr. Kailash Balani, highlighted the main activities undertaken by the Federation in the course of the year. (Detailed account had been given in the President’s Report, copies of which were distributed to all the members present in the meeting).

— Five meetings of Executive Committee were held, four at Delhi, and one at Mumbai.

SEMINARS

Seminar on ‘; E-Publishing’ and ‘Piracy of Books’ at Mumbai on 28th April 2012 Bombay Booksellers’ and Publishers’ Association, Mumbai, our State- Affiliated Association at Mumbai, on completion of their 50 years glorious years, had celebrated Golden Jubilee Celebrations on 28th April 2012 at Mumbai. They had invited our Federation to hold a seminar at Mumbai on 28 April 2012. The participants in the Seminar on ‘Publishing’ were addressed by stalwarts of the Indian Book Industry. Dr. Malini Sood, a freelance editor, writer and researcher; Mr. Prabuddha Sircar, who has, since 1974, worked with many multinational publishers; and Mr. S. C. Sethi, Chairman-Seminar Committee, FPBAI. Participants in the Seminar on ‘E-publishing’ were introduced by me. Seminar on ‘Piracy of Books’ was addressed by Mr. Manas Saikia (Cambridge University Press India Pvt. Ltd., New Delhi, and Chairman –Anti-Piracy & Copyright Committee-FPBAI). Mr. Saikia was accompanied by Mr. Bharatvir Singh (Saikrishna Associates, New Delhi). Mr. Bharatvir Singh is an advocate, and specializes in Anti-Piracy.

Proposed Seminar on ‘Publishing and Piracy of Books’ at Srinagar (J&K) The Federation is considering to hold a Seminar on ‘Publishing and Piracy of Books’ at University of Kashmir, J&K for its students to enable them to derive benefits from this Seminar and brighten their career prospects. We are in the process of finalizing the date, in consultation with senior officials of University of Kashmir.

—10th National Book Fair, Lucknow, the prestigious National Book Fair, was held by our U.P. based State Regional Association, Knowledge Tree Foundation, Lucknow, from 4-14th October 2012 in collaboration with the Federation. The fair was very successful as more than 170 stalls with several new publishers had participated therein.

— 21st New Delhi World Book Fair, the biennial World Book Fair, is scheduled to be held at Pragati Maidan, New Delhi, from 4th February to 10th February 2013. National Book Trust, India, are the organizer of this fair.

— Delhi Government had recently announced that production and use of plastic bags will be completely banned in the Capital. We welcome the decision of the Government. However, as books are shrink-wrap-packed in 110 micron film, the Federation had taken up the cause of books and sent a representation to Hon’ble Chief Minister of Delhi with the request that in the interest of students, book lovers and readers at large, the ban imposed on use of polythene should not be made applicable to books. We are happy to inform that, in reply, we have received a copy of the letter from Chief Minister’s Office sent to Secretary (Environment), Delhi Government, forwarding our representation for consideration and appropriate necessary action. We would request our members to use their good offices to approach Delhi Government to consider our request favourably.

In keeping our age old tradition to honour our leading and distinguished members as token of our appreciation for the commendable work done by them for the Indian Book Industry, Awards were also presented to the members at the AGM. While announcing the Award, citation in respect of Awardee was read out by Mr. Vikas Chowdhary, Joint Secretary, FPBAI This Award was given to Mr Ekagra Aggarwal, Star Educational Books Distributor Pvt. Ltd., New Delhi by President Mr. Kailash Balani.

ELECTION OF THE NEW OFFICE BEARERS

7 Mr. A.S. Chowdhary and Mr. Sunil Sachdev started conducting election, as Election Officers, requested non-members to leave to enable them to conduct the elections. They interacted that a circular dated 3rd October 2012 had been issued by the Federation Office requesting for nominations to reach them on or before 7th November 2012. Further, that the elections are to be held for the posts of President-1; 2. Vice Presidents-4 (North, East, West and South); Hony. Secretary-1; Hony. Jt. Secretary-1; and Hony. Treasurer-1. He informed the House that all the nominations (read out by him) were in order (having been proposed and seconded properly), and the names of candidates nominated for these posts were unanimous. The following candidates were declared elected to the posts shown against each of them:

Mr. A.S. Chowdhary and Mr. Sunil Sachdev, Election Officers, thanked the members present at the AGM, and congratulated the President and the members elected as Office Bearers of the Federation for the year 2012-13, and requested the newly elected team to come to dais and take their seats. Mr. S.C. Sethi, President, FPBAI, along with the members of his team, came to the dais and occupied the seats. There was warm applause from the House on the election of each candidate. Mr Sunil Sachdev said that Mr. S.C. Sethi and members of his team deserved a standing ovation from all the members present in the House for having been elected unopposed for the year, and requested all the members to stand and welcome Mr. S.C. Sethi and his team with loud clapping so that they cherish these moments. There was a big applause in the House.

