काकाका.का ...आआआआ.... 12241224( (((अअअअ).).).). —अिधसूचना का िनƄिलिखत Oाďप , िजसे केLीय सरकार, पयाϕवरण (संरϓण ) अिधिनयम, 1986 (1986 का 29) कƙ धारा 3 कƙ उपधारा (2) के खंड (v) और खंड (xiv) तथा उपधारा (3) के साथ पƗठत उपधारा (1) ůारा Oदē शिŎयĪ का Oयोग करते ćए , जारी करने का Oताव करती है, पयाϕवरण (संरϓण ) अिधिनयम, 1986 के िनयम 5 के उपिनयम (3) कƙ अपेϓानुसार , जनसाधारण कƙ जानकारी के िलए Oकािशत Ƙकया जाता है; िजनके उससे Oभािवत होने कƙ संभावना है, और यह सूिचत Ƙकया जाता है Ƙक उŎ OाĐप अिधसूचना पर, उस तारीख से, िजसको इस अिधसूचना को अंतƞवϕट करने वाले भारत के राजपJ कƙ Oितयां जनसाधारण को उपल ध करा दी जाती हġ, साठ Ƙदन कƙ अविध कƙ समािƁ पर या उसके पचा त् िवचार Ƙकया जाएगा;

ऐसा कोई ƆिŎ , जो OाĐप अिधसूचना मĞ अंतƞवϕƍ OतावĪ के संबंध मĞ कोई आपिē या सुझाव देने का इϢछुक है, वह िविनƠदϕƍ अविध के भीतर, केLीय सरकार ůारा िवचार Ƙकए जाने के िलए अपनी आपिē या सुझाव सिचव, पयाϕवरण , वन और जलवायु पƗरवतϕन मंJालय , इंƘदरा पयाϕवरण भवन, जोर बाग रोड, अलीगंज, नई Ƙदली - 110003 को या ई-मेल [email protected] पर िलिखत Đप मĞ भेज सकता है।

OाĐप अिधसूचना वदुवूर पϓी अभयारय 1.281 वगϕ Ƙकलोमीटर (128.10 हेϝटेयर) ϓेJ मĞ फैला ćआ है और तिमलनाडु राϤय के थीďवĐ र िजले के नीदामंगलम ता लुक मĞ िथत है। जल िनकाय मĞ रहने वाले एिवयन जीवजतु के संरϓण के िलए 1999 मĞ लोक िनमाϕण िवभाग ůारा बनाए गए ƚसंचाई टġक को पϓी अभयारय घोिषत Ƙकया गया था (जी.ओ. एमएस. सं.169 पयाϕवरण और वन िवभाग Ƙदनांक: 22-07-1999); औरऔरऔर , यह एक मानव िनƞमϕत ƚसंचाई टġक है जो Oवासी और आवासी जल पिϓयĪ दोनĪ को आकƞषϕत कर रहा है। जल पिϓयĪ के िलए इस आLϕभूिम ůारा Oदान Ƙकए जाने वाले िविभž कायĬ अथाϕत् फोƢगİग, ƚवंटƛरंग , Oजनन और रोƚटंग को बीएनएचएस ůारा Ƙकए गए एक वषĖय संिϓƁ पाƗरिथितकƙ अययन के मायम से Oलेिखत Ƙकया गया है; औरऔरऔर , अभयारय तिमलनाडु के थीĐवĐर िजले के थंजावूर -मžारगुडी राजमागϕ पर िथत है। यह थंजावूर- मžारगुडी राजमागϕ पर थंजावूर से लगभग 22 Ƙक लोमीटर और थी ďवďर से लगभग 45 Ƙक लोमीटर, उदयमाथİदापुरम पϓी अभयारय से लगभग 58 Ƙक लोमीटर और वाइंट कैलीमर पϓी अभयारय लॉक बी से 50 Ƙक लोमीटर दूर िथत है; औरऔरऔर , अभयारय िवƉ के िविभž भागĪ से आने वाले Oवासी जल पिϓयĪ के िलए महवपूणϕ भोजन भूिम है। हर साल यह िसतंबर से फरवरी तक जल पिϓयĪ कƙ 54 से अिधक OजाितयĪ को आकƞषϕत करता है। पϓी उēर मĞ Oजनन थानĪ पर वापस जाने से पहले भोजन के िलए अभयारय टġक जाते हġ। Oवास अविध के पहले भाग मĞ, अथाϕत् अϝटूबर से Ƙदसंबर तक छोटे पिϓयĪ कƙ जनसंϞया जैसे Ɨटल और बēख कƙ जनसंϞया अिधक है ϝयĪƘक पानी कƙ गहराई अिधक है। जैसे ही जल Ƙदसंबर से घटना शुď हो जाता है, पĞƗट ड टॉकϕ, ओपन िबल टॉकϕ इयाƘद जैसे बड़े पिϓयĪ को अभयारय मĞ एकिJत Ƙकया जा ता है। अतः, यह अिनवायϕ है Ƙक आस -पास के वातावरण को वतϕमान और भिवय के िलए एिवयन जीवजतुĸ के अनुकूल बनाया जाना चािहए;

