The Toronto Police Services Board approved the Minutes of the meeting held on February 16, 2007 and the special meeting held on February 26, 2007 with the exception of Minute No. P20/07 pertaining to the review of a complaint about Toronto Police Service policy. Minute No. P20/07 was amended by the Board. MOMENT OF SILENCE The Board observed a moment of silence in memory of Police Constable Daniel Tessier of the Laval Police Force who was killed while on duty on March 02, 2007 THIS IS AN EXTRACT FROM THE MINUTES OF THE PUBLIC MEETING OF THE TORONTO POLICE SERVICES BOARD HELD ON MARCH 22, 2007 #P94. CONCLUSION OF TERM: THE HONOURABLE HUGH LOCKE, Q.C. Chair Mukherjee noted that the term of appointment for The Honourable Hugh Locke, Q.C., would conclude on April 14, 2007 and, unless he is re-appointed by the Premier of Ontario, this would be the last meeting for Judge Locke. The Board acknowledged the valuable contribution that Judge Locke has made during the past three years, particularly his legal and judicial knowledge. The Board extended its thanks and appreciation to Judge Locke for his work with the Board. OUTSTANDING & PENDING REPORTS - PUBLIC The Board was in receipt of the following report March 07, 2007 from Alok Mukherjee, Chair: Subject: OUTSTANDING & PENDING REPORTS - PUBLIC Recommendations: It is recommended that: (1) the Board receive the attached list of pending and outstanding public reports; and (2) the Board provide direction with respect to the reports noted as outstanding. Financial Implications: There are no financial implications related to the approval of the foregoing recommendations. Background: At its meeting held on March 27, 2000 the Board agreed that the Chair would be responsible for providing the Board with a list of the public reports which had previously been requested but which had not been submitted and were, therefore, considered as “outstanding”. The Board further agreed that when outstanding reports were identified, the Chair would provide this list to the Board for review at each regularly scheduled meeting (Min. No. C70/00 refers). I have attached a copy of the current list of all pending and outstanding public reports required from both the Chief of Police and representatives from various departments of the City of Toronto. A review of this list indicates that there are outstanding reports; these reports are emphasized in bold ink in the attachment. The Board received the foregoing and approved the following Motion: THAT, as a result of a review of the outstanding reports, the Board delete the requirement for the following reports: - Board Minute No. P190/05 – Collection of Information - Board Minute No. P352/05 – RASAR Proposal - Board Minute No. P382/06 – Status of $650,000 – update provided in Minute No. P120/07. LEGAL FEES – TORONTO POLICE SERVICES BOARD: INQUEST INTO THE DEATH OF OTTO VASS The Board was in receipt of the following report January 09, 2007 from Alok Mukherjee, Chair: Subject: LEGAL FEES TORONTO - POLICE SERVICES BOARD - INQUEST INTO THE DEATH OF OTTO VASS Recommendation: It is recommended that the Board approve payment of legal fees charged by Borden Ladner Gervais LLP, in the amount of $95,665.86. Financial Implications: The funding required to cover the cost of these legal fees is available within the Board’s 2006 operating budget. Background/Purpose: Attached is a statement of account from the legal firm of Borden Ladner Gervais LLP in the amount of $95,665.86 for professional services rendered in connection with the above noted matter. The account is for the period ending December 19, 2006. I recommend that the Board approve payment of this account from the Board’s operating budget. This report corresponds with additional information provided on the in-camera agenda. The Board approved the foregoing. THIS IS AN EXTRACT FROM THE MINUTES OF THE PUBLIC MEETING OF THE TORONTO POLICE SERVICES BOARD HELD ON MARCH 22, 2007 #P97. LEGAL FEES – TORONTO POLICE SERVICES BOARD ATS. NORMAN GARDNER The Board was in receipt of the following report January 10, 2007 from Alok Mukherjee, Chair: Subject: LEGAL FEES - TORONTO - POLICE SERVICES BOARD ATS NORM GARDNER Recommendation: It is recommended that the Board approve payment of legal fees charged by Torys LLP, in the amounts of $8,148.85 and $4,722.00. Financial Implications: The funding required to cover the cost of these legal fees is available within the Board’s 2006 operating budget. Background/Purpose: Attached are statements of account from the legal firm of Torys LLP for professional services rendered in connection with the above-noted matter. The attached accounts are for the months ending October 31, 2006 and November 30, 2006, in the amounts of $8,148.85 and $4,722.00, respectively. I have also appended a letter dated January 4, 2007, from Mr. Albert Cohen, City Solicitor, Legal Services, in which he recommends “payment of these invoices as they are reasonable in my opinion and the services provided were necessary in defending this action.” I, therefore, recommend that the Board approve payment of this account from the Board’s operating budget. This report corresponds with additional information provided on the in-camera agenda. The Board was also in receipt of a copy of correspondence dated February 23, 2007 from Ms. Trisha Jackson, Torys LLP, to Mr. Albert Cohen, City of Toronto – Legal Services Division, with regard to a replacement account for the period ending December 31, 2006 in the amount of $254.40. A copy of Ms. Jackson’s correspondence is appended to this Minute for information. The Board approved the foregoing report from Chair Mukherjee and the additional replacement account in the amount of $254.40. REQUEST FOR A REPORT: PROPOSED BY-LAW PROHIBITING PANHANDLING IN OFFICIALLY DESIGNATED TOURIST AREAS The Board was in receipt of correspondence dated February 07, 2007 from Case Ootes, Councillor, City of Toronto, containing a request for a report with regard to a proposed by-law prohibiting panhandling in officially designated tourist areas. THIS IS AN EXTRACT FROM THE MINUTES OF THE PUBLIC MEETING OF THE TORONTO POLICE SERVICES BOARD HELD ON MARCH 22, 2007 #P99. 2006 HATE/BIAS CRIME STATISTICAL REPORT The Board was in receipt of the following report February 19, 2007 from William Blair, Chief of Police: Subject: 2006 HATE/BIAS CRIME STATISTICAL REPORT Recommendations: It is recommended that: 1) the Board receive the attached report for information; and 2) a copy of this report be forwarded to the Policy and Finance Committee for information. Financial Implications: There are no financial implications relating to the recommendations contained within this report. Background: The Hate Crime Unit of Intelligence Services has collected statistics and has been responsible to ensure full and thorough investigation of hate/bias crime offences since 1993. Attached is the 2006 Hate/Bias Crime Statistical Report. Discussion: At the time the 2005 Hate/Bias Crime Statistical Report was presented last year, the Board enquired about “the manner in which the Service determines the names of the victim groups, particularly, what criteria are used to differentiate a victim’s ethnicity from nationality or race”. The Board also enquired about “the definition of what constituted a hate crime”. The Unit advises that responses to these questions are included within the 2006 Hate/Bias Crime Statistical Report. Classification criteria are outlined in the Methodology of Categories section on page 5 and hate/bias crime definitions are provided in the Introduction section on page 3. Deputy Chief A.J. (Tony) Warr of Specialized Operations Command will be in attendance to answer any questions that the Board may have.     Rouge River State of the Watershed Report Surface Water Quantity Goal: Surface waters of a quantity, volume and naturally variable rate of flow to: $ protect aquatic and terrestrial life and ecological functions; $ protect human life and property from risks due to flooding; $ contribute to the protection of Lake Ontario as a domestic drinking water source; $ support sustainable agricultural, industrial, and commercial water supply needs; $ support swimming, fishing and the opportunity to safely consume fish; and $ contribute to the removal of Toronto from the Great Lakes list of Areas of Concern. Surface Water Quantity Key Findings: The Main Rouge subwatershed has been subject to significant urbanization with an approximate total impervious cover of 18% as of 2002. Several studies suggest that the maximum impervious cover that a watershed can withstand before experiencing severe hydrologic changes and consequent geomorphic and ecological impacts is approximately 10%. There has been significantly less urbanization in the Little Rouge subwatershed and impervious surfaces make up only 2% of the subwatershed area. As a result, hydrologic impacts and related effects are much less severe than on the Main Rouge River. Average annual flows in the Main Rouge River show a long-term increasing trend of over 1.3% per year in the past 40 years. This rate of increase is significantly greater than that on the Little Rouge River or nearby rural watersheds and is indicative of the effect of urbanization on the hydrologic cycle. The Rouge River has become flashy and now generates high flows in response to rainfall events that caused almost no response in the river prior to widespread development.

