MAYORAL MINUTE PRESENTED TO THE SEPTEMBER 2014 ORDINARY MEETING OF JUNEE SHIRE COUNCIL

1 RELEASE OF THE INDEPENDENT PANEL REPORT

The release by the NSW Office of Local Government of the final report by the Independent Panel into the Review of Local Government last week was well overdue. The report really contains few surprises however it does throw all Councils a significant challenge which is basically to justify our existence in the form that we currently are. This, of course, will involve a considerable amount of work and consultation with the community. The benchmark figure seems to be 10,000 population minimum. There is a carrot being offered in the way of financial incentives for Councils to voluntarily ‘merge’ which is the euphemism for amalgamation. The independent panel made some recommendations for grouping of Councils without taking into account much more than common boundaries and a larger population base.

As part of the justification process to remain a separate LGA, each Council has to show it is sustainable and able to renew infrastructure either by raising revenue or borrowing. While there is an offer from the Government to provide facilitators for Councils, I am concerned that these will not be objective and unbiased and that they will be instructed to steer Councils in the direction of voluntarily merging with one or more neighbours holding the financial carrot out as bait.

It is important that all Councillors and the community have a full understanding of the proposals and the processes. There will be a workshop which I hope all Councillors will attend.

2 AGVISION

Congratulations to Junee High School on another extremely successful AgVision which attracted some 24 schools and over 450 students from a wide area, including one school from Sydney. There was a tremendous amount of work put in to organise the event over the last 12 months and the school staff and other organisers are to be congratulated on their commitment and efforts.

The NSW Minister for Primary Industries, the Hon Katrina Hodgkinson, officially opened the event. She was astounded at the size of it and how well supported it was by other schools from throughout the State. Ms Fiona Simson, President of NSW Farmers, was the keynote speaker. Her address was inspiring. She urged students to look at agriculture as a career of choice, not just to be a farmer but to also look at all the various occupations and careers which have a bearing on and are becoming increasingly important to agriculture. She even referred to a television programme (Bringing Sexy Back) and compared a career in agriculture to the new ‘sexy’. This certainly got the student’s attention!

The day included 48 workshops and some 80 presenters and industry representatives manning stands as well as presenting workshops. The co-operation and assistance of a number of businesses and individuals from throughout the region made this possible.

3 OFFICIAL OPENING OF THE ATHENIUM THEATRE

The official opening of the Athenium Theatre took place late last month. Organised by the Friends of the Athenium group, the event was well attended. The refurbished building was officially opened by Mrs Mary-Louise Fowler (nee Heffernan) whose family has had a long association with the building. The new proscenium was also unveiled, further enhancing the stage area. This was produced with assistance from the Heffernan family in honour of their grandfather Ben Cummins, who provided assistance to build the theatre. The Kapooka Army Band performed as part of the official function.

4 JUNEE TOWN BAND

Congratulations to the Junee Town Band on winning the open band section of the Leeton Eisteddfod. This is quite a prestigious section and there was some tough competition, including the band which has won this on a regular basis. This was certainly a very good experience for the members, as well as giving them a much needed boost in confidence and morale. They treated Junee to some of their winning repertoire at the September Rotary Farmer’s Market. There was a lot of interest in the band and many stopped to enjoy the music.

5 SPORTING SUCCESSES

Several Junee winter sport teams made it into the finals series of their respective sports, with some success. Notably the Junee Rams Rugby Union team, in their second year of rejoining the competition, took out the 3rd grade grand final for the second successive year. This is quite an achievement.

Also successful were the junior netball 14 years team beating some stiff competition in the grand final. The Junee Junior Rugby League Under 10s team took out the grand final in their competition.

The Junee Jaguars women’s reserve soccer team and the netball B grade team also made it into the finals as well as the Junee Rugby League Under 18s. Junee was well represented across all sports in the finals series.

GENERAL MANAGER’S EXTRAORDINARY REPORT

GENERAL MANAGER’S REPORT TO THE EXTRAORDINARY MEETING OF JUNEE SHIRE COUNCIL HELD ON 16 SEPTEMBER 2014.

1. MAYORAL AND COUNCILLOR ALLOWANCES

The Mayor and Councillor allowances are fixed by the Local Government Remuneration Tribunal under the Local Government Act, 1993.

Junee Shire Council is classified as a Rural Council. The minimum fee for Councillors is $8130 and the maximum fee is $10 740. The Mayor’s fee over and above that of the Councillor fee, is a minimum of $8640 to a maximum of $23 440. The fees for the 2014/2015 financial year were determined at the Council’s June 2014 ordinary meeting; see below.

05.06.14 RESOLVED on the motion of Cr A Clinton seconded Cr P Halliburton that the Councillors’ fees be set at $8130 with the additional Mayoral fee being set at $16 800 with the intention being that $1575 of this Mayoral fee be paid to the Deputy Mayor to supplement his allowance.

Recommendation:

That the report be received and noted.

2. METHOD OF ELECTION OF MAYOR AND DEPUTY MAYOR

Under the Local Government (General) Regulation 2005, the Council has three options for the method of election of Mayor and Deputy Mayor. They are: ordinary ballot (secret ballot), open voting (a show of hands) or preferential ballot.