औरऔरऔर,और ,,, अभयारय मूल Đप से एक ƚसंचाई टġक है, अभयारय के अंतगϕत कोई Oाकृितक वन नहĕ है। अकेिसया नीलोƗटका कƙ पौधरोपण 1 986 और 1988 के दौरान उगाई गई थी , और अकेिसया पौधरोपण के अलावा देशी Oजाितयां जैसे इंका डुसे, िज़िज़फस इंिडका , पĪगािमया िपžा टा भी उपल ध हġ। ये वृϓ और िमŝी बाँध बड़ी संϞया मĞ हेरोनरी पिϓयĪ के घĪसले और Đट के िलए आकƞषϕत करते हġ;;; औरऔरऔर , अभयारय मĞ एिवयन जीवजतुĸ कƙ 54 Oजाितयां अिभिलिखत कƙ गई हġ, िजनमĞ दुलϕभ Oवासी पϓी शािमल हġ जो इस अभयारय मĞ आते हġ और Đट करने आते हġ और कुछ Oजाितयां अंडे से िनकलती हġ। Oितवषϕ इस पϓी अभयारय मĞ लगभग 40,000 पϓी आते हġ। यह अभयारय पϓी-िवϔानी , पϓी दशϕकĪ और शोधकताϕĸ के िलए महĔवपूणϕ पϓी अभयारय है। िविभž पिϓयĪ के उदाहरण िलƗटल =ैबे (टैिचबै टस ĐƘफकोिलयस ), =े हेरॉन (आदğया िसनेरेƗरया ),,, ओपन िबल टॉकϕ (अनाटोमस ऑसीटानस ),,, पॉट -िबल डक (अनास पोसीलोƛरंका ),,, ƘफजĞट - पूंछ जैकाना (हाइGोफैिसžस िचďगϕस ),,, इंिडयन िपफौल (पावो Ƙ;टेटस ), इंिडयन लांƗटव कूकू (कैकोमांƗटस पासƗरनस ) आƘद हġ; औरऔरऔर , अभयारय मĞ िततिलयĪ, कƙड़े-मकोड़Ī, सरीसृपĪ, उभयचरĪ, तनधाƗरयĪ कƙ भी कुछ Oजाितयां हġ। िततिलयĪ के उदाहरण लू पैसी (जुनोिनया ओƗरया ), सामाय गुलाब (कोलोटीस डाना ), =ाम लू (यू@ीसॉ स Ƒीजस ), Ɨटनी =ास लू (िज़ज़Ãला हैइलैϝस ) आƘद हġ; उभयचरĪ के उदाहरण कॉमन इंिडयन टोड (दēाPाइनस ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3

मेलेनोिटϝटस ), िकपर Pोग (यूि लिϝटस साइनोि लिϝटस ), कॉमन Eी Pोग (पॉलीपीडैटस मैकुलैटस ) आƘद हġ; तनधाƗरयĪ के उदाहरण इंिडयन लाइंग फॉϝस (टेरोपस िगगांटेस), इंिडयन =े मĪगोस (हेपğटेस एडवडसĖ ), गोड न जैकल (कैिनस ऑƗरयस ) आƘद हġ; औरऔरऔर,और ,,, वदुवूर पϓी अभयारय के चारĪ ओर के ϓेJ को, िजसका िवतार और सीमाएं इस अिधसूचना के पैरा =ाफ 1 मĞ िविनƠदϕƍ हġ, पाƗरिथितकƙ और पयाϕवरणी य कƙ दृिƍ से पाƗरिथितकƙ संवेदी जोन के Đप मĞ सुरिϓत और संरिϓत करना तथा उŎ पाƗरिथितकƙ संवेदी जोन मĞ उźोगĪ या उźोगĪ कƙ XेिणयĪ के Oचालन तथा Oसंकरण को Oितिषŵ करना आवयक है; अतः अबअबअब,अब ,,, केLीय सरकार, पयाϕवरण (संरϓण ) अिधिनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ पƗठत पयाϕवरण (संरϓण ) अिधिनयम, 1986 (1986 का 29) कƙ उपधारा (1) तथा धारा 3 कƙ उपधारा (2) एवं उपधारा (3) के खंड (v) और खंड (xiv) ůारा Oदē शिŎयĪ का Oयोग करते ćए , तिमलनाडु राϤय मĞ वदुवूर पϓी अभयारय कƙ सीमा के चारĪ ओर 0.50 Ƙकलोमीटर तक के साथ ϓेJ 1.229 वगϕ Ƙकलोमीटर मापा गया है जो िवताƗरत ϓेJ को वदुवूर पϓी अभयारय पाƗरिथितकƙ संवेदी जोन (िजसे इसमĞ इसके पचात् पाƗरिथितकƙ संवेदी जोन कहा गया है) के Đप मĞ अिधसूिचत करती है, िजसका िववरण िनƄानुसार है, अथाϕत् :-

1. पाƗरिथितकƙ संवेदी जोन काकाका िवतार औरऔरऔर सीमा --(1) पाƗरिथितकƙ संवेदी जोन का िवतार ओसुदु झील पϓी अभयारय के चारĪ ओर 0.50 Ƙकलोमीटर तक फैला ćआ है। पाƗरिथितकƙ संवेदी जोन का ϓेJफल 1.229 वगϕ Ƙकलोमीटर है।

(2) पाƗरिथितकƙ संवेदी जोन कƙ सीमा का वणϕन उपाबंधउपाबंध----IIII के Đप मĞ संलŐ है।

(3) पाƗरिथितकƙ संवेदी जोन कƙ सीमा के संरिϓत ϓेJ का मानिचJ उपाबंधउपाबंध----IIIIIIIIकककक से उपाबंधउपाबंध----IIIIIIIIङङङङ मĞ है।

(4) पाƗरिथितकƙ संवेदी जोन और संरिϓत ϓेJ कƙ सीमा के भू-िनदğशांकĪ कƙ सूची ;मश : उपाबंधउपाबंध----IIIIII ककक और उपाबंधउपाबंध----IIIIIIIIIIIIखखखख मĞ है।

(5) Oमुख ƚबंदुĸ के भू-िनदğशांकĪ के साथ पाƗरिथितकƙ संवेदी जोन के अंतगϕत आने वाले =ामĪ कƙ सूची उपाबंधउपाबंध---- IVIVIV के Đप मĞ संलŐ है।

222.2... पाƗरिथितकƙ संवेदी जोन केकेके िलएिलएिलए आंचिलक महायोजनामहायोजना. ...–––– (1) राϤय सरकार, पाƗरिथितकƙ संवेदी जोन के Oयोजन के िलए, राजपJ मĞ अंितम अिधसूचना के Oकाशन कƙ तारीख से दो वषϕ कƙ अविध के भीतर, थानीय ƆिŎयĪ के परामशϕ से और इस अिधसूचना मĞ Ƙदए गए अनुबंधĪ का पालन करत े ćए , राϤय सरकार के सϓम Oािधकारी के अनुमोदनाथϕ एक आंचिलक महायोजना बनायेगी।

