The enquiry report of MVI Pala dtd 10/08/2018 revealed the following. 1. Total distance of the route : 34 Kms. 2. Intra/ Inter District route : Intra District. 3. Details of Virgin Portion : Nil 4. Details of Road Fitness certificate : N.A. 2 5. Details of Overlapping : Total distance of overlapping is 1.6 KM ie, 4.7 % of the total route length [34 km] which is within the permissible limit. 1) Route portion of 1.5 Km at Pala Town objectionably overlaps on Kottayam – Kattappana Scheme GO[MS] 139/67/PW SRO No. 199/67 2) 100 meters in Pampady objectionably overlaps on Thekkady – Ernakulam scheme. 6. Details of Vehicle produced : KL 05 Y 5099 owned by the applicant. Tax- 30/06/2018, Date of Regn. 08/02/2008 [Completed 10 years] Permit – R.P. valid up to 28/04/2022 on Kodungoor –Pala Route. 7. Details of Concurrence :N A. 8. Necessity, recommendation if any : Enquiry officer reported that the entire portion is not having sufficient public transport facilities. Only two stage carriages are operating on this route including one KSRTC through the major portions of this route. Hence the proposed service will be highly beneficial for the commuters including students on this route. 9. Court Direction, if any : Nil. 10. Kottayam Dist- 47.00 kms Pathanamthitta Dist- 16.300 kms 4 3. Details of Virgin Portion : Nil 4. Details of Fitness certificate : Not Applicable 5. Details of Overlapping : Total distance of overlapping 3 Kilometers ie,, 4.7 % of the total route length [63.3 km] which is within the permissible limit. 1) Route portion of 1.900 km from Pala Kottaramattom Bus Stand to Maharanikavala Overlaps on the Kottayam - Kattappana No.G.O[MS]139/67/PW dtd 18.07.1967 2) Route portion of 0.800 km from Kanjirappally Kurusupalli to to Pettakavala Overlaps on the Kottayam – Thekkady No.26959-TB3/66/PW notified Scheme. 3) Route portion of 0.300 km from Mukkada – Mukkada Jn overlaps on the Changanassery -Changanassery GO/MS/146/67/PW 6. Details of Vehicle produced : KL-05-L-6382 is 2001 model D/R is 28/02/2002 hence the 15 years registration validity was expired on 27/02/2017. 7. Details of Concurrence : Yes, Concurrence GRANTED by the RTA Pathanamthitta in vide Order No G1/1309/2018/ PTA dtd 18/06/2018. 8. Necessity, recommendation if any : MVI, Pala reported that the proposed service is beneficial for the passengers especially for students and also reported that the applicant requested for one trip only from Perinad to Kanjirappally. Hence it is proposed that more trips may also be considered. 9. Court Direction, if any : Nil 10. There is no explanation as to why the plaintiff was not so put in possession of the property even after the payment of a major portion of the sale consideration to the defendants. That is a strong indication to show that Ext.A1 agreement even if genuine was not intended to be followed up by a sale deed between the parties. We take cue from the decision of the Supreme Court in Tejram v. Patirambhau ((1997) 9 SCC 634) wherein the agreement was construed as one evidencing loan transaction. 7. It is unsafe to grant a decree either for specific performance or for return of the advance amount on the basis of Ext.A1 agreement and normally we would have dismissed the suit in toto. But the defendants fairly concede that a sum of ` 75,000/- was availed as loan on the date of Ext.A1 agreement from Mr.V.L.Ittiachen. The said Ittiachen was a Director of the plaintiff company along with his wife and three sons evident by Ext.A4 Memorandum of Association and Articles of Association. It is discernible from the conspectus of events that the plaintiff company was a family concern and that Ittiachen had a say in the monetary transactions. The defendants are willing to repay the sum of ` 75,000/- with interest and the plaintiff is also not averse to receive the amount in the circumstances.
