Before the start of the meeting the Board has paid tributes to Shri Mahatma Gandhiji on Martyr’s Day and the members observed 2 minutes Silence.

Before proceeding to the agenda points Elected Members have given certain representations to the President Cantonment Board as follows:-

Smt. Anitha Prabhakar, Elected Member, Ward No. III, raised an issue of irregular water supply in the ward. She requested to cater to the needs of the People through supply of water tankers on time. The CEO apprised the Board that the Cantonment Board is dependent on supply of water from HMWS&SB and the supply is not adequate which is causing irregular and insufficient water supply in areas of Ward II & Ward III. The CEO informed that except in Wards II & III the remaining Wards have no major problems in regard to water supply. The CEO also informed that the matter has already been taken up with HMWS&SB.

Shri J Ramakrishna, Elected Member, Ward No. V, informed that the State Government has introduced a scheme of free Water Supply to the households upto 20KL per month, but Cantonment area has been excluded for the same. Efforts have to be made to extend the benefit to the residents of Cantonment Area.

Shri J Maheshwar Reddy, Vice President & Elected Member, Ward No. I, has informed that the Hon’ble Minister of Municipal Administration and Urban Development, Shri. K T Rama Rao, has assured that the benefit of free water supply scheme would be extended to Cantonment area.

Hon’ble MLA Shri G. Sayanna has informed that the scheme of free water supply has been introduced very recently in the GHMC area and it shall be extended to Cantonment area too.

PCB opined that the Government Orders of State Government, with regard to free water supply scheme to be studied in detail and necessary action be taken for extending the scheme in Secunderabad Cantonment area too. PCB also opined that phase wise installation of water meters in Cantonment area has to be taken up.

Shri J Maheshwar Reddy, opined that the installation of water meters will have a additional burden on small income groups residing in Cantonment area. Phase wise implementation will however be carried out.

After detailed discussion the Board unanimously resolved requesting the State Government to extend the free water supply scheme upto 20KL per month per household to Secunderabad Cantonment Area.

Shri S Keshava Reddy, Elected Member, Ward No. II, informed that there are certain building plans which are not included in the present agenda and requested that the same be considered in the present meeting. President Cantonment Board informed that any such plans can only be included in the next Board meeting after due inspection in all aspects by the technical staff of the Board.

Shri J Maheshwar Reddy, has given a representation to PCB to allot place near Jubilee Bus Station for installation of Statue of Shri Krishna Swamy Mudiraj, Former Mayor of . PCB informed that the request will be considered after identifying the suitable land and not only the statue of the former Mayor but the statues of all illustrious Personalities National & State including Freedom Fighters shall be installed only in places designated by the Cantonment Board. The detailed plan may be submitted by the CEO in this regard.

After the above discussions the regular agenda points were discussed as under.

LEASING OF COLLECTION RIGHTS OF TOLL TAX FOR THE PERIOD FROM 15.03.2020 TO 14.03.2021.

Reference, CBR No. dated 19.10.2020.

[ 02 ] To consider the legal opinion of Senior Standing Counsel, Cantonment Board, Secunderabad dated 30.12.2020 in connection with extension of leasing of collection rights of toll tax for a period of three months as requested by the contractor due to hardship faced by them on account of Covid-19 pandemic and also opinion on vetting of the lease agreement.

It is to submit that the letter submitted by the M/s. Balaji Enterprises, dated 08-09-2020 stating the hardship faced by them due to the pandemic Covid – 19 and to extend the contract by three months to recover the loss suffered by them. The matter was placed before the Board and the Board vide its CBR No 26, dated 14-10-2020 resolved that the contract agreement be got vetted from legal expert and to obtain the legal opinion on the said matter

Accordingly the matter was referred to Shri K R Koteshwar Rao, Senior Standing Counsel for Cantonment Board vide this office letter No SCB/Tax/Toll Tax/2455, dated 10th November 2020 requesting to forward the opinion at an early date for taking further necessary action. In response the Senior Standing Counsel vide his letter dated 30-12-2020 opined that the Board is competent authority to grant extension of lease for a period of three months as requested by the contractor on payment of usual monthly installments on or before 10th of every month during the extended period if the lessee is willing to perform on such conditions, the same can be considered by the Board. Further with regard to vetting of agreement, the Standing counsel opined that the clauses of the agreement are proper, legally tenable and fit into the relevant provision of the Indian Contracts Act and the same has been vetted as proper document for its enforceability.

Further it is to submit that the contract has come into force with effect from midnight 0000 hours on 14/15-03-2020 and the operations have stopped due to pandemic COVID-19 from 21st March 2020. The firm has re - started collection of toll tax from 02nd June 2020 during day time only and from 7th July 2020 they have started the collection round the clock.

The legal opinion along with the relevant file and detailed report is placed before the Board.