(2) राϤ य सरकार ůारा पाƗरिथितकƙ संवेदी जोन के िलए आचंिलक महायोजना इस अिधसूचना मĞ िविनƠदϕ ट रीित से तथा Oासंिगक कĞLीय और राϤय िविधयĪ के अनुĐप तथा कĞLीय सरकार ůारा जारी Ƙदशा िनदğशĪ, यƘद कोई हĪ, के अनुसार बनायी जाएगी ।

(3) आंचिलक महायोजना मĞ पाƗरिथितकƙ और पयाϕवरण संबंधी सरोकारĪ को शािमल करने के िलए इसे राϤय सरकार के िनƄिलिखत िवभागĪ के परामशϕ से बनाया जाएगा, अथाϕत्: --

(ii) वन और वयजीव, (iii) कृिष, (iv) राज व , (v) शहरी िवकास, (vi) पयϕटन, (vii) =ामीण िवकास, (viii) ƚसंचाई और बाढ़ िनयंJण, (ix) नगरपािलका, (x) पंचायती राज, (xi) लोक िनमाϕण िव भाग, (xii) राजमागϕ, और (xiii) तिमलनाडु राϤय Oदूषण िनयंJण बोडϕ। (4) जब तक इस अिधसूचना मĞ िविनƠदϕƍ न हो , आंचिलक महायोजना मĞ वतϕमान मĞ अनुमोƘदत भू-उपयोग, अवसंरचना और Ƙ;याकलापĪ पर कोई Oितबंध नहĕ लगाया जाएगा तथा आचंिलक महायोजना मĞ सभी अवसंरचनाĸ और Ƙ;याकलापĪ मĞ सुधार करके उहे अिधक दϓ और पाƗरिथितकƙ -अनुकूल बनाने कƙ Ɔवथा कƙ जाएगी।

(5) आंचिलक महायोजना मĞ वनरिहत और अव;िमत ϓेJĪ के सुधार, िवźमान जल िनकायĪ के संरϓण , आवाह ϓेJĪ के Oबंधन , जल-संभरĪ के Oबंधन , भू-जल के Oबंधन , मृदा और नमी के संरϓण , थानीय जनता कƙ आवयकताĸ तथा पाƗरिथितकƙ एवं पयाϕवरण के ऐसे अय पहलुĸ कƙ Ɔवथा कƙ जाएगी िजन पर यान Ƙदया जाना आवयक है।

(6) आंचिलक महायोजना मĞ सभी िवźमान पूजा थलĪ, =ामĪ एवं शहरी बितयĪ, वनĪ कƙ XेिणयĪ एवं ƘकमĪ , कृिष ϓेJĪ , ऊपजाऊ भूिम, उźानĪ एवं उźानĪ कƙ तरह के हƗरत ϓेJĪ , बागवानी ϓेJĪ , बगीचĪ , झीलĪ और अय जल िनकायĪ कƙ सीमा का सहायक मानिचJ के साथ िनधाϕरण Ƙकया जाएगा । इस महायोजना मĞ िवźमान और Oतािवत भू- उपयोग कƙ िवशेषताĸ का यौरा देने वाले मानिचJ भी Ƙद ए जाएंगे।

(7) आंचिलक महायोजना मĞ पाƗरिथितकƙ संवेदी जोन मĞ होने वाले िवकास का िविनयम न Ƙकया जाएगा और सारणी मĞ यथा सूचीबŵ Oितिषŵ एवं िविनयिमत Ƙ;याकलापĪ का पालन Ƙकया जाएगा। इसमĞ था नीय जनता कƙ आजीिवका कƙ सुरϓा के िलए पाƗरिथितकƙ -अनुकूल िवकास का भी सुिनƇय एवं संवधϕन Ƙकया जाएगा ।

(8) आंचिलक महायोजना, ϓेJीय िवकास योजना कƙ सह -कािलक होगी ।

(9) अनुमोƘदत आंचिलक महायोजना , मानीटरी सिमित के िलए एक संदभϕ दतावेज होगी ताƘक वह इस अिधसूचना के उपबंधĪ के अनुसार मानीटरी के अपने कतϕƆĪ का िनवϕहन कर सके ।

3. राϤय सरकार ůारा ƘकएƘकएƘकए जाने वाले उपायउपाय....---- राϤय सरकार इस अिधसूचना के उपबंधĪ को Oभावी बनाने के िलए िनƄिलिखत उपाय करेगी, अथाϕत्:-

(1) भूभूभू-भू---उपयोग.उपयोग.उपयोग.–––– (क) पाƗरिथितकƙ संवेदी जोन मĞ वनĪ , बागवानी ϓेJĪ , कृिष ϓेJĪ , मनोरंजन के िलए िचिह त उźानĪ और खुले थानĪ का वृहद वािणिϤयक या आवासीय पƗरसरĪ या औźोिगक Ƙ;याकलापĪ के िलए Oयोग या संपƗरवतϕन अनुϔात नहĕ Ƙकया जाएगा : ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5

परंतु पाƗरिथितकƙ संवेदी जोन के भीतर भाग (क) मĞ िविनƠदϕƍ Oयोजन से िभž Oयोजन के िलए कृिष और अय भूिम का संपƗरवतϕन , मानीटरी सिमित कƙ िसफाƗरश पर और सϓम Oािधकारी के पूवϕ अनुमोदन से ϓेJीय नगर योजना अिधिनयम तथा यथा लागू केLीय सरकार एवं राϤय सरकार के अय िनयमĪ एवं िविनयमĪ के अधीन तथा इस अिधसूचना के उपबंधĪ के अनुसार थानीय िनवािसयĪ कƙ िनƄिलिख त आवासीय जĐरतĪ को पूरा करने के िलए अनुϔात Ƙकया जाएगा :-

(i) िवźमान सड़कĪ को चौड़ा करना, उहĞ सुदृढ करना और नई सड़कĪ का संिनमाϕण करना ;

(ii) बुिनयादी ढांचĪ और नागƗरक सुिवधाĸ का संिनमाϕण और नवीकरण ;

