THE PURPOSES OF THIS The purposes of this architectural, engineering, and REPORT Phase I environmental site assessment report are to:

1. describe architectural and engineering conditions as they relate to the subject property's current state of being

2. identify and analyze, to the extent feasible, recognized environmental conditions in connection with the subject property

This report is an opinion work. The conclusions presented are held with confidence and, where possible, opinions are supported by positive knowledge and proof. The content of this report is subject to appropriate privacy and non-disclosure privilege. The mention of trade names or commercial products does not constitute endorsement, or recommendation for use. 6======~

THE PROPERTY The Property Condition Report is performed by architects CONornoN REPORT and engineers who ascertain the current condition of the subject property.

Current condition is defined as the subject property's condition as evaluated on the date the subject property was inspected. That evaluation date is recorded on the cover page.

The information presented in the Property Condition Report sections of this report is collected by conducting a visual inspection of the property that includes, but is not limited to:

Cost estimates are based on the professional judgment of Building Diagnostics' Inspectors and Management. Costs are not based on construction bids or contracts from trade professionals. ======~

lliE PHASE I Building Diagnostics' Inspectors examine the building and ENVIRONMENTAL SITE its immediate surrounds to identify recognized ASSESSMENT (ESA) environmental conditions in connection with the subject property.

In doing so, Inspectors attempt to identify the presence, or likely presence, of conditions that present material risk of harm to the public health or to the environment.

Building Diagnostics' Inspectors do not report de minimis conditions that do not present a material risk of harm to the public health, or to the environment, and that generally would not be the subject of an enforcement action if brought to the attention of appropriate government agencies.

The Phase I site reconnaissance includes, but is not limited to reviewing for the:

ENVIRONMENTAL The purpose of a Phase I records and database review is RECORDS AND to·. identify, to the extent feasible, recognized DATABASE REVIEW environm~ntal conditions in connection with the subject property.

Recognized environmental conditions means the presence or likely presence of any hazardous substances or petroleum products on the subject property, and within a specified approximate mean search distance (AMSD), under conditions that indicate an existing release, a past release, or a material threat of a release of any hazardous substances or petroleum products into structures on the property or into the ground, groundwater, or surface water of the property.

These guidelines include hazardous substances or petroleum products even under conditions in compliance with laws.

Building Diagnostics' Inspectors do not report de minimis conditions that generally do not present a material risk of harm to public health or the environment and that generally would not be the subject of an enforcement action if brought to the attention of appropriate government agencies. 6======~

4. review of applicable federal, state, and local environmental regulatory agency databases for information about the subject property and its adjoining properties

Building Diagnostics' Environmental Analysts perform the records review based on (1) ASTM's Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessment Process E 1527-94, (2) the client's scope of work requirements, and (3) Building Diagnostics, Ltd. internal standards and practices.

Building Diagnostics' Analysts review information in a manner and form that yields information relevant to the property without the need for extraordinary analysis of irrelevant data.

Records that cannot be feasibly retrieved by reference to the exact location of the property or a precise geographic area in which the property is located are not, generally, considered practically reviewable. Large databases with numerous facility records are generally considered not practically reviewable unless they can be obtained from the source agency in the smaller geographic area of zip codes. Even when the information is provided by zip code, it is common for an unmanageable number of sites to be identified. When so much data is generated that it cannot be feasibly reviewed for its impact on the property, it is not practically reviewable. Building Diagnostics relies on the ASTM definitions of reasonably ascertainable and practically reviewable when determining the scope of the records review for a given property. b======~

The purpose of the Phase II investigation is to more thoroughly define potential problems (and potential liability) on the subject property, including type, location, and extent of contamination. Phase II follow-up activities generally include:

• additional records investigation and additional interviews with persons who have, or may have, knowledge of the site . • soil borings and/or soil gas survey soil sampling and analysis • surface water sampling and analysis • groundwater sampling and analysis • metal detection surveys to locate buried drums and tanks • seismic, electrical, and electromagnetic surveys to define sub-surface geologic and hydrologic conditions • underground storage tank testing

SUBJECT PROPERlY.

Location OJervie.N The Desert Fashion Plaza, hereafter referred to as the subject property, is located in Palm springs, California. The subject property consists of one building with a total of 358,227 Square Feet. The building was initially constructed between 1968 and 1971 on 11 acres and was renovated in 1986. The site is bordered on all sides by hotels or retail shops. b======d Subject Property The building is one story in height (two anchor stores are two lmprovemen1s Desaiption stories) and is of light steel and masonry construction. Exterior finishes are mainly stucco. The buildings have flat roofs and skylights. There is a Regency Suite Hotel physically connecting to the North side of the Mall. There are two interconnecting multi-level parking garages below the Mall and street level. Main access to the subject property is from North Palm Canyon Drive and Tahquitz-Mc Callum Way. ======d Tenant Listing There were thirty-eight tenants at the time of the inspection. 6======~

No major changes appear to have occurred over the years that would, otherwise, be in conflict with those codes.

OVERVIEW The statements in this section are written to provide only a brief and general look at ADA legislation as it applies to multi-family housing.

Title Ill ofthe ADA divides covered buildings and facilities into two categories: public accommodation and commercial facilities.

A public accommodation is a private entity that owns, leases (or leases to), or operates a "place of public accommodation". Although the ADA does not require compliance for residential structures, a leasing office may, under specific circumstances, be considered public accommodation and, therefore, required to comply.

Building Diagnostics' Inspectors make a casual evaluation of barrier removal remedies in the course of their Property Condition Report. They do not conduct an ADA audit. These are the observations made during the Property Condition Report of the subject property: ======d Observations

ASBESTOS CONTAINING MATERIAL (ACM)

ACM Overview The USEPA defines ACM as any material containing more than 1% asbestos as identified during laboratory analysis. Asbestos was added to building materials until banned by the USEPA in 1973 (spray-applied insulation), 1976 (pre­ molded friable insulation), and 1978 (spray-applied surfacing finishes).

