INTRODUCTION:

The has been bifurcated from undivided Koraput district and started functioning as a new district w.e.f. 02.10.1992 vide Govt. in Revenue & Excise Department Notification No.49137/R-Dt-01.10.1992.

The District has covered an area of 7584.7 sq.kms (Ac. 18,74,220.19) with a total population of 961959 Nos., having 469672 Nos. male & 492287 Nos. female as per 2011 Census. The district consists of 2 Sub-Divisions namely- Rayagada & . There are 11 No. of Tahasils, 11 Blocks, 01 Municipality, 02 NACs, 15 Police Stations, 81 R.I. Circles, 171 GPs & 2667 Nos. Revenue villages. The district has 139514 Nos. of SC, 541905 Nos. ST & 280540 No. of others population & 3 Assembly Constituencies.

REVIEW OF CASE RECORDS:

OLR (REVISION) CASE NO.1/2013

The case is re-opened on the strength of the order dated 16.07.2012 passed by the Hon’ble Member Board of Revenue, Odisha, Cuttack in OLR Revision Case No.2/2007. In the said order, the Hon’ble Member Board of Revenue, Odisha, Cuttack has allowed the revision petition filed u/s 59 (2) of the OLR Act and quashed the order of ADM, Rayagada dated 24.01.1998 passed in OLR Revision Case No.7/1992 and directed to dispose the said case as per law by the Collector, Rayagada. The case has been re-opened and re-numbered as OLR Revision Case No.1/2013.

The background of the case is that the OLR Case No.10/1974 was initiated against the petitioner by the Revenue Officer-cum-Tahasildar, Rayagada. the Tahasildar disposed of the case on 26.02.1976 clarifying all the lands of the petitioner except Ac.3.415 in Khata No.6/9 of village Jayaramguda as Class-II lands on the ground that the lands were having irrigation facilities from the Rayagada Gedda Lift Irrigation Society and allowed 12.00 standard acres of land to be retained by the petitioner and directed vesting of an extent of Ac.18.91 decimal of village Barijhola as surplus. The petitioner’s appeal was dismissed by the Tahasildar on 26.02.1976. The petitioner filed a writ before the Hon’ble High Court of Orissa vide OJC No.2165/1981 against orders of all three forums i.e. Revenue Officer-cum-Tahasildar, Sub-Divisional Officer and the ADM. The Hon’ble High Court have remanded the case to ADM, Koraput for verifying the payment of water charges by the land holder and to allow the party to adduce evidence, if any, and to dispose the case by order dated 28.08.1991 passed in OJC No.2165/1981.

After formation of Rayagada district, the case came to the file of ADM, Rayagada for disposal. The ADM, Rayagada vide his Order dated 24.01.1998 in OLR Revision Case No.7/1992 dispose the case by dropping the Original Ceilling Case in OLR Case No.10/1974 of R.O-cum-Tahasildar, Rayagada.

Against, the order passed by the ADM, Rayagada, the revision petition has been instituted on the basis of a motion made u/s 59 (2) of the OLR Act, 1960 by the Collector, Rayagada on 23.10.2007. The Hon’ble Member, Board of Revenue, Odisha, Cuttack quashed the order of the ADM, Rayagada dated 24.01.1998 in OLR Revision Case No.7/1992 and remanded to the Collector, Rayagada for disposal as per law.

Accordingly, notice has been issued to the ceilling holder to appear in the Court of Collector, Rayagada and filing of counter. The Advocate was appeared on behalf of the Ceilling holder and filed Vokalatanama and petition to allow time for filing of counter. In the meantime, the Advocate General, Odisha, Cuttack has communicated stay dated 12.07.2013 in W.P (C) No.15237/2013 of the Hon’ble High Court of Orissa against

6 the order dated 16.07.2012 passed by the Hon’ble Member, Board of Revenue, Odisha, Cuttack in OLR Revision Case No.2/2007 vide Wireless Message No.27593 dated 17.07.2013 and await further direction from the Hon’ble High Court of Orissa. The Superintendent of Orissa High Court has furnished a copy of Court’s Judgment dated 08.01.2015 passed in W.P (C) No.15237/2013 (D.Bhakta Priyamba @ Bhaktapriya-Vrs- Member, Board of Revenue & Others) along with entire OLR Case No.10/1974 vide Lr. No.4420 dated 04.02.2015.

