Manyin Specialist in Asian Affairs Foreign Affairs, Defense, and Trade Division U.S.-Vietnam Relations: Background and Issues for Congress Summary After communist North Vietnam’s victory over U.S.-backed South Vietnam in 1975, U.S.-Vietnam relations remained essentially frozen until the mid-1990s. Since then, bilateral ties have expanded remarkably, to the point where the relationship has been virtually normalized. Indeed, since 2002, overlapping strategic and economic interests have compelled the United States and Vietnam to improve relations across a wide spectrum of issues. Congress played a significant role in the normalization process and continues to influence the state of bilateral relations. Voices favoring improved relations have included those reflecting U.S. business interests in Vietnam’s reforming economy and U.S. strategic interests in expanding cooperation with a populous country — Vietnam has over 85 million people — that has an ambivalent relationship with China. Others argue that improvements in bilateral relations should be conditioned upon Vietnam’s authoritarian government improving its record on human rights. The population of over 1 million Vietnamese Americans, as well as legacies of the Vietnam War, also drive continued U.S. interest. Economic ties are the most mature aspect of the bilateral relationship. The United States is Vietnam’s largest export market. The final step toward full economic normalization was accomplished in December 2006, when Congress passed and President Bush signed H.R. 6111 (P.L. 109-432), extending permanent normal trade relations (PNTR) status to Vietnam. For years, the United States has supported Vietnam’s market-oriented economic reforms, which many credit with Vietnam’s extraordinary economic performance; from 1987-2007, annual gross domestic product (GDP) growth has averaged over 7%. Since the early 1990s, poverty levels have been halved, to less than 30%. In 2008, the two countries launched bilateral investment treaty (BIT) talks and the Bush Administration announced that it would explore whether to add Vietnam to the Generalized System of Payments (GSP) program, which extends duty-free treatment to certain products that are imported from designated developing countries. Since 2002, the United States and Vietnam have expanded political and security ties, symbolized by reciprocal summits that have been held annually since 2005. Vietnam is one of the largest recipients of U.S. assistance in East Asia; estimated U.S. aid in FY2008 surpassed $100 million, much of it for health-related activities. In September 2007, the House passed the Vietnam Human Rights Act, H.R. 3096, which would freeze some non-humanitarian U.S. assistance programs at existing levels if Vietnam does not improve its human rights situation. Since 2006, arrests of dissidents and other developments have increased concerns about human rights. Vietnamese leaders have sought to upgrade relations with the United States due in part to worries about China’s expanding influence in Southeast Asia and the desire for continued U.S. support for their economic reforms. Many argue, however, that there is little evidence that Hanoi seeks to balance Beijing’s rising power. Also, some Vietnamese remain suspicious that the United States’ long-term goal is to end the Vietnamese communist party’s monopoly on power through a “peaceful evolution” strategy. Against a backdrop of the expanding and deepening of U.S.-Vietnam relations, in late June, Vietnamese Prime Minister Nguyen Tan Dung traveled to Washington, DC, to meet with President Bush. Since 2005, the United States and Vietnam have held annual visits between President Bush and either the Vietnamese President (the official head of state) or the Prime Minister (the head of government). The White House appears to be using these top-level meetings to try to encourage economic and political reforms inside Vietnam. Dung also became the highest level Vietnamese official since the Vietnam War to visit the Pentagon, where he met with Secretary of Defense Robert Gates. Dung’s trip was notable for the number and range of agreements the two governments came to, as well as the new steps they took to deepen their level of engagement. Major developments included:2 ! the announcement of a formal “Security Dialogue” on political-military issues, a process that the United States has with four other Southeast Asian countries; ! the launch of bilateral investment treaty (BIT) negotiations; ! the Bush Administration’s announcement that it would begin the process of exploring whether to add Vietnam to the Generalized System of Payments (GSP) program, which extends duty-free treatment to certain products that are imported from designated developing countries; ! an agreement in principle to introduce a Peace Corps program in Vietnam; ! the launch of a “high-level” bilateral Education Task Force; ! the announcement of new initiatives on adoptions, nuclear safety, aviation, climate change, food safety, and other issues. In another high-level visit, Deputy Secretary of State John Negroponte traveled to Vietnam from September 11-14, 2008. U.S. concerns regarding Pakistan include regional and global terrorism; Afghan stability; democratization and human rights protection; the ongoing Kashmir problem and Pakistan-India tensions; and economic development. A U.S.