Although banned in the construction of new building materials, "in stock" supplies of ACM were still used during building construction until approximately mid-1981. Under OSHA, certain materials in any building built prior to 1981 must be presumed to contain asbestos including all thermal system insulation, surfacing materials, and vinyl floor tile. OSHA reguires these presumed asbestos containing materials be covered by an O&M Program until laboratory testing proves otherwise.

Examples of common suspect ACM in residential units are drywall & joint compound, floor tile and mastic, ·drop ceiling tile, and textured surfacing finishes. Building Diagnostics' Inspectors follow recommended USEPA guidelines for surveying and sampling and are USEPA accredited to perform bulk sampling.

In assessing whether or not asbestos-containing materials may be present, Building Diagnostics' Inspectors consider whether the subject property was constructed before 1981, whether documented evidence of asbestos exists in building plans, arid whether a prior ACM sampling episode has taken place.

Only readily visible material is evaluated in the assessment process. In the event friable or potentially friable suspect asbestos-containing material is discovered, the Inspector takes samples and sends them to .a laboratory where a Polarized Light Microscopy analysis will determine the asbestos content.

All asbestos removal projects must comply with specific state and federal guidelines. While disposal of asbestos containing materials is not regulated as hazardous waste under RCRA, some states do regulate how and where asbestos waste can be disposed. ======~

Assessment While Building Diagnostics inspectors are AHERA Methodology certified for asbestos sampling and follow USEPA guidelines. for visually assessing a property for suspect building materials, the limited sampling undertaken during this assessment should not be confused with a complete AHERA-type asbestos survey. Similarly, the results of this survey do not remove the need for possible additional· sampling of suspect materials if extensive renovation or building demolition is planned. 6======~

Assessment Results Based on available information, the subject property was extensively renovated in 1986. Original Mall construction began in 1968 and was finished in 1971. An asbestos survey and sampling task was completed in 1996 during the previous ESA. A total of 62 samples of various building materials were laboratory analyzed for asbestos content. The only asbestos-containing material identified was spray-applied acoustical ceiling finish in a shoe-store tenant space. This friable material was noted to be in good condition during the previous ESA. No additional sampling of suspect asbestos-containing materials was undertaken during this assessment. b======d Recommendations Asbestos containing materials (spray-applied ceiling finish) were identified on-site during the previous ESA. As a result, an Operations & Maintenance (O&M) Program is recommended for the subject property. b======d

IPOLY-CHLORINATED BIPHENYL (PCB) . I PCB Overview In 1976, the Toxic Substances Control Act (TSCA) was passed to regulate polychlorinated biphenyl (PCB): a chemical believed to pose unreasonable risk of injury to health or to the environment. PCB's were historically used as coolants and insulating fluids in electrical equipment and some types of hydraulic fluids prior to the 1977 USEPA ban on PCB production.

TSCA defines three classifications transformers based on PCB content. Non-PCB Transformers are those containing less than 50 ppm PCBs. PCB contaminated Transformers are those containing between 50 and 499 ppm PCBs. Those transformers containing over 499 ppm PCBs are considered to be PCB Transformers.

Electrical transformers often contain labels regarding PCB content. Where these labels are visible, Building Diagnostic's can verify PCB content. Where transformers are found lacking labeling, the utility provider (transformer owner) can provide sampling and laboratory analysis of the cooling fluid. ======~

ILEAD IN DRINKING WATER I Lead in Drinking Water The 1974 Safe Drinking Water Act gave the USEPA Overview authority to require public and private water suppliers to test water provided for human consumption and set allowable contaminant levels. The USEPA has developed recommended maximum levels for numerous pollutants for protection of human health. These recommended maximum pollutant levels are known as water quality criteria.

The USEPA has set an action limit of 15 ppb for lead in drinking water. Compliance for this limit is measured at the point where a municipal water supplier discharges potable water to the municipal system, and at the users water tap. Elevated lead in drinking water concentrations may result from lead-containing components of drinking fountains, lead-based solder in the plumbing system and lead-based plumbing components in the municipal· water distribution system. b======~

IHAZARDOUS MA1CRIALS MANAGEMENT I Hazardous Materials The Resource Conservation and Recovery Act (RCRA) Overview stipulates that all hazardous materials be properly containerized and stored while on site. Depending on the quantity, and the length of time the hazardous material is stored on site, a USEPA RCRA Permit and ID number may be required.

OSHA stipulates that all drums containing hazardous materials be properly labeled according to contents and hazards, and that Material Safety Data Sheets (MSDS) be held on site in a central location, or in a location where the hazardous materials are handled.

Building Diagnostics' Inspectors attempt to determine if there are regulated substances stored on the subject property, and look for appropriate hazard communications such as signs, warnings, labels, and/or alarms on the subject property. However, the level of assessment undertaken during a Phase _I ESA inspection should not be confused with that which would take place during a complete RCRA Environmental Audit. IABOVEGROUND ·STORAGETANKS I Overview Aboveground storage tanks (ASTs) are defined as those tanks with less than 1 0% of their volume placed below the ground surface. This includes tanks sometimes referred to as "vaulted tanks". On residential properties ASTs are commonly used to contain fuel oil. On commercial properties ASTs can be used for the storage of virgin product, or waste byproducts, and may have to be labeled appropriately if the waste is considered hazardous.

ASTs are not formally regulated by the USEPA such as underground storage tanks (USTs). However some states or local governments regulate register requirements, size, use, or location of ASTs following either the Uniform Fire Code (UFC), the National Fire Protection Association (NFPA), the Building Officials & Code Administration (BOCA), or the Southern Building Code Congress '======:!~ International (SBCCI) guidelines.

Assessment Results A total of one AST was present on the subject property and is further described below:

Assessment Results Sanborn Map dated 1969 was acquired from EDR­ Sanborn, Inc., for this assessment. The 1969 Sanborn Map indicates the subject property was occupied by the Desert Inn and Palm Canyon Hotel. Property to the south and east are shown as a hotel and mixed retail, respectively. NPL Overview The Comprehensive Environmental Response, Compensation and Liability Act (CERCLA, commonly known as the "Superfund") was passed in 1980 to provide a regulatory framework and financial fund to address remedial action where an uncontrolled release of hazardous materials to the environment has taken place. Based on 1995 USEPA data, 85% of NPL sites have some degree of groundwater contamination.

