Selanjutnya, makalah ini menguraikan keberadaan masalah dan melihat lebih dalam ke dalam implementasi masalah sebagai dasar untuk pengembangan hukum Islam di Indonesia. Makalah ini adalah yuridis normatif menggunakan pendekatan doktrinal. Pada akhirnya, dapat disimpulkan bahwa konsepsi maslahah adalah metode penggalian hukum Islam yang didasarkan pada aspek manfaat dan kebaikan bagi manusia selama tidak bertentangan dengan norma syariah Islam. Selain itu, implementasi masalah sebagai dasar untuk penemuan hukum Islam di Indonesia tidak dapat disangkal. Hal ini dapat dilihat dari daruratnya undang-undang atau peraturan di bawahnya yang mengatur berbagai aspek hukum Islam di Indonesia dalam menanggapi masalah kehidupan masyarakat sebagai dampak dari zaman dan teknologi. Kata Kunci: eksistensi, maslahah mursalah, hukum Islam. Abstract This paper aims to analyze the conception of maslahah in the discourse of the development of Islamic law. Furthermore, this paper elaborates the existence of maslahah mursalah and looks deeper into the implementation of maslahah as a basis for the development of Islamic law in Indonesia. This paper is normative juridical using a doctrinal approach. In the end, it can be concluded that the conception of maslahah is a method of extracting Islamic law which is based on aspects of benefit and goodness for humans as long as it does not conflict with Islamic sharia norms. -

The study found al-Dihlawi’s thoughts in this book reflect his idealism as an Islamic scholar. He expressed impressive thoughts with the Qur’an as a fundamental ingredient and Sunna as a commentator to the Qur’an. While the reflection may generate useful perspective from the point of significance or preference according to the prevailing realities. Due to dissension between the Islamic parties during that time was considered chronically. This anxiety inspired a number of ideas to him to rebuild civilization of life in the name of Islam without mingling with the seeds of superstition and believing in mythical. Hukum taklifi adalah ketentuan hukum yang menuntut para mukallaf (aqil-baligh) atau orang yang dipandang oleh hukum cakap melakukan perbuatan hukum baik dalam bentuk hak, kewajiban, maupun dalam bentuk larangan. Apabila orang ingin mempelajari Islam dari sudut disiplin ilmu hukum, ia tidak mungkin menggunakan “western approach” yang sudah terbiasa semata-mata mengkaji kondisi dan pengaruh tipe tertentu dari sikap prilaku sosial yang penuh dengan prasangka. Kata Kunci: Al-ahkam al khamsah, Hukum Islam, syariah, Perbandingan A. Pendahuluan Hukum Islam merupakan rangkaian dari kata “Hukum dan Islam”. Kedua kata ini berasal dari bahasa Arab, namun apabila dirangkai menjadi “hukum Islam”, kata tersebut tidak dikenal dalam terminologi Arab baik didalam Alquran dan Hadis. He competed with philosophers with the power of his knowledge. He was a famous religious scholar of the Abbasi period. During the heyday of Islam, two schools of thought became famous. One school of thought became famous as the Motazilies and the other discipline of thought became known as the Ash'arites. Abu al-Hasan al-Ash'ari remained a supporter of the Mu'tazilites for forty years. Then there was a disagreement with Mu'tazilah about the issue of value. Imam al-Ghazali is one of the leading preachers of his Ash'arite school of thought. Abu al-Hasan al-Ash'ari inherited a passion for collecting books. As a child, he used to collect books from his hobby. Sometimes there are very difficult places in the path of knowledge, only a real student can pass through these places safely. He has been remembered by the Islamic world in very high words. There was a student who drank the ocean of knowledge but his thirst was not quenched. -

The existing laws show that there exists non-dissidence in determining the position of children which conflicts with syariah crime. The term young offender was duly provided in the shariah procedural enactment but not in states’ shariah criminal law. Similarly, the term ‘baligh’ was defined and the position of non-baligh children was elucidated in the said law but not under the shariah procedural enactment. Hence, this articles serves to lay down the provisions of both enactments concerned and to compared them with the shariah criminal principles in terms of ascertainment of age and the position of children which are in conflict with the shariah criminal law through the ulama and Islamic fuqaha’s standpoint. -

Notes of Lectures on Fiqh by Maulana Sadiq Hasan Lecture # 18 (Thursday 3 July 2003) REVIEW OF FIQH & TAQLEED Fiqh means to follow the orders (ahkam) of Allah. According to Islam, the purpose of creation of human beings is to submit to the will of Allah, i.e., to lead a life in this world according to the ahkam of Allah. Islam teaches that we are actually created for the next world (akhirat) and not for this temporary world. The life in this world is a trial period for all human beings in order to judge who follows the ahkam of Allah and who does not. In order to follow the ahkam of Allah, it is essential to acquire knowledge and understand the ahkam of Allah (i.e. fiqh). There are two main sources of knowledge of fiqh: the Quran and the Hadith. While the holy Quran is available in a single book form, the literature of Hadith is scattered in different books written over different times. A Mujtahid is an alim who has acquired a thorough knowledge and understanding of the Quran and the Hadith. A Marja is that Mujtahid who is the most knowledgeable (highest ranking) among all Mujtahids. Islam expects every Muslim to either become a Mujtahid or do taqleed of the highest ranking Mujtahid (i.e. follow a Marja). Hence taqleed is wajib for all Muslims who can not become a Mujtahid. A mujtahid writes a book of ahkam (Islamic Laws), which is used by his followers (muqallideen) to know his rulings (fatwa) about different issues. -

This literature depicts the pre-mod- ern period as one in which Islamic law and ethics were in harmony—a harmony that was disturbed, if not completely upended, by the emergence of the modern state and its proj- ect of codification. CALL FOR PAPERS Modern Hadith Studies Between Arabophone and Western Scholarship 09-10 January 2017 Organised by: Belal Alabbas, Prof. Christopher Melchert, Dr Nicolai Sinai Pembroke College, University of Oxford Hadith literature is part and parcel of disciplines related to Islam and Muslim societies. At some point during their research scholars are likely to encounter primary sources containing hadith material related to history, law, sociology, or the complex science of kalam. However, hadith studies present two significant challenges. First, the hadith corpus is immense and large parts of it remain insufficiently explored. Second, it has bifurcated the world of Islamicists to a sceptic and a sanguine. Many academic scholars in the Arab world continue to view the study of hadith in Western secular universities as a colonialist project that aims to attack the tenets of Islam. The inverse also holds, whereby scholars in secular universities in the Anglophone view Islamic scholarship on the hadith corpus as biased and uncritical. The absence of proper scholarly interaction between both scholarly communities is deplorable and unnecessary, given that some of their premises, methods, and results actually exhibit significant convergence. This conference therefore invites scholars from Arabophone and Western institutions to discuss current research on the hadith corpus, aiming to bridge the divide between Anglophone and Arabophone research in hadith studies. It is based on the belief that the absence of any engagement of the scholarly communities with one another inhibits any significant methodological convergence. A more sustained dialogue and debate between scholars from various disciplines would bring to light further areas of historiographical and methodological agreement, provide stimuli for further research, and facilitate a mutually beneficial exchange of expertise. -
