Egwyddor bwysig ar gyfer ein gwaith yw ceisio cael gwell cydbwysedd democrataidd o fewn pob cyngor fel bod pob pleidlais sy’n cael ei bwrw mewn etholiad, hyd y mae’n ymarferol rhesymol, yn cario’r un pwysau â phob un arall yn ardal y cyngor. Byddai cyflawni’r nod hwn, ynghyd â mesurau eraill, yn sicrhau llywodraeth leol effeithlon a chyfleus. Ar ddechrau proses yr arolwg, gwelwyd rhai gwahaniaethau sylweddol rhwng y nifer o bleidleiswyr i gynghorwyr nid yn unig rhwng cynghorau yng Nghymru ond hefyd o fewn ardaloedd cynghorau eu hunain. Cyfyngir y Comisiwn gan nifer o bethau yn y modd y gall gyflawni ei waith: • “Blociau adeiladu” sylfaenol rhanbarthau etholiadol yw’r cymunedau o fewn Cymru. Sefydlwyd y cymunedau hyn dros 30 mlynedd yn ôl ac er waetha’r gwaith a wnaed yn barod gan rai awdurdodau lleol a hefyd gennym ni, mae nifer o fannau o hyd lle nad yw’r cymunedau’n adlewyrchu patrwm presennol bywyd y cymunedau. • Mae cywirdeb y wybodaeth am nifer y trigolion ym mhob cyngor ymhen 5 mlynedd, yn her i bawb - mae’n anodd rhagfynegi’r dyfodol. Felly, mae’r Comisiwn wedi mabwysiadu ymagwedd gofalus wrth ddefnyddio’r rhagfynegiadau hyn. • Mae’r rheolau cyfreithiol y mae’n rhaid i ni weithredu o’u mewn hefyd yn gymharol gaeth ac eto’n gosod cyfyngiadau ar yr hyn y gallwn ni ei wneud ym mhob rhanbarth etholiadol. Mae’r adroddiad hwn yn cyflwyno ein hargymhellion cyntaf ar yr hyn sydd angen ei wneud o fewn ardal y cyngor hwn. Ein nod yw ceisio cael gwell cydbwysedd democrataidd ynghyd â threfniadau etholiadol sy’n cyfrannu at gael llywodraeth leol effeithlon a chyfleus ble bynnag rydych chi’n byw yng Nghymru. CYFLWYNIAD 1.1 Rydyn ni, aelodau Comisiwn Ffiniau Llywodraeth Leol i Gymru, wedi cwblhau cam cyntaf yr arolwg o’r trefniadau etholiadol ar gyfer Bwrdeistref Sirol Wrecsam ac yn cyflwyno ein Cynigion Drafft ar gyfer trefniadau etholiadol y dyfodol. Gwelir geirfa o dermau a ddefnyddiwyd yn yr adroddiad hwn yn Atodiad 1. Ar hyn o bryd, mae 100,941 o etholwyr ym Mwrdeistref Sirol Wrecsam. Mae’r rhain wedi’u rhannu yn 47 rhanbarth ar hyn o bryd (5 yn aml-aelod a 42 ag un aelod) gyda chyfanswm o 52 cynghorydd. Cymhareb gyffredinol aelodau i etholwyr yn y Fwrdeistref Sirol ar hyn o bryd yw 1:1,941. Gwelir y trefniadau etholiadol manwl presennol yn Atodiad 2. 2. CRYNODEB O’R CYNIGION 2.1 Cynigiwn y dylid newid y trefniadau ar gyfer y rhanbarthau etholiadol er mwyn sicrhau gwelliant sylweddol yn lefel y cydraddoldeb etholiadol ar draws Bwrdeistref Sirol Wrecsam a chynnal maint presennol y cyngor o 52 aelod etholedig. O’r rhanbarthau etholiadol arfaethedig, mae 13 yn rhanbarthau aml-aelod a 26 yn rhanbarthau etholiadol ag un aelod. 