CERCLA established the National Priorities List (NPL) whereby contaminated sites are listed and assigned a priority based upon the severity of the contamination as determined under a Hazardous Ranking System (HRS) evaluation (40 CFR Part 300). NPL sites are those where the USEPA determined an imminent and substantial threat of endangerment to human health or the environment was present. b======~

CERCUS Overview CERCUS requires an owner or operator of a facility where hazardous waste has been stored, treated, disposed of, or placed, to notify the USEPA of the existence of such facility unless the facility has previously been issued a permit under the direction of RCRA or the Solid Waste Disposal Act. The CERCUS database provides a comprehensive listing of identified hazardous materials sites. A property's inclusion on the CERCUS database does not imply that federal activity or hazardous conditions necessarily exist at that property.

CERCUS properties, which have been "delisted", are identified on the CERCUS No Further Remedial Action Planned (NFRAP) database. NFRAP sites are those where contamination was deemed not serious enough to warrant federal action under Superfund. NFRAP sites may be remediated under SHWS or Brownfields Programs. ======~

RCRA Overview RCRA, enacted in 1976, and amended in 1980 and 1984, requires "cradle to grave" management and control of hazardous materials as part of an effort to minimize the future threat to human health and the environment from the indescriminant handling, transport, or disposal of materials of this type. RCRA requires generators to obtain an EPA 10#, properly handle waste, retain transport manifests, maintain on-site records, and file annual reports.

Three generator types are defined by RCRA including: Large Quantity Generators (> than 1,OOOkg of hazardous waste a month), Small Quantity Generators (between 100 and 1,000kg of hazardous waste a month), and, Conditionally Exempt(< than 100kg of hazardous waste a month). Most conditionally exempt generators will only show up on the FINDS database.

Facilities operating under a RCRA permit are tracked under the RCRA Resource Conservation and Recovery Information System (RCRIS). RCRA sites for which Section 3008 complaint orders have been filed are listed on the RCRA Administrative Action Tracking System ~======:!! (RAATS).

SWF/LS Overview Regulation of solid waste management and disposal was first addressed by the Solid Waste Disposal Act of 1965. This act was amended in 1970 with the Resource Recovery Act, which was itself amended in 1976 and became known as RCRA. SWF/LS are sites that are regulated by RCRA Subtitle D or equivalent state programs for the operation and maintenance of solid waste facilities.

In many cases, closed landfills may not appear on the SWF /LS database because they pre-date passage of RCRA. RUST Overview The 1988 amendments to RCRA and 1986 amendments (SARA) to CERCLA added an additional element that has had a significant impact on real estate transactions. The RCRA amendment created a new Subtitle I, which established a complete regulatory scheme for the control of underground storage tanks (defined as any tank with 10% or more of its volume, including piping, beneath ground surface). Regulations promulgated pursuant to this Subtitle ·have established stringent construction standards for new underground storage tanks including corrosion protection, spill/overspill protection, and leak detection. Further, these regulations created extensive reporting requirements for existing tanks, as well as stringent procedures to be followed for removing or discontinuing use of tanks. Tanks used for the storage of heating oil for on-site consumption are excluded from the federal regulations but may be regulated by some state or local agencies.

Tanks installed during the 1950's - 1960's were commonly constructed of uncoated carbon and asphalt­ coated steel, both .of which proved susceptible to corrosion. During the post 1970's, galvanized steel and non-corrosive materials such as fiberglass, Teflon, and neoprene became available for tank construction, thereby reducing the chance of corrosion.

The USEPA states that regulated USTs installed prior to 1988 must have had leak detection installed by 1993, and must have spill, overfill, and corrosion protection installed by 1998. Tanks installed after 1988 must have had all of the above at the time of installation. ======d

RUSTs, continued Regulated on-site USTs should be registered with the proper regulatory agency. Records of inventory control and tank tightness testing should be kept on site. By the end.of 1998, all regulated USTs must have some means of corrosion protection and spill/overspill prevention systems installed, and a monthly monitoring program in effect as set forth in 40 CFR Part 280.21(a). Tank tightness testing will no longer be accepted as the sole method of leak detection.

USTs no longer in service on site must be removed within federal or state guidelines. If such verification cannot be provided, it is recommended that the UST be removed within the required guidelines.

The mere presence of RUSTs within the AMSD does not, by itself, construe a significant environmental impact. Only those RUSTs reporting a release (LUST), represent a potential for negative environmental impact. b======d Assessment Results Total Number Identified in AMSD: 0

LUST Overview Section 9003(h) of RCRA Subtitle I gives the USEPA and states authority to clean up releases from UST systems, or require owners or operators to do so. RCRA stipulates that owners/operators of leaking UST facilities notify the appropriate regulatory agency of the release within a specified time interval. Failure to comply with the notification process could subject the owner/operator to substantial penalties. Contamination resulting from leaking tanks must be investigated and, in most cases, remediated. The particular details of remedial investigations and actions will depend upon the requirements established by the USEPA or state UST oversight agency.

EXECUfiVE SUMMARY

This report summarizes the results of a Phase I Environmental Assessment ofthe Desert Fashion Plaza at 123 North Palm Canyon Drive, Palm Springs, California for Financial Security Assurance, Inc. This assessment was performed in accordance with ATC proposal P%-336 as authorized by Mr. Joseph DiProspero.

The Subject Property is rectangular in shape and is contained on an 11 acre parcel. Improvements to the property consist of a shopping mall and adjoining parking structures. The Subject Property has been occupied by a shopping mall since it was built in 1968-1971. The site was renovated to its present configuration in 1985.

No evidence of underground storage tanks such as fill ports, vent lines or dispensers were observed on the Subject Property.