Resolution: The CEO apprised the Board that leasing of collection rights of toll tax for a period of one year was awarded to M/s. Balaji Enterprises on 14/15-03-2020. Due to the pandemic COVID 19 the collection of toll tax was stopped from 21-03-2020 to 02-06-2020. Thereafter the contractor has started collection from 03.06.2020 to 06.07.2020 only during the day time as night curfew was in place due to COVID 19. Thereafter from 07.07.2020 the contractor has started collection of toll tax throughout the day and night without any hindrance. The request of the contractor for extending the contract for three months was placed before the Board and the Board vide its CBR No 26, dated 14-10-2020 resolved that the contract agreement be got vetted from legal advisor and to obtain the legal opinion on the said matter. The Senior Standing Counsel of Cantonment Board has submitted legal opinion on 30.12.2020 stating that the Board is competent authority to grant extension of lease for a period of three months as requested by the contractor on payment of usual monthly installments on or before 10th of every month during the extended period if the lessee is willing to perform on such conditions, the same can be considered by the Board. The PCB asked any of the member to read the legal opinion. Shri J Maheshwar Reddy, Vice President has read the same and opined that the legal opinion is clear and extension of the contract may be considered. Shri J Ramakrishna, Elected Member, Ward No. V has also expressed his view to consider the request of M/s. Balaji Enterprises as there was no collection of toll tax during the lockdown period. After the deliberate discussion the Board resolved that non operative period from 21.03.2020 to 02.06.2020 and thereafter the non operative nights from 03.06.2020 to 06.07.2020, to be considered as half days, be considered as dies non period i.e. a total of 91 days be considered as dies non and for equivalent number of days the contract period be extended from the day after the last day of the present contract at the same terms and conditions as opined by the legal standing counsel. The CEO is authorized to take necessary action in this regard.

OCCUPATION/ALLOTMENT OF LAND FOR TELANGANA STATE DISASTER RESPONSE AND FIRE SERVICES DEPARTMENT

[ 03 ] To consider the letter No.1869/Plg 2020 dated 18.07.2020 and dated 21.08.2020 from the Director General Telangana State Disaster Response

5 | Page and Fire Services Department requesting for allotment of suitable land for construction of new fire station building at Secunderabad Cantonment so as to provide essential and emergency services required for the safety of life and property of residents of cantonment and to respond to all the fire and emergency calls. They have also mentioned that they have to attend to stand by duties during the visits of VVIP His Excellency President of every year at Rastrapathi Nilayam at Bollarum.

In this regard it is pertinent to mention that as per Section 62(xv) of Cantonments Act, 2006, it shall be the duty of every Board, so far as the funds at its disposal permit, to make reasonable provision within the cantonment for rendering assistance in extinguishing fires, and protecting light and property when fire occurs.

In this connection report from the Engineering Branch along with the proposed sites are attached herewith for the consideration of the Board. Further the President of Teachers Colony, Trimulgherry has proposed two sites in the location for allotment of suitable land to fire service department.

The Board may take the decision in the matter.

Resolution: Considered and approved to recommend allotment of 598 Sq.Yds. out of 40% Gifted-land in Teachers Colony in GLR Sy. No. 364/A for construction of a new fire station building which is a public purpose. The allotment is proposed on lease basis renewable every 5 years on payment of premium and rent as per the instruction of Govt. of India, Ministry of Defence from time to time.

RE-APPROPRIATION OF BUDGET SANCTIONED BY THE GOC-IN-C IN THE SAME HEAD CODE.

[ 04 ] To consider the report submitted by Accounts Department for re- appropriation of Budget sanctioned by the GOC-in-C in the same Head Code.

As per the report, the PDDE , SC, Letter No. 8078/Budget/Cantt/ Gen/V/DE, dated 01st October, 2020, sanction of GOC-in-C in respect of Cantonment Board Budget for the financial year 2020-21 (revised) and financial year 2021-22 (Original) has received. The same was noted in the Cantonment Board meeting for its noting and the same was noted by the Board vide its CBR No. 47, Dated:19-10-2020. The sanctioned budget has been entered in the ABAS system and intimation was sent to PDDE vide this office Lr.No. SCB/AB/Budget/152 Dated : 20th November, 2020.

The sanctioned budget in some of the detailed head codes are in excess of the expenditure incurred and expected expenditure for the financial year 2020-21 and there is a need of budget re-appropriation within

As per Rule No. 33(2(b)) re-appropriation of budget “if it involves a re- appropriation of sum within the same Basic Function, the Chief Executive officer shall place it before the Board for sanction along with his recommendations”.

Resolution: The CEO apprised the Board about the need for such re- appropriation. The Board Considered and approved for the re appropriation within the same Head Codes.

Resolution: Considered and approved. Further the Board authorized the CEO to take the decision on selling of Asbestos Sheets which are unsold even after placing them for the auction twice.

MANNING AND OPERATION OF WATER PUMPING STATIONS AND RESERVOIRS WITHIN SECUNDERABAD CANTONMENT BOARD ON CONTRACT BASIS FOR ONE YEAR

[ 06 ] To consider the report of Water Department regarding the tender proceedings of “Manning and Operation of water Pumping Stations and Reservoirs within Secunderabad Cantonment Board on contract basis for one year”, with reference to 1st cited above this office has called for e-tenders for the subject work vide Tender Notice No.SCB/SWW/ETen/Manning/ 2020/1124, dated 02-06-2020 and mentioned that last date of submission of Tenders as 23-06-2020 upto 1200 hrs. In response to the above, three bidders have participated and in which one of the bidders has quoted (-) negative percentage and retendering was done by rejecting negative quoted bidder to participate.