Books are an indispensable instrument for the economic growth of a country. No business or industry can flourish and all roads to prosperity are blocked in a society where books are debarred from playing their rightful role. ❍ ❍ ❍❍❍

Books are the most penetrating and free means of communication. The primary social function of a book is to inspire, inform and entertain. Beyond this, its larger purposes are to ensure freedom and diversity and contribute to social growth and political stability.

PLANS AND PROGRAMMES FOR 2013-2014

— The President informed the house that during the current year, we are extensively covering the institutions to make sure that GOC terms for purchase of books are accepted. — We are planning to organize seminars in Calcutta and Srinagar. — We are planning to hold three Executive Committee meetings outside Delhi. — We will be doing some charitable work during the current year. — The President proposed for the constitution of an NGO which could look after the interest of the employees’ families in the publishing industry. It was also suggested that the deserving candidates amongst employees and their dependants should be assisted for continuing education. On this Mr. B.R Chawla suggested that instead of forming a separate NGO, the Federation can itself start the said work and we can create a fund in the Federation itself for the said purpose.

Mr. S.C. Sethi, President, FPBAI, thanked all the members for their support, cooperation, and the confidence posed in him by electing him as President, and members of his team as Office Bearrers of the Federation. He very much hoped that he would do his best, with the help of his team. He assured the members that due attention will be given to problems being faced by the Book Industry, and would keep in touch with the esteemed members from time to time and inform/

9 consult them about developments, programmes etc. in various matters concerning the Industry. He invited suggestions from the members to help him in this regard. He also offered any member want to become the part of Executive Committee; he is most welcome. He informed the house that our last year balance sheet was under scrutiny by Income Tax authorities and our Chartered Accountant has given undertaking that we will spend ` 07 Lakhs on charities before 31st March 2013. He also informed the house that we are a trust and can’t keep on increasing our income and we will have to do some charity work. House was very happy and it was agreed that whatever undertaking we have given to income tax authorities should be fullfilled before 31st March 2013. He also informed that during their visit to Srinagar as a Chairman of GOC were able to convince Director of Higher Education, Director of School Education and Director of J&K to buy books from the Federation members only and our proposal was accepted and in last two months we were able to enroll 50 booksellers as our members. This commitment was given by me as Chairman of GOC during last AGM which has been kept by me. House appreciated this achievement. He also informed that GOC is being slowly-slowly accepted by the most of the Universities of India and they are also insisting that supplier should be member of Federation.

PROPOSED AMENDMENT OF CLAUSE 31 AT PAGE 17 TO ‘MEMORANDUM OF ASSOCIATION AND ARTICLES OF ASSOCIATION OF THE FPBAI’ AT 58TH AGM

Clause 31 reads as: “The business of the Annual General Meeting shall be: (a) To receive the report of the work of the Federation since the previous Annual General Meeting. (b) To receive and adopt the accounts. (c) To elect the office bearers and the other members of the Executive Committee in place of those retiring. (d) All such other matters as may be resolved upon by the Executive Committee and of which due notice has been given.”

Proposed Amendment to above Sub-Clause (c): (c) Under normal circumstances, election for the Office Bearers is held every year. However, if the members of the Executive Committee feel that election should be held once in two years, they are empowered to decide accordingly. Justification for the above amendment: Presently elections for Office Bearers are held every year. By the time the elected Office Bearers are able to pick up the threads, and understand the working of the Federation, next elections are announced. Thus the team of Office Bearers gets a working period of only 8-9 months, which is hardly sufficient time for them to put in their meaningful contribution for the Federation’s functioning. Hence, this is need of the hour to amend this clause suitably, mentioning that elections for Office Bearers should he held once in two years instead of every year in the Annual General Meeting. It was unanimously passed by the House the amendment proposed above.

Following the election of Office Bearers at 58th Annual General Meeting of FPBAI held on 17th December 2011, the Executive Committee has been reconstituted. Also, Chairmen of various sub-Committees were appointed. This provided the formal framework for launching programmes and carrying out the Federation’s activities during the year 2013-2014.

