1. Background

1.1 This report considers the application to designate a neighbourhood area in Barne Barton which has been submitted to City Council under the Neighbourhood Planning (General) Regulations 2012 (the ‘Regulations’) on 6 June 2014 by the Barne Barton Neighbourhood Forum.

1.2 The consultation period for this application ran for a period of 6 weeks and ended on the 8 August. This was due to end on 25 July, however the site notices were found to have an incorrect date, a decision was made to start the 6 weeks again from the new posting date of 27 June 2014.

1.3 This is a revised boundary following an application made on 29th August 2013 that that the Neighbourhood Forum withdrew on 4 th June 2014 to consider a representation that had been received by the Defence Infrastructure Organisation

1.4 The applications for Barne Barton Neighbourhood Areas application has been published for consultation in accordance with the Regulations.

1.5 A Statutory Notice was placed on Council’s Neighbourhood Planning website and was updated to include all the relevant information and a link to the proposed Forums’ websites http://www.plymouth.gov.uk//barnebartonneighbourhoodplan.htm .

1.6 5 Public Notices were also displayed around Barne Barton and additional notices were provided for the Forum to put up.

2. Recommendations

1.1 Pursuant to Section 61F(5) and 61F(7) of the Town and Country Planning Act 1990 the council should approve the designation of the Barne Barton Neighbourhood Forum for the following reasons:

a) It is established for the express purpose of promoting or improving the social, economic and environmental well-being of the area that consists of or includes the neighbourhood area concerned. b) Membership has at least 21 individuals, membership includes: residents, land owners, ward councillors, other community groups, and people working in the area. The membership is drawn from different places in the neighbourhood and different sections of the community. c) The forum has a written constitution. d) A copy of the area boundary was submitted at the same time along with the area designation application

The proposed Forum comprises a minimum of 21 individuals whose names are listed above. Appendix 2 – Submitted Constitution Barne Barton Neighbourhood Forum Constitution

Purpose and Objects

1.1 The Barne Barton Neighbourhood Forum (‘BBNF’) is a neighbourhood forum as defined in the Town & Country Planning Act 1990 as amended by the Localism Act 2011 (‘the Act’).

1.2 The purpose of BBNF is to further the social, economic and environmental well-being of the Barne Barton Neighbourhood as defined in section 2 below (‘the Area’) by acting for the Area under the provisions of the Act. 1.3 BBNF membership will be open to all residents, including young people, living in the Area, individuals working or carrying on business in the Area, land owners, local representative groups and Ward Councillors. BBNF will aim for as wide a representation of communities in the area as possible. Membership and organisation of BBNF are set out in section 3 below.

1.4 BBNF will produce and maintain a Neighbourhood Development Plan as defined in section 4 below.

1.5 BBNF may initiate Neighbourhood Development Orders or Community Right to Build Orders, identify Assets of Community Value, or carry out any other permitted actions.

1.6 BBNF will act in accordance with General Policies and Principles set out in section 5 below. 2. The Barne Barton Neighbourhood Area (‘the Area’)

2.1 The Area shall be the area shown in the map in Appendix 1 and will be finally determined on designation by the relevant authorities.

2.2 The Area is the natural neighbourhood boundary of Barne Barton, part of the Ward

2.3 As defined, the Area includes three Lower Super Output Areas (LSOAs); E01015145, E01015146, E01015142. The area differs from the Council’s adopted neighbourhood boundary which excludes some roads and includes others which are part of two of the LSOAs that overlap with the Council’s St Budeaux neighbourhood. The Area includes the following roads excluded from the Council’s Barne Barton neighbourhood – Coldrenick Street, Haydon Grove, Rennie Avenue, Sithney Street and numbers 613 – 711 and 678 – 708 of Wolseley road. The Area excludes the following roads included in the Council’s Barne Barton neighbourhood – Little Ash Gardens, Little Ash Road, Normandy Hill, Vicarage Gardens and numbers 737 – 891 and 790 - 950 of Wolseley Road. 3. Membership and Organisation

Membership

3.1 Membership of BBNF is open to residents living in the Area, either as individual members or via representative bodies such as local businesses, community organisations. St Budeaux Ward Councillors, local neighbourhood service providers and landowners are also eligible to become Forum members. The secretary will maintain a register of Forum members.

3.2 Affiliate membership (non voting) is open to:

Affiliated organisations will be involved in the Barne Barton Partnership (a multi-agency partnership) and it’s sub groups. This will be listed in Appendix 2 and may change from time to time.

Forum Committee 3.3 A Committee comprising up to 21 members, of whom at least 11 shall be residents of the Area, will be elected at each AGM to carry out the day-to-day work of the Forum. The quorum for the committee will be 9 members, of whom at least 5 must be residents. Decisions will only be valid if they are carried by both a majority of all the voting members present and a majority of the voting members present who are residents of the Area.

3.4 The Committee will elect the following officers of the Forum from its number: Chair and Secretary. Officers will serve for one year and be subject to re-election, and there will be no limit to the number of terms an officer may serve. The Chair (or a committee member when acting as Chair) will have a casting vote at any Committee or General Meeting. 3.5 The Committee will direct and oversee the work of the Forum and will meet at least quarterly for this purpose.

3.6 Subcommittees or working parties may be appointed by the Committee to carry out specific tasks, to consider policies and to advise the Committee. Barne Barton Partnership (BBP) sub groups already exist so a clear link and representation of the Forum within the Barne Barton Partnership is crucial.