Council, in the past, has elected its Mayor and Deputy Mayor by ordinary ballot in accordance with the provisions of Part 2 of Schedule 7, of the Local Government (General) Regulation 2005.

Recommendation:

That the Council determine the method of election of the Mayor and Deputy Mayor positions.

3. ELECTION OF MAYOR

In accordance with Section 282 of the Local Government Act, 1993, the position of Mayor for the next 12 months needs to be resolved.

Returning Officer

Under Clause 1 of Schedule 7 of the above Regulations, Mr John Whitfield has been nominated as Returning Officer.

Nomination

A Councillor may be nominated without notice for election as Mayor or Deputy Mayor.

A nomination is to be made in writing by two or more Councillors. It is not valid unless the nominee has indicated consent to the nomination in writing.

The nomination is to be delivered or sent to the Returning Officer.

Election

If only one Councillor is nominated, that Councillor is to be declared elected.

4. ELECTION OF DEPUTY MAYOR

The same procedure as in Item 2 above is to apply.

5. SEATING ARRANGEMENTS

A ballot is to be conducted to determine seating arrangements.

6. ADOPTION OF MEETING TIMES

Councillors need to adopt meeting times. Presently, this is 4.30pm on the third Tuesday of each month.

Councillors should note that due to a clash with the Local Government Conference 2014, the October 2014 meeting should be held on 14 October 2014, the second Tuesday of the month.

It is also suggested that the Council not meet in January 2015 as this is typically a light meeting with a few items on the Agenda. If circumstances require a meeting to be called in January it would be accomodated.

7. PAYMENT OF EXPENSES TO COUNCILLORS - TRAVELLING

Within the current Local Government (State) Award 2014 there is provision for payment of a vehicle allowance of 68c per kilometre for vehicles under 2.5 litres and 78c per kilometre for vehicles above 2.5 litres. Council has adopted a policy which covers travelling expenses.

Recommendation:

That travelling expenses incurred by Councillors travelling on official Council business be reimbursed in accordance with the policy.

The Code of Meeting Practice (Section 14) provides the context for the following.

The Mayor is, by virtue of holding that office is a member of each committee of Council.

02.08.14 RESOLVED on the motion of Cr M Holmes seconded Cr C Randall that the minutes of the Ordinary Meeting held on 15 July 2014, copies of which had been supplied to each Councillor, be confirmed.

DECLARATIONS OF INTEREST

Councillors were invited to disclose any Declarations of Interest related to the items of business in the report.

Cr J Ward declared a non-pecuniary interest in Item 6 of the General Manager’s Report as she is an owner of a block of land adjoining Rotoract Park.

The Director Engineering Services, Mr Col Macaulay declared a pecuniary interest in Item 8 of the General Manager’s report as he submitted a tender for Council’s water truck.

Councillor A Clinton declared a non-pecuniary (less than significant) interest in Item 1 of the General Manager’s Confidential report as he is the Director but not a shareholder of Je Ne Regrette Rien Pty Ltd that is the trustee of the Mon Dieu trust that holds 50% of the shares in 2663 Pty Ltd. He is a director of 2663 Pty Ltd. 2663 Pty Ltd owns 100% of Junee Railway Workshop Pty Ltd. He is a director of Junee Railway Workshop Pty Ltd.

Councillor M Austin declared a non-pecuniary (less than significant) interest in Item 1 of the General Manager’s Confidential report as he is an employee of Junee Railway Workshop Pty Ltd, which has a commercial relationship with Qube Logistics.

MAYORAL MINUTE

1. INLAND TOURISM AWARDS

Congratulations to the Junee Rhythm ‘n’ Rail Festival on receiving the award for the community festivals division in the Inland Tourism Awards announced in Griffith last month. Other entrants included the Regenerate Youth Festival in Wagga and the Boggabri Drivers Campfire.

This award recognises the involvement of the community and many volunteers as well as the organising committee. Rarely can a committee supply all the manpower required to organise and run such an event as this, so considerable support is required from volunteers and the community as a whole and the success of the festival must also be attributed to all those involved. The involvement of community groups and their willingness to organise and run events as part of the festival is also to be applauded. It is a massive job to co-ordinate all the activities and events being held over such a short period, and the committee and Tilma Management are to be congratulated on what has been achieved.

Congratulations must go to the author of the entry submission also. There are a significant number of quantifying details which must be supplied for the consideration of the judges. The quality of the entry must ensure that favourable consideration is given to the festival as a contender for the award.

Once again Junee’s community spirit is to be applauded. Support of businesses and sponsors is also vital particularly if the experience for visitors to the festival is to be a memorable and very satisfying one.

Unfortunately the winner of this category of the awards does not progress to the State final.

2. RIVERINA SCHOOLBOYS FOOTBALL CARNIVAL

The 72nd annual Riverina Schoolboys Football Carnival was attended by a number of Rugby League identities from the metropolitan area however the most attention was given to Junee’s own Laurie Daley and the State of Origin shield which he kindly brought and displayed at the carnival. Many eager young footballers, not to mention their fathers, lined up to have their photo taken with Laurie and the shield and to get autographs from the former Australian captain and NSW State of Origin coach. Laurie is a terrific ambassador for Rugby League and for Junee.