With reference to 2nd cited above this office has recalled the tender vide Tender Notice No. SCB/SWW/ETen/Manning2/2020/1859, Dated 27- 08-2020. In response to the above, five bidders have participated and it is observed that, two bidders have quoted the abnormally low i.e. decimals after zero and considered unresponsive in the light of office Memorandum of Ministry of Finance Dept., of expenditure, Govt of India dated 28-01-2014 and CDA(Fin) letter dated 27-09-2017, hence not considered and decided to recall the tender. With reference to 3rd cited above this office has recalled the tender vide Tender Notice No.SCB/SWW/ETen/Manning3/2020/2538, dated 18- 11-2020. In response to the above, only two bidders have participated and one of the bidders has quoted negative (-) percentage on total wages, which is not acceptable in the subjected work, and the same was also mentioned in the tender document & BoQ as “The quotation abnormally low or with

decimals after zero will not be allowed”, accordingly, tender has been cancelled and forfeited the EMD submitted by the L1 bidder.

With reference to the 4th cited above this office has recalled the fresh tender vide tender Notice No. SCB/SWW/ETen/Manning4/2020/2825, Dated 09-12-2020. In response to the above, only one bidder has participated.

From the above it is observed that, KOTA ASSOCIATES has quoted the lowest percentage i.e., (+) 5.99% on the total wages and the current running rate is 14%.

Resolution: Considered and resolved to approve the lowest rates quoted by the qualifying L1 contractor M/s. KOTA ASSOCIATES. Further it is resolved that until finalization of new tenders the existing contract will be continued as per the prevailing rates. This shall hold good for all contracts of the Cantonment Board.

APPLICATIONS FOR SANCTION OF BUILDING CONSTRUCTIONS

[ 07 ] To consider the building notices received under section 235(1) of the Cantonments Act 2006 from the following applicants for erection of Building on Plot / Survey Numbers in colonies mentioned against each.

The building plans are in accordance with the building byelaws and FSI restrictions. The site in each case is situated outside notified civil area classified as B-2 land as per the GLR maintained by the DEO, AP Circle, Secunderabad.

The layout of these colonies was sanctioned after 1974 and the societies have handed over 40% open area for civic and other amenities to the Cantonment Board, Secunderabad by a way of Registered Gift Deed as per the bye-laws.

As per the decision of the Board in its meeting held on 04th November 1997, No Objection Certificate from Airport Authority of India has not been insisted in such cases where construction of only Ground Floor is involved.

The Board resolved to approve the building applications under section 235 of the Cantonments Act, 2006 subject to condition that the plan will be released only after Rain Water Harvest Pits are made in the plots. CEO shall release the plinth sanction only as resolved under CBR No.12 dated 07th August 2013. On satisfactory completion of plinth, rest of the building plans will be cleared.

The sanction for erection of the building shall be available for two years from the date of issue. If building so sanctioned is not begun within the period, the sanction will lapse. The date of commencement shall be reported / intimated to the Board and completion certificate shall be obtained.

The erection as per plan shall be completed within the period of one year from the date of its commencement. The plan should be adhered to absolutely in every respect. The sanction is Municipal sanction only and is without prejudice to anyone else’s right on or to the land. The date of completion shall be reported as required under section 242 of the Cantonments Act 2006.The sanction will be subject to receipt of NOC from concerned authorities. Any typographical / clerical mistake with regard to details mentioned on the agenda side may be amended by the CEO in the agenda / at the time of sanction.

The building plans are in accordance with the building byelaws and FSI restrictions. The site in each case is situated outside notified civil area classified as B-2 land as per the GLR maintained by the DEO, A P Circle, Secunderabad.

The layout of these colonies was sanctioned after 1974 and the societies have not handed over 40% open area for civic and other amenities to the Cantonment Board, Secunderabad by a way of Registered Gift Deed as per the byelaws.

As per the decision of the Board in its meeting held on 04th November 1997, No Objection Certificate from Airport Authority of India has not been insisted in such cases where construction of only Ground Floor is involved.

Resolution: The CEO apprised the Board that the Cantonment Board had in the past insisted NOC from the Airport Authority of India consequent to the Board Resolution vide CBR No.33, Dt.20-07-1996. Subsequently an exemption was made vide CBR No.9, Dt.30.08.1997 to exclude the same in respect of the constructions involving only ground floor except in Mahendra Hills and the above practice had continued till 2013 wherein the Cantonment Board has sanctioned Building Plans in Mahendra Hills only after obtaining NOC from Airport Authority of India even in the case of construction of Ground Floors.

Kiran Reddy has filed a Writ Petition bearing No.34370 of 2013 and the Hon’ble High Court has ordered directing the Cantonment Board to process the building application without insisting NOC from AAI for construction of Ground Floor in respect of plot No.4, Santosh Cooperative Housing Society, Sy.No.74/5, Mahendra Hills, East Marredpally. Thereafter, the building plans were sanctioned vide CBR No.29, Dt.26.02.2014. Similar orders were obtained in the Writ Petition filed by Shri Usha Sachdev in respect of Plot No.256, Balamrai Cooperative Housing Society in WP No.12409 of 2015 and the said building plan was sanctioned vide CBR No.10(21), Dt.22.10.2016. Further, the following building applications have been considered and sanctioned by the Board where no NOC is granted by the AAI in view of the orders of the Hon’ble High Court of Telangana.