Two diesel powered generators with attached fuel tanks belonging to Saks Fifth Avenue and the former I. Magnum (Unit #239) are present on the roof of the Subject Property. A pad mounted diesel powered generator with an attached fuel tank belongs to the mall. No spills or leaks Were observed from any of these generators.

A preliminary asbestos survey was part of the scope of this assessment. During the site visit, bulk samples of various materials including joint compound, drywall, acoustic ceiling tile/ spray acoustic ceiling materiat sprayed fireproofing material, vinyl floor tile, vinyl sheet flooring, and carpet mastic were collected for testing. In addition, samples of suspected thermal pipe insulation were also taken. None of the tested samples contained asbestos except for the spray-applied acoustical ceiling samples taken from Ted Land Shoes. These samples each contained three percent chrysotile.

A lead-based paint survey was not part of the scope of this assessment. Based on the date of original construction there is some potential for lead-based paint; however, based on the structural renovation

(1985) 1 there is little potential for lead to be present in exposed paint.

The Subject Site periodically generates small quantities of waste paint and floor stripping agents. In

December 19941 the Subject Propert)r improperly discharged a small quantity of Zeptone Sealer, a hazardous material, into a planter that drains into the storm sewer. Since this violation, any waste paint and floor stripping agents have been -stockpiled into 55 gallon drums. Periodically, the material in these drums is recycled by Brco Environmental.

Review of readily available federal, state, and local regulatory database information indicated no environmental concerns within the area of the Subject Property.

A review of historical aerial photographs/ building permits and Sanborn Maps did not reveal any past site uses of facilities on the Subject Property that could adversely impact the soil and ground water beneath the Subject Property.

No oil or gas wells are located on, or in close proximity to the site. The closest plugged and abandoned wells (dry hole) are located approximately seven miles from the Subject Property. Based on the information presented in this report, it is ATCs professional opinion that the Subject Property has a low potential to be impaired by hazardous materials and there is little potential for significant environmental liability.. .

Based on the information reviewed and contained within this report, ATC recommends an Asbestos Operation & Maintenance Plan be developed and implemented for the mall. Otherwise, no additional investigation appears warranted at this time. ·

1.0 . SCOPE OF WORK

This report summarizes the results of a Phase 1 Environmental Assessment of the Desert Fashion Plaza located at 123 North Palm Canyon Drive, Palm Springs, California (Subject Property). This work was performed by ATC Environmental Inc. (ATq for Financial Security Assurance, Inc. This assessment was performed in accordance with ATC proposal P96-336, as authorized by Mr. Joseph DiProspero. A site location map and a site plan are included in Appendix A.

1.1 Purpose and Scope

The purpose of the Phase I Environmental Site Assessment was to evaluate the poten~al for environmental concerns or liabilities due to past and/ or current land use practices at the Subject Property or from nearby sites.

The scope of services for this assessment included the following tasks:

• A visit to the SubJect Property to obtain information regarding obvious visual signs of contamination; hazardous materials. usage, storage or disposal in the vicinity of the Subject Property if any;_ and type of business activities within the area;

• Review of available historical aerial photographs, fire insurance maps, and topographic maps for information regarding previous land use of the Subject Property and vicinity;

• Assess the presence of underground storage tanks on.the Subject Property;

• Observation of the property for potential PCB-contaminated electrical equipment;

• Contact applicable regulatory agencies and review local, state and U.S. Environmental Protection Agency (EPA) lists to obtain information regarding environmental permits, environmental violations or incidents and/ or status of enforcement actions at the Subject Property and immediate vicinity;

• Review of geologic and hydrogeologic literature to obtain information regarding general subsurface conditions;

• Preparation of this report to present our findings.

1.2 Site Location

The Subject Property is located at 123 North Palm Canyon Drive, Palm Springs, California.

The Subject Property is bounded by Hyatt Hotel and North Belardo Road to the north, Tahquitz Canyon Drive to the south, North Palm Canyon Road to the east, and Museum Drive to the west. The -site is located in the downtown retail commercial district of Palm Sprin~s. There are institutional and hotel developments adjacent to the Subject Property.

2.0 SITE INSPECilON

On July 23, 1996, ATC representative Mr. Troy Cox met with Mr. Lee Haven from Desert Fashion Plaza and performed a reconnaissance visit to the Subject Property and vicinity to visually observe existing site conditions and types of land use in the site vicinity. Photographs taken at the time of the site visit are included in Appendix B.

2.1 Site Description and .Current Use of the Property

The Subject Property is irregular in shape and is contained on an 11 acre parcel. Improvements to the property consist of a fully enclosed shopping mall and two adjoining multi-level parking structures.

The mall is anchored by Saks Fifth Avenue and consists of eighty-one other tenant and storage spaces. Forty-five ·of which are currently occupied by clothing stores, specialty retail and entertainment stores, and restaurants. In addition, the adjacent Hyatt Regency Hotel maintains a banquet room (unit #501) and a storage (unit #485) within the midi. The mall is one story except for Saks Fifth Avenue, and units #239 and #101 which are each two stories. The mall management office occupies the mall's mezzanine level. In addition, units #169 (fed Land), #287, and #227 each have individual mezzanine levels.

2.2 Historical Use of the Property.

Historical aerial photographs and building permits indicated that the Subject Property was part of a shopping center and resort complex from 1948 until 1968. Construction of the mall in its originalconfiguration began in 1968. In 1985, the mall was structurally remodeled to its current configuration.

2.3 Current Use of Site Vicinity

The site is located in the downtown commercial district of Palm Springs. The Subject Property is bordered to the north by the Hyatt Hotel and North Belardo Road; beyond North Belardo Road is the O'Donnell Golf Course. To the east is North Palm Canyon Drive; beyond which are twenty-three small retail shops. To the south is Tahquitz Canyon Road; beyond which is a vacant lot, a Holiday Inn, a Holiday Oasis Hotel, and a Starbucks ·Coffeehouse. To the west is Museum Drive; beyond which is The Palm Springs Museum.