Other Rugby League officials attending the carnival were Mr David Smith, CEO of the National Rugby League, Mr Terry Quinn, CEO of Country Rugby League who was accompanied by Mr Bert Lowrie, Operations Manager CRL, and the President of the Board of CRL. As well, the media liaison unit from NSWRL attended filming games, interviewing key identities and the visiting dignitaries.

This was the first visit to the carnival for David Smith, Terry Quinn and Bert Lowrie. They were all very impressed with the organisation. How the carnival ran and the number of teams it attracted as well as the wide area they came from. David Smith in particular was amazed at the size of it and the community support given to the event. He could not get over the fact that other sporting groups, with no connection to Rugby League, came and volunteered their time and manpower on the day. Likewise, the number of community organisations and many individuals who all supported the carnival with manpower. He was particularly impressed that the Junee Show Society manned the gates on the day. He also was very complimentary about the condition of the grounds, especially Laurie Daley Oval and Loftus Oval. He stated that many Sydney football fields would envy us the playing surface.

I did have the chance to speak to him briefly about assistance with the provision of infrastructure at Laurie Daley Oval in particular. However, the approach was a broad one based on Local Government’s backlog of infrastructure generally and our inability to adequately fund large sporting infrastructure projects. I plan to follow this up in the future.

3. VALE GEORG KROGH

The death of Mr Georg Krogh is indeed a loss to our community. Georg was the design engineer and supervising foremen for the Recreation Centre and always made himself available for advice for Council projects. Georg emigrated from Denmark and settled initially in Leeton before moving to Junee in the late 1980s or early 1990s. Georg put himself through adult education to become a structural engineer and worked around the Riverina on a number of projects, especially with water authorities with the construction of reservoirs. Georg had a pragmatic, no nonsense approach to design – the main thing was that it would work and do the job it was designed for.

Georg took on many local projects for residents, designing everything from garages and carports to industrial type buildings. Our condolences to his family.

4. VIETNAM VETERAN’S CEREMONY

Yesterday, the South West Slopes branch of the Vietnam Veteran’s Association remembered Long Tan Day with a commemorative ceremony at the cenotaph. The address was given by Col Pat Thorne AM. Unfortunately numbers were down on previous years as a number of veterans were in Melbourne for a special ceremony to dedicate the Vietnam Veterans Museum. Students from Junee High and Junee Public Schools attended and also marched with the veterans. One veteran had travelled from Boggabri to attend the ceremony.

GENERAL MANAGER’S REPORT

The General Manager presented a report which dealt with Items 1 to 9, and the following action was taken:

04.08.14 RESOLVED on the motion of Cr N Smith seconded Cr P Halliburton that:

1. The Council advertise the Payment of Expenses and Provision of Facilities for Mayors and Councillors Policy for 28 days.

2. A report be brought to the October 2014 meeting including any public comments on the Payment of Expenses and Provision of Facilities for Mayors and Councillors Policy.

3[DCCS] FINANCIAL ASSISTANCE GRANT

06.08.14 RESOLVED on the motion of Cr M Austin seconded Cr J Ward that:

1. The report be noted.

2. The additional amount from the Financial Assistance Grant of $33,746 be transferred to Council’s Employees Leave Entitlements Reserve.

It was MOVED by Cr N Smith seconded Cr C Randall that:

1. The Junee Brass Band be provided with a $3,000 financial contribution in 2014-15 with these funds to come from the Councillor Projects budget item.

2. The Council modify its Long Term Financial Plan, on its next review, to allow an ongoing $3,000 financial contribution to the Junee Brass Band.

An AMENDMENT was MOVED by Cr A Clinton seconded Cr P Halliburton that:

1. The Junee Brass Band be provided with a $3,000 financial contribution in 2014-15 with these funds to come from the Councillor Projects budget item.

2. The Council modify its Long Term Financial Plan, on its next review, to allow a $3,000 financial contribution to the Junee Brass Band in 2015-16 and in 2016-17.

The AMENDMENT was PUT and CARRIED.

The AMENDMENT then became the MOTION. The MOTION was then PUT and CARRIED.

5[DCCS] DONATION TO COUNTRY WOMEN’S ASSOCIATION – JUNEE BRANCH

08.08.14 RESOLVED on the motion of Cr N Smith seconded Cr C Randall that Junee Shire Council make a donation of $360.90 to the Country Women’s Association of Junee to pay the rates and charges currently outstanding on its Lorne Street assessment.

16.07.14 RESOLVED on the motion of Cr M Holmes seconded Cr N Smith that the Council:

1. Receive the independent report into a review of the Junee Junction Recreation & Aquatic Centre.

2. Implement the Recommendation Table contained in this report in accordance with the staged roll out, in particular:

• Implement promotional membership campaigns that encourage membership to the Junee Junction Recreation and Aquatic Centre via discounting to attract fortnightly direct debit for single and concession memberships.

• Allocate $7500 in the September Quarterly Budget Review towards promotional incentive packages to attract new members to the Junee Junction Recreation and Aquatic Centre.

• Allocate $10,000 in the September Quarterly Budget Review for staff training at the Junee Junction Recreation and Aquatic Centre.