Thereafter, the Cantonment Board has further noted that at several places in Mahendra Hills the public who were applying for Building Plan sanction are facing difficulties in getting NOC from AAI and the state government revenue authorities. Having regard to the directions given from time to time by the Hon’ble High Court in similar cases, the Board vide CBR No.28, Dt.13.06.2017 resolved that the NOC of AAI shall not be insisted for building applications which involves only ground floor even in case of Mahendra Hills. Having regard to the fact that these building applications are being submitted on private lands in authorised layouts approved by the competent authority, the building plans have been sanctioned without insisting NOC from AAI in case of ground floors. So far 46 building applications of ground floor have been sanctioned in various Board Meetings since 30.10.2017 in Mahendra Hills without insisting NOC from AAI.

It is further submitted that as per the processing of the NOCs by AAI, the highest point of the proposed site is being considered for giving clearance with reference to the permissible height laid down with the corresponding distance from the runway.

In light of the above, the Board resolved that the following aspects may be considered in processing of ‘0’ height building applications in Mahendra Hills where AAI has given nill height relaxation.

i. The plinth level of the plot shall be fixed by the applicant himself by giving a declaration in writing defining the corresponding site elevation of the subject site for fixing the plinth and the plinth level shall be proposed as per the nearest approach road. The plinth level be as close as possible to the adjoining approach road level and

to this effect a certificate of technical justification from the licensed structural engineer be obtained from the applicant as to why the plinth level is not at the level of the adjoining approach road. The construction of ground floor be allowed upto 4.5 m or 15 feet from the plinth level to include all structures like parapet wall, water tank and temporary structures too.

ii. The applicant is required to submit a site elevation certificate even in the case of ‘0’ height clearance showing the longitude and latitudes of all four corners of the proposed site.

iii. As per the basic civil engineering principle in fixing the plinth level it is to ensure that a balanced depth of excavation be fixed so as to minimise the quantity of earth filling / carting of excavated material which results in cost effectiveness.

iv. Not more than one cellar or basement is permitted and such cellar or basement be used only for parking purpose.

Shri J Maheshwar Reddy informed that an inspection of buildings in Mahendra Hills be carried out to identify unauthorized constructions. The same was agreed to by PCB. PCB CEO and Engineer will carry out the inspection of violations. The Board resolved to approve the building applications on the agenda side as per the conditions set above.

Grant of Extension of time

[ 12 ] ( 01 ) To consider the letter dated17.02.2020 received from Sri. K V Srinivas requesting to grant of extension of time for construction of Commercial Buildingin respect of Open Land in GLR Sy.No 516/2 abutting to NH 44 Nagpur Highway, Secunderabad Cantonment. Earlier the plans were sanctioned vide CBR No.9(1) dated 31.05.2018 and released preliminary sanction for construction upto plinth level vide this office letter dated 07.07.2018. The applicant has commenced the construction by erecting RCC pillars upto ground level and the said construction was stopped by Army Authorities stating that the subject land is in GLR Sy.No 516 which is classified B4 under management of DEO, AP Circle. In fact, the said land was transferred to the applicant by sale vide document NO 1745/1994 Book I dated 03.08.1994 and the building plan was sanctioned after obtaining the NOC from DEO vide letter No 24/7/XXXI/54, dated 13.05.2016 stating that there is no defence land is involved in it.

Subsequently, on receipt of the representation from the applicant about the said issue, the matter was taken up with DEO AP Circle vide this office letter No SCB/EB/OP/C’thokatta/56 dated 07.01.2020 for taking up the matter with the concerned officials and requested to allow the construction as per the sanctioned plans.

In response to the above, the DEO AP circle has carried out joint survey and marked out the B4 land clearly by erecting a sign board and requested this office to erect a boundary wall with barbed wire fencing before carrying out

50 | Page the construction activity on the subject land. The applicant has undertaken that he will construct a compound wall with barbed wire as suggested by DEO, A P Circle during the construction of the proposed building and an undertaking is also submitted that he will keep a right way for entering into the defence land through the subject premises.

Therefore, the request of the applicant for extension of time may be considered for a period deemed to be reasonable as per the provisions made under section 237 & 245 of the Cantonments Act 2006 as a considerable time was consumed for the above process.

[ 12 ] ( 02 ) To consider the letter received from Shri G Sanjeeva Reddy requesting in his letter dated 20.11.2020 for grant of extension of time for construction of Residential building on Plot No.33 in Sy.No 258, 259/1 & 260 Indian Airlines Employees Cooperative Housing Society, situated at Thokatta Village, Bowenpally Secunderabad Cantonment which was sanctioned vide this office letter No. SCB/EB/PNo.33/Thokatta(V)/192/20 dated 12.02.2019, as considered and resolved by the Board vide Resolution No.12(7) dated 02.01.2019. The applicant has not commenced the work at site. The extension may be considered u/s 245 of the Cantonments Act 2006.

Building Plan

[ 13 ] To consider the Building application re-submitted by Smt. Subbalaxmi Sarikonda in respect of Plot No.92, Govt. Press Employees CHS, Ward No.VI, Secunderabad Cantonment

Smt. Subha Lakshmi Sarikonda, has submitted a building application dt.07.10.2019 for construction of residential building consisting of Ground, First & Second Floors in respect of Plot No.93, Sy.No.159/9 (New No.157/10), Government Press Employees CHS (also known as Vahini Nagar), Sikh Road, Secunderabad Cantonment. After scrutinizing the building application, the file was placed before the Board meeting held on 21.03.2020 and the Board vide CBR No.12(36), Dt.21.03.2020 sanctioned the subject building plan.

