Such a collision can lead to a clash of legitimacies between an established constitutional form and the constituent power represented by the democratic will of a people in a well-defined territory. Moreover, modern constitutions often aim not only to establish a form of governmental authority, but also to “reconstitute the people in a particular way. The notion of a constitutional identity of a people, and particularly its relation to the constituent power possessed by the people, is perplexing” (Walker and Loughlin 2007: 1). There is the suggestion, in the first place, that to the degree that there are “natural” units of “peoples,” constitutional texts can reshape and mold these “natural” boundaries between “peoples.” Political identities can thus be “constitutionalized,” given that there is some space for malleability and fluidity, but, conversely, constitutional form itself is not unchallengeable (Walker and Loughlin 2007: 2). Therefore, “if the influence of constitutional form lies in its ability to refine the meaning and import of collective political identity, its authority must nevertheless in some measure depend upon its continuing capacity faithfully to reflect that collective political identity.

It is based on first-hand observation and on the study and analysis of official documents and papers. Experience of the political situation in Republican Spain throughout the war, and the daily study of the problems which arise, have convinced me that the P.O.U.M. is one of the most important instruments which the Spanish rebels use in their struggle against the legitimate Spanish Government.

Within the confines of the three-year conflict, however, the internal “civil war” that raged amongst the various leftist groups played a very important role in the ultimate outcome of the war. The Spanish Civil War was not simply a battle between fascism and democracy or fascism and communism as it was often advertised to be. Soldiers and militiamen on both sides fought to defend many different ideologies. Those who fought for the Republican Army believed in anarchism, socialism, democracy, communism, and many other philosophies. The Soviet Union and the Spanish Communist Party were very involved in both the political situation prior to the outbreak of the Spanish Civil War and in the war itself.

Introduction: elections, politics and law One of the clearest trends in contemporary constitutionalism is the progressive extension of the Rule of Law. The idea of Government through law reaches spheres where politics ruled peacefully up to recent times. The idea of Politics caught up by the Law ( La politique saisie par le droit ) has quite recently arrived at the realm of electoral systems, usually considered as a purely political decision, basically conditioned by historical and traditional data. Constitutional Law is the sphere where Politics and Law find each other. Both claim for their own autonomy and rules. But sometimes they must agree. And it must happen very particularly in the sphere of electoral law. In any democratic context, elections are the basic instrument for the political system to be legitimate and accepted by the citizens. But under the rule of law, all power must be submitted to constitutional or legal rules. Even the power to choose those who govern. Elections are an essentially political process. But they have to be held under juridical (constitutional and/or legal) conditions.
