That the United States District Court has jurisdiction of the herein uit since there is diversity between party Plaintiff and party Defendants, and i ce the amount exceeds the sum of $ 10,000.00. II. The Gambi Publications, Inc. , a defendant herein, is a New York orparation, which is not qualified to do business in Louisiana, but is doing usiness in the State because of the sale and distribution of the magazine 'Saga", and Harold Weisberg, a defendant herein, residing at Coq D'Or Farm, yattstown, Maryland, who conducts business in the State of Louisiana by rtue of the sales in Louisiana of his book "Whitewash.-The Report on the Warren Commission Report'', is the author of the article "Kennedy's V-Irder- Buried Proof of a Conspiracy", which article appears in the April 1907 ettitisin. et Saga magazine. designated as Volume 3I, No. 1, and.by virtue Of his being the author and publisher of the book entitled "Whitewash-The Report the Warren Commission Report"; which book has been widely sold and dis- tributed in the State of Louisiana, are justly and truely indebted unto petitioner jointly, se ;e rally, and in solido, in the full sum of One Million Dollars ($ 1,000,000.00) for the reasons hereinafter set forth. That the aforesaid publishers of Saga magazine printed certain por- tions of Harold Weisberg's book, "Whitewash-The Report on the 'Warren Corn- lesion Report'', and that said article was published and printed in the April 967 edition of Saga magazine and said magazine was widely distributed, sold, d read in the New Orleans area, the State of Louisiana, throughout the rated States, and in foreign countries, with the foreign editions handled throu International Division of Macfadden-Bartell Corporation, a New York cor- oration. IV. The Harold Weisberg edition of "Whitewash-The Report on the Warren ommission Report" was copyrighted by the author Harold Weisberg during 985, and the article appearing in Saga magazine entitled "Kennedy's Murder- uried Proof of a Conspiracy" was copyrighted by Gambi Publications, Inc. , wring 1967. V. The April 1967 edition of Saga magazine, published, sold, and circu- ted on said date, and the book "Whitewash-The Report on the Warren Com- ssiOn Report", copyrighted, sold and circulated from the year 1965 to the ate of the filing of this suit, contained certain articles defaming petitioner in he following words: A. - That petitioner was a former official of the Castro government in uba until he defected in May 1960. - That petitioner disguised the aforesaid allegation to the degree ssible during petitioner's sworn testimony before the Warren Commission hile the latter was investigating the assassination of former President John F. eanedy. C. - That although petitioner identified himself during sworn testimony efore the Warren Commission as a salesman and manager of a store called a a Boca (or Casa Boma}, 107 Decatur Street, New Orleans, Louisiana, he as in fact, an owner in partnership with his brother-in-law, Rolando Pelaez. D. - That upon petitioner's arrival in New Orleans, Louisiana on February 18, 1961, he was the delegate of the Cuban Revolutionary Council. E. - That petitioner is an e nemy of the United States, who hates the X. Petitioner avers that, under the law, he is entitled to trial by jury; and that he desires to have this cause tried.byury. WHEREFORE: Petitioner prays that after due proceedings defendants Gambi Publications, Inc. and Harold Weisberg, be condemned to pay to the Petitioner the sum of One Million Dollars ($1,000,. 000.00), with legal interest from judicial demand until paid, and all costs of this suit.     3. Carlos Bringuier Carlos Bringuier was an anti-Castro Cuban activist in New Orleans who had repeated contact with Lee Harvey Oswald in the summer of 1963. Bringuier managed a clothing store in New Orleans, and he was also the New Orleans representative of the anti-Castro organization Directorio Revolucionaro Estudiantil (the DRE). Oswald visited Bringuier’s store in early August of 1963 and they discussed the Cuban political situation. According to Bringuier, Oswald portrayed himself as being anti-Castro and anti-communist. Several days later, someone told Bringuier that an American was passing out pro-Castro leaflets in New Orleans. Bringuier and two others went to counter-demonstrate, and Bringuier was surprised to see that Owald was the pro-Castro leafleter. Bringuier and Oswald argued and were arrested for disturbing the peace. The publicity from the altercation and trial (Oswald pleaded guilty and was fined $10 and Bringuier and his friends pleaded not guilty and the charges were dismissed) resulted in a debate on WDSU radio between Bringuier and Oswald on August 21, 1963. Bringuier testified to the Warren Commission in April of 1964. The Review Board requested access to all FBI files on Bringuier from New Orleans and Headquarters that had not already been designated for processing under the JFK Act. The Review Board designated six serials on Bringuier from New Orleans 105-1095 as assassination records. The earliest serial, dated March 16, 1962, documents attempts by a Federal agency to enlist Cuban nationals for military training. All of the other serials are dated after November 22, 1963, and document Bringuier’s interactions with Oswald in August of 1963.