(iii) Oदूषण उपž न करने वाले लघु उźोग ;

(iv) कुटीर उźोग एवं =ाम उźोग ; पाƗरिथितकƙ पयϕटन मĞ सहायक सुिवधा भडार , थानीय सुिवधाएं तथा =ह वास; और

(v) बढ़ावा Ƙदए गए पैरा=ाफ 4 मĞ उिलिखत Ƙ;याकलाप ; परंतु यह भी Ƙक ϓेJीय शहरी िनयोजन अिधिनयम के अधीन सϓम Oािधकारी के पूवϕ अनुमोदन के िबना तथा राϤय सरकार के अय िनयमĪ एवं िविनयमĪ एवं संिवधान के अनुϢछेद 244 के उपबंधĪ तथा तसमय Oवृē िविध, िजसके अंतगϕत अनुसूिचत जनजाित और अय परंपरागत वन िनवासी (वन अिधकारĪ कƙ मायता ) अिधिनयम, 2006 (2007 का 2) भी आता है, का अनुपालन Ƙकए िबना वािणिϤयक या औźोिगक िवकास Ƙ;याकलापĪ के िलए जनजातीय भूिम का Oयोग अनुϔात नहĕ होगा : परंतु यह भी Ƙक पाƗरि थितकƙ संवेदी जोन के अंतगϕत आने वाली भूिम के अिभलेखĪ मĞ ćई Ƙकसी JुƗट को, मानीटरी सिमित के िवचार OाƁ करने के पƇात्, राϤय सरकार ůारा Oयेक मामले मĞ एक बार सुधारा जाएगा और उŎ JुƗट को सुधारने कƙ सूचना कĞLीय सरकार के पयाϕवरण , वन और जलवायु पƗरवतϕन मंJालय को दी जाएगी:

परंतु यह भी Ƙक उपयुϕŎ JुƗट को सुधारने मĞ, इस उप-पैरा मĞ यथा उपबंिधत के िसवाय, Ƙकसी भी दशा मĞ भू- उपयोग का पƗरवतϕन शािमल नहĕ होगा। (ख) अनुOयुϝ त या अनु पादक कृिष ϓेJĪ मĞ पुन: वनीकरण तथा पयाϕवासĪ और जैव - िविवधता कƙ बहाली के Oयास Ƙकए जाएंगे। (2) Oाकृितक जल Zोत ...- आंचिलक महायोजना मĞ सभी Oाकृितक जल ZोतĪ/नƘदयĪ/जलमागĬ के आवाह ϓेJĪ कƙ पहचान करके उनके संरϓण और बहाली कƙ योजना सि म िलत कƙ जाएगी । (3) पयϕटन/पाƗरिथितकƙ पयϕटन. ––– (क) पाƗरिथितकƙ संवेदी जोन मĞ सभी नए पाƗरिथितकƙ पयϕटन Ƙ;याकलाप या िवźमान पयϕटन Ƙ;याकलापĪ का िवतार पाƗरिथितकƙ संवेदी जोन स बंधी पयϕटन महायोजना के अनुसार अनुϔात होगा । (ख) पाƗरिथितकƙ पयϕटन महायोजना राϤय सरकार के पयाϕवरण और वन िवभा ग के परामशϕ से पयϕटन िवभाग ůारा बनायी जाएगी । (ग) पयϕटन महायोजना आंचिलक महायोजना का घटक होगी । (घ) पाƗरिथितकƙ पयϕटन संबंधी Ƙ;याकलाप िन ना नुसार िविनयिमत Ƙकए जाएंगे, अथाϕत् : - (i) संरिϓत ϓेJ कƙ सीमा से 1 Ƙकलोमीटर के भीतर या पाƗरिथितकƙ संवेदी जोन कƙ सीमा तक, इनमĞ जो भी अिधक िनकट हो, Ƙकसी होटल या Ɨरजॉटϕ का नया सिžमाϕण अनुϔात नहĕ Ƙकया जाएगा : 6 THE GAZETTE OF INDIA : EXTRAORDINARY [P ART II—SEC . 3(ii)]

तथािप, पाƗरिथितकƙ पयϕटन सुिवधाĸ के िलए संरिϓत ϓेJ कƙ सीमा से 1 Ƙकलोमीटर कƙ दूरी से परे पाƗरिथितकƙ संवेदी जोन कƙ सीमा तक पूवϕ पƗरभािषत और अभीिहत ϓेJĪ मĞ पयϕटन महायोजना के अनुसार, नए होटलĪ और Ɨरजॉटϕ कƙ थापना अनुϔात होगी ;

(ii) पाƗरिथितकƙ संवेदी जोन के अदर सभी नए पयϕटन Ƙ;या -कलापĪ या िवźमान पयϕटन Ƙ;याकलापĪ का िवतार , केLीय सरकार के पयाϕवरण, वन और जलवायु पƗरवतϕन मंJालय ůारा जारी ƘदशािनदğशĪ तथा पाƗरिथितकƙ पयϕटन पर बल देने वाले राƎीय Ɔा> संरϓण Oािधकरण ůारा जारी पाƗरिथितकƙ पयϕटन संबंधी ƘदशािनदğशĪ (समय -समय पर यथा संशोिधत) के अनुसार होगा; (iii) आंचिलक महायोजना का अनुमोदन होने तक, पयϕटन के िवकास और िवźमान पयϕटन Ƙ;याकलापĪ के िवतार को वातिवक थल -िविशƍ संवीϓा तथा मानीटरी सिमित कƙ िसफाƗरश के आधार पर संबंिधत िविनयामक OािधकरणĪ ůारा अनुϔात Ƙकया जाएगा और पाƗरिथितकƙ संवेदी जोन मĞ Ƙकसी नए होटल/Ɨर सो टϕ या वािणिϤयक OितƏान का संिžमाϕण अनुϔात नहĕ होगा ।