2.4 Historical Use of Site Vicinity

The aerial photographs and building permits reviewed for this assessment indicated that the site vicinity has been a shopping and resort center as early as 1948. Since 1948, the surrounding land uses have not changed substantially even though some of the buildings have been· tom down and replaced.

2.5 Underground Storage Tanks

ATC contacted the Riverside County Department of Environmental Health and requested information on underground storage tanks (USTs) and hazardous materials· pertaining to 123 North Palm Canyon Drive. This agency had no records pertaining to USTs on the· Subject Property. Mr. Lee Haven; the site contact, communicated that the current owners have never installed underground tanks and· they are not aware of any existing or former· USTs on the · Subject Property. ·

2.6 · PCB Equipment

Prior to 1976,. Polychlorinated Biphenyls {PCBs} were commonly used in dielectric fluids in transformers, capacitors, and light ballasts due to their desirable thermal characteristics. Due to the demonstrated toxicity and persistence in the environment PCB manufacturing in the United States was discontinued.

Two pad mounted electrical transformers were observed at the northwestern side of the Subject Property. However, these transformers are owned by Southern California Edison~ who have never specified the use of PCB$ as a dielectric fluid in their transformers.

The Subject Property contains three elevators and two escalators. There is little potential that the hydraulic fluid used in these mechanical systems contain PCBs since their hydraulic fluid is regularly·changed out by Schindler Elevator Service.

Some of the storefronts within the Subject Property contain fluorescent light fixtures. Since portions of the Subject Property were constructed in 1968, there is some potential for the fluorescent light ballasts observed on the Subject Property to contain PCBs:. However, the fluorescent light ballasts were in good condition· and no leaks were observed;

2.7 · Asbestos-Containing Materials

A preliminary asbestos survey was part of the scope of this assessment. Based on the construction date of the original mall (1968 -1971), there is a potential for asbestos to be found in the acoustical ceiling panels, spray-applied acoustical ceiling, vinyl floor tile, and vinyl sheet flooring, and carpet mastic found in the units that predate the 1985 structural renovation. Since the mall was structurally remodeled in 1985, there is less potential for the newer building materials, seen throughout the buildings to contain asbestos.

During the site visit, bulk samples of various materials including joint compound, drywall, acoustic ceiling tile, spray acoustic ceiling material,· sprayed fireproofing material, vinyl floor tile, vinyl sheet flooring, and carpet mastic were sampled for testings as indications of possible asbestos-containing materials. In addition, samples of suspected thermal pipe insulation were also taken. All bulk samples were submitted for analysis to Hygeia Environmental Laboratories (Hygeia) located at 82 Sierra Madre Boulevard, Sierra. Madre; California where they were analyzed via Polarized Light 1\.~icroscopy (PLM). None of the samples contained asbestos except for the spray applied acoustical ceiling samples taken from Ted Land Shoes. These samples each contained three percent c~rysotile. Bulk logs of all samples are included in Appendix C.

During the site visit, the site contact, Lee Haven, communicated that before Bank of America vacated space #101, they conducted an Asbestos Survey and that no asbestos was found. ATC contacted Bank of America's .Corporate Real Estate office in an effort to secure a cop·y of the . report, but we have not received the report at the time of this writing..

During the site visit, ATC met with Mary Wahlberg from the Subject Property's Saks Fifth Avenue store and asked if an Asbestos Survey was conducted for the store. She communicated that one had been prepared and that no asbestos was found. ATC contacted the Saks Fifth Avenue Corporate Real Estate Office in an attempt to ·seclU'e a copy of the aforementioned report, but we have not yet received it. ·

2.8 Solid and Hazardous Waste

Non-hazardous solid wastes (typical household type wastes) are collected iUld placed in a fully enclosed compactor/collection bin located in a service tunnel on northwestern side of the Subject Property. This material is collected and disposed of by a licensed waste contractor.

The Subject Site periodically generates small quantities of waste paint and floor stripping agents In December 1994, the Subject Property improperly discharged a small quantity of Zeptone Sealer, a hazardous material, into a planter that drains into the storni sewer. Since this ·violation, any waste paint and floor stripping agents have been stockpiled into 55 gallon d.rwns. Periodically, the material in these drums is recycled by Brco Environmental.

In adqition, Saks Fifth A venue is temporarily storing small quantities of unused· paints and waxes on the roof until they can contract a certified waste recycler to remove the material.

2.9 Chemical Use and Storage

During the site visit, Mr. Lee Haven disclosed that small amounts of chemicals are stored on the Subject Property. These chemicals are restricted to small quantities of cleaning solutions, paint~ floor stripping agents, and diesel fuel. No leaks or spills were observed in the storage areas.

There are two roof mounted and one. pad mounted diesel powered generators on the Subject Property. The two roof mounted generators each have a 50 gallon above-ground tank attached to them and the pad mounted generator has a 1SO gallon abOve-ground tank attached to it. No spills or leaks were observed from these generators. ·

2.10 Utilities

. The Subject Property is serviced·by underground utilities. Southern California Edison provides electricity to the Subject Property. Desert Water Agency provides water service to the Subject Property. The natural gas service is provided by the Southern California Gas Company. 2.11 Lead-Based Paint

Iri 1978, due to the dangers of lead poisoning the Consumer Product Safety Commission banned the sale of lead-based paint,. defined as containing more than 0.06% lead by dry weight, to consumers and the use of lead based paint in residences and other areas where consumers have direct access to painted surfaces.

At the time of our site visit, all of the paint observed was in good condition. Paint sampling was not part of the scope of this assessment. Since the Subject Property was structurally renovated in 1985, the potential for the presence of lead-based paint (LBP) exposure on the Subject Property is low.

2.12 Urea-Formaldehyde Foam Insulation

. At the time of our site visit, there were no indications of the presence of urea-formaldehyde foam insulation on the Subject Property. Destructive sampling techniques were not employed during the survey. ·

2.13 Vegetation

A few planter boxes with trees and shrubs were observed surrounding the parking structures located on the Subject Property. No stressed vegetation was observed.