3. CWMPAS A PHWRPAS YR AROLWG 3.1 Mae Adran 57 Deddf Llywodraeth Leol 1972 (Deddf 1972) yn mynnu bod y Comisiwn bob 10 mlynedd o leiaf ac yn sicr o fewn pymtheg mlynedd, yn cynnal arolwg o’r trefniadau etholiadol ym mhob prif ardal yng Nghymru er mwyn ystyried a ddylid cyflwyno cynigion i Lywodraeth Cynulliad Cymru ai peidio ar gyfer newid yn y trefniadau etholiadol hynny. 3.2 Mae Gweinidog Cyfiawnder Cymdeithasol a Llywodraeth Leol Llywodraeth Cynulliad Cymru wedi cyfarwyddo’r Comisiwn i gyflwyno adroddiad am yr arolwg o drefniadau etholiadol Bwrdeistref Sirol Wrecsam erbyn 31 Mehefin 2011. Trefniadau Etholiadol 3.3 Diffinnir “trefniadau etholiadol” prif ardal yn adran 78 Deddf 1972 fel: i) cyfanswm y nifer o gynghorwyr i’w hethol i’r cyngor; ii) nifer a ffiniau rhanbarthau etholiadol; iii) nifer y cynghorwyr i’w hethol ar gyfer pob rhanbarth etholiadol; ac iv) enw unrhyw ranbarth etholiadol. - 1 - Rheolau i’w Dilyn wrth Ystyried Trefniadau Etholiadol 3.4 Disgwylir i ni gydymffurfio ag adran 78, hyd y mae’n rhesymol ymarferol, gyda’r rheolau a welir yn Nhrefnlen 11 Deddf 1972 (yn unol â gwelliant Deddf 1994). Mae’r rhain yn mynnu bod y Comisiwn yn sicrhau bod un aelod ar gyfer pob rhanbarth etholiadol. Fodd bynnag, gall y Gweinidog ddweud wrth y Comisiwn am ystyried dymunoldeb cael mwy nag un aelod mewn rhanbarth etholiadol ar gyfer prif ardal gyfan neu ran ohoni. 3.5 Mae’r rheolau hefyd yn mynnu: Y dylid ystyried unrhyw newid yn nifer neu ddosbarthiad etholwyr llywodraeth leol y brif ardal sy’n debygol o ddigwydd o fewn y cyfnod o bum mlynedd yn union ar ôl ystyried y trefniadau etholiadol: i) yn amodol ar baragraff (ii), bydd nifer etholwyr llywodraeth leol, mor agos ag y gall fod, yr un peth ym mhob rhanbarth etholiadol yn y brif ardal; ii) pan fydd un neu fwy nag un rhanbarth aml-aelod, bydd cymhareb y nifer o etholwyr llywodraeth leol i’r nifer o gynghorwyr i’w hethol, mor agos ag sy’n bosibl, yr un peth ym mhob rhanbarth etholiadol yn y brif ardal (gan gynnwys unrhyw un nad yw’n rhanbarth aml-aelod); iii) bydd pob ward cymuned sydd â chyngor cymuned (un ai ar wahân neu’n gyffredin) yn gyfan gwbl o fewn un rhanbarth etholiadol; a iv) bydd pob cymuned nad sydd wedi’i rhannu yn wardiau cymuned, yn gyfan gwbl o fewn rhanbarth etholiadol sengl. Wrth ystyried y trefniadau etholiadol, rhaid i ni ystyried (a) dymunoldeb gosod ffiniau sydd ac a fydd yn parhau i gael eu hadnabod a (b) unrhyw gysylltiadau lleol a fyddai wedi cael eu torri wrth osod unrhyw ffin arbennig. Cyfarwyddiadau’r Gweinidog 3.6 Mae’r Gweinidog wedi dweud bod yn rhaid i’r Comisiwn ystyried dymunoldeb rhanbarthau etholiadol aml-aelod ym mhob cyngor sir a chyngor bwrdeistref sirol yng Nghymru. 