Proposed oyster lease AL09/008 applies to an area of water which is not in a priority oyster aquaculture area (Non- POAA) under the NSW Oyster Industry Sustainable Aquaculture Strategy (OISAS). As such, the successful tenderer(s) of this lease will be required to obtain development consent from Council under Part 4 of the Environmental Planning and Assessment Act 1979. An approved GIS survey is not available for proposed leases AL10/006 and AL09/008. The successful tenderer(s) will be required to obtain an approved survey, to be completed by a registered surveyor at the expense of the successful tenderer(s). SCHEDULE Explanatory Note: This notice replaces the Grain Auger Combination Exemption Notice 2007, that was published in the Government Gazette No.95 of 27 July 2007 at pages 5136 to 5139, and subsequently amended from time to time.

PART 1 – PRELIMINARY 1.1 Citation This Notice may be cited as the Class 1 Grain Auger Combination Exemption Notice 2010. 1.2 Commencement This Notice takes effect on 1 October 2010. 1.3 Effect This Notice continues to have effect up to and including 30 September 2015 unless it is amended or repealed earlier. 1.4 Interpretation 1.4.1 Unless stated otherwise on Part 5 of this Notice, the words and expressions used in this Notice have the same meaning as those defi ned in the Road Transport (General) Act 2005. 1.4.2 Except where a contrary intention is indicated, the index and notes in the text of this Notice do not form part of this Notice.

PART 2 – APPLICATION, 2.1 Application 2.1.1 This Notice applies to a grain auger trailer in combination with a towing motor vehicle where a dimension for the trailer or the combination exceeds a dimension limit specifi ed in clauses 71, 74 (1) (d), 75 (4) and 76 (2) of Schedule 2 to the Road Transport (Vehicle Registration) Regulation 2007, or the dimension limits specifi ed in Schedule 1 and clause 24 of Schedule 2 to the Road Transport (Mass, Loading and Access) Regulation 2005, but does not exceed a dimension specifi ed in Diagram 1 and Table 1 to this Notice. Note: Where dimensions in this Notice are exceeded, an application for a specifi c permit must be sent to the Roads and Traffi c Authority’s Special Permits Unit for assessment.

PART 3 - OPERATING AND TRAVEL CONDITIONS 3.1 Operating Conditions 3.1.1 A copy of this Notice and a copy of the General Class 1 Oversize (Agricultural Vehicle) Notice 2007 must be carried in the driving compartment whenever operating as a grain auger combination and must be produced in response to a request by a police offi cer or an authorised offi cer. 3.1.2 This Notice applies provided that a vehicle, of the kind described in 2.1.1, is operated in accordance with the relevant provisions of the General Class 1 Oversize (Agricultural Vehicle) Notice 2007. 3.1.3 Unless a contrary intention is stated by this Notice, a vehicle operating under this Notice must comply with the statutory requirements of the road transport legislation as defi ned by Section 5 of the Road Transport (General) Act 2005. 3.2 Travel Conditions 3.2.1 Vehicles operating under this Notice may operate in the Metropolitan, Eastern and Western Zones, as defi ned in Part 6 of Class 1 Oversize (Agricultural Vehicle) Notice 2007, subject to: (a) The dimension limits applicable to each zone as set out in Part 4 of this Notice; and (b) The pilot vehicle requirements as set out in Part 4 of this Notice; and (c) The travel restrictions imposed as set out in Parts 6 and 7 of the General Class 1 Oversize (Agricultural Vehicle) Notice 2007. PART 4 SPECIAL CONDITIONS 4.1 Dimensions Limits 4.1.1 A vehicle operating under this Notice must not exceed the dimension limits as set out in Table 1, subject to Clause 4.1.2 of this Notice.

4.1.2 The auger’s rear overhang (dimension A) must be the lesser of: (a) The dimension limit set out in Table 1, and (b) 53 percent of the auger’s overall length (dimension B in Diagram 1).

4.2 Pilot Vehicle Requirements 4.2.1 Metropolitan Zones When a vehicle, to which this Notice applies, is operating in a Metropolitan Zone and the distance of dimension A exceeds 5.5 metres, it must be accompanied by at least one pilot vehicle. 4.2.2 Eastern Zone When a vehicle, to which this Notice applies, is operating in the Eastern Zone, and: (a) the distance of dimension A exceeds 7.0 metres; or (b) the distance of dimension F exceeds 3.0 metres it must be accompanied by at least once pilot vehicle. 4.2.3 Western Zone When a vehicle to which this Notice applies, is operating in the Western Zone, and the distance of dimension A exceeds 9.0 metres, it must be accompanied by at least one pilot vehicle.

4.2.4 Critical Locations A vehicle to which this Notice applies, must not travel through a critical location, as set out in Part 7 of the General Class 1 Oversize (Agricultural Vehicle) Notice 2007, unless the NSW Police have been contacted and advised that the vehicle may: (a) travel through the critical location; or (b) travel through the critical location and must be accompanied by a Police escort. PART 5 GLOSSARY OF TERMS In this Notice dimension: A means the rear overhang of the grain auger as defi ned in the Road Transport (Vehicle Registration) Regulation 2007. B means the length of the grain auger. C means the overall length of the grain auger in combination with the towing motor vehicle. D means the height of the grain auger. E means the width of the grain auger's tube. F means the maximum width of the combination.