The applicant was asked to pay the Betterment charges of Rs.61,081/- vide this office Lr.No.SCB/EB/P.No.93/Government Press ECHS/824, Dt.07.05.2020 and after receipt of the said betterment charges,

51 | Page preliminary sanction for construction upto plinth level has been released vide this office lr.No.SCB/EB/P.No.93/Government Press ECHS/371/289, Dt.02.06.2020.

Later, the applicant Smt. Subha Lakshmi Sarikonda submitted a letter dt.03.07.2020 stating the construction upto plinth level has been completed and requested this office release the final building permission for further construction of the said building.

Before releasing the final sanction, the subject site has been inspected and it is observed that the construction of the building was being carried out on Plot No.92, whereas it was sanctioned to erect on Plot No.93. Accordingly, the applicant Smt. Subha Lakshmi Sarikonda has been directed to submit the revised plans as per the exact location and was also asked to rectify the schedule of property in Sale Deed as Plot No.92, AP Government Press Employees CHS for taking further necessary action in the subject matter.

In reply to the above Smt. Subha Lakshmi Sarikonda has submitted a letter dt.28.10.2020 stating that the registration office of Govt. of Telangana were closed and will make necessary changes in the sale deed document as soon as the Govt. of Telangana restarts the registration offices. The applicant Smt. Subha Lakshmi Sarikonda has also submitted a notorized affidavit to that effect and requested to release the plan for further construction of the building.

Later Smt. Subha Lakshmi Sarikonda has submitted an application dt.27.11.2020 for re-submitted of building plans by correcting the Plot No. as 92, Govt. Press Employees CHS and requested to accord sanction for release building plan for further construction until the rectification sale deed is submitted by the applicant.

Resolution: Considered and resolved that the CEO is authorized to approve the building plan after submission of rectified sale deed.

The Board resolved to approve the building application under section 235 of the Cantonments Act, 2006 subject to condition that the plan will be released only after Rain Water Harvest Pits are made in the plots. CEO shall release the plinth sanction only as resolved under CBR No. 12 dated 07th August 2013. On satisfactory completion of plinth, rest of the building plans will be cleared.

The sanction for erection of the building shall be available for two years from the date of issue. If building so sanctioned is not begun within the period, the sanction will lapse. The date of commencement shall be reported / intimated to the Board and completion certificate shall be obtained.

The erection as per plan shall be completed within the period of one year from the date of its commencement. The plan should be adhered to absolutely in every respect. The sanction is Municipal sanction only and is without prejudice to anyone else’s right on or to the land. The date of completion shall be reported as required under section 242 of the Cantonments Act 2006.The sanction will be subject of receipt of NOC from concerned authorities. The above approval will be subject to verification of requisite NOCs from DEO, SEMO and Airports Authority by the CEO. Any typographical / clerical mistake with regard to details mentioned on the agenda side may be amended by the CEO in the agenda / at the time of sanction.

COMMUNITY HALL

[ 14 ] To consider the application received from Shri H Venugopal Rao, President of M/s Sai Ansh Arcade requesting for grant of permission for construction the Community Hall at M/s Sai Ansh Arcade in Open Plot in Sy.No. 99, Trimulgherry Village, Secunderabad Cantonment.

EXTENSION OF “MAINTENANCE & REPAIRS TO CANTONMENT FUND BUILDINGS FOR THE YEAR 2018-19”

[ 21 ] To consider the matter of Extension of “Maintenance & Repairs to Cantonment Fund Buildings for the Year 2018-19.”

The work of “Maintenance & Repairs to Cantonment Fund Buildings for the Year 2018-19” was awarded to M/s. Sri Sai Constructions and was approved vide CBR No.08, Dated 09.08.2019. The tender was called for an amount of Rs.6.00 Crores. Till date work orders were placed for an amount of Rs.4.26 Crores only. The contract period is from 18.11.2019 to 17.11.2020.

M/s. Sri Sai Constructions has submitted a letter dt.05.11.2020 requesting for extension of time period for the subject work upto June 2021 as work orders were not placed for the total tender amount of Rs.6.00 Crores.

Further, it is to inform that it is also resolved vide CBR No.08, dt.09.08.2019 that until finalization of new tenders the existing contract will be continued as per the prevailing rates.

Therefore, the subject work may be extended for a further period of six (06) months i.e. upto 17.05.2021

ONE TIME SETTLEMENT OF WATER BILLS AND NULLIFICATION OF ARREARS

Ref:- CBR No. 4(1) dated. 02.01.2019

[ 22 ] To consider the report submitted by Water Department in connection one time settlement of water bills and nullification of arrears.

As per their report, reference the CBR No. 4(1) dated. 02.01.2019 an OTS Scheme was approved by this office for slums and basthis where regular monthly bills from January, 2016 will be sent to the consumers who are availing OTS scheme on payment of OTS of Rs. 3000/-, 4000/- and 8500/- for Non – RCC, RCC & G+1 structures of less than 99 sq.yds respectively. The accumulated arrears before January, 2016 will be nullified after availing of OTS amount as mentioned above.

Accordingly the consumers residing in slums and basthis have availed the scheme and some of the consumers are yet to pay OTS amount to clear arrears before January, 2016. The scheme is being prolonged and even the consumers are availing OTS to this date.