While much has been accomplished, several factors, if not addressed directly and quickly, will significantly jeopardize the ability of Conservation Authorities and all levels of governments to maintain and improve on this level of management and protection. Flood management is a shared responsibility in Ontario and Conservation Authorities are on the front lines of the Provincial Flood Forecasting and Warning program.     Hurricanes Influencing the Richmond Area Why should residents of the Middle Atlantic states be concerned about hurricanes during the coming hurricane season, which officially begins on June 1 and ends November 30? After all, the big ones don't seem to affect the region anymore. Consider the following: The last Category 2 hurricane to make landfall along the U.S. East Coast, north of Florida, was Isabel in 2003. The last Category 3 was Fran in 1996, and the last Category 4 was Hugo in 1989. Meanwhile, ten Category 2 or stronger storms have made landfall along the Gulf Coast between 2004 and 2008. Hurricane history suggests that the Mid-Atlantic's seeming immunity will change as soon as 2009. Hurricane Alley shifts. Past active hurricane cycles, typically lasting 25 to 30 years, have brought many destructive storms to the region, particularly to shore areas. Never before have so many people and so much property been at risk. Extensive coastal development and a rising sea make for increased vulnerability. A storm like the Great Atlantic Hurricane of 1944, a powerful Category 3, would savage shorelines from North Carolina to New England. History suggests that such an event is due. Hurricane Hazel in 1954 came ashore in North Carolina as a Category 4 to directly slam the Mid-Atlantic region. It swirled hurricane-force winds along an interior track of 700 miles, through the Northeast and into Canada. More than 100 people died. Hazel-type wind events occur about every 50 years. Areas north of Florida are particularly susceptible to wind damage.