(4) Oाकृितक िवरासत ...–.––– पाƗरिथितकƙ संवेदी जोन के अंतगϕत आने वाले बćमूय Oाकृितक िवरासत के सभी थलĪ जैसे Ƙक जीन पूल Ɨरजवϕ ϓेJ , शैल संरचना, जल Oपात , झरने, दरğ, उपवन, गुफाएं, थल , वनपथ, रोहण मागϕ, उOपात आƘद कƙ पहचान कƙ जाएगी और उनकƙ सुरϓा एवं संरϓण के िलए आंचिलक महायोजना के भाग के Đप मĞ एक िवरासत संरϓण योजना बनायी जाएगी।

(5) मानव िनƞमϕत िवरासत थ ल.ल.ल.-ल. --- पाƗरिथितकƙ संवेदी जोन मĞ भवनĪ , संरचनाĸ , कलाकृित-ϓेJĪ तथा ऐितहािसक, थापय संबधी , सĭदयाϕमक और सांकृितक महव के ϓेJĪ कƙ पहचान कƙ जाएगी और उनके संरϓण के िलए आंचिलक महायोजना के भाग के Đप मĞ एक िवरासत संरϓण योजना बनायी जाएगी। (6)  वविनव िन Oदूषण. - पयाϕवरण अिधिनयम के अधीन विन Oदूषण (िविनयमन और िनयंJण) िनयम, 2000 मĞ िनयत उपबंधĪ के अनुसार मĞ पाƗरिथितकƙ संवेदी जोन मĞ विन Oदूषण के िनयंJण के िलए िविनयमĪ को कायाϕिवत करेगा । (7) वायु Oदूषणषणषण.षण ...- पाƗरिथितकƙ संवेदी जोन मĞ वायु Oदूषण कƙ रोकथाम और िनयंJण , वायु (Oदूषण िनवारण और िनयंJण ) अिधिनयम, 1981 (1981 का 14) के उपबंधĪ और उसके अधीन बनाए गए िनयमĪ और उनमĞ Ƙकए गए संशोधनĪ के अनुसार Ƙकया जाएगा ।

(8) बिहZाव काकाका िनसारण ...- पाƗरिथितकƙ संवेदी जोन मĞ उपचाƗरत बिहZाव का िनसारण, साधारणĪ मानकĪ के अतगϕत पयाϕवरण अिधिनयम और उसके अधीन बनाए गए िनयमĪ के अधीन आने वाले पयाϕवरणीय Oदूषण के िनसारण के िलए साधारण मानकĪ या राϤय सरकार ůारा िनयत मानकĪ, जो भी अिधक कठोर हो, के उपबंधĪ के अनुसार होगा।

(9) ठोसठोसठोस अपिशƍ ...-.--- ठोस अपिशƍ का िनपटान एवं Oबधन िनƄानुसार Ƙकया जाएगा :-

(i) पाƗरिथितकƙ संवेदी जोन मĞ ठोस अपिशƍ का िनपटान और Oबंधन भारत सरकार के पयाϕवरण, वन और जलवायु पƗरवतϕन मंJालय कƙ समय -समय पर यथा संशोिधत अिधसूचना सं. का.आ. 1357(अ), Ƙदनांक 8 अOैल , 2016 के तहत Oकािशत ठोस अपिशƍ Oबंधन िनयम, 2016 के उपबंधĪ के अनुसार Ƙकया जाएगा। अकाबϕिनक पदाथī का िनपटान पाƗरिथितकƙ संवेदी जोन से बाहर िचिहत Ƙकए गए थानĪ पर पयाϕवरण - अनुकूल रीित से Ƙकया जाएगा । ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 7

(ii ) पाƗरिथितकƙ संवेदी जोन मĞ माय OौźोिगƘकयĪ (ईएसएम) का Oयोग करते ćए िवźमान िनयमĪ और िविनयमĪ के अनुĐप ठोस अपिश ƍ का सुरिϓत और पयाϕवरण अनुकूल Oंबंधन अनुϔात Ƙकया जायेगा।

(10) जैव िचƘकसा अपिशट ...- जैव िचƘकसा अपिशट का Oबंधन िनƄानुसार Ƙकया जाए गा:-

(a) पाƗरिथितकƙ संवेदी जोन मĞ जैव िचƘकसा अपिशƍ का िनपटान भारत सरकार के पयाϕवरण, वन और जलवायु पƗरवतϕन मंJालय कƙ समय –समय पर यथा संशोिधत अिधसूचना सं.सा.का.िन 343 (अ), तारीख 28 माचϕ, 2016 के तहत Oकािशत जैव िचƘकसा अपिशƍ Oबंधन िनयम, 2016 के उपबंधĪ के अनुसार Ƙकया जाएगा ।

(b) पाƗरिथितकƙ संवेदी जोन मĞ माय OौźोिगƘकयĪ (ईएसएम) का Oयोग करते ćए िवźमान िनयमĪ और िविनयमĪ के अनुĐप ठोस अपिश ƍ का सुरिϓत और पयाϕवरण अनुकूल Oंबंधन अनुϔात Ƙकया जायेगा।

(11) लािटक अपिशƍ का O बंधनबंधन....---- पाƗरिथितकƙ संवेदी जोन मĞ लािटक अपिशƍ का Oबंधन, भारत सरकार के पयाϕवरण, वन और जलवायु पƗरवतϕन मंJालय कƙ समय -समय पर यथा संशोिधत अिधसूचना सं.सा.का.िन 340(अ), तारीख 18 माचϕ, 2016 के तहत Oकािशत लािटक अपिशƍ Oबंधन िनयम , 2016 के उपबंधो के अनुसार Ƙकया जाएगा।

(12) िनमाϕण और िववंस अपिशƍ का Oबंधन ...-.--- पाƗरिथितकƙ संवेदी जोन मĞ िनमाϕण और िववंस अपिशƍ का Oबंधन, भारत सरकार के पयाϕवरण, वन और जलवायु पƗरवतϕन मंJालय कƙ समय -समय पर यथा संशोिधत अिधसूचना सं.सा.का.िन 317(अ), तारीख 2 9 माचϕ, 2016 के तहत Oकािशत संिनमाϕण और िववंस अपिशƍ Oबंधन िनयम, 2016 के उपबंधĪ के अनुसार Ƙकया जाएगा।