12 SUCCESS STORY

MANAS SAIKIA’S JOUST WITH LIFE Cambridge University Press

“Ce n’est que le premier pas qui coutel” (Only the first step is difficult). I subscribe to this famous French saying as the same precious words got transmitted into my life. Before giving a brief account of the strides I took and the milestones I covered on the highway of my career, I would like to offer this piece of advise to youngsters on the threshold of career that while moving out for the target destination, it is the first step which is of paramount importance, which must be accompanied with conviction and optimism. I was born in a small town of Nalbari district in Assam. My father was in a frequently transferable government job. I had my early schooling at St. Edmund’s school in Shillong, where at class 5th level, I was awarded Merit Scholarship. I pursued my secondary education at Ramkishan Mission, Narendrapur, West Bengal, followed by further education at Guwahati and Delhi. Today, on this 2nd day of February, 2013, I feel delighted with the feeling of fulfillment on completion of my four decades of inhabitation in this dream city of Delhi, the soft breeze of which infused in me the industrious spirits and the fine sense of belongingness towards it. I have therefore no inhibition or reservation to pronounce myself a certitude ‘Delhiwala’ (Delhi’ite), albeit by domicile. On 3rd February, 1993, I had grabbed the opportunity of joining the prestigious Oxford University Press (OUP) in the capacity of Sales Representative in the age of 19 years on gross salary of Rs. 400/-. During the eight years of my stay at OUP, I had the benefit of learning from Book Publishing giants like Santosh Mukherji, Neil O’brien, late Ravi Dayal and many others. In 1980 I joined Springer India, thereby reporting to yet another Industry stalwart, N.K. Mehra. This was followed by my joining with the British Council as Book Development Officer. Over here, I had to my credit an illuminating exposure of interacting with the International publishing groups which resulted in my close rapport and juxtaposition with British publishers. In 1985, Cambridge University Press (CUP) offered me the post of Representative for India on commission basis. My entering into business sphere was quite accidental. CUP was faced with the problem distribution of its journals in India. I therefore asked my friend Vinod Vasishat, whom I had met in Springer, to enter with me in to partnership and then we created “Foundation Media” specifically to distribute and promote CUP journals in 1987. In 1990-91, India was passing through terrible economic crises. There was no foreign exchange. The only way books could be imported, was by putting in equivalent money in the fixed deposit. As a result import of books suffered a lot. Being a commission agent, we could get no commission since there were no sales. At that juncture, I asked CUP to let me import and deal in books. They agreed and Foundation Books came into being. Foundation Books started from a tiny 300 sq. ft. office in Ansari Road. With the growing income, Foundation Books grew at a fast pace. Meanwhile as my commissions became escalated, I was offered the post of Country Manager by CUP on a fixed salary which I accepted.