The Hon’ble High Court vide their order dated 08.01.2015 have concluded that the impugned order passed by the Hon’ble Member, Board of Revenue, Odisha, Cuttack cannot be sustained and accordingly the same was quashed and restored the order dated 24.01.1998 passed by the ADM, Rayagada in OLR Revision Case No.7/1992.

As there is no conclusive proof of irrigation on stipulated date of initiation of the case and as per direction of the Hon’ble High Court of Odisha, the extract of the order alongwith OLR Case No.10/1974 and copy of the order dated 08.01.2015 passed by the Hon’ble High Court of Orissa in W.P (C) No.15237/2013 communicated to the Revenue Officer-cum-Tahasildar, Rayagada for follow up action vide L.No.657 dated 13.03.2015.

2. OPLE (REVISION) CASE NO.5/2016

One Sri D.Ramesh Kumar, S/o-Late D.Nageswar Rao of Aurobindo Nagar, J.K Pur, P.S- in the district of Rayagada has filed OPLE (Revision) case bearing No.5/2016 arising out of OPLE Appeal Case No.3/2016 dated 26.04.2016 passed by the Sub-Collector, Rayagada before the Collector, Rayagada u/s 12 of OPLE Act, 1972 on 11.05.2016.

The brief fact of the case that Sri D.Ramesh Kumar, S/o-Late D.Nageswar Rao has encroached Govt. land to an extent of Ac.0.40 decimal out of Plot No.747/1 vide Khata No.60, Kissam-Patra Jungle of village Chandili for dwelling purposes since more than 40 years. The Tahasildar, Ra;yagada has initiated Encroachment Case basing on the ‘G’ Form produced by the R.I, Komtalpeta on 09.02.2015 vide Encroachment Case No.707/2015. Although noticed, Sri D.Ramesh Kumar did not appear in the court of the Tahasildar, Rayagada. The Encroacher was penalized assessment and penalty and Form ‘B’ was issued on dt.09.05.2015 for eviction of the land. He has neither paid the assessment nor penalty as imposed by the Tahasildar, Rayagada.

The Encroacher has filed an appeal vide Encroachment Appeal No.02/2015 before the Sub-Collector which was rejected for non-compliance of Section-14 of OPLE Act, 1972.

Then the encroacher has challenging the order of eviction under OPLE Act, 1972 dated 10.07.2015 in Encroachment Case No.707/2015 passed by the Tahasildar, Rayagada and dismissal order of the Sub-Collector, Rayagada.

The Hon’ble High Court of Orissa set-a-side the order passed by the Sub-Collector in the appeal and remitted the matter back to the Sub-Collector, Rayagada to hear the appeal a fresh giving opportunity of hearing to the petitioner i.e. Sri D.Ramesh Kumar and the Hon’ble Court also directed to the petitioner to appear before the Sub-Collector on 29.02.2016 in their order No.3 dated 15.02.2016 passed in W.P (C) No.14652/2015. The status quo as on date in respect of the land in question shall be maintained till disposal of the appeal.

As per the direction of the Hon’ble High Court of Orissa, Sri D.Ramesh Kumar has appeared before the Sub-Collector, Rayagada on 08.03.2016 instead of 29.2.2016 and filed an appeal before the Sub-Collector afresh bearing Encroachment Appeal Case No.3/2016. The Sub-Collector, Rayagada allowed two chances i.e. on 29.03.2016 and 26.04.2016 to the petitioner to produce supporting documents in connection with appeal petition. But, the petitioner did not produce the same before the Appellate Authority till 26.04.2016. Hence, the case was dismissed.

Sri D.Ramesh Kumar has filed OPLE (Revision) Case No.5/2016 before the Collector, Rayagada against the Order dated 26.04.2016 passed by the Sub-Collector, Rayagada in Encroachment Appeal Case No.3/2016. After perusal of the Lower Court Record i.e. the Court of Tahasildar, Rayagada and Sub-Collector, Rayagada and report of RI, Komtalpeta vide his L.No.296 dated 15.09.2015 submitted by the Tahasildar, Rayagada in E.C No.707/2015 that the petitioner has a steel railing shop at Rayagada from which he earns Rs.1,10,000/- per annum. He has got homestead lands to an extent of Ac.0.293 decimals vide Khata No.59/1799, 59/1877, 59/2079, 59/2280 & 59/939 in Mouza Komtalpeta.

As per Notification No.16309 dated 01.06.2015 of Rev.&DM Department, the ceiling of annual income of homestead less person is Rs.40,000/-. He does not come within the category of homestead less person as defined in the aforesaid Notification.

Since, the encroached land attracts Forest (Conservation) Act, 1980 and does not come within the purview of Section 7 and 8-A of OPLE Act, 1972.

The Collector, Rayagada uphold the order passed by the Sub-Collector, Rayagada dated 26.04.2016 in Encroachment Appeal Case No.03/2016. The case was dismissed on 26.07.2016 as non-maintainable.

On review of the record, it is found that the Collector has dismissed the OPLE (Revision) Case in the right manner and protects the Govt. land.

REVIEW OF CASE RECORDS

1. OGLS (Appeal) Case No.01/2014

The appeal petition u/s 7 of OGLS Act, 1962 was filed by Sri A. Raju, S/o-Late A.Rammurty and Smt.A.Radha, W/o-A.Jagannath Raju of Kasturi Nagar, Rayagada before the Court of the A.D.M, Rayagada against the order passed by the Sub-Collector, Rayagada in GPLC Case No.4045/2010 of Tahasildar, Rayagada.

The brief fact of the case that Sri A.Jagannath Raju and his wife Smt.A.Radha have filed a petition for settlement in their favour in possession of the case land in Mouza Tumbiguda, Khata No.67, Plot No.282, Kissam-Basti to an extent of Ac.0.070 decimals out of total Ac.2.220 decimals. They were in possession of above case land for a period of at least three years prior to the appointment date i.e. 26.02.2009.

The Tahasildar, Rayagada has observed the required formalities like issue of proclamation inviting objection, field enquiry, realization of demarcation fees, proclamation fees, court fees etc. and submission of ‘Sabik’ records, field visit memorandum form and copy of G.N etc. After expiry of the appeal period, the case record bearing No. GPLC Case No.4045/2010 has been transmitted to the Sub-Collector, Rayagada for settlement of the above schedule of Gram Kantha Paramboke (Basti) Land on rayati status in favor of appellants under Rule 5 (b) of the OGLS (Amendment) Rules, 2010 for necessary approval.

After perusal of the above case record on 23.04.2012, the Sub-Collector, Rayagada have visited the field on the very day and found that there is a temporary structure on the case land and there is no permanent fixture on the ground. The continuation possession of more than three years prior to the appointed date is doubtful. The built up area is not equal to the proposed area for settlement. The proposal of Tahasildar, Rayagada for confirmation of the above schedule of G.K.P land in favour of the appellants was rejected on 23.04.2012.

Gone through the case record by the ADM, Rayagada on 13.03.2015 and found that a second appeal has been filed by the State represented by the Collector, Rayagada in the Hon’ble High Court of Orissa vide RSA No.10/2015 against the orders in T.A No.3/2005 arising out of T.S No.19/2000 in connection with OGLS Appeal No.1/2014 and awaited the order of the Hon’ble Court.

On 05.05.2017, the Advocate for the petitioners have submitted the certified copy of Order No.4, dated 22.02.2016 in Misc. Case No.13/2015 and Order No.5 dated 22.02.2016 in RSA No.10/2015 of the Hon’ble High Court of Orissa. Perused the above documents and found that the RSA No.10/2015 has been dismissed by the Hon’ble High Court of Orissa.

As regards the suit land, steps have been taken to move the matter before Govt. of Odisha, Rev.& DM Department to obtain necessary clearance from Law Department so as to file appeal petition before the Hon’ble Apex Court against the Order dated 22.02.2016 passed in RSA No.10/2015 by the Hon’ble High Court of Orissa. Accordingly, Govt. in R&DM Department have already been moved by the Collector, Rayagada vide Lr.No.2035 dated 21.06.2017.

The case is now subjudice in the Court of ADM, Rayagada.

The Collector should impress upon the Tahasildars to dispose of the pending mutation cases at an early date. It is seen from the above statement that during the year 2015-16, 6239 cases were instituted making a total of 6321 cases for correction of RoR and 6134 no. of cases were corrected leaving a balance of 187 cases for correction of RoR. During the year 2016-17, 6164 cases were instituted making a total of 6351 cases for correction of RoR and 5911 no. of cases were corrected leaving a balance of 440 cases for correction of RoR. During the year 2017-18, 1743 cases were instituted making a total of 2183 cases for correction of RoR and 1949 no. of cases were corrected leaving a balance of 234cases for correction of RoR. The Tahasildars should be instructed to dispose of the pending cases early for correction of RoR. The Collector, may during her normal tour to Tahasil/R.I. offices verify some cases to ascertain the actual position of correction of RoR and correction in the corresponding map. During inspection the Collector, Rayagada brought to my notice that a new high level road bridge over Jhanjabati Nala near Majhighariani temple, Rayagada is yet to be constructed by the PWD due to want of approval of Government on exchange of land between Railway and PWD. The Collector is advised to pursue the matter with the Government and I will take up the matter with the Principal Secretary at the earliest.

It is seen that during the year 2016-17, 325 No. of cases involving an amount of Rs.190.87 lakh were pending for disposal in different courts leaving a balance of 303 cases covering an amount of Rs. 188.08 lakh. It appears that the cases with heavy amount are pending in the court of the Tahasildar, Rayagada, Sub-Collector, Rayagada and Revenue officer, Rayagada.

During the year 2017-18, 316 cases involving an amount of Rs.189.20 lakh were pending for disposal in different courts leaving a balance of 223 cases covering an amount of Rs. 113.52 lakh. It appears that the cases with heavy amount are pending in the court of the Sub-Collector, Rayagada, Revenue officer, Rayagada & Tahasildar, Rayagada.

The Collector is advised to issue necessary instructions to the certificate officers for disposal of cases as early as possible.

During year 2016-17, 1463 cases have been disposed of with collection of premium of Rs.100.10 lakhs in different Tahasil of the district. During the year 2017-18, 2564 cases have been disposed of with collection of premium of Rs.106.61 lakh and during the year 2018-19 (upto 31.05.2018), 224 cases have been disposed of with collection of premium Rs. 19.71 lakh.

The Collector is advised to take steps for realization of premium in disposal of more numbers of cases.

ANNUAL LAND REVENUE ADMINISTRATION

The Annual Land Revenue Administration Report for the year 2013-14 has already been sent to RDC (SD), Berhampur vide this office letter No.3332 dated 03.10.2015 under intimation to Board of Revenue, Odisha, Cuttack. The above report for the year 2014-15 is under process,

Review of disciplinary proceedings

The pendency of disciplinary proceedings and suspension cases were last reviewed on 16.03.2017 by a committee under the chairmanship of Collector, Rayagada. Proceedings of the meeting was released vide memo No.679 dated.10.04.2017. The pendencies are also reviewed in each staff meeting.

1.Staff Position: Sri. Dhruba Kumar Nayak is working as District Small Savings Officer since 22-03-2013. Prior to him, Sri S.K. Mohapatro was in charge of this section. Besides, Miss K. Madhu Gouri and Sri. Satyaban Sahoo has been working in this section as junior clerk and peon on contractual basis since 02-06-2017 and 15-12-2007 respectively.

2.Target and achievement of Small Savings Collection: Government in Finance Department has assigned an ambitious target of Rs.27.00 Crore for our District for the financial year 2017-18. 3.Small Savings Incentive Schemes: Government in Finance Department had launched Small Savings Incentive Scheme under the caption ‘AO’ Series w.e.f. 01-01-2017 to 31-12-2017 with a view to accelerate the pace of postal collection in the state. The depositors who had invested with minimum of Rs. 2000/- in the specified postal savings schemes like K.V.P., N.S.C., PORD A/C- 5year, SSA A/C, MIS A/C, PPF A/C and SCSS A/C during the above period were eligible to get one free coupon. In this context, 43836 nos. of incentive coupons as against the target of 40,000 coupons were issued in the district. The BSSO at the block level, the SDSSO at the Sub-Divisional level and the DSSO at the District Level are authorized to issue o the eligible investors. The Government of Odisha has not yet notified about the launching of another series of Small Savings Incentive Scheme. The draw of the above lottery series was taken up on 29-04-2018 and it is ascertained from the said draw that our district has fetched a total ten(10) prizes only involving nine prizes of Rs.2000/- each and rest one prize of Rs.5000/- totaling total prize amount of Rs.23000/-.

Area of Jurisdiction

Rayagada district was declared on 2nd October1992 being carved out from Koraput district. This district is situated in the Southern part of Odisha adjacent to Andhra Pradesh covering an area of 7073 Sq. Kms. Rayagada district is surrounded by the neighboring district of Gajapati to the East , Kalahandi to the West , Kandhamal to the North and Koraput & Andhra Pradesh to the South .

The entire administrative set up of Rayagada district is a part of 21-Koraput (ST)Parliamentary Constituency and divided in to two Sub-Divisions i.e. Rayagada & Gunupur, three Assembly Constituencies viz. 138-Gunupur (ST) , 139-Bissam Cuttack(ST) and 140- Rayagada(ST)
