TRUE EXTRACT OF THE ORDINARY BOARD MEETING OF THE CANTONMENT BOARD, SECUNDERABAD HELD AT THE CONFERENCE HALL, OFFICE OF THE DEFENCE ESTATES OFFICER, T & A.P. Vijayant Chauhan, Nominated Member SPECIAL INVITEES: ⮚ Shri A. Revanth Reddy, Hon’ble Member of Parliament, has not attended the meeting. ⮚ Shri G. Sayanna, Hon’ble MLA, has attended the meeting. Before the start of the meeting the Board has paid tributes to Shri Mahatma Gandhiji on Martyr’s Day and the members observed 2 minutes Silence. President Cantonment Board welcomed all the Members of the Board. 1 | Page Before proceeding to the agenda points Elected Members have given certain representations to the President Cantonment Board as follows:- Smt. Anitha Prabhakar, Elected Member, Ward No. III, raised an issue of irregular water supply in the ward. She requested to cater to the needs of the People through supply of water tankers on time. The CEO apprised the Board that the Cantonment Board is dependent on supply of water from HMWS&SB and the supply is not adequate which is causing irregular and insufficient water supply in areas of Ward II & Ward III. The CEO informed that except in Wards II & III the remaining Wards have no major problems in regard to water supply. The CEO also informed that the matter has already been taken up with HMWS&SB. Shri J Ramakrishna, Elected Member, Ward No. V, informed that the State Government has introduced a scheme of free Water Supply to the households upto 20KL per month, but Cantonment area has been excluded for the same. Efforts have to be made to extend the benefit to the residents of Cantonment Area. Shri J Maheshwar Reddy, Vice President & Elected Member, Ward No. I, has informed that the Hon’ble Minister of Municipal Administration and Urban Development, Shri. K T Rama Rao, has assured that the benefit of free water supply scheme would be extended to Cantonment area. Hon’ble MLA Shri G. Sayanna has informed that the scheme of free water supply has been introduced very recently in the GHMC area and it shall be extended to Cantonment area too. PCB opined that the Government Orders of Telangana State Government, with regard to free water supply scheme to be studied in detail and necessary action be taken for extending the scheme in Secunderabad Cantonment area too. PCB also opined that phase wise installation of water meters in Cantonment area has to be taken up. Shri J Maheshwar Reddy, opined that the installation of water meters will have a additional burden on small income groups residing in Cantonment area. Phase wise implementation will however be carried out. After detailed discussion the Board unanimously resolved requesting the State Government to extend the free water supply scheme upto 20KL per month per household to Secunderabad Cantonment Area. Shri S Keshava Reddy, Elected Member, Ward No. II, informed that there are certain building plans which are not included in the present agenda and requested that the same be considered in the present meeting. President Cantonment Board informed that any such plans can only be included in the next Board meeting after due inspection in all aspects by the technical staff of the Board. 2 | Page Shri J Maheshwar Reddy, has given a representation to PCB to allot place near Jubilee Bus Station for installation of Statue of Shri Krishna Swamy Mudiraj, Former Mayor of Hyderabad. PCB informed that the request will be considered after identifying the suitable land and not only the statue of the former Mayor but the statues of all illustrious Personalities National & State including Freedom Fighters shall be installed only in places designated by the Cantonment Board. The detailed plan may be submitted by the CEO in this regard. After the above discussions the regular agenda points were discussed as under. No. 02, dated Trimulgherry, GLR Sy.No.279-50 & 279-51, Class 'C' 02.11.2020 land, Secunderabad Cantonment for a period of five (05) years under section 267 of the Cantonments Act, 2006 (or amended time to time, as the case may be). Provisioning of Conservancy Services at Non- Cantonment Military Station, Golconda including Circular Agenda Mehdipatnam and Langer House by providing 156 09. No. 01, dated Conservancy Safaiwalas and Garbage lifting vehicles 11.01.2021 for 24 MT garbage per day for a period of one year for 2021-22. Relevant files are placed before the Board. Resolution: Considered and noted. LEASING OF COLLECTION RIGHTS OF TOLL TAX FOR THE PERIOD FROM 15.03.2020 TO 14.03.2021. Reference, CBR No. dated 19.10.2020. [ 02 ] To consider the legal opinion of Senior Standing Counsel, Cantonment Board, Secunderabad dated 30.12.2020 in connection with extension of leasing of collection rights of toll tax for a period of three months as requested by the contractor due to hardship faced by them on account of Covid-19 pandemic and also opinion on vetting of the lease agreement. It is to submit that the letter submitted by the M/s. Balaji Enterprises, Ahmedabad dated 08-09-2020 stating the hardship faced by them due to the pandemic Covid – 19 and to extend the contract by three months to recover the loss suffered by them. The matter was placed before the Board and the Board vide its CBR No 26, dated 14-10-2020 resolved that the contract agreement be got vetted from legal expert and to obtain the legal opinion on the said matter Accordingly the matter was referred to Shri K R Koteshwar Rao, Senior Standing Counsel for Cantonment Board vide this office letter No SCB/Tax/Toll Tax/2455, dated 10th November 2020 requesting to forward the opinion at an early date for taking further necessary action. In response the Senior Standing Counsel vide his letter dated 30-12-2020 opined that the Board is competent authority to grant extension of lease for a period of three months as requested by the contractor on payment of usual monthly installments on or before 10th of every month during the extended period if the lessee is willing to perform on such conditions, the same can be considered by the Board. Further with regard to vetting of agreement, the Standing counsel opined that the clauses of the agreement are proper, legally tenable and fit into the relevant provision of the Indian Contracts Act and the same has been vetted as proper document for its enforceability. 4 | Page Further it is to submit that the contract has come into force with effect from midnight 0000 hours on 14/15-03-2020 and the operations have stopped due to pandemic COVID-19 from 21st March 2020. The firm has re - started collection of toll tax from 02nd June 2020 during day time only and from 7th July 2020 they have started the collection round the clock. The legal opinion along with the relevant file and detailed report is placed before the Board. Resolution: The CEO apprised the Board that leasing of collection rights of toll tax for a period of one year was awarded to M/s.