2.14 Underground Pipelines

Underground pipelines are usually delineated by an above ground steel pipe with a sign affixed to it. No such signs were observed on, or adjacent to, the Subject Property.

2.15 Ce~spools/Sewage Dispos~

No cesspools or depressions from cesspools were observed on the Subject Property. The Subject Property is presently connected to the sanitary sewer serviced by the City of Palm Springs. No unusual odors were noted at the time of the site inspection.

3.0 PHYSICAL CHARACTERISTICS

3.1 Topography

The Subject Property and su~ounding area are included within the U.S. Geological Survey, Palm Springs, California, 7.5-minute quadrangle map (1957, Photorevised 1980). The elevation of the Subject Property is shown as approximately 460 feet above mean sea level (MSL). The local topographic gradient is approximately forty feet per mile to the east. ·

3.2 Geology

The Subject Property is underlain by wind blown sand, alluvium, and alluvial fan deposits. These deposits consist primarily of interlayered boulders, gravel, sand. and silt which are unconsolidated and poorly stratified. There are no knewn active faults in the immediate area of the Subject Property.

3.3 Surface Hydrology

Surface drainage from the subject and adjacent tracts is to stonn sewers. The regional surface drainage is towards the east.

3.4 Ground Water Hydrology

The Subject Pr.operty is located within the Coachella Valley Ground Water Basin, Indio subbasin, Palm Springs subarea. ATC contacted the Desert Water Agency regarding the depth to ground . water in the area of the Subject Property. According to a representative of this agency, ground water was measured at a depth of approximately 219 feet in wells #5 and #18 located approximately a quarter ,mile north-northwest of the Subject Property. Typically, ground water in the area ofthe Subjeet Property occurs at a depth of approximately 235 feet below the ground sur!ace. In the vicinity of the Subject Property, the regional ground water gradient is towards the east.

4.0 GOVERNMENT AGENCY RECORDS REVIEW

Since the early 1970s, environmental agencies have been tracking the compliance of many facilities with the various laws that were promulgated to halt the pollution of the .air, land and water. More recently, records have been maintained documenting spills of hazardous materials and the locations of known waste sites or regulated waste handling facilities. The following sections summarize our review of a computerized search of a database (Environmental Risk Information & Imaging Services - EiUIS) of local, state and federal lists and highlights the approximate location ofsuch sites with respect to the Subject Property. ·

•.1 Federal

The following EPA lists were reviewed to search for sites within the area of the Subject Property:

• The National Priority List (NPL);

• The Resource Conservation Recovery Act (RCRIS} Treatment, Storage, and Disposal Facili~es (fS) List;

• ComprehEmsive Environmental Response, Compensation· and Liability Information System (CERCUS) List;

• The Resource Conservation Recovery Act (RCRIS) Small and Large Quantity Generator Lists;

• The Emergency Response Notification System (ERNS) List;

NPL, RCRIS-TS, CERCUS, and RCRIS Generator facilities within one (1) mile and ERNS facilities within one-half (0.5) mile of the Subject Property are listed below and/ or in Appendix D.

An NPL site is an uncontrolled or abandoned hazardous waste site identified for priority remedial action under the Superfun~ Program. The Subject .Property was not·listed as a NPL site. There are no NPL sites listed within one mile of the Subject Property.

The RCRIS-TS list contains information pertaining to facilities that either treat, store, or dispose of hazardous waste. The Subject Property was not listed as a RCRIS..TS facility. There are no RCRIS-TS listed facilities within one mile of the Subject Property. ·

The CERCUS List is the EPA compilation of sites for which the EPA has, or is investigating a. release or threatened release of hazardous substances which may be subject to review in accordance with the terms and conditions .of the Comprehensive Environmental Response, Compensation and Liability Act of 1980 (Superfund Act). The Subject Property was not listed as a CERCUS site. There are no CERCUS site listed within a mile of the Subject Property.

The ERNS list is a database that is used to store information on the sudden and/ or accidental release of hazardous substances, including petroleum; into the environment. The Subject Proputy was not listed as a ~NS site.

The RCRIS Generators list designates generator numbers to facilities which generate, store, treat, or dfupose of hazardous materials. RCRIS Generators are classified as large quantity generators if they generate over a 1000 kg of non-acutely hazardous waste per month and are classified as small quantity generators if they produce less than 1000 kg per month. Violations and Corrective Actions Lists are also published by the USEPA. The Subject Property is not listed as a RCRIS Generator site. There are four small quantity RCRIS Generator sites and three large quantity RCRIS Generator ·sites. listed within a mile of the Subject Property. The distance and status of the closest RCRIS Generator to the Subject Property is as follows:

Sites formerly listed in the Annual Workplan (AWP), the Abandoned Sites Project Information System (ASPIS), and the Bond Expenditure Plan (BEP) are now included in the CalSites Database. The California Solid Waste Information System (SWF) List contains an inventory of known active, inactive or closed solid waste disposal (landfills) and transfer stations. The Subject Property was not listed as a SWF site. There are no SWF sites listed within one mile of the Subjeet Property.

The Leaking Underground Storage Tank (LRST) Ust is a compilation of sites where leaks of hazardous substances from underground tanks have been detected and reported to state and local agencies. The Subject Property is not on the RST list. There are eight RST sites within one-half mile of the Subject Property. The closest RST site to the Subject Property is as follows:

None of the other RST sites have any violations, so the potential for adverse impacts from these sites on the Subject Property is low. ·

The Toxic Release Inventory System contains information on the release and/ or transfer of toxic chemicals as reportable under Title III of the Superfund Amendments and Reauthorization Act (SARA). The Subject Property was not listed as a TRI site. There are no TRI sites within one-half mile of the Subject Property.

4.3 Local Agencies

4.3.1 Riverside County Department of Environmental Health

ATC requested information concerning USTs and the used of hazardous materials on the Subject Property from the Riverside County Envirorunental Health Department. The agency found no records pertaining to the Subject Property.

