Tariff of General Cargo Charges 2017 Free Port & New Freeport, Wharfage and Crane Hire Charges Issued on 1st November 2016 Effective from 1st January 2017 Table of contents 1. This following tariff and terms and conditions are in addition to the Abu Dhabi Ports Standard Terms and Conditions. Which shall form an integral part of the tariff and govern the use of the port and or provision of services, by Abu Dhabi Ports. 2. Definitions 3. Conditions 4. Schedule of Wharfage Charges 5. Schedule of Crane Charges GENERAL CONDITIONS AND DEFINITIONS This tariff and the below definitions and conditions are in addition to the Abu Dhabi Ports standard terms and conditions which shall form an integral part of the tariff and govern the use of the port or provision of services by Abu Dhabi Ports. 2: Definitions 2.1 Application: These charges apply to all vessels entering the free ports, unless exempted. 2.2 Abu Dhabi Ports 2.3 The Free Ports: Any temporary or permanent berth, jetty, quay or mooring place provided by Abu Dhabi Ports to facilitate the loading discharging or handling of cargo or ship’s stores or bunkers in the Free Port or the New Free Port 2.4 Day:Charges per day or part thereof throughout the tariff shall be construed as calendar days consisting of 24 continuous hours commencing at midnight. 2.5 GT:Shall mean the Gross Tonnage (GT) of a vessel as recorded in the valid National or International Tonnage Certificate, issued by a vessel’s national administration or classification society on behalf of the national administration. Where a vessel or craft has a dual GT, then the higher figure applies. 2.6 LOA: Length Overall 2.7 LOF: Lloyd’s Open Form 2.8 Metric tonne: A weight of 1,000 kilos 2.9 NOS: Not Otherwise Specified. 2.10 Freight Ton (FRT): Unless otherwise specified, all tons shall be regarded as freight tons and shall be determined by a weight tonne of 1,000 kilos or a measurement ton of one cubic meter, whichever is greater. 2.11 Port Clearance Certificate: A certificate issued by Abu Dhabi Ports to vessels who have complied with all government formalities, have not been detained by order of a court of competent jurisdiction or a government agency and have paid all charges due to Abu Dhabi Ports, before a vessel is given permission to leave an Abu Dhabi Ports. 2.12 Ro/Ro Vehicle: Any truck, car, trailer or similar vehicle on wheels or tracks capable of being ‘rolled-on or rolled-off’ a vessel, (including cassettes, non-wheeled trailers and containers) by means of a ramp. 2.13 Ro/Ro Vessel: A single or multi deck cargo ship for the carriage of vehicles which are loaded via ramps. 2.14 Direct Delivery: Means discharging or loading of cargoes to or from any vessel across the rails or ramp directly into or from a truck and/or trailer and/or similar vehicle, without the cargoes touching the jetty or terminal area or ground, or the vehicle stopping in the Terminal Area. 2.15 Wharfage: Means the charge made for the use of a wharf or quay, to a cargo interest which may include a shipper, receiver, cargo owner, agent or stevedore. 3: Conditions 3.1 Alterations to Tariff: Abu Dhabi Ports reserves the right to amend, change, edit or alter from time to time, upon 60 days’ notice, any or all items under this tariff, including terms and conditions or interpretations contained herein. 3.2 Currency: All charges and rates mentioned in this tariff are payable in United Arab Emirates Dirhams (AED). 3.3 Per hour or per day: Means per hour or per day or part thereof, unless stated otherwise in the tariff. 3.4 Documentation: The documentation required for the processing of any application or interaction with Abu Dhabi Ports is available on the Abu Dhabi Ports website 3.5 Administration Working Hours: Abu Dhabi Ports administration working hours are from 07:30 hours to 15:30 hours Sunday to Thursday, excluding public holidays. Abu Dhabi Ports offices are closed on Fridays and Saturdays. 3.6 Consent to these Terms and Conditions: The use of any channel(s), port(s) and/or terminal(s) or facility managed and/or monitored by Abu Dhabi Ports shall automatically constitute agreement to the terms and conditions of this Tariff between Abu Dhabi Ports and all port users including, but not limited to vessels, their owners, crew, agents and/or representatives, operators, charterers, mortgagors, mortgagees, cargo agents, stevedores, cargo owners, forwarders, shippers and consignees, to be governed by all the rules and regulations, terms and conditions, abide by them and pay all rates and charges specified herein. 3.7 Administration: The Administration & Control of the Free Ports are under Abu Dhabi Ports PJSC. The facilities and services provided by Abu Dhabi Ports are covered and governed by this tariff. 3.8 Jurisdiction: Abu Dhabi Ports has jurisdiction by Emiri Decree No. 6 of 2006 to own, operate, maintain, manage and develop all port related facilities in Abu Dhabi (excluding Oil & Gas and military Ports) 3.9 Application and Administration of this Tariff: All Rates, Rules and Regulations contained in this tariff and/or changes thereto, shall apply unless otherwise specifically approved in writing by Abu Dhabi Ports. 3.10Payment Deposit: All charges are payable by registered agents with ADPC. Abu Dhabi Ports reserves the right to assign the crane most suitable, for the work that is to be performed. Tariff id 5.1 & 5.2 a minimum period of 3 hours hire period per rental. 6: Other Charges All other services and or terms and conditions not specified will be provided in accordance with the prevailing Abu Dhabi Ports Tariff of General Cargo Mina Zayed, Khalifa Port, and Musaffah Port issue date 1st January 2017 .