(13) ईईई–ई–––अपिशƍ ...-.--- पाƗरिथितकƙ संवेदी जोन मĞ ई –अपिशƍ का Oबंध न, भारत सरकार के पयाϕवरण, वन और जलवायु पƗरवतϕन मंJालय ůारा Oकािशत तथा समय-समय पर यथा संशोिधत ई–अपिशƍ Oबंध न िनयम, 2016 के उपबंधĪ के अनुसार Ƙकया जाएगा।

(14) सड़कसड़क----यातायातयातायातयातायात....---- सड़क-यातायात को पयाϕवास -अनुकूल तरीके से िविनयिमत Ƙकया जाएगा और इस संबंध मĞ आंचिलक महायोजना मĞ िवशेष उपबंध शािमल Ƙकए जाएंगे। आंचिलक महायोजना के तैयार होने और राϤय सरकार के सϓम Oािधकारी से अनुमोƘदत होने तक , मानीटरी सिमित Oासंिगक अिधिनयमĪ और उनके तहत बनाए गए िनयमĪ एवं िविनयमĪ के अनुसार सड़क -यातायात के अनुपालन कƙ मानीटरी करेगी।

(15) वाहन जिनत Oदूषण ...-.--- वाहन जिनत Oदूषण कƙ रोकथाम और िनयंJण लागू िव िधयĪ के अनुसार Ƙकया जाएगा। वϢछ तर IJधन के Oयोग के Oयास Ƙकए जा एंगे ।

(16) औźोिगक ईकाइयां...-.--- (i) सरकारी राजपJ मĞ इस अिधसूचना के Oकाशन कƙ तारीख को या उसके बाद पाƗरिथितकƙ संवेदी जोन मĞ Ƙकसी नए Oदूषणकारी उźोग कƙ थापना अनुϔात नहĕ होगी।

(ii) जब तक इस अिधसूचना मĞ िविनƠदϕƍ न हो , पाƗरिथितकƙ संवेदी जोन मĞ कĞLीय Oदूषण िनयंJण बोडϕ ůारा फरवरी, 2016 मĞ जारी ƘदशािनदğशĪ मĞ Ƙकए गए उźोगĪ के वगĖकरण के अनुसार केवल गैर-Oदूषणकारी उźोगĪ कƙ थापना अनुϔात होगी। इसके अितƗरŎ, गैर-Oदूषणकारी कुटीर उźोगĪ को बढ़ावा Ƙदया जाएगा।

(17) पहाड़ी ढलानĪ काकाका संरϓण : पहाड़ी ढलानĪ का संरϓण िनƄानुसार Ƙकया जाएगा:-

3. बड़ी ताप एवं जल िवźुत लागू िविधयĪ के अनुसार Oितिषŵ (अयथा उपबंिधत के पƗरयोजनाĸ कƙ थापना । िसवाय) हĪगे। 4. Ƙकसी पƗरसंकटमय पदाथϕ का लागू िविधयĪ के अनुसार Oितिषŵ (अयथा उपबंिधत के Oयोग या उपादन या िसवाय) हĪगे। Oसंकरण । 5. अनुसार िविनयिमत हĪगे ।

10. गैर Oदूषण कारी लघु उźोग। फरवरी, 2016 मĞ केLीय Oदूषण िनयंJण बोडϕ ůारा जारी उźोगĪ के वगĖकरण के अनुसार गैर -Oदूषणकारी उźोग तथा अपƗरसंकट मय लघु और सेवा उźोग, कृिष, पुप कृिष, बागबानी या कृिष आधाƗरत उźोग, जो पाƗरिथितकƙ संवेदी जोन से देशी सामि=यĪ से उपाद बनाते हġ, सϓम Oािधकारी ůारा अनुϔात हĪगे।

11. वृϓĪ कƙ कटाई । (क) राϤय सरकार के सϓम Oािधकारी कƙ पूवϕ अनुमित के िबना वन भूिम या सरकारी या राजव या िनजी भूिम पर वृϓĪ कƙ कटाई नहĕ होगी ।

(ख) वृϓĪ कƙ कटाई कĞLीय या संबंिधत राϤय के अिधिनयम या उसके अधीन बनाए गए िनयमĪ के उपबंधĪ के अनुसार िविनयिमत होगी ।

12. वन उपादĪ और गैर काƏ वन लागू िविधयĪ के अधीन िविनयिमत होगा । उपादĪ (एनटीएफपी) का सं=हण।

(7) मानीटरी सिमित Oयेक वषϕ 31 माचϕ कƙ िथित के अनुसार अपनी वाƞषϕक कारϕवाई Ɨरपोटϕ राϤय के मुϞय वयजीव वाडϕन को, उपाबंध VVV मĞ Ƙदए गए OपJ के अनुसार , उस वषϕ कƙ 30 जून तक Oतुत करेगी ।

(8) केLीय सरकार का पयाϕवरण, वन और जलवायु पƗरवतϕन मंJालय मानीटरी सिमित को उसके कृयĪ के Oभावी िनवϕहन के िलए ऐसे िनदेश दे सकेगा जो वह उिचत समझे ।

MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 7th March, 2019 S.O.1224(E).—The following draft of the notification, which the Central Government proposes to issue in exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub-section (2) and sub- section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to the Public; Any person interested in making any objections or suggestions on the proposals contained in the draft notification may forward the same in writing, for consideration of the Central Government within the period so specified to the Secretary, Ministry of Environment, Forest and Climate Change, Indira Paryavaran Bhawan, Jorbagh Road, Aliganj, New Delhi-110003, or send it to the e-mail address of the Ministry at [email protected]

Draft Notification WHEREAS , the Vaduvoor Birds Sanctuary is spread over an area of 1.281 Square Kilometers (128.10 ha) and situated in Needamangalam Taluk of Thiruvarur District in the State of Tamil Nadu. An irrigation tank maintained by Public Works Department was declared as Bird Sanctuary in 1999 (G.O. Ms.No.169 Environment and Forests Department dated: 22-07-1999) for the conservation of avian fauna that inhabit the water body;