4.3.2 City .of Palm Springs Building Department

ATC visited the City of Palm Springs Building Department to review building permits and other pertinent records for the Subject Property. The earliest building permit found pertaining to the Subject Property was for the construction of a commercial building and shell in 1968. In 1969, a building permit for a covered mall and a bell tower was taken out. The interior shell of the mall . on the Subject· Property was completed in 1971. In 1985, the. current owners, DeBartolo Corporation, took out a permit to structurally remodel the mall and to construct the mall management offices in the existing mezzanine. Since the completion of the first interior shell in 1971, numerous tenant improvement permits have been taken out. No permits were found that indicated the use or storage of hazardous materials at the site.

5.0 HISTORICAL REVIEW

5.1 Historical Aerial Photographs

ATC reviewed historical aerial photographs from the Riverside County Flood Control and Water Conservation Department These photographs were dated 1995,1984,1974,1965,1959 and 1948. A summary of the history of the subject and surrounding properties ·as shown on the aerial photographs is as follows:

1948 Photograph

The eastern half of the Subject Property consists of a parking lot and a strip shopping center and resort cottages. The western half of the Subject Property and the adjacent properties to the west consist of resort cottages and courtyards.. The surrounding property to the north consists of shops and resort cottages. The adjacent property to the northwest is a golf course. The adjacent properties to the east consist of approximately twenty retail shops. The .adjacent properties to the south consist of three single building hotels and a retail building.

1959 Photograph

The Subject and surrounding properties to the north, northwest, east, and west are essentially unchanged from the previous photo.graph. The adjacent properties to the south ·are similar to the previous photograph except that the center hotel (identified as a Holiday Inn) has built a second hotel building.

1965 Photograph

The Subject Property is essentially unchanged from the previous photograph except that the southeast comer is now occupied by additional parking spaces. The adjacent properties to the north, northwest, west, east, and south are essentially unchanged from the previous photograph.

1974 ·Photograph

The Subject Property is occupied by the mall in its original configuration. The adjacent properties to the northwest, south and east are essentially unchanged from the previous photograph. The adjacent property to the north is separated from the Subjec-t Property by a street and consists of a hotel. The adjacent property to the west consists of a museum that is under construction.

1984 Photograph

The Subject Property and the adjacent properties to the north, northwest, south, and east are essentially unchanged from the previous photograph. The museum has been completed on the adjacent property to the west.

1995.Photograph

The mall on the Subject Property is in its current configuration and the adjacent properties to the northwest, east, and west appear as they did in 1984. There is a vacant lot.on the western comer of the adjacent properties to the south. Otherwise, the adjacent properties to the south appear as they did in 1984. There is a hotel complex (identified as the Hyatt Regency) adjoining the Subject Property to the north.

5.2 Historical Topographic Maps

A review was conducted of available historical topographic maps. Topographic. maps from the years 1957 and 1957 (Photorevised 1980) were reviewed. The following pertinent information regarding the Subject Property and vicinity .was observed during the topographic map review:

1957- Palm Springs, California, 7.5 Minute.Quadrangle

No buildings are shown on the Subject Property. There is a golf course northwest of the Subject Property. The Francis S. Stevens School is approximately 0.75 miles north of the Subject Property. The Agua Caliente Indian R~ervation is approximately 0.10 miles east and approximately 0.75 miles south ·oJ the Subject Property.

1957, Palm Springs, California, 7.5 Minute Quadrangle Photorevised 1980

The mall in its former configuration is shown on the Subject Property. In addition to the features shown on the 1957 map, there is a museum just west of the Subject Property and a post office approximately one mile north of the Subject Property.

5.3 Sanborn Fire Insurance Maps

ERIIS, Inc. was contracted to provide copies of historical Sanborn Fire Insurance Maps for the area of the Subject Property. There is no Sanborn Map coverage for the Subject and adjacent properties.

5.4 Oil and Gas Wells

Wildcat Map W1-7 from the State of California, Department ofConservation, Division of Oil and Gas was reviewed to determine the presence of oil wells near the Subject Property. there is a plugged and abandoned dry hole located approximately seven miles northeast of the Subject Property, and another plugged and abandoned dry hole approximately seven miles north of the Subject Property. In addition there is a drilled hole approximately seven miles north-northeast of the Subject Property. These past oil and gas exploration activities do not pose environmental problems for the Subject Property.

5.5 Synopsis of Previous Environmental Investigations

Financial Security Assurance, Inc. provided ATC with a copy of the Stipulated Final Judgment for the December 1994 ch~mical (Zeptone Sealer) disposal incident that occurred on the Subject

Property. Shortly after this incident occurred, Mr. Bruce Bailey and Mr. Wayne P. Hoy from the Riverside County Environmental Health Department took soil samples and water samples from the drainage sump. No residual contamination was found .

6~0 CONCLUSIONS

This report summarizes the results of a Phase I Environmental Assessment of the Desert Fashion Plaza at 123 North Palm Canyon Drive, Palm Springs, California for Financial Security Assurance, Inc. This assessment was performed in accordanc.e with ATC proposal P%-336 as authorized by Mr. Joseph DiProspero.

The Subject Property is rectangular in shape and is contained on an 11 acre parcel. Improvements to the property consist of a shopping mall and adjoining parking structures. The Subject Property has been occupied by a shopping mall since it was built in 1968-1971. The site was renovated to its present configuration in 1985.

No evidence of underground storage tanks such as fill ports, vent lines or dispensers were observed on the Subject Property.

Two diesel powered generators with attached fuel tanks belonging to Saks Fifth Avenue and the former I. Magnum (Unit #239) are present on the roof of the Subject Property. A pad mounted diesel powered generator with an attached fuel tank belongs to the mall. No spills or leaks were observed from any of these· generators. ·

A preliminary asbestos survey was part of the scope of this assessment. During the site visit, bulk samples ofvarious materials including joint compound, drywall, acoustic ceiling tile, spray acoustic ceiling material, sprayed fireproofing material, ·vinyl floor tile, vinyl sheet flooring, and carpet mastic were collected for testing. In addition, samples of suspected thermal pipe insulation were also taken. None of the tested samples contained asbestos except for the spray-applied acoustical ceiling samples taken from Ted Land Shoes. These samples each contained three percent chrysotile.

