This has been part of a wider change as governments have opened up domestic markets to international competition, while rethinking the protections provided by the welfare state. Business has demanded deregulation of all kinds but particularly in the labour market, with the aim of achieving greater flexibility and efficiency in the utilisation of labour. The debate over the reform of industrial relations institutions and processes in Australia has been conducted in terms of ‘enterprise bargaining’, a diffuse term which means (depending on the position of the speaker) either collective bargaining involving national unions but with outcomes tailored to specific workplaces, or firm-specific bargaining by internal enterprise-based parties with minimal involvement from ‘external’ bodies such as unions. During the last decade the debate has moved from an assumption of collective bargaining with union involvement, to the view that agreements should be primarily individual in nature. Legislation has mirrored this debate, with increasing emphasis being given to individual agreements. Hence the legal relationship between collective and individual agreements is of major importance in contemporary Australian labour law. In order to understand any labour law system in a comparative context, it has been said that one must adopt a functional and historical approach, paying regard 4 to the values, history and culture of the country being explained. 1 In the Australian context, discussion of industrial relations is necessarily framed by the long history of compulsory conciliation and arbitration systems. The shift towards enterprise bargaining and individual agreements involves a fundamental change in t he traditional approach to industrial regulation under the Australian Federal and State industrial relations systems. Compulsory arbitration was developed in response to a series of ‘Great Strikes’ during the early 1890s. In these disputes employers respo nded to the growth of trade union power by refusing to recognise unions or bargain with them. The employers’ stance was supported by the common law which made collective industrial action by employees a criminal offence or at the least a compensable civil wrong. State -sponsored compulsory conciliation and arbitration was introduced a century ago with the aim of preventing or settling such disputes. Its primary aim was the encouragement of collective bargaining, either by making agreements or by reaching con ciliated (mediated) settlements. The original aims of the Federal arbitration legislation were to prevent strikes and lockouts, to provide for conciliation ‘with a view to amicable agreement between the parties’ or, in default of that, to settle disputes by an ‘equitable award’ after compulsory arbitration. 2 The original framers of compulsory arbitration believed that collective groups of employers and employees would naturally tend to settle their differences by conciliation and agreement, and most likely on an industry - wide basis. The very existence of formal and compulsory mechanisms for conciliation and arbitration would induce parties ‘to make as between themselves agreements in regard to the conduct of the particular trade or business in which they ar e engaged. Then this Act will bind them.’ 3 The adoption of this system meant that unions did not need to gain recognition from employers. Under compulsory arbitration, unions were recognised by the state. As long as they were registered under the arbitrati on system they could notify a dispute with an employer (or employer association) and thereby invoke the compulsory processes of conciliation and arbitration. Ultimately a union could seek to have the tribunal impose an award on the employer which gave the union and its members both substantive and procedural rights. Rather than treating collective agreements as contracts, the arbitration system gave unions a special though limited legal status, enabling them to enter into particular kinds of agreements regulated by statute and supervised by tribunals separate from the ordinary courts. 4 Thus awards and agreements were not fully integrated into the legal system as occurred in many European countries. 5 Breach of an industrial agreement was not a breach of contract entitling the innocent party to compensatory dama ges but, like breach of an award, a contravention of a statutory obligation resulting in a penalty similar in nature to a fine. In practice, though, it has also been common for parties to obtain an injunctive order compelling the other party to observe the award or agreement. The upshot of the particular historical circumstances in which the compulsory arbitration system was developed, which determined the particular legal form for bargaining and regulation, is that individual and collective labour agreemen ts have been quite different in their juridical nature and form. The contract of employment, a creature of the common law, has remained notionally part of the private law of contract (though resort to the civil courts in employment disputes has been rare u ntil recently). Collective agreements registered under the arbitration system are part of the public law since they are regulated by statute and (especially in recent times) their contents subject to approval by a tribunal with responsibility to act in the public interest. However, it has traditionally received insubstantial attention within human rights scholarship. This article situates the right to freedom of as- sociation at work within human rights discourses. It looks at the status, scope and importance of the right as it has evolved in inter- nationalhuman rights law. In so doing, a case is put that there are strong reasons for states to comply with the right to freedom of association not only in terms of internationalhuman rights obliga- tions but also from the perspective of human dignity in the context of an interconnected world. A detailed case study is offered that examines the right to free- dom of association in the Australian context. There has been a series of significant changes to Australian labor law in recent years. The Rudd-Gillard Labor government claimed that recent changes were to bring Australia into greater compliance with its obligations under internationallaw. This policy was presented to electors as in sharp contrast to the Work Choices legislation of the Howard Liberal-Nationalparty coalitiongovernment.

