THE NORFOLK COUNTY COUNCIL (GREAT YARMOUTH, VARIOUS ROADS) (ON STREET RESIDENTS PARKING PLACES AND VOUCHER PARKING PLACES) ORDER 2014

The Norfolk County Council (hereinafter referred to as “the Council”) in exercise of their powers under section 45 and 46 and Parts III & IV of Schedule 9 of the Road Traffic Regulation Act 1984 (hereinafter referred to as “the Act”) and the Traffic Management Act 2004 (hereinafter referred to as “the 2004 Act”) and of all other enabling powers, and after consultation with the chief Officer of Police in accordance with part III of Schedule 9 to the Act, hereby make the following Order:-

1. This Order shall come into operation on the 22 nd day of August 2014, and may be cited as The Norfolk County Council (Great Yarmouth, Various Roads)(On Street Residents and Voucher Parking Places) Order 2014.

PART 1

GENERAL

2. Interpretation

Any reference to any enactment shall be construed as a reference to that enactment as amended, applied, consolidated, re-enacted by or as having effect by virtue of any subsequent enactment. Where the context otherwise requires the following expressions have the meaning hereby respectively assigned to them.

“Agent” means any period in which there is in force an Agreement under The Local Government Act 2000 beween Norfolk County Council and Great Yarmouth Borough Council, The Borough Council of King’s Lynn and West Norfolk and South Norfolk District Council to administer functions conferred by that Agreement on the Council’s behalf, failing which it shall mean Norfolk County Council;

“Business Parking Permit” means a Parking Permit as set out under Article 6 of this Order;

“Business Visitors Parking Permit” means a Parking Permit as set out under Article 7 of this Order;

“Business Day Visitors Parking Permit” means a Parking Permit as set out under Article 8 of this Order;

“Operational Hours” means the periods specified in Column 5 of the Schedules to this Order in respect of which a charge is made as specified in Article 3;

"Council" means The Norfolk County Council or their Agent;

"Civil Enforcement Officer" has the same meaning as in section 76 of the Traffic Management Act 2004;

"Driver" in relation to a vehicle waiting in a parking place, means the person driving the vehicle at the time it was left in the parking place, or the person deemed to be the driver under the terms of this Order;

"Disabled Person's Vehicles" has the same meaning as in the Local Authorities' Traffic Orders (Exemptions for Disabled Persons) (England) Regulations 2000;

“Disabled Persons Badge” has the same meaning as in the Disabled Persons (Badges for Motor Vehicles)(England) Regulations 2000; and

"Parking Disc" means a disc, issued by a local authority, complying with the requirements of the British Standard Specification for Parking Discs (BS No 3551 : 1970), but coloured blue and capable of showing the quarter hours period during which a period of waiting begins; and for the purposes of this Order a vehicle shall be regarded as displaying a disabled person's badge in the relevant position, when

(a) in the case of a vehicle fitted with a front windscreen

(i) the badge is exhibited facing forwards of the near side of and immediately behind the windscreen, and

(ii) the parking disc is exhibited in the relevant position with the side which shows the time facing forwards or outwards and immediately behind the windscreen, and

(b in the case of a vehicle not fitted with a front windscreen the badge or disc is exhibited in a conspicuous position on the side of the vehicle;

“Enforcement Authority” means the Council or their Agent;

“General Directions” means the Traffic Signs Regulations and General Directions 2002;

“General Regulations 2007” means The Civil Enforcement of Parking Contraventions (England) General Regulations 2007;

"Motor Car", "Motor Cycle" and "Invalid Carriage" shall have the same meaning as in section 136 of the Act;

"Penalty Charge” has the same meaning as in section 2 of the General Regulations;

“Penalty Charge Notice” has the same meaning as in section 8 of the General Regulations 2007;

"Residents Parking Place" means the length of road specified in Column 1 of the Schedules to this Order indicated by markings on the surface as an area where a vehicle in accordance with the provisions of this Order may be stationed;

“Parking Permit” means:- (i) a Residents Parking Permit, (ii) a Residents Visitors Parking permit, (iii) a Business Parking Permit, (iv) a Business Visitors Parking Permit, (v) a Business Daily Visitors Parking Permit; (vi) a Voucher Parking Permit

“Parking Permit Charge” means the charge made by the Council for a Parking Permit as specified in Schedule 4 to this Order;

“Resident” means a legal owner/occupier of a property situated within the Residents Parking Zone;

“Residents Parking Permit” means a Parking Permit as set out under Article 4 of this Order;

“Residents Parking Zone” means the area in the Borough of Great Yarmouth within the southern side of St Nicholas Road and Euston Road, The western side of Marine Parade, the northern side of St Peter’s Road and the eastern side of Temple Road;

“Residents Visitors Parking Permit” means a permit as set out under Article 5 of this Order;

“Residents and Voucher Parking Places” means the areas specified in Column 1 of Schedule 3 to this Order;

“Voucher Parking Permit” means a voucher as set out under Article 13 of this Order.

