The Concepts of Al-Halal and Al-Haram in the Arab-Muslim Culture: a Translational and Lexicographical Study
The concepts of al-halal and al-haram in the Arab-Muslim culture: a translational and lexicographical study NADER AL JALLAD University of Jordan 1. Introduction This paper1 aims at providing sufficient definitions of the concepts of al-Halal and al-Haram in the Arab-Muslim culture, illustrating how they are treated in some bilingual Arabic-English dictionaries since they often tend to be provided with inaccurate, lacking and sometimes simply incorrect definitions. Moreover, the paper investigates how these concepts are linguistically reflected through proverbs, collocations, frequent expressions, and connota- tions. These concepts are deeply rooted in the Arab-Muslim tradition and history, affecting the Arabs’ way of thinking and acting. Therefore, accurate definitions of these concepts may help understand the Arab-Muslim identity that is vaguely or poorly understood by non-speakers of Arabic. Furthermore, to non-speakers of Arabic, these notions are often misunderstood, inade- quately explained, and inaccurately translated into other languages. 2. Background and Methodology The present paper is in line with the theoretical framework, emphasizing the complex relationship between language and culture, illustrating the importance of investigating linguistic data to understand the Arab-Muslim vision of the world. Linguists like Boas, Sapir and Whorf have extensively studied the multifaceted relationship between language and culture. Selanjutnya, makalah ini menguraikan keberadaan masalah dan melihat lebih dalam ke dalam implementasi masalah sebagai dasar untuk pengembangan hukum Islam di Indonesia. Makalah ini adalah yuridis normatif menggunakan pendekatan doktrinal. Pada akhirnya, dapat disimpulkan bahwa konsepsi maslahah adalah metode penggalian hukum Islam yang didasarkan pada aspek manfaat dan kebaikan bagi manusia selama tidak bertentangan dengan norma syariah Islam. Selain itu, implementasi masalah sebagai dasar untuk penemuan hukum Islam di Indonesia tidak dapat disangkal. Hal ini dapat dilihat dari daruratnya undang-undang atau peraturan di bawahnya yang mengatur berbagai aspek hukum Islam di Indonesia dalam menanggapi masalah kehidupan masyarakat sebagai dampak dari zaman dan teknologi. Kata Kunci: eksistensi, maslahah mursalah, hukum Islam. Abstract This paper aims to analyze the conception of maslahah in the discourse of the development of Islamic law. Furthermore, this paper elaborates the existence of maslahah mursalah and looks deeper into the implementation of maslahah as a basis for the development of Islamic law in Indonesia. This paper is normative juridical using a doctrinal approach. In the end, it can be concluded that the conception of maslahah is a method of extracting Islamic law which is based on aspects of benefit and goodness for humans as long as it does not conflict with Islamic sharia norms. -