A lead-based paint survey was not part of the scope of this assessment. Based on the date of original construction there is some potential for lead-based paint; however, based on the structural renovation (1985), there is little potential for lead to be present in exposed paint.

The Subject Site periodicaUy generates small quantities of waste paint and floor stripping agents. In December 1994, the Subject Property improperly discharged a small quantity of Zeptone Sealer, a hazardous material, into a planter that drajns into the storm. sewer. Since this violation, any waste paint and floor stripping agents have been stockpiled into 55 gallon drums. Periodically, the material in these drums is recycled by Brco Environmental. ·

Review of readily available federal, state, and local regulatory database information indicated no environmental concerns within the area of the Subject Properly.

A re·."i~._. cf historical aerial photographs, building permits and Sanborn Maps did not reveal any past site uses of facilities on the· Subject Property that could adversely impact the soil and ground water beneath the Subject Property.

No oil or gas wells are located on, or in close proximity to the site. The closest plugged and abandoned wells (dry hole) are located approximately seven miles from the Subject Property. Based on our review of the data, it is unlikely that the site would be affected by past oil or gas exploration activities.

Based on the information presented in this report it is ATCs professional opinion that the Subject · Property has a low potential to be impaired by hazardous materials and there is little potential for significant envirorunentalliability. ·

7.0 RECOMMENDATIONS

Based on the information reviewed.and contained within this report, ATC recommends an Asbestos Operation & Maintenance Plan be developed and implemented for the mall. Otherwise, no additional investigation appears warranted at this time.

8.0 LIMITATIONS

A TC's work was performed in a professional manner with the best interests of our client in mind. Our objective was to perform our work with care, exerciSing the customary skill and competence of consulting professionals in the relevant disciplines. The conclusions presented in this report are professional opinions based solely upon visual observations of the site and vicinity and our interpretation of the available historical information and documents reviewed. DELISTED NPL: Delisted N PL Sites Source: EPA Telephone: 703-603-8769 DELISTED NPL: The National Oil and Hazardous Substances Pollution Contingency Plan (NCP) establishes the criteria that the EPA uses to delete sites from the NPL. In accordance with 40 CFR 300.425.(e), sites may be deleted from the NPL where no further response is appropriate.

NFRAP: No Further Remedial Action Planned Source: EPNNTIS Telephone: 703-413-0223 NFRAP: As of February 1995, CERCUS sites designated "No Further Remedial Action Planned" (NFRAP) have been removed from.CERCLIS. NFRAP sites may be sites where, following an initial inveStigation, no contamination was found, contamination was removed quickly without the need for the site to be placed on the NPL, or the contamination was not serious enough to require Federal Superfund action or NPL consideration. EPA has removed approximately 25,000 NFRAP sites to lift the unintended barriers to the redevelopment of these properties and has archived them as historical records so EPA does not needlessly repeat the investigations in the future. This policy change is part of the EPA's Brownfields Redevelopment Program to help cities, states, private investors and affected citizens to promote economic redevelopment of unproductive urban sites.

PWS: Public Water Systems Source: EPNO!fice of Drinking Water Telephone: 202-260-2805 Public Water System data from the Federal Reporting Data System. A PWS is any water system which provides water to at least 25 people for at least 60 days annually. PWSs provide water from wells, rivers and other sources.

PWS ENF: Public Water Systems Violation and Enforcement Data Source: EPNO!fice of Drinking Water Telephone: 202-260-2805 Violation and Enforcement data for Public Water Systems from the Safe Drinking Water Information System (SWDIS) after August 1995. Prior to August 1995, the data came from the Federal Reporting Data System (FRDS).

Area Radon lnfonnation: The National Radon Database has been developed by the U.S. Environmental Protection Agency (USEPA) and is a compilation of the EPA/State Residential Radon Survey and the National Residential Radon Survey. The study covers the years 1986 - 1992. Where necessary data has been supplemented by information collected at private sources such as universities and research institutions.

Oil/Gas Pipelines/Electrical Transmission Lines: This data was obtained by EDR from the USGS in 1994. It is referred to by USGS as GeoData Digital Une Graphs from 1 :1 00,000-Scale Maps. It was extracted from the transportation category including some oil, but primarily gas pipelines and electrical transmission lines.

Sensitive Receptors: There are individuals deemed sensitive receptors due to their fragile immune systems and special sensitivity to environmental discharges. These sensitive receptors typically include the elderly, the sick, and children. While the location of all sensitive receptors cannot be determined, EDR indicates those buildings and facilities - schools, daycares, hospitals, medical centers, and nursing homes - where individuals who are sensitive receptors are likely to be located.

USGS Water Wells: In November 1971 the United States Geological Survey (USGS) implemented a national water resource information tracking system. This database contains descriptive information on sites where the USGS collects or has collected data on surface water and/or groundwater. The groundwater data includes information on more than 900,000 wells, springs, and other sources of groundwater.

TC0221860.3r Page A16 Flood Zone Data: This data, available in select counties across the country, was obtained by EDR in 1996 from the Federal Emergency Management Agency (FEMA). Data depicts 100-year and 500-year flood zones as defined by FEMA.

Water Dams: National Inventory of Dams Source: Federal Emergency Management Agency Telephone: 202·646-2801 WATER DAMS: National computer database of more than 74,000 dams maintained by the Federal Emergency Management Agency.

.California Earthquake Fault Lines: The fault lines displayed on EDR's Topographic map are digitized quaternary fault lines, prepared in 1975 by the United State Geological Survey. Additional information (also from 1975) regarding activity at specific fault lines comes from California's Preliminary Fault Activity Map prepared by the California Division of Mines and Geology.

California Drinking Water Quality Database Source: Department of Health Services Telephone: 916-324-2319 The database includes all drinking water compliance and special studies monitoring for the state of California since 1984. It consists of over 3,200,000 individual analyses along with well and water system information.