13 In 2002, Foundation Books were appointed exclusive distributor for CUP and I ceased to be an employee. Foundation Books become a Private Limited company and the growth was rapid. In 2005 CUP expressed a desire to start an operation in India, I and Vinod decided to let them buy out Foundation Books Pvt. Ltd. by taking a majority shares in 2006. Since then the Company changed name and it is now called Cambridge University Press India Pvt. Ltd. This remains a joint venture with a 75/25 CUP and Indian ownership. I continue to lead the company as its managing director. In 2009, I was greatly honored to receive an “Honorary Degree of Master of Art” from the University of Cambridge in recognition of my long service to Cambridge University Press. I feel most delighted to be a long term member of the FPBAI, where I am an Executive Committee member and head of the Copyright and Anti-Piracy Committee. An Appeal Dear Sir, We take this opportunity to bring to your attention a matter of serious concern to all Booksellers/Subscription Agents/Vendors who subsist on the meagre discounts they receive for all the services they render to Libraries in the country. It has been observed over the last couple of years that more and more Foreign Publishing Houses are becoming direct suppliers of books, journals and e-resources to our Educational and other Institutes of Higher Learning. This is a deviation from the past practices and which were serviced by approved Indian Vendors/Subscription Agents. Ever since Independence, the Indian Agent or Library Supplier has played a very vital role in catering to the needs of the Indian Libraries at all levels. In fact, the Indian Agents of foreign and Indian publishers have been the link all over the country in taking care of the needs of all Libraries and making untiring efforts in securing books/journals from all corners of the world. It is therefore disturbing to note that Foreign Publishers are now canvassing for direct orders and are also supplying Library Resources from overseas to our Educational Institutes. In return the Institutes are also going a step further and paying for these requirements directly in foreign currencies. We have to emphasize that not only their losses in terms of revenue of the Indian Booksellers, but their very existence is threatened or called to question. It may be pertinent to mention that in the past all orders which were routed through Indian companies, not only provided business opportunities to wholly owned Indian entities but also these companies had to pay taxes to the Indian Government on commissions earned by them. In the current scenario, no taxes are paid by foreign companies as the payments are received in full overseas. It is to be noted that while Libraries are communicating with foreign organizations for the bulk of their requirements which are essentially e-resources, they are approaching the Indian vendors only for small orders of books or other printed literature. We hereby appeal to Libraries to give us the opportunity to service their complete requirements which would immensely benefit the local industry. The Good Offices Committee is, therefore, sending this Appeal to all Libraries in India that they should route their requirements for any foreign books, journals and e-resources through Indian companies / agents or vendors so that their Libraries continue to receive the highest level of services. We hope you will support our stand as well as that of the Federation of Publishers and Booksellers’ Associations in India who have made this very important and valid recommendation. Now, therefore, in exercise of the powers conferred by section 5 of the Environment (Protection) Act, 1986(29 if 1986), read with Government of India, Ministry of Home Affairs, Notification No. S.O. 667(E) dated the 10th September, 1992 read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, and in supersession of this Government’s notification No.F(8)(86)/EA/ ENV/2008/9473 dated 7th January, 2009, except the acts and things done or omitted to be done before such supersession, the Government, hereby issues the following directions namely :- Directions: 1. No person including a shopkeeper, vendor, wholesaler or retailer, trader, hawker or rehriwala (i.e. which shall include all kinds of hand published/pulled carts which are used to sell various commodities), shall sell or store or use any kind of plastic carry bags for storing or dispensing of any eatable or non-eatable goods or materials. 2. No person shall manufacture, import, store, sell or transport any kinds of plastic carry bags(including that of Poly Propylene, Non-woven fabric type carry bags) in the whole of National Capital Territory of Delhi. 3. No person shall use any kind of plastic cover or plastic sheet or plastic film or plastic tube to pack or cover any book including magazine, and invitation card or greeting card.

Exception: The direction issued under this notification, shall not affect the use of plastic carry bags as specified under the Bio-Medical Waste (Management and Handling) Rules, 1998

Explanation: For the purpose of this Notification” plastic carry bags” shall have the same meaning as defined

18 in the Plastic Waste (Management and Handling) Rules, 2011 issued by Government of India, Ministry of Environment and Forests, which is reproduced as below: “Carry bags” mean bags made from any plastic material, used for the purpose of carrying or dispensing commodities but do not include bags that constitute or form an integral part of the packaging in which goods are sealed prior to use.

Authorized Officers: The following officers are hereby authorized to implement this Notification in their respective jurisdiction, namely: 1. Member Secretary, Delhi Pollution Control Committee (DPCC) and Officers at the Level of Assistant Environmental Engineer and above 2. Director (Environment), Government of National Capital Territory of Delhi, and Officers at the level of scientist and above. 3. Sub-Divisional Magistrates of Government of National Capital Territory of Delhi In their respective jurisdiction. 4. Assistant Sanitary inspectors and above, Health Inspectors and above, General Licensing Inspectors and above of the respective local bodies namely New Delhi Municipal Council (NDMC), Municipal Corporations of Delhi (MCDs) And Delhi Cantonment Board(DCB) and Public Health Inspectors of MCDs. 5. Food and Supply Officers, of the respective area of Government of National Capital Territory of Delhi 6. Director,Health Services or the Medical officers of Government of National Capital Territory of Delhi nominated by him. 7. 19 PLASTIC BAGS: STAY ON CRACKDOWN EXTENDED

Plastic manufacturers and shopkeepers selling their products in plastic bags can breath easy at least for now as the temporary stay on the crackdown and prosecution against them automatically got extended by a month. Since one-and-half months, Delhi Pollution Control Committee has not been taking action against them after the Delhi high court, which is hearing a petition filed by plastic manufacturers association challenging the ban verbally said “no prosecution in furtherance of the government notification”. But there was no written order. A bench headed by chief justice D Murugesan was to make its stand clear on Friday but the case was not taken up. The next date of hearing has been fixed for March 8 and therefore the automatic extension of the stay. Government and DPCC sources said they were to take a stand on future course of action against the traders and users of plastic bag after ascertaining the outcome of the court hearing on Friday. Asked if the crackdown would now continue in the absence of a written order, a government source told HT: “there is already a verbal stay by the court and there is also a gentleman’s agreement between the government and the manufacturers that there will be no action till the court makes it stand clear” The notification, under which no person can manufacture, import, store, sell or transport any kind of plastic bag in the city had come into force from November 23, 2012. Plastic bags included those used to cover magazines, books, invitation cards and also garbage bags. The next date of hearing has been fixed for March 8 and therefore the automatic extension of stay order.