AND WHEREAS , it is a man-made irrigation tank that has been attracting both migrant and resident water birds. The various functions being provided by this wetland for the water birds namely foraging, wintering, breeding and roosting have been documented through one year brief ecological study undertaken by the Bombay Natural History Society (BNHS); AND WHEREAS , the Sanctuary is located on Thanjavur-Mannargudi highway of Thiruvarur District of Tamil Nadu. It is located about 22 kilometers from Thanjavur on Thanjavur–Mannargudi highway and about 45 kilometers from Tiruvarur, about 58 kilometers from Udayamarthandapuram Bird sanctuary and 50 kilometers from Point Calimere Bird Sanctuary Block A;

AND WHEREAS, the sanctuary is an important feeding ground for migratory water birds that come from different parts of the world. Every year it attracts more than 54 species of water birds from September to February. The birds visit the sanctuary tank for feeding before getting back to their breeding places in north. In the first half of the migratory period, i.e. from October to December population of smaller birds like teals and ducks is high as water depth is more. As water starts receding from December onwards, larger birds like painted storks, Open bill storks, etc., are congregating in the sanctuary. Therefore, it is imperative that the surrounding environs are to be enabled to sustain the avian fauna for present and future;

AND WHEREAS , the sanctuary is basically an irrigation tank, there is no natural forest within the sanctuary. The Acacia nilotica plantations were raised during 1986 and 1988, and apart from Acacia Plantation native species like Inca dulce, Ziziphus indica, Pongamia pinnata are also available . These trees and earthen bund attracts large numbers of heronry birds to nest and roost;

AND WHEREAS , the sanctuary has recorded 54 species of avian fauna, including rare migratory birds that visiting and roosts in this sanctuary and certain species are hatching eggs. About 40,000 birds are visiting this bird sanctuary annually. This sanctuary is an important bird sanctuary for ornithologist, bird watchers and researchers. Examples of various birds are Little grebe ( Tachybaptus ruficollius ), Grey heron ( Ardea cinerea ), Open bill stork (Anastomus oscitans ), Spot-bill duck ( Anas poecilorhyncha ), Pheasant-tailed jacana ( Hydrophasinnus chirurgus ), Indian Peafowl ( Pavo cristatus ), Indian Plaintive Cuckoo ( Cacomantis passerinus ) etc.;

AND WHEREAS , the sanctuary also has some species of butterflies, insects, reptiles, amphibians, mammals. Examples of butterflies are Blue Pansy ( Junonia orithya ), common rose ( Colotis danae ), gram blue ( Euchrysops cnejus ), Tiny Grass Blue (Zizula hylax ) etc.; examples of amphibians are Common Indian Toad (Duttaphrynus melanostictus), Skipper Frog (Euphlyctis cyanophlyctis), common tree Frog (Polypedatus maculatus) etc.; Examples of mammals are Indian flying fox ( Pteropus giganteus ), Indian Grey Mongoose ( Herpestes edwardsii ), Golden Jackal ( Canis aureus ) etc.;

AND WHEREAS, it is necessary to conserve and protect the areas, the extent and boundaries of Vaduvoor Birds Sanctuary which are specified in paragraph 1 as Eco-sensitive Zone from ecological, environmental and 26 THE GAZETTE OF INDIA : EXTRAORDINARY [P ART II—SEC . 3(ii)] biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone;

NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub- section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area measuring 1.229 square kilometers with an extent of 0.50 kilometer uniform around the boundary of Vaduvoor Birds Sanctuary in the State of Tamil Nadu as the Vaduvoor Birds Sanctuary Eco-sensitive Zone (hereafter in this notification referred to as the Eco-sensitive Zone) details of which are as under, namely:- 1. Extent and boundaries of Eco-sensitive Zone. - (1) The extent of Eco-sensitive Zone is 0.50 kilometer uniform around the Vaduvoor Birds Sanctuary. The area of the Eco-sensitive Zone is 1.229 square kilometers. (2) The boundary description of the Eco-sensitive Zone is appended at Annexure-I. (3) The map of the Protected Area demarcating the Eco-sensitive Zone boundary is at Annexure-IIA to Annexure-IIE. (4) List of geo co-ordinates of the boundary of the Protected Area and the Eco-sensitive Zone is at Annexure-IIIA and Annexure-IIIB respectively. (5) The list of villages falling within the Eco-sensitive Zone along with their geo co-ordinates at prominent points is appended as Annexure-IV . 2. Zonal Master Plan for the Eco-sensitive Zone. – (1) The State Government shall, for the purposes of effective management of the Eco-sensitive Zone, prepare a Zonal Master Plan within a period of two years from the date of publication of this Notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this Notification for approval of Competent Authority in the State Government. (2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (3) The Zonal Master Plan shall be prepared in consultation with the following of the State Government Departments, for integrating environmental and ecological considerations into the said plan:- (i) Environment, (ii) Forest and Wildlife, (iii) Agriculture, (iv) Revenue, (v) Urban Development, (vi) Tourism, (vii) Rural Development, (viii) Irrigation and Flood Control, (ix) Municipal, (x) Panchayati Raj, (xi) Public Works Department, (xii) Highways, and (xiii) Tamil Nadu State Pollution Control Board.

(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (5) The Zonal Master Plan shall provide for restoration of denuded and degraded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forest, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies and also with supporting maps giving details of existing and proposed land use features. (7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited, regulated activities listed in table and also ensure and promote eco-friendly development for the security of local communities livelihood. (8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan. (9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 27

3. Measures to be taken by State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use. – (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for major commercial or residential or industrial activities: Provided that the conversion of agricultural and other lands, for the purpose other than that specified at part (a), above within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central Government or State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents such as:- (i) widening and strengthening of existing roads and construction of new roads; (ii) construction and renovation of infrastructure and civic amenities; (iii) small scale industries not causing pollution; (iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and (v) promoted activities given under paragraph 4:

Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph. (b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities; (2) Natural water bodies. - The catchment areas of all natural springs/rivers/ channels shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan.