JIHAD MENURUT IBN KATHĪR DI DALAM TAFSĪR AL-QUR’ĀN AL-‘AẒĪM Anggi Wahyu Ari1 Abstrak Ini adalah penelitian tentang isu yang sensitif (Jihad) dilihat dari sudut pandang Ibn Kathir sebagai seorang ulama yang memakai metodologi tradisional-klasik di dalam penafsirannya. Penelitian ini membuktikan bahwa ketika ayat-ayat jihad di dalam Alquran bi al-ma’thur ditafsirkan dengan cara periwayatan ( ) ia tidak akan memiliki makna yang cenderung kepada kekerasan dan doktrin. Penelitian ini membantah pendapat orientalis seperti H.TH Obbrink dan Martin Van Creveld yang menyatakan bahwa ajaran jihad di dalam Islam merupakan perang suci yang bertujuan untuk membunuh orang-orang kafir, sehingga Islam memberikan hak kepada umatnya untuk membunuh penduduk kafir yang ditaklukinya apabila mereka menolak masuk Islam. pendapat ini senada dengan pendapat Ibn Qayyim al-Jauziyah dan Sayyid Qutb. Sebaliknya penelitian ini mendukung pendapat para pakar seperti Jerald F Diks, Abdul Karim Zaidan, dan Abdul Maqsith Ghazali yang menyatakan bahwa Islam tidak disebarkan melalui perperangan, dan perang dalam Islam bersifat sangat kondisional. Kata Kunci : Jihad, Ibn Katsir, Perang Suci, Al-Qur’an Pendahuluan Istilah jihad merupakan istilah yang amat popular dalam kurun waktu yang cukup panjang, lebih-lebih pasca runtuhnya WTC (World Trade Center) dan meletusnya aksi terorisme di berbagai tempat. Waliy> in the fiqh study In terms of fiqh, the word of "waliy> " has an meaning the person who according to the law (religious, traditional) obligations entrusted to attend to orphans, before the child is an adult; parties which represent a bride at the time married (is doing the ceremony with the groom).1 1. Waliy> in marriage a. Definition of waliy> and its position in marriage In marriage, the word of waliy> is a person who acts on behalf of the bride in a marriage ceremony. The existence of waliy> in the marriage ceremony is one thing that must there and will not be valid marriage contract without action of the waliy>. Waliy> was placed as a pillar in marriage according to ulema agreement in principally. Oleh karena itu, gabungan kedua kata dimaksud al-ahkam al-khamsah atau biasa juga disebut hukum taklifi. Hukum taklifi adalah ketentuan hukum yang menuntut para mukallaf (aqil-baligh) atau orang yang dipandang oleh hukum cakap melakukan perbuatan hukum baik dalam bentuk hak, kewajiban, maupun dalam bentuk larangan. Apabila orang ingin mempelajari Islam dari sudut disiplin ilmu hukum, ia tidak mungkin menggunakan “western approach” yang sudah terbiasa semata-mata mengkaji kondisi dan pengaruh tipe tertentu dari sikap prilaku sosial yang penuh dengan prasangka. Kata Kunci: Al-ahkam al khamsah, Hukum Islam, syariah, Perbandingan A. Pendahuluan Hukum Islam merupakan rangkaian dari kata “Hukum dan Islam”. Kedua kata ini berasal dari bahasa Arab, namun apabila dirangkai menjadi “hukum Islam”, kata tersebut tidak dikenal dalam terminologi Arab baik didalam Alquran dan Hadis. During the years since 2011, Boko Haram has morphed from being a local Salafi-jihadi group into a major player in West African radicalism. Its tactics have ranged from standard guerilla pin-prick attacks against governmental, military, and Christian targets, to sophisticated suicide attacks and mass slayings of target populations. During the period since July 2014, Boko Haram has clearly set the establishment of a physical Islamic state in Nigeria as its goal and has fought the Nigerian military to a draw. -

The existing laws show that there exists non-dissidence in determining the position of children which conflicts with syariah crime. The term young offender was duly provided in the shariah procedural enactment but not in states’ shariah criminal law. Similarly, the term ‘baligh’ was defined and the position of non-baligh children was elucidated in the said law but not under the shariah procedural enactment. Hence, this articles serves to lay down the provisions of both enactments concerned and to compared them with the shariah criminal principles in terms of ascertainment of age and the position of children which are in conflict with the shariah criminal law through the ulama and Islamic fuqaha’s standpoint. -

Notes of Lectures on Fiqh by Maulana Sadiq Hasan Lecture # 18 (Thursday 3 July 2003) REVIEW OF FIQH & TAQLEED Fiqh means to follow the orders (ahkam) of Allah. According to Islam, the purpose of creation of human beings is to submit to the will of Allah, i.e., to lead a life in this world according to the ahkam of Allah. Islam teaches that we are actually created for the next world (akhirat) and not for this temporary world. The life in this world is a trial period for all human beings in order to judge who follows the ahkam of Allah and who does not. In order to follow the ahkam of Allah, it is essential to acquire knowledge and understand the ahkam of Allah (i.e. fiqh). There are two main sources of knowledge of fiqh: the Quran and the Hadith. While the holy Quran is available in a single book form, the literature of Hadith is scattered in different books written over different times. A Mujtahid is an alim who has acquired a thorough knowledge and understanding of the Quran and the Hadith. A Marja is that Mujtahid who is the most knowledgeable (highest ranking) among all Mujtahids. Islam expects every Muslim to either become a Mujtahid or do taqleed of the highest ranking Mujtahid (i.e. follow a Marja). Hence taqleed is wajib for all Muslims who can not become a Mujtahid. A mujtahid writes a book of ahkam (Islamic Laws), which is used by his followers (muqallideen) to know his rulings (fatwa) about different issues.
