BACKGROUND

This is the Final Plat of Colbert Hills, Unit Five, a replat of Tract 6, Colbert Hills, Unit Four. The site is generally located along the south side of side of Colbert Hills Drive and generally between Grand Mere Parkway and Vanesta Drive. The applicant and the property owner is State University Management and Research Foundation.

The replat creates three lots associated with the Colbert Hills Golf Course and the Colbert Hills Stay and Play Planned Unit Development (PUD). Lot 1 will be for the practice facilities proposed for Golf Teams. Lot 2 is for the two lodging facilities proposed in the PUD. These two lots are within the boundaries of the Colbert Hills Stay and Play PUD, which was approved by the City Commission on August 20, 2019. The remaining land is part of Lot 3, which remains zoned R-S, Single-Family Residential Suburban.

The Final Plat dedicates easements and rights-of-way to serve the developments proposed in the PUD.

DISCUSSION

On September 5, 2019, the Manhattan Urban Area Planning Board approved the Final Plat of Colbert Hills, Unit Five, based on conformance with the Manhattan Urban Area Subdivision Regulations.

ALTERNATIVES

It appears the Commission has the following alternatives concerning the issue at hand. The Commission may:

1. Accept the easements and rights-of-way, as shown on the Final Plat of the Colbert Hills, Unit Five, as approved by the Manhattan Urban Area Planning Board. 2. Deny acceptance of the easements and rights-of-way, for specifically stated reasons. 3. Table acceptance of the easements and rights-of-way, for specifically stated reasons and provide further direction to City Administration.

RECOMMENDATION

City Administration recommends that the City Commission accept the easements and rights-of-way, as shown on the Final Plat of Colbert Hills, Unit Five, based on conformance with the Manhattan Urban Area Subdivision Regulations, and approval of the Final Plat by the Manhattan Urban Area Planning Board.

POSSIBLE MOTION

BACKGROUND

REQUEST Applicant seeks Final Plat approval of Colbert Hills, Unit Five, a three-lot replat of Tract 6, Colbert Hills, Unit Four.

PROJECT DESCRIPTION The proposed replat is sought in conjunction with a request by the applicant to reclassify a 6.4-acre portion of Tract 6, adjacent to Colbert Hills Drive and immediately west of the clubhouse, to the PUD, Planned Unit Development District [REZ-19-035 and PUD-19-036]. Known as Colbert Hills Stay and Play PUD, the Preliminary Development Plan provides for construction of two, 16-bed Stay and Play Lodges; and, an indoor golf practice facility in- tended for the exclusive use of the K-State men’s and women’s golf programs. The pro- posed reclassification and Preliminary Development Plan appeared before the Planning Board for public hearing on July 15, 2019, and was unanimously recommended for ap- proval. The proposals appeared before the City Commission on August 6th for first read- ing; and, was approved by adoption of Ordinance No. 7439 on August 20th.

As proposed, Lots 1 and 2 coincide with the Colbert Hills Stay and Play PUD with Lot 1 comprising 4.1-acres intended for construction of the indoor golf practice facility; and, Lot 2 comprising 2.3-acres and the site of the two (2) stay and play lodges. July 15, 2019 Manhattan Urban Area Planning Board recommends ap- proval of a proposal to rezone 6.4-acres from R-S, Single- Family Residential, Suburban District to Colbert Hills Stay and Play PUD. The Planning Board also approved the Pre- liminary Development Plan.

August 6, 2019 City Commission approves first reading of an ordinance to reclassify the 6.4-acre tract to the R-S District along with corresponding Preliminary Development Plan of Colbert Hills Stay and Play PUD.

CONSIDERATION OF THE FINAL PLAT The consideration criteria for final plats are found in the Subdivision Regulations, Section 6-403. Review of Final Plat, subsection (A), which states: The MUAPB shall approve the Final Plat if it is in substantial conformance with the Pre- liminary Plat, as approved, including all requirements and conditions placed upon the Preliminary Plat by the MUAPB; and, the Final Plat complies with all requirements of the Subdivision Regulations as of the date of such final approval As currently platted, Tract 6 is one of seven (7) platted tracts of Colbert Hills, Unit Four. All seven (7) tracts encompass the 18-hole golf course of Colbert Hills. As proposed, Col- bert Hills, Unit Five subdivides Tract 6 into three (3) lots with Lots 1 and 2 comprising 6.4- acres that coincides with the Colbert Hills Stay and Play PUD. Lot 3 comprises the remain- der of the tract as currently platted and will continue to be used in conjunction with the golf course.

SUB-19-055 Staff Report to Planning Board 4 09-05-2019 meeting The Preliminary Plat of Colbert Hills Addition was initially approved in 1999 and provided for the establishment of large tracts that correspond to different sections of the 18-hole Colbert Hills Golf Course. A Final Plat of Colbert Hills Addition was approved later that same year and has been replatted three (3) times since. Tract 6, as currently platted, includes Hole #1 of the 18-hole golf course, a 9-hole -3 course, a driving range and practice area, and, the Colbert Hills Clubhouse and parking area. The proposed replat does not change the manner in which Tract 6 is currently used except to divide the north- ern 6.4-acres of the 71.9-acre tract into two (2) lots that correspond to the Colbert Hills Stay and Play PUD. Lots 1 and 2 represent only 8.9% of the original tract and their im- provement, as proposed, will not materially affect traffic, utilities, or stormwater drain- age. The Final Plat of Colbert Hills, Unit Five as proposed complies with the requirements of Manhattan Urban Area Subdivision Regulations.

ALTERNATIVES The MUAPB has the following alternatives concerning the issue at hand. The Board may: 1. Approve the replat of Colbert Hills, Unit Five, based on conformance with the Manhattan Urban Area Subdivision Regulations. 2. Deny the replat of Colbert Hills, Unit Five, indicating specifically how the Final Plat does not comply with the Manhattan Urban Area Subdivision Regulations. 3. Table the replat of Colbert Hills, Unit Five, to a specific date, indicating the reasons for tabling.

RECOMMENDATION City Administration recommends approval of the Final Plat of Colbert Hills, Unit Five, based on conformance with the Manhattan Urban Area Subdivision Regulations.

POSSIBLE MOTION Approve the Final Plat of Colbert Hills, Unit Five, based on conformance with the Manhat- tan Urban Area Subdivision Regulations, as recommended in the staff report.

August 6, 2019 City Commission approves first reading of an ordinance to rezone a 6.4-acre tract from R-S, Single-Family Residential Suburban District to the Colbert Hills Stay and Play Planned Unit Development.

August 20, 2019 City Commission approves Ordinance No. 7439 rezoning zoning the 6.4-acre tract of land to the Colbert Hills Stay and Play PUD.

September 5, 2019 Manhattan Urban Area Planning Board approves Final Development Plan for lodging facilities for the Colbert Hills Stay and Plan PUD and the Final Plat of Colbert Hills, Unit Five.