3.7 Hefyd, mae’r Gweinidog wedi rhoi’r cyfarwyddiadau canlynol i’r Comisiwn i’w arwain i gynnal yr arolwg hwn: (a) ystyrir bod angen lleiafrif o 30 cynghorydd ar gyfer rheoli materion y cyngor sir neu’r cyngor bwrdeistref sirol yn gywir; (b) ystyrir bod angen mwyafrif o 75 cynghorydd fel arfer i leihau’r risg y bydd cyngor sir neu gyngor bwrdeistref sirol yn drwsgl ac anodd ei drin, er mwyn rheoli materion y cyngor sir neu’r cyngor bwrdeistref \ sirol yn gywir; - 2 - (c) ystyrir mai’r nod ddylai fod cael rhanbarthau etholiadol gyda chymhareb cynghorydd i etholwyr ddim is na 1:1,750; (d) ystyrir y dylai penderfyniadau i newid y patrwm presennol o ranbarthau etholiadol aml-aelod a rhai ag un aelod, gael eu gwneud lle mae cynigion o’r fath ar gyfer newid yn cael eu cefnogi’n gyffredinol gan yr etholwyr. Bydd hyn wrth gwrs pan fydd hi’n bosibl cael eu barn i gyflawni gofyn yr ymgynghoriad yn Adran 60 y Ddeddf: ac (e) ystyrir y bydd y Comisiwn, wrth gynnal arolygon yn unol â Rhan 4 y Ddeddf, yn cydymffurfio a pharagraff 1A Trefnlen 11 y Ddeddf, hynny yw, y Rheolau. Mae testun llawn y Cyfarwyddiadau yn Atodiad 4. Eglurwyd y Cyfarwyddiadau ymhellach mewn llythyr gan y Gweinidog ar 12 Mai 2009. Mae copi o’r llythyr hwn yn dilyn y Cyfarwyddiadau yn Atodiad 4. Newidiadau i Lywodraeth Leol 3.8 Ers yr Arolwg diwethaf ar drefniadau etholiadol, gwelwyd un newid i ffiniau llywodraeth leol yn Wrecsam: • Gorchymyn Wrecsam (Cymunedau) 2009 Rhif 2718 (W.230) 2009. Roedd y gorchymyn hwn yn gwneud newidiadau i ffiniau cymunedau Abenbury, Acton, Brychdyn, Brymbo, Parc Caia, Coedpoeth, Gresffordd, Gwersyllt, Yr Holt, Is-y-coed, Marchwiail, Y Mwynglawdd a Sesswick. Gweithdrefn 3.9 Mae Adran 60 Deddf 1972 yn gosod canllawiau gweithdrefnol i’w dilyn wrth gynnal arolwg. Wrth gydymffurfio ag Adran 60 Deddf 1972, ar 18 Chwefror 2010 ysgrifennwyd at Gyngor Bwrdeistref Sirol Wrecsam, yr holl gynghorau cymuned yn yr ardal, Aelodau Seneddol yr etholaethau lleol, Aelodau Cynulliad yr ardal a phobl eraill sydd â diddordeb i’w hysbysu o’n bwriad i gynnal yr arolwg ac i ofyn am eu barn ragbaratoawl. Gwahoddwyd y Cyngor Bwrdeistref Sirol i gyflwyno cynllun neu gynlluniau a baratowyd ar gyfer trefniadau etholiadol newydd. Roedden ni hefyd yn cyhoeddi ein bwriad i gynnal yr arolwg mewn papurau lleol sy’n cael eu dosbarthu yn y Fwrdeistref Sirol a gofynnwyd i Gyngor Bwrdeistref Sirol Wrecsam arddangos nifer o hysbysiadau cyhoeddus yn eu hardal. Hefyd, roedden ni’n sicrhau bod copïau o’n llyfryn canllawiau arolygon etholiadol ar gael. Yn ogystal â hyn i gyd, roedden ni’n gwneud cyflwyniad i gynghorwyr Bwrdeistref Sirol a Chymuned yn egluro proses yr arolwg. 4.