(3) Tourism or Eco-tourism. - (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone. (b) The Eco-Tourism Master Plan shall be prepared by the Department of Tourism in consultation with State Departments of Environment and Forest. (c) The Tourism Master Plan shall form a component of the Zonal Master Plan. (d) The activities of eco-tourism shall be regulated as under, namely:- (i) new construction of hotels and resorts shall not be allowed within 1 kilometerfrom the boundary of the Wildlife Sanctuary or upto the extent of the Eco-sensitive Zone whichever is nearer: Provided that beyond the distance of 1 kilometer from the boundary of the Wildlife Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre- defined and designated areas for Eco-tourism facilities as per Tourism Master Plan; (ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism; (iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel /resort or commercial establishment construction is permitted within Eco-sensitive Zone area.

(4) Natural heritage. - All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.

(5) Man-made heritage sites. - Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan.

(6) Noise pollution. - Prevention and Control of noise pollution in the Eco-sensitive Zone shall be complied with in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 under the Environment Act.

(7) Air pollution. - Prevention and control of air pollution in the Eco-sensitive Zone shall be complied with in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder.

(8) Discharge of effluents. - Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environment Act and the rules made thereunder or standards stipulated by State Government whichever is more stringent.

(9) Solid wastes. - Disposal and Management of solid wastes shall be as under:- (a) The solid waste disposal and management in Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 and published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated 8 th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone. (b) Safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-sensitive Zone.

(10) Bio-medical waste. - Bio medical waste management shall be as under:- (a) The bio medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio- Medical Waste Management, Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification number GSR 343 (E), dated the 28 th March, 2016. (b) Safe and Environmentally Sound Management (ESM) of Bio-Medical Waste Management in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone.

(11) Plastic waste management. - The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18 th March, 2016, as amended from time to time. (12) Construction and demolition waste management. - The Construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29 th March, 2016, as amended from time to time. (13) E-waste. - The e-waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E- Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change and as amended from time to time. (14) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (15) Vehicular pollution. - Prevention and control of Vehicular Pollution shall be incompliance with applicable laws and efforts to be made for use of cleaner fuel. (16) Industrial units.- (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the Eco-sensitive Zone. (ii) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per the classification of Industries in the Guidelines issued by the Central Pollution Control Board in February, 2016, unless so specified in this notification and in addition, the non-polluting cottage industries shall be promoted.

(17) Protection of hill slopes: The protection of hill slopes shall be as under:- (a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted; (b) Construction shall not be permitted on existing steep hill slopes or slopes with a high degree of erosion.

(18) The Central Government and the State Government shall specify other additional measures, if it considers necessary, in giving effect to the provisions of this notification.

4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco- sensitive Zone shall be governed by the provisions of the Environment Act and the rules made there under including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:-

Setting of industries causing New industries and expansion of existing polluting industries in the pollution (Water, Air, Soil, Noise, Eco-sensitive Zone shall not be permitted: etc). Provided that, non-polluting industries shall be allowed within

Eco-sensitive Zone as per classification of Industries in the

Guidelines issued by the Central Pollution Control Board in

February, 2016, unless so specified in this notification and in

addition the, non-polluting cottage industries shall be promoted.

3. Establishment of major hydroelectric Prohibited (except as otherwise provided) as per the applicable project. laws. 4. Use or production or processing of Prohibited (except as otherwise provided) as per the applicable any hazardous substances. laws. 5. Discharge of untreated effluents in Prohibited (except as otherwise provided) as per the applicable natural water bodies or land area. laws. 6. Setting of new saw mills. New or expansion of existing saw mills shall not be permitted within the Eco-sensitive Zone. 7. Setting up of brick kilns. Prohibited (except as otherwise provided) as per the applicable laws.

B. Regulated Activities 8. Commercial establishment of hotels No new commercial hotels and resorts shall be permitted within and resorts. one kilometre of the boundary of the Protected Area or up to the extent of Eco-sensitive zone, whichever is nearer, except for small temporary structures for Eco-tourism activities. Provided that, beyond one kilometre from the boundary of the protected Area or up to the extent of Eco-sensitive zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable. 30 THE GAZETTE OF INDIA : EXTRAORDINARY [P ART II—SEC . 3(ii)]

9. Construction activi ties. (a) New commercial construction of any kind shall not be

permitted within one kilometers from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:

Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub-paragraph (1) of paragraph 3 as per building bye- laws to meet the residential needs of the local residents. Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any. (b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan. 10. Small scale non -polluting industries. Non polluting industries as per classification of industries issued by the Central Pollution Control Board in February, 2016 and non- hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority. 11. Felling of Trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government. (b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made there under. 12. 5. Monitoring Committee.- For effective monitoring of the provisions of this notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986, the Central Government hereby constitutes a Monitoring Committee, comprising of the following, namely: -

(i) District Collector, Thiruvarur Chairman;

(ii) A representative of Non-government Organisation working in the field of Member; wildlife conservation to be nominated by State Government (iii) An expert in Biodiversity nominated by the State Government Member;

(iv) An expert in Ecology and Environment to be nominated by the State Government Member;

(v) A representative from State Public Works Department Member;

(vi) A representative from State Pollution Control Board Member;

(vii) District Forest Officer, Thiruvarur Member- Secretary.

6. Terms of Reference.–(1) The Monitoring Committee shall monitor the compliance of the provisions of this notification. (2) The tenure of the Monitoring committee shall be for three years or till the re-constitution of the new Committee by the State Government and subsequently the Monitoring Committee shall be constituted by the State Government. (3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. 32 THE GAZETTE OF INDIA : EXTRAORDINARY [P ART II—SEC . 3(ii)]

(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006 and are falling in the Eco- sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities. (5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment Act against any person who contravenes the provisions of this notification. (6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31 st March of every year by the 30 th June of that year to the Chief Wildlife Warden in the State as per performa given in Annexure V. (8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification. 8. The provisions of this notification are subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or the High Court or the National Green Tribunal. [F.