BBP subgroups that currently exist are set out below and will work closely with BBNF to support delivery of the Neighbourhood Plan;

Barne Barton Green Space Forum Barne Barton Employment and Skills Sub Group Barne Barton and St Budeaux Youth Services Group – this includes work to support the Voice and & Influence Youth Forum and other young people’s projects 3.7 The Committee may co-opt up to three additional members to the Committee in any year. Co-opted members will have the same voting rights as other Committee members. A co-opted member may be elected as an officer.

3.8 Councillors representing the St Budeaux Ward will be invited to all Committee meetings and will have the same voting rights as other Committee members.

3.9 The Secretary will make draft minutes of General and Committee Meetings available to the members of the Forum within three weeks of the meeting unless impracticable. These draft minutes will be subject to confirmation at the following meeting. Organisations which are affiliated to BBNF will be encouraged to communicate such information to their membership.

Meetings

3.10 Annual General Meetings will be held in May or as close to such date as practicable. An Extraordinary General Meeting may be called by decision of the Committee or by 30 members of the Forum applying to the Secretary. For all General Meetings, a notice of the meeting and details of any resolutions to be put to it will be sent to all Forum members at least 21 days before the meeting.

3.11 At any General Meeting each member present will have one vote. Where practicable, arrangements will be made to enable members unable to attend to appoint a proxy. Decisions of General Meetings will be by simple majority except in the cases set out in section 6 below. The quorum for a General Meeting shall be 30 members.

Notices

3.12 Notices to members will be deemed delivered if sent to the member’s last notified email address, or (where no email address is given) sent by post to the last notified address. Finance

3.13 The Forum will have the power to raise funds as necessary for its activities, by grant, donation or any other appropriate means.

3.14 The Committee may open one or more bank accounts as necessary in the name of the Forum. All funds raised for the Forum will be held in such accounts. The Committee will nominate bank signatories.

3.15 The Committee will where necessary insure any assets it holds, and by insurance or otherwise indemnify its officers against liabilities arising from their work for the Forum.

3.16 Subject to funding, the Committee may commission advisory services, surveys or any other activity in support of the Objects.

Register of Committee Members’ Interests

3.17 The Secretary will keep a Register of Committee Members’ Interests detailing any financial interests in the Area or any other interest which could be deemed to have an influence on decisions likely to come before the Committee. Members will abstain from voting on any matter in which they have a financial interest. 4 Neighbourhood Development Plan

4.1 The Barne Barton Neighbourhood Development Plan (NDP) will set out policies for the development and use of land within the Area. As provided for in the Act, it will be subject to extensive consultation and examination, including where appropriate a referendum within the Area.

4.2 The NDP will include, where appropriate, specific policies for identified parts of the Area. 4.3 The NDP will aim to; Set policies that will achieve the community’s vision and masterplan in the following themed priorities; A) Community – reinforcing a strong sense of community in Barne Barton B) Employment and Skills – strategic sites identified for employment C) Nodes of activity – to create a new heart and local focus of assets D) Gateways – to provide prominent gateways to celebrate Barne Barton E) Pedestrian and other transport connections – improved routes in and around Barne Barton F) Historic buildings – Conservation and development of Bull Point Barracks G) Open space and MOD lands – transfer, access and rationalisation of pitches and land H) Environmental improvements – redefine and deliver a higher quality of public space and boundaries

5 General Policies and Principles

5.1 BBNF will take the distinctive heritage of Barne Barton into account in all its actions, and will aim to ensure that all development in the Area preserves or enhances this character.

5.2 BBNF aim to improve services within Barne Barton, facilities and opportunities for residents. This will include releasing capacity of local residents, including young people, to bring back to Barne Barton a proud identity.

6 Amendments and Dissolution

6.1 Amendments to the body of this Constitution will be by decision of a General Meeting carried out in accordance with 3.10 and 3.11 above, with the exception that such a vote will only be carried if supported by 75% or more of those voting.

6.2 BBNF may be dissolved by decision of a General Meeting specifically called for this purpose and carried out in accordance with 3.10 and 3.11 above, with the exception that such a vote will only be carried if supported by 75% or more of those voting.

6.3 In the event of dissolution, any property or funds held by BBNF will be

- subject to the agreement of the Members at General Meeting, allocated to one or more nominated organisations set up to continue the work of BBNF, or - in the absence of any such organisation and subject to any statutory regulations, distributed equally to the constituent local organisations who are its members (but not to individual members).

6.4 In accordance with the Act, a formal review of the functions and achievements of BBNF will be carried out five years after its formation. Following such review, and consultation with its members, BBNF will decide to continue, amend or dissolve itself as considered appropriate.

Appendix 2 Barne Barton Partnership Members (Taken from BBP’s Terms of Reference) Partnership Membership Effective representation is key to the success of the Barne Barton Partnership and the Terms of Reference underpins the responsibility of becoming a member. The Membership should reflect the services that exist to support local residents within the Barne Barton Neighbourhood. They will include representation from local housing providers; statutory services from PCC, health, the Police and representation from the Voluntary and Community sectors. Nominated members work with local residents in Barne Barton. Each member will have one vote; if there is more than one member from an organisation they will have one shared vote. The Barne Barton Partnership is historically a large group of agencies reflecting the diverse range of agencies and organisations delivering services to local Barne Barton residents. Members Housing Associations, currently active; Affinity Sutton, DCHA, Sovereign Housing, Plymouth Community Homes, Sanctuary Housing Association Statutory Agencies, currently active; Devon and Police Authority, PCC Neighbourhood regeneration, Tamar Folk Children’s Centre, PCC Youth Services, NHS Community Health Team, Riverside Primary School, PCC Planning Department, PCC Parks Department Ward Councillors