PART II

DESIGNATION, CHARGES AND PENALTY CHARGES

Classes and position of vehicles

3. The lengths of carriageway specified in column 1 of Schedules 1 to 3 to this Order are authorised to be used, subject to the following provisions of this Order, by the driver of a vehicle possessing a valid parking permit as parking places for such classes of vehicles, in such positions and on such days and during such hours as are specified in relation to that section of road in columns 2-6 of the said Schedules.

Residents Parking Permits

4. The driver of a vehicle, being a Resident of a property situated within the Residents Parking Zone may, subject to the Council’s discretion, apply to the Council for a Resident’s Parking Permit to be valid in respect of one specified vehicle for a period of up to twelve months from the date of issue. A Resident’s Parking Permit may be used to allow that specified vehicle to wait in a Resident’s Parking Place as specified by the Parking Permit and in accordance with the Schedules to this Order.

5. A Resident of a property situated within the Residents Parking Zone may, subject to the Council’s discretion, apply to the Council for one Resident’s Visitors Parking Permit to be valid for a period of up to twelve months from the date of issue. A Resident’s Visitors Parking Permit may be used to allow a vehicle to wait in a Resident’s Parking Place as specified by the Parking Permit and in accordance with the Schedules to this Order.

Business Parking Permits

6. The driver of a vehicle, being a proprietor of a business situated within the Residents Parking Zone may, subject to the Council’s discretion, apply to the Council for a Business Parking Permit to be valid in respect of one specified vehicle for a period of up to twelve months from the date of issue. A Business Parking Permit may be used to allow that specified vehicle to wait in a Resident’s Parking Place as specified by the Parking Permit and in accordance with the Schedules to this Order.

7. A proprietor of a business situated within the Residents Parking Zone may, subject to the Council’s discretion, apply to the Council for one Business Visitors Parking Permit to be valid for a period of up to twelve months from the date of issue. A Business Visitors Parking Permit may be used to allow a vehicle to wait in a Resident’s Parking Place as specified by the Parking Permit and in accordance with the Schedules to this Order.

8.(1) A proprietor of a business, being an Hotel or a Guest House situated within the Residents Parking Zone may, subject to the Council’s discretion, apply to the Council for a maximum of 365 Business Day Visitors Parking Permits for use within a specified twelve month period.

8.(2) A Business Day Visitors Parking Permit is valid for one day within the twelve month period.

8.(3) A Business Day Visitors Parking Permit may be used to allow a vehicle to wait in a Resident’s Parking Place for a period of one day, being the date specified on the Parking Permit and in accordance with the Schedules to this Order.

Residents and Business Parking Permits

9. The issue of any Residents of Business Parking Permit is at the discretion of the Council and subject to receipt of the correct Parking Permit Charge as specified in Schedule 4 to this Order, for that Parking Permit. The Council may limit the number of issue of any type of Parking Permit in respect of any Residents Parking Place or address. The Council shall not be obliged to issue any Parking Permit if doing so would exceed the permitted maximum number of Parking Permits for that Residents Parking Zone.

Display of Residents and Business Parking Permits

10. The driver of a vehicle using a Parking Permit issued in accordance with Articles 4- 9 of this Order and

(a) which vehicle possesses a windscreen shall display the Parking Permit within the vehicle either by attaching it firmly to the front windscreen or by placing it on the dashboard of the vehicle; (b) which vehicle does not possess a windscreen shall display the Parking Permit in a conspicuous position,

so that the registration details, the period of eligibility and all other particulars appropriate to the Parking Permit as specified in this Order are clearly visible from outside the vehicle during the entire period the vehicle is waiting in the Residents or Residents and Voucher Parking Place. A Parking Permit which is not displayed in accordance with this clause is not valid.