    Ilillllllll \II~\IIII\\II\\I\\\IIIIIII 200507280 REGULATING THE POWER SHIFT: THE STATE, CAPITAL AND ELECTRICITY PRIVATISATION IN AUSTRALIA Damien Cahill and Sharon Beder In 1990, British political economist Grahame Thompson observed: One of the most remarkable features of the 'conservative tum' experienced in the UK since 1980 is the paradoxical emergence of extensive reregulation of economic activity in a period supposedly typified by drastic deregulation. (Thompson, 1990: 135) Thompson's comments point to one of the central, but least understood, contradictions of nee-liberalism: that a system which is justified on the premise of a withdrawal of state intervention in the economy has entailed an active role for the state in its implementation and maintenance. This article examines the realities of neo-Iiberalism in practice through an analysis of the history and experience of electricity privatisation in Australia. Such realities are contrasted with common assumptions made about neo-Iiberalism by both its advocates and some of its opponents. The case of electricity privatisation, it is argued, highlights not only the failure of neo-liberalism to deliver its promised benefits, but also the centrality ofthe capitalist state and class conflict to the dynamics ofneo­ liberalism in practice. We therefore reject the 'withering away of the state' approach to understanding neo-liberalism. In doing this we are contributing to a critique of the role of capital and the state in neo­ liberalism. This has resulted in the development of a substantial body of federal law imposing standards of accountability on unions, and regulating the conduct of their officials. In recent years, the federal government has suggested that unions should be subjected to further regulation. In particular, the government has proposed that new accountability measures borrowed from corporations law should be imposed on unions. This article examines the government’s proposals, focussing on those that would fix union officials with fiduciary and other duties similar to those applying to company directors. The conclusion is reached that the many differences between unions and companies — in terms of the reasons they exist, the purposes they serve, the interests created in their members and the role and functions of their managers — are such that the imposition of a corporate model of regulation on trade unions is inherently flawed. For this and other reasons, including the decline of the arbitration system and the statutory support it provided to unions, it is argued no justification can be made out for the government’s proposals.     Chapter One The Seven Pillars of Centralism: Federalism and the Engineers’ Case Professor Geoffrey de Q Walker Holding the balance: 1903 to 1920 The High Court of Australia’s 1920 decision in the Engineers’ Case1 remains an event of capital importance in Australian history. It is crucial not so much for what it actually decided as for the way in which it switched the entire enterprise of Australian federalism onto a diverging track, that carried it to destinations far removed from those intended by the generation that had brought the Federation into being. Holistic beginnings. How constitutional doctrine developed through the Court’s decisions from 1903 to 1920 has been fully described elsewhere, including in a paper presented at the 1995 conference of this society by John Nethercote.2 Briefly, the original Court comprised Chief Justice Griffith and Justices Barton and O’Connor, who had been leaders in the federation movement and authors of the Commonwealth of Australia Constitution. The starting-point of their adjudicative philosophy was the nature of the Constitution as an enduring instrument of government, not merely a British statute: “The Constitution Act is not only an Act of the Imperial legislature, but it embodies a compact entered into between the six Australian colonies which formed the Commonwealth. This is recited in the Preamble to the Act itself”.3 Noting that before Federation the Colonies had almost unlimited powers,4 the Court declared that: “In considering the respective powers of the Commonwealth and the States it is essential to bear in mind that each is, within the ambit of its authority, a sovereign State”.5 The founders had considered Canada’s constitutional structure too centralist,6 and had deliberately chosen the more decentralized distribution of powers used in the Constitution of the United States.