20 Acting upon Resolution No. 245 of 28th July, 2008 (Annexure-1) to the counter affidavit filed by respondents, impugned challans of 27th December, 2011 and 7th January, 2012 (Annexure P- 4 colly) have been issued to petitioner, which have been assailed in this petition. Learned counsel for petitioner contends that without amending relevant Schedule to the Delhi Municipal Corporation Act, 1957, petitioner cannot be challaned for storage of books, copies, stationery etc., as no trade license is required for storage of such books, copies, stationery etc.

Learned counsel for respondents draws attention of this Court to Resolution of 28th July, 2008 (Annexure A-1) to the counter affidavit of respondents and Brochure for obtaining license/ permission to run the trade and storage of the year 2008 (Annexure A-2) to point out that by invoking Sub-Section (b) of Section 417 of the Delhi Municipal Corporation Act, 1957, the Commissioner of respondents is empowered to add or delete any item for which trade license is required.

Upon hearing counsel for parties and on perusal of material on record and the relevant provisions of Delhi Municipal Corporation Act, 1957, this Court finds that The Eleventh Schedule to Delhi Municipal Corporation Act, 1957 spells out the articles/ goods for which the license is required and books, stationery etc. does not figure therein. It is preposterous on the part of counsel for respondents to contend that Brochure (Annexure A-2) permits respondents to add or subtract items in The Eleventh Schedule on the basis of mere Resolution, without actually amending The Eleventh Schedule to Delhi Municipal Corporation Act, 1957. To say the least, respondents cannot proceed to challan persons storing books, stationery etc. on the basis of Resolution (Annexure A-1) and Brochure (Annexure A-2) without getting The Eleventh Schedule to Delhi Municipal Corporation Act, 1957 amended to add the articles, as mentioned in the Brochure (Annexure A-2) requiring trade license.

This petition is accordingly allowed and respondents are restrained from issuing challans for storage of books, stationery etc. unless amendments made as per Resolution (Annexure-1) and Brochure (Annexure A-2) are duly incorporated in The Eleventh Schedule to Delhi Municipal Corporation Act, 1957.

With aforesaid observations, this petition and pending applications are disposed of, with no order as to costs.

NEW DELHI WORLD BOOK FAIR 4th February to 10th February 2013

New Delhi World Book Fair began in the capital from 4 to 10 February 2013 at Pragati Maidan, New Delhi. The fair was organised by National Book Trust, India, an apex body of the Ministry of Human Resource Development engaged in book promotional activities in the country with India Trade Promotion Organization (ITPO), Pragati Maidan. This year France is the Guest of Honour country. The theme of the Fair was “Indigenous Voices: Mapping India’s Folk and Tribal Literature”, where the multifarious expressions of India’s traditional native cultures including exhibit of books, traditional art forms, crafts, panel discussions and performances were showcased. About 123 countries including China, USA, Poland, South Korea, Turkey and UNO agencies like WHO, UNESCO, among others displayed books in the Foreign Pavilion. The fair was inaugurated by the Minister of State for HRD, Dr. Shashi Tharoor. “Nothing delights me more than encouraging Indians to read and celebrating books and childhood is the time to discover books,” said Dr. Sashi Tharoor. He also said that though e-publishing has made inroads in India but only 16% of people read digital books, rest 74% still rely on conventional printed books. Dr. Karan Singh, MP (Rajya Sabha) and President of Indian Council for Cultural Relations (ICCR) was the Guest of Honour. He said that for a book lover, there is no greater treat than book fair. “Books have played critical and crucial role in civilisation,” he said. He also reiterated the fact that though quantum of publishing is equivalent to the number of readers, but attempt needs to be taken to cover other languages as well. Besides, he also emphasised on the fact that there need to be value-based education in the curriculum. His Excellency Francois Richier, Ambassador of France for India was the special guest on the occasion. “It is very important occasion for France,” said Mr. Francois, “Though France has not invented writing, or internet, they have been contributing a lot to books not only for our consumption but whole community.” The seven day long World Book Fair was a one stop platform for promoting titles, co-publication arrangements and trade contracts. It was a major event for all the book lovers and an opportunity to explore the biggest book market in the world. Nearly 1,100 exhibitors from 28 countries