The Water Dept., of Secunderabad Cantonment Board has completed surveying of each and every houses of slums and basthis to categorize non- RCC, RCC and G+1 structures of less than 99 Sq.yds., and a list of the consumers who are eligible for OTS scheme and tariff reduction has been prepared. Vide note submitted on dated. 24.07.2020, this office has started applying OTS scheme to all the eligible consumers by nullifying arrears accumulated before January, 2016 and necessary changes were also made in the billing software as the consumers were opposing to clear the huge accumulated arears.

A field survey was carried out in all slums & basthis by the E-PoS billing team along with the bill distributors, officials of this office. A three – level check has been done before applying OTS scheme to the consumers for nullification of arrears up to January, 2016.

HIRING OF 200 HP & 70 HP POCLAIN MACHINE AND TIPPERS (15 CUB MTR) FOR DE-SILTING OF TRIMULGHERRY LAKE OR ANY OTHER WORKS IN SECUNDERABAD CANTONMENT AREA

[ 23 ] To consider the report of the Health department in matter of “Tender for the work of hiring of 200 hp& 70 hp Poclain machine and tippers (15 cub mtr) for de-silting of Trimulgherry lake or any other works in Secunderabad Cantonment area”.

As per the said report, with reference to this office Tender Notice No.SCB/HS/ETen/Special/2021/39, Dated 06-01-2021for the purpose of finalizing work contracts for hiring of 200 hp& 70 hp Poclain machine and tippers (15 cub mtr) for de-silting of Trimulgherry lake or any other works in Secunderabad Cantonment area, this office has received Three (03) tenders online through e-tendering process. All these Three (03) tenderers qualified in technical bid. The financial bid was opened of these qualified in technical bids were opened and the details are as mentioned as under:

Resolution: Considered and resolved to approve the lowest rates quoted by the qualifying L1 contractor Shri Suresh Chippa. Further it is resolved that until finalization of new tenders the existing contract will be continued as per the prevailing rates. This shall hold good for all contracts of the Cantonment Board.

RESCUE MEASURES DURING FLOOD SITUATIONS

[ 24 ] To consider the report submitted by Health Department in connection with rescue measures to face flood situations.

As per the report, the Indian Meteorological Department (IMD), Hyderabad has predicted heavy to very heavy rainfall in Hyderabad and Secunderabad and have cautioned the public. There are chances that the heavy rainfall may lead to water stagnation and flooding as has been experienced in the previous years. We may require extra manpower and vehicles to attend to such a situation in case of emergency.

It is to submit that the below tippers, JCBs and manpower teams are procured / hired / engaged for a period mentioned against each on emergency basis for attending to such a situation at the rates approved by the Board and also calling quotations.

HIRING OF ADDITIONAL JETTING AND SUCTION MACHINE FOR CLEANING OF SILT/SLUDGE IN SECUNDERABAD CANTONMENT AREA.

[ 25 ] To consider the report submitted by Health Department in connection with hiring of additional jetting and suction machine for cleaning of silt/sludge in Secunderabad Cantonment area.

As per their report the health department has presently hired two (2) jetting and suction machines for cleaning of silt / sludge from private contractors through e-tender process vide CBR No. 06, Dt. 29-05- 2020,which was implemented from 01st June 2020 onwards. A third vehicle was also hired as per the CBR No. 06, Dt. 29-05-2020 from 01st July 2020 onwards initially for a period of three months and thereafter again a period of three months till 31st December 2020. This office is also receiving lot of complaints from public and elected members for cleaning of silt / sludge in drains and the two vehicles are not found sufficient to cater to the situation and hence the additional vehicle is being continued.

As there is a requirement of cleaning the drains, this office may continue hiring the additional jetting and suction machine from the existing

interested contractor at the same rates approved by the Board, for a further period of six months.

Resolution: Considered and approved that the hiring of the additional jetting and suction machine from the existing interested contractor at the same rates approved by the Board, for a further period of six months i.e. upto 30.06.2021. Further CEO apprised the Board that the expenditure for hiring the additional jetting and suction machine same is Rs. 18,00,000/-.

[ 27 ] To consider the matter of “Term Contract for Maintenance & Repairs to Underground Drains in Secunderabad Cantonment Area for a Period of one year”

This office has invited online tender for “Term Contract for Maintenance & Repairs to Underground Drains in Secunderabad Cantonment Area for a Period of one year” vide this office Lr.No.SCB/EB/UGD/2020/2580, Dt.19.11.2020 and the same was published in the website eprocure.gov.in.

Four (04) bidders i.e. M/s. M. Laxman Rao & Sons, M/s. B. Ramachandraiah & Sons, M/s. SLV Builders and M/s Sri Sai Constructions participated in the online tender and after technical evaluation of the requisite documents uploaded by the bidders, M/s. SLV Builders was

76 | Page rejected in Technical Bid and the remaining three (03) bidders were admitted for Financial Bid.

The Financial Bid of the said firms was opened on 19.12.2020 and the from the BoQ Comparative statement it is observed that M/s. Sri Sai Construction quoted the lowest total Rs.4,59,94,600/-.