11. A Parking Permit issued in accordance with Articles 4-9 of this Order shall not be considered valid for the purposes of this Order if:-

(a) the Parking Permit is defaced or obstructed so that the particulars cannot be read from outside the vehicle, or (b) the Parking Permit has expired by effluxion of time, or (c) the Parking Permit has been declared invalid by the Council following any payment for that Parking Permit being dishonoured, or (d) the driver of a vehicle displaying the Parking Permit is no longer a Resident, (e) the Parking Permit is not displayed as required by Article 10, (f) the Parking Permit is declared invalid as specified in Article 14.

12. The driver of a vehicle shall not allow that vehicle to wait in a Residents or Residents and Voucher Parking Place if that vehicle displays a Residents Parking Permit, a Voucher or a Business Parking Permit which was purchased either for a different vehicle or for a different Parking Place than that in which the vehicle is waiting.

Voucher Parking Permits

13.(1) The driver of a motor vehicle using a Voucher Parking Place shall, on leaving the vehicle wholly in that parking place, pay the appropriate Parking Charge in accordance with the scale of charges specified in Schedule 4 to this Order.

13.(2). The Parking Charge shall be payable by (i) purchase of a Voucher at the following providers:

(a) 129 Nelson Road, Great Yarmouth (Currently Childs Newsagents) (b) 61-62 Crown Road, Great Yarmouth (Currently Premier Stores) (c) Great Yarmouth tourist Information Office currently located at Maritime House, 25 Marine Parade, Great Yarmouth,

(ii) other means as authorised by the Council and prominently specified on a Traffic Sign at the Parking Place.

13.(3) The driver who has purchased a Voucher for a vehicle using a Voucher Parking Place in accordance with Articles 13(1) and 13(2) of this Order; and

(i) which vehicle possesses a windscreen shall display the Voucher issued by the provider specified in 13(2) above within the vehicle either by attaching it firmly to the front windscreen or by placing it on the dashboard of the vehicle; (ii) which vehicle does not possess a windscreen shall display the Voucher Parking Permit in a conspicuous position,

so that the payment in accordance with the scale of charges appropriate to the Voucher Parking Place as specified in Schedule 4 to this Order, the day, date and time of issue and all other particulars shown are clearly visible from outside the vehicle during the entire period the vehicle is waiting in that parking place. A Voucher Parking Permit which is not displayed in accordance with this clause is not valid.

13.(4). Any Voucher Parking Permit issued on payment of the Parking Charge referred to in Article 13(1) of this Order is not transferable and shall not be valid for any vehicle (whether or not that other vehicle is owned or is under the control of the driver) other than that for which it was originally purchased.

All Parking Permits

14. Where a Parking Permit has been used contrary to the conditions of use of the Parking Permit or is otherwise in breach of the provisions of this Order the Council may declare that Parking Permit invalid.

15. A Parking Permit issued under Articles, 4-9 and 13 of this Order shall not be valid for any vehicle other than the vehicle for which it was issued (whether or not that other vehicle is owned or is under the control of the driver).

16. A Parking Permit issued under Articles 8 and 13 of this Order shall be valid for the date specified on the Parking Permit. The date and time of issue for that Parking Permit must be entered, in ink, on the Parking Permit and clearly visible as specified in this Order.

17. Where in the Schedules to this Order the Residents or Residents and Voucher Parking Place is described, or is designated by surface or other markings, as available for vehicles of a specified class, the driver of a vehicle shall not permit it to wait in the Residents or Residents and Voucher Parking Place, unless it is of the specified class.

18. The driver of a vehicle shall not:-

(i) cause or permit a vehicle to be left in a Residents or Residents and Voucher Parking Place in any position other than wholly within a Residents or Residents and Voucher Parking Place; nor (ii) cause or permit a vehicle to be left in such as position as to prevent the driving away of any vehicle already standing in a Residents or Residents and Voucher Parking Place or in such a position as to cause an obstruction to other vehicles.

Disabled Person’s Parking

19. Nothing in Article 13 of this Order shall prohibit a person to cause or permit a disabled person’s vehicle which displays in the relevant position a disabled person’s badge, and a parking disc (on which the driver, or other person in charge of the vehicle, has marked the time at which the period of waiting began) to wait in the lengths of road or on the side of roads referred to in Schedule 3 to this Order for a period not exceeding the time specified in the current regulations.

