Know Your Rights Guide: Protests This guide covers the legal protections you have while protesting or otherwise exercising your free speech rights in public places. Although some of the legal principles are firmly established, as with many areas of law, free speech law is complex and continually developing. Generally speaking, you are free to exercise your right to protest, but the government may impose restrictions if you are infringing on the rights or safety of others. Where, when, and how can I protest? Can the government restrict where, when, and how protests may take place? Yes. The government may impose reasonable restrictions on the time, place and manner of speech, but these restrictions cannot be based on the content of the speech. For example, speech may be restricted if it is exceedingly loud in a residential area at 2am. On the other hand, the government may not disallow a protest because it has an anti-war message. Speech at certain “sensitive areas,” such as health care facilities, abortion clinics, military bases, and airport terminals, may also be subject to reasonable time, place, and manner restrictions. For example, near health care facilities, there can be rules about not blocking entrances and not making too much noise. Can protesters march in the street? Yes, but… many cities require permits if a march will block traffic; the rules for obtaining permits and enforcement of permit requirements vary by jurisdiction. If you march without a permit and block traffic while refusing an order from police to get out of the street, you could be arrested or detained. -

The last few years have been characterized by a return to tensions between major regional powers, in particular between the United States and China, with Russia clamoring for the superpower status. China is very openly seeking to promote its political model and become the world’s leading economic power, while Russia seems rather interested in discrediting democracies and increasing its sphere of influence and the United States in maintaining its status as the world’s hegemon and economic leader. We could describe these three countries in terms of gradations, with China being an assumed dictatorship and Russia still keeping the appearances of a democracy, if only nominal, but of its own ‘managed’ type with one loyal party dominating the political scene, farcical elections and most fundamental freedoms flouted. The United States, for its part, showed during the last presidential elections that democratic safeguards still worked and that alternation of power between democrats and republicans was still possible despite Trump’s populism. It is in this context that this article compares the political repression in those three countries and how the Covid-19 is impacting it. 1. Political repression in China, Russia and the United States Political repressions bear many similarities between China and Russia: if the Chinese Communist Party has been holding its grip on power since the creation of the Peoples’ PÀGINA 1 / 20 Republic of China in 1949, making the country a de facto one-party State, Putin’s United Russia Party has now been in power for some two decades. -

www.icnl.org [email protected] PRESENTED TO UN HUMAN RIGHTS COMMITTEE SUBMISSION Draft General Comment No. 37 (Right of Peaceful Assembly) Introduction ICNL is grateful for the opportunity to provide comments on the revised draft General Comment No. 37 on Article 21 (right of peaceful assembly) of the International Covenant on Civil and Political Rights (ICCPR). Please find below principal comments relating to the following issues of general significance: (1) the definition of “assembly”; (2) assemblies through digital means; (3) authorization and notification requirements; (4) use of force in the context of assemblies; and (5) the fundamental nature of peaceful assembly rights. Accompanying these principal comments, we have attached a marked-up version of General Comment No. 37 which addresses the text of the Comment in greater detail, indicating proposed edits (including edits on a number of specific or technical issues not raised in our principal comments) and rationales for these edits. We hope the Committee will find these comments helpful in its review of the draft Comment. Principal Comments 1. THE DEFINITION OF “ASSEMBLY” The conception of “assembly” set forth in the draft General Comment, at paras. 4 and 13, is limited to gatherings of persons with a common expressive purpose in a publicly accessible place. In our view, this conception omits historically and currently important forms of assembly that require protection against restrictions, while also 1126 16th Street NW #400 Washington, DC 20036 2/21/2020 leaving insufficient room to encompass evolving and future forms of assembly. We would recommend clarifying that the protections of article 21 apply to gatherings where the participants intend to engage in important civic activities other than common expression; to gatherings in private, non-publicly-accessible places; and to gatherings “by persons,” in various forms, rather than “of persons”. -

The Commission‘s intention was to give support to implementation of the Declaration on human rights defenders and also to gather information on the situation of human rights defenders around the world (see Resolution 2000/61 establishing the mandate). In August 2000, Ms. Hina Jilani was named by the Secretary General as Special Representative of the Secretary-General on the situation of human rights defenders. Her mandate was renewed by the Commission in 2003 (Resolution 2003/64) and by the Human Rights Council in 2007 (Resolution 5/1). In March 2008, the Human Rights Council, with Resolution 7/8, decided to renew the mandate on human rights defenders for a period of three years. The Human Rights Council appointed Ms. Margaret Sekaggya as Special Rapporteur on the situation of human rights defenders. Mandate The mandate on human rights defenders is broad and stipulates that the Special Rapporteur‘s main roles are to: seek, receive, examine and respond to information on the situation of human rights defenders; establish cooperation and conduct dialogue with governments and other interested actors on the promotion and effective implementation of the Declaration; recommend effective strategies better to protect human rights defenders and follow up on these recommendations; integrate a gender perspective throughout her work. -