The rate quoted by M/s. Sri Sai Constructions i.e. Rs.4,59,94,600/- was forwarded to GE (South) for vetting of reasonability of rates vide this office letter no.SCB/EB/UGD/GE Reasonability/2997, Dt.28.12.2020. The GE (South) vide their office Lr.No.8019/CB/62/E8, Dt.22.01.2021 vetted and sent their reasonability of rates and reduced rates of certain items as quoted by the bidder and thus the total is Rs.4,52,29,400/-. The reduced rates were informed to contractor i.e. M/s. Sri Sai Constructions to seek their consent vide this office Lr.No.SCB/EB/UGD/2020/200, Dt.22.01.2021. In response to the above, the contractor M/s. Sri Sai Constructions has forwarded a letter dt.22.01.2021 in which the bidder submitted his willingness to carry out the subject work on the rates suggested by GE (South) for an amount of Rs.4,52,29,400/- (Rupees Four Crores Fifty Two Lakhs Twenty Nine Thousand and Four Hundred only).

[ 28 ] To consider the matter of “Providing the work of Manpower Establishment of Special School for Mentally Challenged Children, Rasoolpura, Secunderabad Cantonment for one year”

This office has invited online tender for “Providing the work of Manpower Establishment of Special School for Mentally Challenged Children, Rasoolpura, Secunderabad Cantonment for one year” vide this office Lr.No. SCB/EB/Spurthy School/2578, Dt.19.11.2020 and the same was published in the website eprocure.gov.in.

Eight (08) bidders participated in the online tender and after technical evaluation of the requisite documents uploaded by the bidders, Four (04) Builders were rejected in Technical Bid and the remaining four (03) bidders viz. (I) Impressive Data Services Pvt. Ltd., (V) S. Raju, (VI) Shakthi Securities & Maintenance Services Pvt. Ltd., & (VIII) SV Facility Services were admitted for Financial Bid.

The Financial Bid of the said firms was opened on 23.01.2021 and the from the BoQ Comparative statement it is observed that M/s. Impressive Data Services Pvt. Ltd. quoted lowest @ 1% on the wages.

At present Shri S. Raju, Contractor was executing the subject work @ +2.89% on wages.

INSPECTION OF OGBs IN SECUNDERABAD CANTONMENT

[ 29 ] The Board to authorize the following persons under sections 305, 306, 307 & 308 of Cantonments Act, 2006, subject to conditions under sections 309, 310, 311 & 312 of the Cantonments Act, 2006.

A) One Elected Member of the Secunderabad Cantonment Board. B) One Nominated Member of the Secunderabad Cantonment Board. C) Representative of the President, Secunderabad Cantonment Board D) Representative of Chief Executive Officer, Secunderabad Cantonment Board. E) Representative of DEO, Secunderabad, T&AP Circle. F) Representative of SEMO. G) Representative of GE South.

The names of the representatives shall be sent to the Chief Executive Officer, Secunderabad Cantonment Board. The above team shall inspect the Old Grant Bungalows in Secunderabad Cantonment Area and report to the Secunderabad Cantonment Board regarding 1) State of Occupation, Vacant or otherwise 2) Unauthorized structure if any with vintage 3) Safety of building structure 4) Adequate measures for hygiene and sanitation.

The above team shall report to the Chief Executive Officer, Secunderabad Cantonment Board periodically to appraise the progress. The list of OGBs along with HOR shall be obtained from the office of Defence Estates Officer, Secunderabad, Telangana & Andhra Pradesh Circle. The team before entering any building should ascertain that the prior consent of the owner/occupant is ordinarily obtained as per Section 311 of Cantonments Act, 2006. The Dy. CEO, in consultation with the above team shall give prior intimation of date and time of inspection to the owner/occupant.

Resolution: Shri J Maheshwar Reddy, opined that since the Old Grant Bungalows are subject of concern of Defence Estates Officer, Cantonment Board should not be involved in the said exercise. The PCB informed that the entire exercise is from a Security point of view but not intended for any demolition or eviction. The PCB also informed that the role of Cantonment Board is limited only to check unauthorized constructions, stability of building structure, sanitation and hygiene. The DEO will verify from the land point of view. The LMA role is confined for security angle.

Shri J Ramakrishna informed that the Cantonment Board being under the Ministry of Defence its role is to protect the Government land under its jurisdiction. Therefore this exercise of inspection of Old Grant Bungalows be carried out.

After the detailed discussion and opposition from majority of elected members of the Board the matter is pended for the next Board Meeting.

[ 32 ] To consider the matter of “Maintenance & Repairs to Open Drains and Nalas in Secunderabad Cantonment for a period of one year”

This office has invited online tender for “Maintenance & Repairs to Open Drains and Nalas in Secunderabad Cantonment for a period of one year” vide this office Lr.No.SCB/EB/Open Drains & Nala/2579, Dt.19.11.2020 and the same was published in the website eprocure.gov.in.

Two (02) bidders i.e. M/s. M. Laxman Rao & Sons and M/s. SLV Builders participated in the online tender. Even after calling the tender for the seventh time only two bidders were participated in the tender. After technical evaluation of the requisite documents uploaded by the bidders, M/s. SLV Builders was not admitted in Technical Bid and M/s. M. Laxman Rao & Sons was admitted for Financial Bid (Technical Evaluation Sheet enclosed).

The Financial Bid of the said firm was opened and the BoQ statement is enclosed herewith for your perusal:

From the BoQ Comparative statement it is observed that M/s. M. Laxman Rao & Sons quoted @ +149% above MES SSR 2010 rates.