Hurricane Isabel made landfall in eastern North Carolina around midday Thursday, September 18, 2003, as a Category 2 hurricane on the Saffir-Simpson Hurricane Scale (Appendix A). Although damage estimates are still being tabulated as of this writing, Isabel is considered one of the most significant tropical cyclones to affect northeast North Carolina, east central Virginia, and the Chesapeake and Potomac regions since Hurricane Hazel in 1954 and the Chesapeake-Potomac Hurricane of 1933. Hurricane Isabel will be remembered not for its intensity, but for its size and the impact it had on the residents of one of the most populated regions of the United States.

    The History of Flood Control in the TRCA The need for authorities In the 1940's development increased in previously unurbanized areas. As a result, natural resources, including water, were becoming commodities which needed to be regulated and controlled. In 1944 a decision was made to find a new approach to water resource conservation in Ontario and a conference, in London was organized to discuss what needed to be done1. From this conference a conservation branch in the provincial government was born2. Its first task was to prepare a bill which would become the Conservation Authorities Act3. In 1946 the act was passed4 . In the Toronto area several Conservation Authorities, including the Etobicoke Conservation Authority, were created to deal with pressing flood control issues5. In total four conservation authorities were created. They comprised of the Etobicoke- Mimico Creek C.A., the Humber River C.A., the Don River C.A., and the Rouge-Duffins- Highland-Petticoat C.A. These four Conservation Authorities mainly dealt with local flooding issues and reforestation within their watersheds. In 1957 the four Conservation Authorities were amalgamated into the Metropolitan Toronto and Region Conservation Authority (MTRCA). Flooding in the region The first written account of a flood in the Toronto region was in 17976. Records since that time have shown that flooding has been a problem in the region throughout the area’s history. The first severe flood, in recorded history, to hit the Toronto region was in 18787 when five inches of rain fell in less than seven and a half hours8. Downtown Brampton was flooded, bridges were washed out, stores and houses were flooded, and almost every mill and mill dam in the area was badly damaged or destroyed9.

A list of those who participated can be found in Appendix A. As participants arrived, they were divided into small groups and were provided with the following as they signed in: • Route map showing the location of, and a brief overview for each of the eight information stations; and • Feedback form and pencil to provide comments during the evening. One or two participants in each group were asked to wear a bright safety vest to ensure high visability of the groups as they crossed busy intersections and walked along high traffic bike paths. Experts were situated at eight stations which were strategically located around the Keating Channel and 480 Lakeshore Boulevard. Discussion topics at each of the stops included fish and aquatic habitat; flora and fauna; flood protection; recreation; soil remediation at 480 Lakeshore Boulevard; infrastructure and other active planning studies; Commissioners Park; and river management issues.

    Name : ______________________________________________________ Briefing Sheet #4 Hurricane Hazel—Central Ontario (1954) Hurricane Hazel created severe flooding in central Ontario, washing out more than 50 bridges and leaving many residents without homes. Hurricane Hazel, the eighth tropical storm of the Atlantic hurricane season of 1954, was the worst of the year. The storm was so deadly that the name was retired from use. It killed a thousand people in Haiti, spread destruction and death along the coast of the Carolinas as a category 4 hurricane, and was still a category 1 hurricane on October 15 when it reached Toronto, more than 1,000 kilometres from its origin. In less than 24 hours, 200 millimetres of rain fell, and rivers flooded.Water levels rose by as much as 8 metres. Winds of 110 kilometres an hour buffeted buildings and scattered debris. Another 81 people were killed in central Ontario by Hazel, most of them in Toronto. The flooding caused massive damage, washing out more than 50 of Toronto’s bridges, including some on major highways. Streets were washed away, as were railways, houses and other buildings. Thousands were left without homes. The total damage in Toronto was estimated at $25 million in 1954 dollars. A flash flood in Toronto’s Humber River was devastating. One section of Raymore Drive, which ran parallel to the river, was completely washed away: the street, the homes on it, and the people in them. Thirty-five people died. In Woodbridge, nine other people were killed by the Humber’s flash flood, and dozens of houses were ruined.
