Banco Court lectures 2018 Introduction In 2012 the Banco Court was the venue for the fi rst seminar to be conducted in this building. The tradition continues in 2018 when, for the fi rst time, the Supreme Court Library Queensland has compiled this event guide to 13 free legal lectures presented in the Banco Court. The Selden Society lectures hosted by the library are presented in the guide, as is the Supreme Court Oration—which this year will be delivered by the Honourable Geoffrey Ma GBM, Chief Justice of the Hong Kong Court of Final Appeal. The guide also features lectures from the jointly managed Current Legal Issues seminar series, the Australian Academy of Law Queensland lecture, the Australian Institute of Judicial Administration’s annual oration, and the fi rst event of the Justice in Focus series. Across these various lecture series the topics are wide-ranging and engaging, with the speakers being drawn from many different courts and universities. • Hidden Depths: Diversity, Difference and the High Court of Australia
1 Hidden Depths: Diversity, difference, and the High Court of Australia Rachel Cahill-O’Callaghan1 and Heather Roberts* There is a growing international emphasis on the importance of diversity in the judiciary, and the impact of the individual in decision-making. However, it can be a challenge to gain insight into the individuals who sit on the bench. For instance, there is limited official information about the individuals who sit on the High Court of Australia. One of the rare glimpses provided by the Justices themselves is their judicial swearing-in speech. Drawing on a case study of the swearing-in speeches of High Court Justices sitting between 2008- 2016, this paper illustrates how these speeches can illuminate key demographic information about the judiciary, as well as facets of the individual rarely explored in studies of judicial diversity: personality and values. This study demonstrates how swearing-in speeches can assist with filling information gaps about judicial diversity, and so extend debates about judicial selection.2 Key Words: judicial studies, diversity, ceremony, psychology, personality, values 1 Reader, Cardiff School of Law and Politics, Cardiff University, Wales E-mail: [email protected] * Assistant Professor & ARC DECRA Fellow, ANU College of Law, The Australian National University, Australia [email protected]. I suppose that the collective noun for Administrators is a bureau. The Vice-Chancellor of Charles Darwin University (Professor Barney Glover) has initiated this series and is also present. I honour the university that bears the famous name of Charles Darwin. That name, and the intellectual legacy that goes with it, demands open-mindedness, constant questioning of received wisdom and recognition of the process of change that exists in all living things1. It is by an inbuilt capacity to change and to embrace gradual variation that living organisms (including institutions) survive, adapt and flourish. * Text on which was based the second Austin Asche Lecture, delivered at Charles Darwin University, NT, 27 August 2012. ** Justice of the High Court of Australia (1996-2009): President of the International Commission of Jurists (1995-8); Laureate of the UNESCO Prize for Human Rights Education (1998); Gruber Justice Prize (2010). 1 Charles Darwin, The Origin of Species, in William Benton (ed.), Great Books of the Western World, Encyclopaedia Britannica Inc, Chicago, Vol.
