Haley School of Law A sweeping proviso that protects basic or fundamental interests of a legal system is known in various names – ordre public, public policy, public order, government’s interest or Vorbehaltklausel. This study focuses on the concept of Indonesian public order in private international law. It argues that Indonesia has extraordinary layers of pluralism with respect to its people, statehood and law. Indonesian history is filled with the pursuit of nationhood while protecting diversity. The legal system has been the unifying instrument for the nation. However the selected cases on public order show that the legal system still lacks in coherence. Indonesian courts have treated public order argument inconsistently. A prima facie observation may find Indonesian public order unintelligible, and the courts have gained notoriety for it. This study proposes a different perspective. It sees public order in light of Indonesia’s legal pluralism and the stages of legal development.

Summary Is gender equality at stake in the European context of crisis and austerity measures? This was the leading question of our exchange, to which we have tried to respond by interviewing a wide range of experts in two countries – Austria and Portugal –, similar in population and size, but different on economic and social living conditions. Austria and Portugal are, at the same time, far away and so close. Apart all the differences, we have discovered something (unfortunately) in common: gender inequality is a reality at all levels. The dimension and extent of this finding are shocking. In Austria and Portugal, women are discriminated in several domains: they receive less money for the same job, they are accepted in less social valued jobs, they have difficulties on coming to the labour market after having children, they are more subject to precarious work (Portugal) and part-time work (Austria), they are the main doers of unpaid housework, they are the ones taking care of children, elderly, disabled people. Gender equality is suffering from the crisis, but was already not in a good shape before 2009. The structural problem may have worsened, but what is still lacking, in times of crisis or prosperity, is a structural change. Gender equality takes more than money and social protection, it requires a mindset reset.

    PATTERNS OF MILITARY CONTROL IN THE INDONESIAN HIGHER CENTRAL BUREAUCRACY John A. MacDougall* Summary This article analyzes current military penetration of Indonesia's higher central government bureaucracy. Any civilian or military officeholder in this bureaucracy is referred to as a karyawan. The article focuses on the incumbent Cabinet and topmost echelon of civil service officials. Findings are based on public biographies of these persons and published specialized secondary sources on the Indonesian military. The principal conclusions follow below. The Higher Central Bureaucracy The Indonesian military has long played a "dual civil and military function." Military karyawan, active duty and retired officers in civilian assignments, comprise an increasingly visible, influential, and strategic segment of the dominant military faction, that of President Suharto and his 1945 Generation supporters. --The military karyawan in the higher central bureaucracy are especially critical actors in maintaining the Suharto regime. --Together with their civilian karyawan colleagues, virtually all of them wield decision-making powers of some considerable degree. --Some mix of military and civilian karyawan occurs in all Cabinet Departments except the Department of Defense and Security, now entirely military-controlled. --The Indonesian armed forces' doctrinal commitment to preventing civilian con­ trol of the military has resulted in the Department of Defense and Security be­ coming effectively equivalent to the consolidated armed forces' staff and command structure. Extent of Military Penetration Active and retired military karyawan now occupy half the positions in the Indo­ nesian higher central bureaucracy. --At the highest levels, military penetration remains near complete (the President and his principal immediate aides) or has increased (Coordinating Ministers) over the course of the New Order regime (1966 to the present).

    The Emergence of Political Homophobia in Indonesia 465 The Emergence of Political Homophobia in Indonesia: Masculinity and National Belonging Tom Boellstorff University of California, Irvine, USA abstract This paper explores an unprecedented series of violent acts against ‘gay’ Indonesians beginning in September 1999. Indonesia is often characterized as ‘to- lerant’ of homosexuality. This is a false belief, but one containing a grain of truth. To identify this grain of truth I distinguish between ‘heterosexism’ and ‘homophobia,’ noting that Indonesia has been marked by a predominance of heterosexism over homophobia. I examine the emergence of a political homophobia directed at public events where gay men stake a claim to Indonesia’s troubled civil society. That such violence is seen as the properly masculine response to these events indicates how the nation may be gaining a new masculinist cast.     Chapter 7 Portugal Impoverished media struggling for survival Joaquim Fidalgo Introduction The Portuguese media landscape has been strongly influenced by its political, economic, cultural, and social evolution during the last decades of the twentieth century and the first decades of the twenty-first century. Five main factors should be considered. First, the small size of the country (with a population of 10.3 million), associated with a very low rate of news media consumption, makes it difficult for media outlets to achieve enough scale to be viable. Second, the economic weakness of the country (an annual gross domestic product per capita of EUR 18,550 compared with the EUR 28,630 average for EU/28 countries; Eurostat, 2019) leads to low purchasing power for media consumers and little advertising for the media industry. Third, there has been a rather brief experi- ence of life in a democracy, after almost half a century (1926–1974) of political dictatorship where basic rights – freedom of expression, freedom of the press, freedom of association – were either forbidden or strictly controlled. Fourth, the long-standing tradition of a centralised society is very dependent on the state and has low levels of autonomous social dynamism and tends towards solving problems at the macro-level of the law, but not necessarily at the micro-level of actual practices. And fifth, economic, cultural, and technological development in the country has been quick in more recent years, particularly after joining the EU in 1986. The legal and regulatory framework for the media still bears marks of the revolutionary period in the country between 1974 and 1975, when democracy was reinstated and important changes occurred.