3. Prepare altered fees and charges in accordance with the Recommendation Table contained in this report for the Junee Junction Recreation and Aquatic Centre and place on public exhibition for 28 days.

GENERAL MANAGER’S REPORT TO THE ORDINARY MEETING OF JUNEE SHIRE COUNCIL HELD ON 16 SEPTEMBER 2014.

1[GM] OFFICE OPERATIONS – CHRISTMAS NEW YEAR 2014/2015

It has been Council practice to close the administration offices during the Christmas/New Year period. In most years Council has ceased operations on the last working days prior to Christmas and has re-opened the offices on the first working day after New Year’s Day.

This year the various offices will be closed and open on the following dates:

• Council's office will be closed from 1.00pm on Wednesday, 24 December 2014 and will re- open at 9.00am on Monday, 5 January 2015.

• Junee Library will be closed from 1.00pm on Wednesday, 24 December 2014 and will re- open at 9.30am on Monday, 5 January 2015.

• Family Day Care Office and Community Transport Office will be closed from 1.00pm on Wednesday, 24 December 2014 and will re-open at 9.00am on Monday, 5 January 2015.

Limited services for Community Transport will be available over this period by phoning 6924 4880.

• Junee Junction Recreation and Aquatic Centre will be closed on Christmas Day and Boxing Day. It will operate public holiday hours on New Year’s Day and normal summer hours for the rest of this period.

During this period of time, some officers will be at work and Council’s emergency numbers and contact numbers will be advised in the local press for people to contact should an emergency arise. The time taken off by staff during this period is either annual leave or accrued rostered days off.

Recommendations:

That in relation to the Christmas/New Year period 2014/2015:

1. The report be noted; and

2. Suitable advertisements be placed in the local press advising the community of the office arrangements for the Christmas/New Year period.

2[DCCS] DELEGATIONS TO THE MAYOR AND GENERAL MANAGER

Section 380 of the Local Government Act 1993 requires Councils to have completed a review of its delegations within twelve months of its first term of office. The delegations outlined in this report have not changed since they were last adopted in September 2014.

Appropriate delegations of authority enable the Mayor, General Manager and Officers of Council to administer the functions of Council in an appropriate and timely manner, in accordance with those delegations and Council policies, without having to constantly refer matters to Council for decision, thus expediting the decision making process.

The Local Government Act, 1993, provides three specific areas in relation to a Council delegation of powers to the Mayor, General Manager and other bodies.

The relevant provisions are as follows:

Section 226 – What is the role of the Mayor

The role of the mayor is:

• to exercise, in cases of necessity, the policy-making functions of the governing body of the council between meetings of the council

• to exercise such other functions of the council as the council determines

• to preside at meetings of the council

• to carry out the civic and ceremonial functions of the mayoral office.

Section 335 – Functions of General Manager

(1) [General responsibilities] The general manager is generally responsible for the efficient and effective operation of the council’s organisation and for ensuring the implementation, without undue delay, of decisions of the council.

(2) [Particular functions] The general manager has the following particular functions:

• the day-to-day management of the council.

• to exercise such of the functions of the council as are delegated by the council to the General Manager

• to appoint staff in accordance with an organisation structure and resources approved by the council

• to direct and dismiss staff

• to implement the council’s equal opportunity management plan,

(3) [Further functions] The general manager has such other functions as may be conferred or imposed on the general manager by or under this or any other Act.

Section 377 – General power of the council to delegate

(1) [Non-delegable functions] A council may, by resolution, delegate to the general manager or any other person or body (not including another employee of the council) any of the functions of the council, other than the following:

• the appointment of a General Manager

• the making of a rate

• a determination under section 549 as to the levying of a rate

• the making of a charge

• the fixing of a fee

• the borrowing of money

• the voting of money for expenditure on its works, services or operations

• the compulsory acquisition, purchase, sale, exchange or surrender of any land or other property (but not including the sale of items of plant or equipment)

• the acceptance of tenders which are required under this Act to be invited by the council

• the adoption of a management plan

• the adoption of a financial statement included in an annual financial report

• a decision to classify or reclassify public land under Division 1 of Part 2 of Chapter 6

• the fixing of an amount or rate for the carrying out by the council of work on private land

• the decision to carry out work on private land for an amount that is less than the amount or rate fixed by the council for the carrying out of any such work

• the review of a determination made by the council, and not by a delegate of the council, of an application for approval or an application that may be reviewed under section 82A of the Environmental Planning and Assessment Act 1979

• the power of the council to authorise the use of reasonable force for the purpose of gaining entry to premises under section 194

• a decision under section 356 to contribute money or otherwise grant financial assistance to persons

• the power of the council under section 455 in relation to attendance at meetings

• the making of an application, or the giving of a notice to the Governor or Minister

• this power of delegation

• any function under this or any other Act that is expressly required to be exercised by resolution of the council.

Section 378 prescribes that the General Manager may delegate to another employee of the council any of his functions under section 335 or any delegated functions under section 377.

The suggested delegations for Mayor and General Manager are at the tail end of this report. The former are defined as those things the Council wants the Mayor to carry out on its behalf. The latter are defined by the things that the Council wants to keep to itself besides the mandatory exclusions.

