In the Supreme Court of the United States
NO. In the Supreme Court of the United States LISA R. KIRBY, NEAL L. KIRBY, SUSAN N. KIRBY, BARBARA J. KIRBY, Petitioners, v. MARVEL CHARACTERS, INCORPORATED, MARVEL WORLDWIDE, INCORPORATED, MVL RIGHTS, LLC, WALT DISNEY COMPANY, MARVEL ENTERTAINMENT, INCORPORATED, Respondents. On Petition for Writ of Certiorari to the United States Court of Appeals for the Second Circuit PETITION FOR WRIT OF CERTIORARI MARC TOBEROFF Counsel of Record TOBEROFF & ASSOCIATES, P.C. 22337 Pacific Coast Hwy, Suite 348 Malibu, CA 90265 (310) 246-3333 [email protected] Counsel for Petitioners Becker Gallagher · Cincinnati, OH · Washington, D.C. · 800.890.5001 i QUESTIONS PRESENTED The Copyright Act grants the children of a deceased author the right to recover the author’s copyrights by statutorily terminating prior copyright transfers. 17 U.S.C. §§ 304(c), (d). “Works for hire” are the sole exclusion. Id. Petitioners, the children of the acclaimed comic-book artist/creator Jack Kirby (The Fantastic Four, X-Men, The Mighty Thor, The Incredible Hulk, etc.), served statutory notices of termination on the Marvel respondents regarding the key works Kirby authored as an independent contractor in 1958-63. Section 26, the “work for hire” provision of the 1909 Copyright Act, applicable to pre-1978 works, states simply: “The word author shall include an employer in the case of works made for hire.” For six decades, including in 1958-63, “employer” was duly given its common law meaning, and “work for hire” applied solely to conventional employment, not to independent contractors like Kirby. It follows then, in 1958-63 Kirby was the original owner of the copyrights to the works he authored and subsequently assigned to Marvel, and his children have the right to recapture his copyrights by termination of such assignments under 17 U.S.C.§304(c). -
The Practical Use of Comics by TESOL Professionals By
Comics Aren’t Just For Fun Anymore: The Practical Use of Comics by TESOL Professionals by David Recine A Thesis Submitted in Partial Fulfillment of the Requirements for the Degree of Master of Arts in TESOL _________________________________________ Adviser Date _________________________________________ Graduate Committee Member Date _________________________________________ Graduate Committee Member Date University of Wisconsin-River Falls 2013 Comics, in the form of comic strips, comic books, and single panel cartoons are ubiquitous in classroom materials for teaching English to speakers of other languages (TESOL). While comics material is widely accepted as a teaching aid in TESOL, there is relatively little research into why comics are popular as a teaching instrument and how the effectiveness of comics can be maximized in TESOL. This thesis is designed to bridge the gap between conventional wisdom on the use of comics in ESL/EFL instruction and research related to visual aids in learning and language acquisition. The hidden science behind comics use in TESOL is examined to reveal the nature of comics, the psychological impact of the medium on learners, the qualities that make some comics more educational than others, and the most empirically sound ways to use comics in education. The definition of the comics medium itself is explored; characterizations of comics created by TESOL professionals, comic scholars, and psychologists are indexed and analyzed. This definition is followed by a look at the current role of comics in society at large, the teaching community in general, and TESOL specifically. From there, this paper explores the psycholinguistic concepts of construction of meaning and the language faculty. -

The Formation of Temporary Communities in Anime Fandom: a Story of Bottom-Up Globalization ______
THE FORMATION OF TEMPORARY COMMUNITIES IN ANIME FANDOM: A STORY OF BOTTOM-UP GLOBALIZATION ____________________________________ A Thesis Presented to the Faculty of California State University, Fullerton ____________________________________ In Partial Fulfillment of the Requirements for the Degree Master of Arts in Geography ____________________________________ By Cynthia R. Davis Thesis Committee Approval: Mark Drayse, Department of Geography & the Environment, Chair Jonathan Taylor, Department of Geography & the Environment Zia Salim, Department of Geography & the Environment Summer, 2017 ABSTRACT Japanese animation, commonly referred to as anime, has earned a strong foothold in the American entertainment industry over the last few decades. Anime is known by many to be a more mature option for animation fans since Western animation has typically been sanitized to be “kid-friendly.” This thesis explores how this came to be, by exploring the following questions: (1) What were the differences in the development and perception of the animation industries in Japan and the United States? (2) Why/how did people in the United States take such interest in anime? (3) What is the role of anime conventions within the anime fandom community, both historically and in the present? These questions were answered with a mix of historical research, mapping, and interviews that were conducted in 2015 at Anime Expo, North America’s largest anime convention. This thesis concludes that anime would not have succeeded as it has in the United States without the heavy involvement of domestic animation fans. Fans created networks, clubs, and conventions that allowed for the exchange of information on anime, before Japanese companies started to officially release anime titles for distribution in the United States. -

Media Industry Approaches to Comic-To-Live-Action Adaptations and Race
From Serials to Blockbusters: Media Industry Approaches to Comic-to-Live-Action Adaptations and Race by Kathryn M. Frank A dissertation submitted in partial fulfillment of the requirements for the degree of Doctor of Philosophy (Communication) in the University of Michigan 2015 Doctoral Committee: Associate Professor Amanda D. Lotz, Chair Professor Susan J. Douglas Professor Lisa A. Nakamura Associate Professor Aswin Punathambekar © Kathryn M. Frank 2015 “I don't remember when exactly I read my first comic book, but I do remember exactly how liberated and subversive I felt as a result.” ― Edward W. Said, Palestine For Mom and Dad, who taught me to be my own hero ii Acknowledgements There are so many people without whom this project would never have been possible. First and foremost, my parents, Paul and MaryAnn Frank, who never blinked when I told them I wanted to move half way across the country to read comic books for a living. Their unending support has taken many forms, from late-night pep talks and airport pick-ups to rides to Comic-Con at 3 am and listening to a comics nerd blather on for hours about why Man of Steel was so terrible. I could never hope to repay the patience, love, and trust they have given me throughout the years, but hopefully fewer midnight conversations about my dissertation will be a good start. Amanda Lotz has shown unwavering interest and support for me and for my work since before we were formally advisor and advisee, and her insight, feedback, and attention to detail kept me invested in my own work, even in times when my resolve to continue writing was flagging. -

Five StarsBy CustomerA very sweet story with very relatable characters.2 of 2 people found the following review helpful. Jonesy is a Cupid-like character who has the ability to make people fall in love with other peopleBy The Hermit LibrarianJonesy caught my eye because the color and the style reminded me so much of the television show Steven Universe. While as far as I know neither creator has nothing to do with the show, this book has its own humor and shine.Jonesy is a Cupid-like character who has the ability to make people fall in love with other people, things, ideas, etc. Some of these matches are much more successful than others. Many have consequences that force Jonesy to confront her view on the subject and figure out how to make things better or whether to meddle again when she has the potential to make things even worse. There's no indication yet where her powers come from, whether they're passed down from a family member or spontaneously bestowed upon her, but she's certainly making use of them since discovering them accidentally when shipping two characters on t.v.The weird thing about Jonesy is, even though she's described in the summary of the book as being a fan of anime and a devotee of grrrl bands and 1D, I didn't really get that from her in this book. -