22 showed books in every category in 2,100 stands. A special inclusion for e-books has also been made where e-book developers, publishers, and content providers displayed their e-books. Overall the fair was a successful event and is one of the best platform which went out of its way to push business opportunities—its primary focus—with two important B2B events, a New Delhi Rights Table and CEO Speak where Indian and foreign publishers discussed trade and exchanged ideas. The fair was more people and media-friendly this year with civic servies such a shuttles to ferry tourists around the halls covering nearly 45,000 square metres and instant information for the national and international media. “The next World Book Fair will commence from February 15 to Febraury 23, 2014 at the Pragati Maidan,” and Poland will be the guest country. We must appreciate the efforts of National Book Trust (NBT) for organizing New Delhi World Book Fair, which was very well organized. However, we received several complaints from our members which are mainly related to the following deficiencies:- 1. Toilets were very dirty as usual. 2. Cleanliness was not upto the mark. 3. Local transport facility ferrying the passengers from gates to pavilion was inadequate, which caused hardship to ailing people and senior citizens. 4. Non-availability of drinking water. 5. Inappropriate behaviour of security staff at gates. It is hoped that next time NBT will escalate these concerns to ITPO and all concerned.

In a move that marks an expansion into the Indian market, HarperCollins Worldwide has taken complete ownership of HarperCollins India after running the company for 10 years as a joint venture with Living Media India, an Indian media company focused on publishing and music. E-BOOK SALES DATA, THE TRUTH IS OUT THERE

Published for the first time in the UK e-book sales data throws a chink of light on the size and variance of the e-book market and its relationship to print book sales. The basic numbers are clear. The data shows that the e-book market for traditionally published digital books is much bigger than previously thought, with estimates suggesting that a total number of 65 million e- books were sold in 2012, representing a b value of about £ 200m –at least double what it was in 2011 (in volume terms more than double). That would mean the overall book market grew in 2012, despite spending on print books falling £ 44m..

The data was gathered from the major trade publishers, and those smaller presses with books in The Bookseller’s Top 50 of 2012, including Hesperus Press. The approach harks back to pre- Nlelsen BookScan days when Peter Hartand of Bookwatch and Alex Hamilton of ‘fastsellers’ fame would compile lists based on publisher’ sales. Unlike those days when publishes could inflate sales by ignoring returns, and including exports, the data we have is based on e- books that have actually sold(thre are no returns in the e-book world, and we asked for UK sales only).

24 Excluding titles where –e-book sales data wasn’t given, the average share of book sales in the top 50 that came from digitial editors was 16 % but there were huge fluctuations within the data, not least within genre. Just 7% of total sales of the non-fiction titles that are currently available in formats (Call the e-book share of cheaper non-fiction titles that are currently available in paperback formats(Call the Midwife. A Street Cat Named Bob. Thinking Fast and Slow), were higher at between 12% and 21%. The e-book share of adult-audience novels in the Top 50 is significantly higher than non-fiction and children’s with the print/e-book share averages being 74%26%. But even within the fiction sector, there are fluctuations. A massive 45% of sales of S.J.Watson’s Before I go to sleep and Jonas Jonasson’s The Hundred-year-Old Man came in “e” in 2012. But just 8% of sales of Sue. Townsend’s The Woman Who Went to Bed for a Year were digital. Of course not all the titles listed in the top 50 will have been the biggest e-books of the year, and had we re-ranked the list according to total print and e-book sales, fiction titles would have moved up the list (and new ones come) in) at the expense of non-fiction books. Anchoring the chart by print sales allows us to limit the universe, and also un-artificially exclude most 20 p e- and self-published titles. I have nothing against either, but the chart needs to be meaningful beyond a duplicate of the Kindie bestseller lists. Of course the intention is not to replace third-party e-book bestsellers lists when they become available, but to use this data to supplement. The Bookseller’ analysis of the physical book market each week(Contrary to what I’ve read elsewhere the lack of e-book sales data from NelsenBookScan does not undemine that serve, but serves to emphasize how important it has become as a service to the trade. The current lack of e-book data helps no-one but Amazon. Only this week the internet company announced that 15 of its top 100 best-selling Kindle books of 2012 were written by independent(i.e. self-published) authors and published using Kindle Direct Publishing according to Amazon 12 authors have sold in excess of 100,000 copies. One would think from Amazon’s publicity that it was the only game in town. But judging by our top 50 list, and other figures supplied privately, there are many traditionally published writers selling far more, in e-book alone. When you include print sales the list grows to beyond 200. Amazon’s own bestselling KPD bestseller list contains titles that I now know have sold far fewer copies that e-books published by publishing companies such as Hachette and Simon & Schuster. In fact there are books I’ve not even heard of that have sold more copies than those books feted over the year by Amazon. I don’t write this to undermine those self-published writers of their hits, in fact I greatly admire how they’ve seized the opportunities open to them and given publishes a bloody nose, and in some cases managed to earn a living publishing direct to the consumer. But readers deserve more. Amazon should be promoting the most popular titles available, not just those titles that serve its business aims. There is a wider argument too. As I wrote in my leader article in this week’s Bookseller for years we’ve been labouring under the assumption that books were somehow in decline, that reading particularly of traditionally published books, was going out of fashion – published out by smartphones, iPads, computer games and, of course, the digital slush-pile. But the aggregate numbers we have been able to gather this week, and which we hope to build on in the weeks and months ahead, show a different ;picture. By no means the complete picture, but a better one than we’ve previously had access to, and an encouraging one both for authors and their publishers. —Source: www.futurebook.net