The rate quoted by M/s. M. Laxman Rao & Sons i.e. + 149% above MES SSR was forwarded to GE (South) for vetting of reasonability of rates vide this office letter no.SCB/EB/Open Drain/GE Reasonability/2998, Dt.28.12.2020. The GE (South) vide their office Lr.No.8019/CB/64/E8, Dt.28.01.2021 vetted and sent their reasonability of rates without any change in quoted rate i.e. +149% above MES SSR 2010.

EXTENDING THE BENEFITS OF GRATUITY AND ADDITIONAL RELIEF ON DEATH / DISABILITY OF GOVERNMENT SERVANTS COVERED UNDER THE DEFINED CONTRIBUTION PENSION SYSTEM (NPS)

[ 33 ] To consider the report submitted by the Accounts Department for extending the benefits of gratuity and additional relief on death / disability of Government Servants who are covered under the Defined Contribution Pension System (NPS).

As per the report, the Ministry of Personnel Public Grievances and Pensions, Government of India vide its Office Memorandum No. 38/41/06/P&PW(A), Dated 05th May, 2009 & Office of the Controller General of Accounts, Department of Expenditure, Ministry of Finance vide its Office Memorandum No. 1(7)/DCPS(NPS)/2009/TA/221, Dated 02nd July, 2009 extended the benefits of additional relief on death / disability of Government servants covered by the Defined Contribution Pension System (NPS).

The salient features and the eligible criteria for NPS employees appointed after 01-04-2004 are as under

(I) Retirement from Government service on invalidation not attributable to Government duty: (II) Death in service not attributable to Government duty: (III) Discharge from Government service due to disease/injury attributable to Government duty: (IV) Death in service attributable to Government duty:

Further the Dearness Pension / Dearness Relief admissible from time to time in addition to above benefits, on provisional basis are to be paid to the employee / his family. These instructions will be applicable to those Government Servants who joined Government service on or after 01-01- 2004 and will take effect from the same date i.e. 01-01-2004.

The matter involves financial implication and may be placed before the Board for onward transmission to PDDE/ GOC-in-C for seeking in principle sanction under Rule 89 of the Cantonment Board Account Rules (CBAR), 2020.

With the permission of the chair the following points were discussed.

1. A letter from the Board be sent to the GoC-in-C on his promotion as Vice Chief.

2. The issue of change of water supply Pumps used in various pump houses maintained by Secunderabad Cantonment Board was raised by Shri Sada Keshav Reddy and the Board approved to change the same in a phased manner.

3. Shri J Maheshwar Reddy raised the issue of building plans left out without placing the same in the said Board meeting even after the applicants submitted the application beforehand. PCB informed that going forward the Board may be informed about the list of building applications received and placed before the Board and other applications which are not placed before the Board for the reasons thereof.

4. Shri J Maheshwar Reddy submitted a representation for processing the building applications and relaxations of certain areas in Calculation of FSI & also building regularization. The PCB informed that the revised building bye laws which are proposed by the Board are framed according to the present situations and will suffice the need as per requirement.

5. Shri J Maheshwar Reddy submitted a representation of Shri Telukunta Satish Gutpa requesting to write off the arrears off water charges to apartments. PCB informed that a suitable solution would be brought in this matter.

6. Shri J Maheshwar Reddy made a representation with regard to allotment of quarters to Secunderabad Cantonment Staff at Hasmathpet area. CEO apprised the Board that the matter is taken up at DG level and the Director General Defence Estates has approached Housing & Urban Development Corporation (HUDCO) to submit the detailed project report after the detailed study on the said project. The project report has to be submitted by the HUDCO. However in the recent JCM held with union members of Secunderabad Cantonment Board, it was discussed to write a letter from the office side to the HUDCO to know the status of the same.

7. Kum. P. Nalini Kiran, Elected Member, Ward No. V, submitted a representation for allotment of open land in GLR Sy. No. 487 for the purpose of park for Children’s to play in Gandhi Colony. PCB directed the CEO to look into the said matter and to be brought up in the subsequent Board meeting.

8. Shri J Maheshwar Reddy, Ward No. I, has submitted a representation to release the Bill of Mr. C. Anil (Contrator). PCB informed the CEO to enquire into the matter and take suitable action.

9. Shri J Maheshwar Reddy requested the President Cantonment Board about opening of Cantonment Roads which are still closed even after the directions of Ministry of Defence. The PCB informed that all the roads in Cantonment are open and public are allowed to use these roads by showing any ID proof. All are advised to send the Judgment of Hon’ble High Court of Andhra Pradesh in PIL No. 62 and 82 of 2014, WP No.’s 5772, 5782 and 11321 of 2014.

10. The Elected Members also requested to extend the term and contractual value of the Roads Contract. CEO apprised the Board that presently the contractual value of the said contract has already been extended by 20% as per the provisions; further extension may lead to objections from audit authorities. The Elected Members informed that since the term of the members will expire in 10 days the new tender proceedings would take atleast 15 days, so they are making such a request. They have also informed that since the Board is competent authority and have made such extensions of contractual period and

contractual value in the past; the same type of decision may be made considering the expiry of term of present Board Members. The CEO is directed to consider the request of members and increase the contractual value as per the necessity.

11. Shri J Lokanatham requested the Board to release the additional funds of Rs. 25,00,000/- for Risala Bazar Community Hall. The Board approved the same, the CEO is authorised to incur the expenditure as per the availability of funds.