-Pakistan relationship marked by periods of both cooperation and discord was transformed by the September 2001 terrorist attacks on the United States and the ensuing enlistment of Pakistan as a key ally in U.S.-led counterterrorism efforts. Top U.S. officials praise Pakistan for its ongoing cooperation, although long-held doubts exist about Islamabad’s commitment to some core U.S. interests.     INTRODUCTIONI VIETNAm’s iCE AGE In January 2011, the Arab Spring transformed Tunisia. Egypt followed suit. Then Burma had its own spring. But no spring ever came to Vietnam. On the contrary, the political chill deepened. When National Assembly speaker Nguyen Phu Trong took over as Vietnamese Communist Party general secretary, he was ready to do anything to maintain order and, above all, stay in power. He inaugurated a new era marked by a growing crackdown on journalists and bloggers. Since his promotion, those who refuse to submit to the single party’s censorship have been subjected to waves of arrests, trials, physical attacks and harassment. The Trong era’s statistics are impressive, if not glorious. In 2012 alone, the Vietnamese authorities prosecuted no fewer than 48 bloggers and human rights activists, imposing a 3 total of 166 years in jail sentences and 63 years of probation. Vietnam is now the world’s second biggest prison for blogger and netizens, after China. Relative to population size, the situation is much worse in Vietnam than China. A total of 35 bloggers and netizens are currently detained just for exercising their right to information and expression, of whom 26 were arrested since Trong took over. The new Vietnamese strongman’s achievements including reinforcing the human and technological resources assigned to Internet surveillance, and the constant adoption of new repressive laws and directives. The latest, called Decree 72, makes it illegal to use blogs and online social networks to share information about news developments. It marks a new low in the regime’s campaign against use of the modern Internet as a tool of independent information and troublesome counterweight to Vietnam’s traditional media, which are kept under tight party control.

It begins with an investigation and discussion of the human rights provisions from the 1946 Constitution to the 1992 Constitution – a period where the socialist human rights tradition was established in Vietnam. It follows with an analysis of the debates on the new human rights and citizens’ rights provisions in the 1992 Constitution, where a new concept of natural human rights emerged. The article continues to explore how the struggle and debates surrounding the competing conception of rights – socialist and positivist on one hand and natural law-based on the other – come into play in shaping the 2013 Constitution. It then proceeds to evaluate the potential challenges involved in the implementation of these rights in the coming years. The authors argue that the development of constitutional human rights in Vietnam is still limited by ideological barriers. It also faces substantial practical challenges owing to, inter alia, the absence of provisions for the immediate implementation of such rights as well as legal mechanisms for the protection of constitutional rights, such as a constitutional review system.

Meeting the group in Kastrup Airport: 2 persons arrived 40 minutes late due to late arriving train from Jylland. 2 ladies travelling together were booked as double room, but they needed twin beds (should have been noted on the rooming lists). Air transportation: international transportation with Turkish Airlines (Boeing 777), and 2 domestic flights with Vietnam Airlines (Airbus 320). Group reservation always gives some problems with seating. All flights were done according to plan and on time. All luggages arrived on time. OBS: Our flight had an intermediate stop in Bangkok, which surprised the participants – it should have been mentioned in the letter of departure! Local transportations in Vietnam: all buses and drivers were good. Night train from Hanoi to Dong Hoi were OK (a myriad of Vietnamese travelers slept on the floors in the corridors due to Tet). It is not optimal to arrive in Dong Hoi at 4.40 a.m. – a later arrival would be better! The hotel boat in Halong Bay was not big enough for our group – a second boat was needed, and 4 passengers had to climb between the boats, when they went to sleep. Hotels in Vietnam: all hotels were OK, but Asian Ruby 3 in Saigon had not enough capacity for breakfast for 33 pax ++. Medaillion Hotel in Hanoi was charming and good situated. Moonlight Hotel in Hué was very new, good and with a nice restaurant at the top floor.