25 THE GLOBAL 50: THE WORLD’S LARGEST BOOK PUBLISHERS, 2012

Pearson’s commitment to publishing allowed it to widen the company’s lead as the world’s largest book publisher in 2011. While Pearson, with holdings in both the trade and educational publishing segments, was able to increase its revenue last year, its closest rivals lost ground, according to Livres Hebdo/’s annual ranking of the world’s largest publishers. Second place Reed Elsevier, for example, saw its publishing sales fall as it had created a risk management division, which has no book-related sales. Among other top 10 companies, Hachette Livre sales dipped due to spotty softness worldwide, including a small decline in the U.S. Grupo Planeta sales were also off in 2011, and with economic conditions worsening in Spain the publisher faces a difficult 2012. Softness in the school market resulted in a decline in sales at McGraw-Hill Education in 2011, but the company remained the largest U.S.-based book publisher. Bertelsmann’s book revenue declined in 2011 as well, due to the sale of its direct group business, and its publishing activities are now centered around ’s trade publishing operations. The company could move up the charts in the future, however, if Bertelsmann makes good on its plan to expand into educational publishing. Its German rival, Holtzbrinck, has long had a diversified publishing portfolio of trade, science, and educational properties, and it had strong gains in 2011, closing the gap with Bertelsmann (at least on the publishing side) and putting the parent company of Macmillan in ninth place among the global publishing giants. The 10 largest publishers accounted for about 47% of all revenue generated by the 54 companies that made this year’s list. Beyond the top 10, one of the most notable changes among the largest publishers occurred in the first part of 2012, when Russian publishing leader AST (#45 overall in 2011) bought EKSMO (#54).

29 NEW-AGE AUTHORS CASH IN ON GROWING MARKET

If you thought writers live in garrets, then you have not followed the story of India’s rapidly growing market for commercial fiction, which has spawned a whole new tribe of writers. In a country, where the benchmark for a bestseller is a mere 5,000 copies, the sales of their books regularly hit the 1-lakh mark, mostly within months of release. And these authors never set out to be writers in the first place. Recently, many of them — Amish Tripathi, Ashwin Sanghi, Ravinder Singh and of course, Chetan Bhagat, all management professionals, — even figured on the Forbes India Celebrity 100 list on the basis of their fame and money earned as writers. Having earned financial security from the phenomenal sales of their books, many of them are giving up their cushy management jobs to become full-time writers — and even publishers. In 2011, Delhi-based Durjoy Datta, an alumnus of Delhi College of Engineering, quit his job at American Express as a marketing analyst and turned a full-time writer. Datta has no regrets — he earns about Rs. 30 lakh a year from sales of his books — more than what he was earning as a marketing analyst. Besides, he set up a publishing house — Grapevine India — with the objective of “identifying young and upcoming talent, backing them and developing them into strong recognisable brands”. His publishing venture has already brought out about 20 titles by new writers from varied backgrounds. “With the market for commercial fiction expanding exponentially, it is a good time to be in publishing,” says Datta, who is currently busy with the publicity of his seventh book, ‘Someone like You’, co-authored by Nikita Singh. It made its way into the bestseller list within the first week of its release earlier this month. Mumbai -based Amish Tripathi , an IIM (Kolkata) alumnus, also quit his job as a banker in 2011 to take up writing full time. “I am a risk-averse banker! I resigned only after writing my first two books and feeling reasonably confident that my royalty cheque would be enough for me to pay my bills. So I’m one of those lucky people who are earning their living from work that they like doing,” says Tripathi, whose first two books — The Immortals of Meluha and The Secret of the Nagas — have crossed the 1 million sales mark. The concluding part of his Shiva trilogy — The Oath of The Vayuputras — is to be released later this month with an astounding print run of 5 lakh copies. Then there are those high-earning authors such as Ashwin Sanghi, a Mumbai-based management graduate from Yale, who says while his earnings from the sales of his books are enough to allow him to live as a full time writer, he has chosen to follow writing as a passion, not profession. “My earnings from royalties and movie rights are substantial enough to support me financially. But if I were to give up working and focus only on writing, then my writing would become work,” says Sanghi, who runs his own business. Sanghi is the bestselling author of The Rozabal Line, Chanakya’s Chant and The Krishna Key, whose combined sales is about half a million copies. So, what is the secret of success of these writers — the smart, largely self-driven marketing or great story-telling? Vaishali Mathur, senior commissioning editor, Penguin Metro Reads, publishers of Ravinder Singh and Durjoy Datta, says that commercial writers are successful because they have a huge connect with their readers. “Those who read their books can relate to the stories and identify