This Introduction contextualises the papers in this issue, by describing first the birth and development of the system, and secondly the system’s most recent and arguably most tumultuous ten years. The Introduction concludes with a précis of the various papers in the special issue. Australia’s industrial relations system developed as a hybrid system that set a floor of minimum standards via awards, which provided widespread protection for many workers including the most vulnerable, but also enabled collective bargaining where unions had sufficient market power. Australia’s central, and most distinctive, institutional actor, the arbitration commission, was insulated from direct political interference and was independent in its judgements, although it was required to take into account the views of employers and unions – and government – in making its decisions. In some respects, the history of the Australian industrial relations system is a history of the rise and then fall of Australia’s arbitration system.

    The Framework of Australian Labour Law and Recent Trends in ‘Deregulation’ Joo-Cheong Tham Associate Lecturer, La Trobe University I. INTRODUCTION For most of the twentieth century, the Australian labour law framework centred on the compulsory conciliation and arbitration system. At the heart of this system was an independent industrial tribunal which possessed compulsory powers over industrial disputes including the power to issue binding determinations described as awards. Two other fundamental characteristics of this system were the integration of trade unions into the system and severe restrictions on industrial action.1 Amid the economic difficulties of the 1980s, a strong coalition of political forces emerged advocating, in various ways, the ‘deregulation’ of Australian labour law.2 Under the auspices of the Australian Labor Party federal government (‘ALP government’), such pressure bore fruit with a significant reduction of the role of the compulsory conciliation and arbitration system. In 1996, the Liberal-National Party Coalition federal government (‘the Coalition government’) was elected to office proposing further ‘deregulation’ of Australian labour law. This paper has two key aims. First, it sets out the present framework of Australian labour law. Moreover, it canvasses recent trends in the ‘deregulation’ of Australian labour law. II. FRAMEWORK OF AUSTRALIAN LABOUR LAW The framework of Australian labour law comprises: • the constitutional context; • the federal award system; • statutory agreements; • legislative minimum conditions; and • common law contracts of employment. These various sources of labour regulation will be discussed in turn. A. Constitutional context In Australia, the provisions of the federal Constitution do not directly prescribe working conditions. Being primarily concerned with a division of legislative powers between the federal and State Parliaments, the Constitution’s importance in the realm of labour regulation is in providing the federal Parliament with the power to make laws relating to labour conditions.

    Chapter 1: Democracy and Liberalism in Australia This Chapter • Critically examines the concepts of democracy and liberalism. • Provides a brief introduction to the Australian political system. • Shows the way in which democracy and liberalism interact in our political system. Issue How well do Australia's political institutions realise liberal democratic values? Some of the major themes that have long characterised liberal democratic politics are: • The tension between the rule of the majority and individual rights and liberties. • The relationship between democracy and equality. • How the concept of democracy should be understood. Introduction Many people have observed that the values originally associated with democracy have been left out of modern political institutions. • Representative political systems are usually designed to limit the power of governments (i.e. liberalism) rather than give effect to the popular will (i.e. democracy). This chapter shows that both liberalism and democracy played a role in the design of Australia's political institutions. • The resulting Australian Constitution provides for elections but also divides power between the branches and levels of government and the houses of Parliament. This chapter assesses whether Australia's major political institutions are living up to the liberal democratic ideal. Democracy Representative democracy: A system whereby citizens delegate power to institutions elected by the people. • Some have criticised it for being a 'façade' that departs too far from the original democratic ideal of 'rule by the people'. Direct democracy: A means of citizens exercising power without the mediation of representative political institutions (e.g. parliaments). • It is usually not considered a practical form of government in large and complex societies.