20.. The driver of a vehicle displaying a disabled person’s badge may, subject to compliance with all other provisions of this Order, park that vehicle in a designated disabled parking bay or length of road specified in Schedule 3 to this Order provided that:

(a) the driver of the vehicle is a disabled person to whom the badge was issued in respect of that vehicle;

(b) the vehicle is being used for the carriage of a disabled person to whom the badge was issued;

(c) the vehicle is one being used for the carriage of disabled persons by an institution to whom the badge was issued in respect of that vehicle; or

(d) the time during which the vehicle will be parked in the said parking bay is indicated on the parking disc provided by local authority for that purpose.

Penalty Charge and Penalty Charge Notice

21. Where a vehicle is left waiting in a Residents or Residents and Voucher Parking Place in contravention of this Order a Penalty Charge shall become payable. A Penalty Charge Notice to that effect will be attached to the vehicle or handed to the driver by a Civil Enforcement Officer, in accordance with Article 23 of this Order.

22. A Penalty Charge shall be payable to the Enforcement Authority.

23. A Penalty Charge Notice referred to in Article 21 and issued by a Civil Enforcement Officer shall include the following particulars:

(a) the enforcement authority,

(b) the Residents or Residents and Voucher Parking Place at which the contravention occurred,

(c) the registration mark or when the vehicle is being used under a trade licence, the registration mark of that trade licence,

(d) the date and time at which the Penalty Charge was seen to be payable,

(e) the grounds on which the Civil Enforcement Officer serving the Penalty Charge Notice believes that a Penalty Charge is payable,

(f) the amount of the Penalty Charge,

(g) the manner in which and time within which the Penalty Charge shall be paid,

(h) a statement that a reduced charge may be payable if payment is made within fourteen days of the Penalty Charge Notice being incurred,

(i) a statement to the effect that if the Penalty Charge is not paid before the end of the period of 28 days a Notice to Owner may be served by the Enforcement Authority on the owner of the vehicle.

24. Where a driver has left a vehicle in a Residents or Residents and Voucher Parking Place in contravention of this Order and a Penalty Charge Notice could not be issued as specified in Article 21 of this Order a Penalty Charge Notice may be issued by post by the Enforcement Authority in accordance with section 10 of the General Regulations 2007.

25. Any Penalty Charge Notice issued in accordance with Article 24 of this Order shall, in addition to the particulars specified in Article 23(a), (b), (c), (e) and (f) of this Order, include the particulars specified in paragraph 2 of the Schedule to the General Regulations 2007.

26. The driver of a vehicle in respect of which a Penalty Charge Notice has been incurred shall pay the Penalty Charge or provide proof of payment of the Penalty Charge to the Enforcement Authority as detailed on the reverse of the notice within 28 days of the date on which the Penalty Charge Notice is served. If payment is received within a period of 14 days beginning with the date on which the Penalty Charge Notice is served the amount of the Penalty Charge shall be reduced by 50% (provided that if the fourteenth day falls upon a day on which the Enforcement Authority’s offices are closed the period within which payment of the said charge is due shall be extended to 1.00 p.m. on the next full day on which the office is open).

27. Where the driver of a vehicle fails to pay the Penalty Charge as specified in Article 25 of this Order the Enforcement Authority may follow the procedures set out in the General Regulations 2007 to recover the Penalty Charge.

28. The driver of a vehicle who desires to make representation to or appeal against a Penalty Charge Notice issued to him may make representation or appeal to the Enforcement Authority pursuant to the procedures set out in the Civil Enforcement of Parking Contraventions (England) Representations and Appeals Regulations 2007.

29. Where a Penalty Charge Notice has been attached to a vehicle in accordance with Article 21 of this Order no person, not being the driver of the vehicle or a person duly authorised by the Enforcement Authority shall remove that Notice from the vehicle unless authorised to do so by the driver.

PART III

USE OF PARKING PLACES

30. The driver of a vehicle using a Residents or Residents and Voucher Parking Place shall stop the engine as soon as the vehicle is in position in that parking place and shall not start the engine except when about to change the position of the vehicle in that parking place, or to depart from that parking place.

31. Except with the authority of the Council no person shall use a vehicle, whilst it is in a Residents or Residents and Voucher Parking Place, in connection with the sale of any article to persons in or near that parking place or in connection with the selling or offering for hire of his skill or services.

32. