This Writ Petition is filed under Articles 226 and 227 of the Constitution of praying to quash the impugned order dated 19.10.2005 vide Annexure-H passed by R3.

This writ petition coming on for hearing this day, the Court made the following.

O R D E R

The order at Annexure-H passed by the Deputy

Conservator of Forests, Davangere by which the petitioner’s application for grant of licence to establish and run the saw- mill came to be rejected, is called in question in this writ petition.

2. The order at Anenxure-H is based on the order passed by the Apex Court in S.L.P. No.202/95. Even otherwise, the impugned order can be questioned before the Appellate Authority under Rule-163(6) read with Rule

163(10) of the Karnataka Forest Rules, 1969. Hence this

Court declines to entertain this writ petition. If the petitioner is still aggrieved by the impugned order, it is open for him to approach the Appellate Authority within one 4

month from this date. If such an appeal is filed within the said period, the same shall be considered by the Appellate

Authority without raising the question of delay. But the

Appellate Authority should keep in mind the judgment of the Apex Court cited supra.

Writ Petition is disposed of accordingly.