30 with the characters as most authors are also in the same demographics as their readers,” she points out. This new breed of writers has changed the very concept of bestsellers in India. Earlier, any book that crossed the 5,000 mark was considered a bestseller, now the figures have risen to upwards of 10,000. Adds Kapish Mehra, managing director, Rupa Publications, publishers of Chetan Bhagat and Ravi Subramanian, “It is possible to make money as a writer in this country, if you can break into the exclusive club that includes the likes of Chetan Bhagat and constantly sell 1 lakh copies per year.” And this exclusive club is expanding fast. —Hindustan Times, February 24, 2013

INDIAN AUTHORS WRITE THEIR WAY TO THE BANK

Gone are the days when writers needed a day job to make ends meet. Today, Indian authors are quitting cushy jobs and still earning enough to live decently. In a country where the benchmark for a bestseller is a mere 5,000 copies, people who never set out to become writers are crossing the one lakh-mark, thanks to young readers who find their work ‘relatable’. Earlier this month, Ravinder Singh left his job with Microsoft in Hyderabad and moved to Delhi to pursue writing full-time. His first book, I Too Had A Love Story, became a bestseller in 2008. “I never thought my book would change my life and career,” he says. While Chetan Bhagat’s rise to fame has been well-documented, authors such as Singh, Amish Tripathi and Ashwin Sanghi figure alongside him in the Forbes India Celebrity 100 list, which ranked people based on money and fame earned between October 2011 and September 2012. In one year, Tripathi made about Rs. 10 crore, Bhagat Rs. 3.29 crore, Sanghi Rs. 98 lakh and Singh Rs. 42 lakh. So lucrative is the profession that Ravi Subramanian, a Mumbai-based banker and author of If God Was A Banker, managed to buy a BMW with his royalty money alone. —Hindustan Times, February 24, 2013

The Enforcement Directorate has been asked to investigate alleged violation of Foreign Direct Investment regulations by e-commerce company Filipkart Online Services and cash & carry chain Bharti Wal-Mart. Publishing company HarperCollins is launching a new education publishing division, Collins India, to provide school text and reference books Upwards of 90,000 schools in India teach in English, Collins India expects to provide its first range of books into schools in 2014. The UK Collins business has been publishing books in English language, , literacy, mathematics and science. Collins will exploit published content assets, and also develop content locally to match the CBSE (Central Board of Secondary Education) curriculum, to start with. The English language schools market in India is already bigger-at more than £ 150 million – than the market in the UK and growing steeply, the company said. —The Hindustan Times, February 4, 2013

The utility needs to be downloaded afresh from ‘DOWNLOADS’ section of ACES website, www.aces.gov.in or after logging in, under the navigational path RET-> e-Filing -> Download eFiling Utility. Before filling-in the Return, please go through the FAQs available under HELP Section of ACES Website under the navigational path: https://www.aces.gov.in > Help > Frequently Asked Questions > Returns > ST 3 Return for July-September, 2012. The last date of e-filing of this return is 15th April, 2013. After uploading the return to ACES, the status of the return can be checked under RET-> e-Filing -> View XML Status and the filed return can be viewed under ‘View Original ST3’ and ‘View ST3’ options in the RET module of ACES after a few days (the exact date to be announced later).