Also set out below is a very specific delegation that was first made to the Rural Fire Service in February 2005 and re-confirmed in September 2009. This delegation should also be re-confirmed again at this meeting.

These delegations will also be used as the basis for the General Manager to revise the sub- delegations of specific functions to Department Managers and other Council Officers.

MAYOR

(A) That the Mayor of the Junee Shire Council be delegated authority under Section 377 of the Local Government Act, 1993, to exercise and/or perform on behalf of the Council the powers, authorities, duties and functions as prescribed for the position of Mayor under the Local Government Act, 1993, Schedules, Regulations, Cognate Legislation and Related Legislation and generally as listed in the Register of Delegations attached hereto, provided that such delegations are not to be sub-delegated without specific approval by Council or as prescribed under the Local Government Act, 1993.

(B) If, under any other Act, a function is conferred or imposed on the Mayor of Junee Shire Council, the function is taken to be conferred or imposed on the Council and the Mayor of the Council will exercise and or perform on behalf of the Council the powers, authorities, duties and functions as prescribed under that other Act, pursuant to Section 381 of the Local Government Act, 1993.

REGISTER OF DELEGATIONS TO MAYOR

(1) Conferring Powers or Duties To give effect to the provisions of the Local Government Act, 1993, and any other Act conferring powers or duties upon the Mayor; and to any resolution of direction given to the Mayor by the Council.

(2) Direct General Manager - Implementation of Council Policies To direct the General Manager, where necessary, in the interpretation and implementation of each and every policy of the Council which is current and has been adopted by the Council. (3) Preside at Meetings of Council and Civic Functions a) Preside at all meetings of the Council, Committees, Working Parties, Community Committees and Public Meetings convened by the Council at which the Mayor is present, unless the Committee or working party has a composition and chairperson decided by Council or unless the Mayor otherwise appoints another Councillor or person to perform this function;

b) approve and tender Civic Receptions where the Mayor considers it appropriate and the period for arranging the reception does not permit time for a decision to be made by the Council;

c) perform naturalisation ceremonies and present Certificates of Australian Citizenship as provided by the relevant Act.

(4) Negotiations on behalf of Council With the consent of Council to participate in negotiations on behalf of the Council with third parties and in connection with the sale, purchase and lease of land and buildings, in conjunction with the General Manager.

(5) Code of Conduct To give direction to the Council, following consultation with the General Manager, in the application of the Code of Conduct as adopted by the Council.

(6) Council Objectives and Strategies To give direction, in conjunction with the General Manager, to the Council in the pursuit of the objectives and strategies contained with the Junee Shire Council Delivery Program.

(7) Represent Council - Government and Other forums a) To represent the Council, in conjunction with the General Manager, in deputations to government, inquiries and other forums where it is appropriate that the Mayor should present the Council's position;

b) attend to Council business as considered necessary by the Mayor both within and outside of the Shire boundaries with reasonable expenses to be reimbursed by the Council in accordance with Council policy.

(8) Sign and Execute Documents With the consent of Council to sign and execute documents under the Seal of the Council in conjunction with at least one other Councillor, or the General Manager, or an Officer authorised by delegation of the General Manager.

(9) Media Releases To made Media Statements and issue Press Releases in respect of Council resolutions and policy decisions and matters of a day to day public interest nature and to respond to enquiries from the media on matters relating to the affairs of the Council and Junee Shire generally.

(10) General Manager's Adminstrative Matters a) On behalf of Council supervise the General Manager in terms of the Local Government Act 1993 and the General Manager’s Contract of Employment with Council:

(11) Conferences and Seminars for Elected Members a) Such delegation shall not be exercised if there is a prior council meeting at which the attendance might be considered allowing sufficient time for registration, arrangements, etc;

b) provision has been made for such expenditure in the Council’s budget.

GENERAL MANAGER

(B) If, under any other Act, a function is conferred or imposed on the General Manager of the Junee Shire Council, the function is taken to be conferred or imposed on the Council and the General Manager of the Council will exercise and/or perform on behalf of the Council the powers, authorities, duties and functions as prescribed under that other Act, pursuant to Section 381 of the Local Government Act, 1993.

(C) The Council specifically notes that the following functions stemming from the Environmental Planning and Assessment Act 1979, together with associated Regulations, and the Local government Act 1993 together with associated Regulations are excluded from the delegation. ie. the following development consent matters must be determined by the Council:

• DAs proposed for refusal.

• DAs with one or more objections or a petition.

• DAs with a proposed development value of more than $500 000 excluding single or dual occupancy developments. • Subdivision applications involving the creation of more than four allotments.

• DAs for all licensed premises under the Liquor Act 2007.

• DAs, which in the opinion of the General Manager should be brought to the attention of the Councillors, notwithstanding whether any objections have been lodged.

(D) The pricing of all Council property sales shall be a matter for Council resolution as to price or to an authority for negotiation.

NSW RURAL FIRE SERVICE — DELEGATIONS

I, James Davis, General Manager of Junee Shire Council by this my instrument made pursuant to Sections 378/380 of the Local Government Act 1993(as amended), until otherwise amended or revoked, hereby sub-delegate to Roger Orr, Zone Manager Riverina Zone of the Rural Fire Service, and to any person holding the aforementioned position in an acting capacity, power and authority, subject to compliance with office I or accounting procedure, Council safe working procedure, any policy, regulation or resolution of Council, or directive of an authorised officer of the Council and also subject to the terms and conditions of the Service Agreement or Service Level Agreement entered into by council and the New South Wales Rural Sire Service. a) to carry out the regular rural fire protection services and operations of the Council within the sums voted by Council for expenditure within the NSW Rural Fire Service’s area of responsibility; and b) to act as an authorised person within the meaning of the Local Government, Act 1993; and

All or any of these delegations may be sub-delegated by the said Roger Orr to any authorised employee of the NSW Rural Fire Service. k) all prior delegations are hereby revoked.

3[DCCS] FINANCIAL REPORTS TO 30 JUNE 2014

The Annual Financial Reports to 30 June 2014 are currently being finalised to be ready for audit at the end of September 2014. Council’s auditor Auswild & Co has joined forces with Crowe Horwath in the last twelve months. So Council staff are working with a new audit team that come from the Crowe Horwath office in . They require a lot more background material because this is there first audit of Junee Shire Council.

At this stage it’s too early to comment on the Financial Reports with figures expected to be finalised just prior to the auditors visit.

Presentation of Financial Reports

A detailed analysis and interpretation of the key results will be presented to Council at the November 2014 meeting once audit is complete. A complete set of General Purpose Financial Reports, Special Purpose Financial Reports and Special Schedules will be attached to the business paper for this meeting.

Certification by Council

Section 413 of the Local Government Act 1993 and the Code of Accounting Practice and Financial Reporting requires the Council to make the following Statements.

At Council’s meeting held 18 March 2014, the arrears at 10 March 2014 were reported as $694,075.78. Councillors will note that it has decreased significantly from that time to $469,281.31 at 30 June 2014. Staff attribute this to the increased debt recovery action that has taken place over the last five months.

As has been the case for a number of years now, Residential Rates in Junee are by far the sector most in arrears but not the highest proportion. Business – Rural has the highest proportion at 18.79%. Farmland ratepayers that represent 50% of the rates levied each year are excellent in paying their rates on time.

For the 2014-15 year, a total of 2,980 Rate Notices were posted in late July. Of this 440 (15%)paid in full, 1790 (60%) paid the first Instalment and 750 (25%) were unpaid. Reminder notices are going out to the 750 unpaid this week.

6[DES] GRAIN HARVEST MANAGEMENT SCHEME

As Councillors would be aware the Grain Harvest Management Scheme was approved for the harvest season 2013/14 with Transport for NSW reporting back to Council on the success or otherwise of the scheme to enable Council to decide to approve the scheme for the 2014/15 harvest and onwards.

To remind Councillors, the basis of the scheme was to allow farmers a 5% tolerance on their legal load to enable them to more closely load their truck to capacity without suffering financial penalty if they were up to 5% overloaded. A warning would be given to a farmer/truck driver that they were within the 5% limit. If they were between the 5% and 10% overloaded they would be given three warnings and then put out of the scheme as well as donating their excess weight above 5% to charity.

Council has not received any of the promised information from the Transport for NSW, nor have we received an application for the program to be extended into the future. The anecdotal evidence from conversations with farmers/truck drivers, appears as though the scheme was successful in providing more efficient road haulage of the grain to the delivery point. Council did not notice any increased road maintenance issues over the harvest period, having said that, it was a reasonably dry harvest period.

Staff feel that if the scheme is re-applied for, Council should approve it. The concern is that the application will be left to the last minute, as was the case last year, which gave Council very little time for due consideration of the scheme.

Recommendation:

That if Transport for NSW apply for a continuation of the Grain Harvest Management Scheme for the 2014/15 harvest, that it be approved.

Minutes of the Junee Junction Recreation & Aquatic Centre Section 355 Committee Meeting held Wednesday, 10 September 2014 at the Junee Shire Council Chambers

The meeting commenced at 4.05pm.

1. Confirmation of Minutes

It was resolved on the motion of John Whitfield and Marg Chisholm that the Minutes of the meeting, held 14 May 2014, be confirmed.

2. Matters arising out of the minutes

The first ClubGRANT application for work at the Centre was unsuccessful but expressions of interest for a new round of ClubGRANTS have just been released. Council is now working on a new application for this grant.

3. Financial Result for year ended 30 June 2014

It was resolved on the motion of James Davis and John Whitfield that the report be received and noted.

4. New Membership Offer

New membership offers and fee structure for the Centre are planned. An information night is to be held on Thursday, 25 September 2014 for existing members, to explain the changes. An advertising campaign is planned to advise the community of new offers at the Centre.

5. Recreation Centre Manager

The recruitment for a new manager for the Centre with advertising for the position is proposed towards the end of September, 2014.

6. General Business

Council is in the process of developing new web pages, one of which will be for the Recreation Centre.

• The Riverina Regional Red Guide Post scheme is underway, with posts provided and the promotional component to start later in the year. Red metal guide posts will be sited at significant weed infestations on major roads to alert operational staff and travelling public to their existence. It is aimed at increasing awareness and reducing spread by mechanical means. • I have completed the DPI vertebrate pest management course. Operations in this area, plans, bait, trap and firearms are included in insurance coverage. Rabbits and foxes in the urban setting are becoming a common problem. • The Riverina noxious Weeds Project Officer and I are part of the WAP 2 state planning group, meeting again in June. • As yet contact with LLS management is limited at both regional and local levels. • I met with and presented to the Weeds Enquiry panel three times on regional and local issues. • I participated in 2 tele conferences with LGA staff regarding Weeds Enquiry responses • RENWA submitted a response to the Weeds enquiry recommendations

4. Rail Corridor

Ongoing issues with John Holland Rail’s management of its rail corridors are being addressed. Meeting scheduled in coming weeks with John Holland Rail (JHR) in an attempt to obtain written commitment. If response not received, matter will be pursued through ROCs as all Shires are experiencing the same response from JHR.

5. General Business

Future planning

Regardless of all these factors, DPI is proceeding to develop the WAP 2 as a 5 year plan very similar to the original. ie- 5 year plan, regionally based, project officer managed, local Government delivered and based around the same funding model. However funding between Regions will most likely be competitive. WAP currently encourages an investment in weed management of approximately $35 to $1 of State funds overall.

• Delegated Authorities for Weeds Officers The DPI has released standardised documentation for these delegations under the Noxious Weeds Act.

It is recommended that LCA’s re-issue delegations using the standardised documentation.

• Community Based Social Marketing (CBSM) I attended a DPI funded CBSM workshop in Sydney in April. The CBSM concept revolves around knowing exactly what behavioural change is sought in the targeted group and using specific techniques to achieve results. It requires time, planning and is best developed using pilot studies to prove strategies. DPI is investigating how it can best be used in the invasive species area where community involvement can help offset a lack of funding.

• Biosecurity Information System (BIS)

DPI is managing a state funded project to build and test an electronic recording and reporting system for all biosecurity events and issues. It is envisaged to be multi levelled from basic field mapping to use in biosecurity emergency events. It will provide a state standard of data

Bio Security legislation, required to be before cabinet by December 14. Date to be enacted and operational unknown, the bible for all matters relating to biosecurity in the future. It is essential for this legislation to be in place and functional if major change is to take place. Invasive Species Plan review- regarded as a successful document, pivotal to future planning in NSW review under way to be put in place for the 2015- 2020 periods. Review completion date unknown.

Gaylene spoke about the Kangaroo March meeting and told us that she is taking orders for the commemorative tins that she and The Chocolate Factory are doing.

There was one new claim for the month of August 2014.

3[LOIC] LIBRARY

The library held Soup ‘n’ Squares on Friday, 1 August 2014. This event was aided by Kim Richards who made all the soups and provided much of the equipment. A group of around 10 women participated in this activity involving knitting and sewing squares for the Wrap with Love charity. Over 1200 squares were collected at the library this year.

Elyne Mitchell Display 4-14 August. The Junee High School and the Public School both attended the library to visit the Elyne Mitchell display and were provided with student worksheets created by Kim Richards. The travelling display was bolstered by some other fun hands-on activities. The exhibition was also warmly received by the general public who often had a story to tell about their experience with the book or the author.

Children’s Storytime presentations. Children’s Council of Australia (CBC) Book Week 16-22 August was celebrated with a one hour visit from GoodStart Learning. A group of 20 children and adults were presented with this year’s nominated book Silver Buttons and were supplied with a related craft activity. Kim Richards presented this activity on Thursday, 21 August. Goodstart Learning returned the following week for another presentation by Kim and will continue to visit once a week for the remainder of the term.

Storytime on Tuesday’s was presented by Linda Dyer (5 August), Kim Richards (12 & 26 August) and Margaret Kanaley (19 August).

Meetings, training and other activities:

• Senior internet training with Duke of Edinburgh volunteer Stuart Darling every Friday afternoon at 4:30pm.

• Sureway Employment and Training used the conference room twice this month. Sureway will be reducing their visits to once a fortnight as their need has dropped.

• Kim Richards refreshed The Pink Tubs ‘waiting room libraries’ service to the Junee Medical Centre, Junee Hospital, Junee Recreational Centre and Commins Hendriks Solicitors.

State Road 78 and State Road 57 Goldfields Way

These two roads have had minor work carried out including guide posts and pothole maintenance. A drainage line has been laid on the down-hill lane where it has been widened. This widening has had a drainage mattress of ag pipe, geotextile fabric and 100mm to 125mm blue metal rock placed to allow ground water to filter through. The next layer placed is 150mm of select gravel from our Summer Hill gravel pit. The Roads & Maritime Services will then test this layer before it is covered with 150mm of densely graded sub-grade material from West Wyalong.

Rural Sealed Roads

A section of Combaning Road, one kilometre north of Clear Hills Lane, has been ripped up and reformed. New roadbase has been added and two new sets of stormwater pipes placed.

The maintenance grader has been shouldering McGledes Hill, Wantiool and Clear Hills Roads.

Rural Roads Unsealed

Summer Hill, Mees Lane, Oades Lane and Burnt Creek Lane have been maintenance graded.

Junee Township

Some minor heavy patches were dug out near the gutters in Dalley Street and George Street.

The playground equipment from Percy Street Rotary Park has now been relocated to front Hammond Street with new bark added.

5[DES] SEWERAGE SYSTEM

Over the Month of August, there were seven chokes in the services and three chokes in the mains. One damaged service at 18 Beach Street was dug up and repaired.

Inflow to the treatment plant totalled 33ML with 5 ML being reused. The treatment plants are producing good effluent.

Junee Transfer Station

The Junee Transfer Station is functioning well with no issues or incidents at the site.

The rural transfer stations were inspected on 11 September 2014. All were found to be in an excellent condition with only a minor amount of rubbish on the ground at .

7[DES] STATE HIGHWAY MAINTENANCE CONTRACT

Routine maintenance has been carried out on SR57 and SR78. MR78 Bethungra Hill job is still in progress. Heavy patching has been completed on MR57 and MR78.

8[EO] NOXIOUS WEEDS

• Mapping of the three Shires continued. The dry conditions are exemplified by the dying off of Oxalis and the premature heading of Barley Grass along the roads.

• The long awaited spraying of Coolatai Grass by John Holland Rail contractors has finally occurred along the rail line between Old Junee and Marrar. While the operation was thorough, collateral damage has occurred on native grasses. This issue will be enquired into as the natives provide significant competition against Coolatai Grass.

• Chris Slinger spoke at an Ag n Chat session in the affected areas highlighting the need for locals to be able to identify the weed. Other planned activities are including the weed in our regular stands at local agricultural shows, Henty Field Days and static displays in the area.

• Chris Slinger attended the Show on the 23 August, 2014 with a display of live weeds, posters and pamphlets including Coolatai Grass and Prairie Ground Cherry which are both deemed to be low on the community identification scale.

Take Charge Youth Forum

The REROC Youth Forum was held on Friday, 29 August 2014 with six students attending from Junee High School ranging from years 8-10. Unfortunately, the Community Development Officer (CDO) was unable to attend. Below is the report from Junee High School teacher Mrs Anne Higginson, who attended on the day.

“All students that attended felt the procedure of the day was good; talk, workshop, activity/food, as it had variety. The set up was good too with the three different colour groups for the workshops and two groups for the hula hooping. This meant in the workshops you met new people. The different workshops were informative and you learnt what has happened to some people during their lives and how to go about getting help and volunteering your time too in various ways.

The age difference in the speakers was a good thing and all were impressed by the 12 year old girl, Eva Cohan, and the procedure she went through to have the inventor of the black box recognised and then have part of Canberra airport named after him.

The hula hooping was a good active activity which the girls enjoyed and did well at but the boys found it less interesting as they were not quite as competent. It was a good ice breaker and kept them moving.

Page 7 of 10 Students were pleased with the useful bag of goodies they were given and a positive feature was the food. A good day is always based on the food when it comes to kids! There was a huge range of food supplied and it was amazing, plentiful, yummy and good.”

School Holidays

The program for the school holidays is as follows:

The activities will be advertised in school newsletters, at Council as well as in the Junee Southern Cross.

Community Builders Funding

The CDO will attend a Service Provider forum which is being conducted by FaCS Murrumbidgee District, Sector Development and Performance team. The purpose of the forum is to discuss the new Contract Governance framework that affects our funding as well as the “Going Home, Staying Home” reform (GHSH). This forum will take place on Tuesday, 23 September in Wagga. The CDO will report on the outcome of this forum in next month’s report.

National Tree Day

As reported in previous months report, the CDO sent out letters inviting the schools in the shire to participate in National Tree Day by planting trees provided by Council. This has been an annual

Page 8 of 10 program run by Council for many years and this year is the final year that it will run due to budgetary restraints. Junee High School was the only school to apply and was awarded the whole amount to plant trees at the school. Mr Terry Vercoe (Principal, Junee High School) liaised with Gary Hobson to discuss appropriate trees and planting requirements. The school now has several new trees to complement their beautification work on the exterior of the building.

Seniors Week 2015

The CDO is currently preparing an application for a Seniors Week 2015 grant to conduct our Seniors Week activities. Every year, the Department of Family and Community Services (FACS) provides funding for local government and community organisations to participate in NSW Seniors Week. Council should be advised of the outcome prior to the end of 2014.

Warren Family Trust

The recipient of the Ray Warren Family Trust is Jasmine Phillips. Jasmine is a Junee High School student and is a competitive swimmer representing both Junee Swimming Club and Junee High School both at a local and state level. It is her goal to represent Junee and State at a national level. A cheque handover will take place on Monday, 15 September and will be reported on by the Junee Southern Cross.

Newsletter CD for the Visually Impaired

The CDO has been liaising with Edmund Baker who narrates, among other things, Council newsletters and records them onto a CD. Many Councils utilise this service to provide their newsletter to visually impaired residents. Junee Shire Council has recently come on board with this project and will have our quarterly newsletter available in an mp3 version for the website as well as a copy for the library. A media launch will be held for this in the coming months and invites will be forwarded for those interested in attending. More information to follow.