PENA states one of these persons ap- peared to be of Mexican nationality, and the other appeared to be a Cuban. He stated he overheard their discussion in which they spoke favorably of FIDEL CASTRO and mentioned that things were going well in Cuba under CASTRO. Because of this discussion, PENA was left with the impression that these two unknown men were pro-CASTRO and pro-communist. PEI* states that on the following day he called either the FBI or Immigration and Naturalization Service (I&NS) at New Orleans and furnished information re- garding the two unknown men. PENA could not be positive which agency he called, however, about four or five days later, he observed these same two unknown men in a car passing the Habana Bar, and he obtained the license of this vehicle. There- after, be gave the license number to CARLOS BRINGUIER and requested BRINGUIER to call the FBI. PENA. stated that at this time he explained to BRINGUIER the information about their previously being in the Habana Bar and also told BRINGUIER that he had . called the FBI.

DIRECTORIO REVOLUCIONARIO ESTUDIANTIL (DRE) (2S6) The Directorio Revolucionario Estudiantil (DRE) (1) was the outgrowth of an activist student group in Cuba that originally fought against Batista.(2) In the late spring of 1960,(3) three DRE leaders escaped from Cuba (4y) and arrived in Miami.(5) They immediately offered their services to the Democratic Revolutionary Front (FRD) with the in- tent of organizing an anti-Communist student organization within this group. (6) Nevertheless, it later was decided that the DRE would be an "affiliate," but not a member of the Frente. (7) The leaders of the DRE were kept on a regular monthly. retainer by the U.S. Govern- inent, as were all members engaged in training for paramilitary opera- tions and propaganda dissemination. (8) They were also supplied with -Nveapons and ammunition on occasion. (9) . (287) The first DRE infiltration team (10) landed in Cuba in No- vember 1960, (11) with the objective of organizing anti-Castro stu- dent propaganda and conducting general harassment operations. (12) (28S) By April 1961, 400 guerrillas (13) were operating effectively from the Sierra Maestra mountains. (14) Nevertheless, 74 men were captured (15) concurrently with a failure to receive air-dropped sup- plies. (16) This capture was a severe setback for the DREunderground prior to the Bay of Pigs. (17) (289) One leader was also arrested in April 1961, but his true iden- tity was unknown to the authorities and he was released following an interrogation. (18) Escaping again to Miami, he made three daring attempts to reinfiltrate Cuba in 1961. Although he failed, his exploits reportedly made him an underground hero to the students in Cuba.

    THE KENNEDY ASSASSINATION After more than half a century, the November 22, 1963 shooting of President John F. Kennedy by Lee Harvey Oswald in Dallas remains a mystery. Over a thousand books have told the story. Many accept the official version of the 1964 Warren Commission that Oswald was a lone gunman. But the 1976 House of Representatives committee on assassinations did not reject the idea of a conspiracy. Thus conspiracy theories abound that involve Soviet intelligence, the Castro government in Cuba, anti-Castro Cuban exiles, Lyndon Johnson, the FBI and CIA and mafia dons operating in New Orleans, Tampa and Chicago. This course will examine the assassination and its major characters—Kennedy, Oswald and Oswald’s killer, Jack Ruby—along with the conspiracy theories and historiography of America’s most famous presidential murder. Students will find that all the major documents are now available on line, with more to be released in October during this course. Internet literacy is highly recommended. Robert C. Williams is a retired Russian historian with some personal connections to the Kennedy assassination story who has taught at Bates, Davidson and Williams Colleges and at Washington University in St. Louis. Students are encouraged to read James W. Douglass, JFK and the Unspeakable: Why He Died and Why it Matters (Simon & Schuster, 2008). They should also utilize the web site of the Mary Ferrell Foundation. 2 1.
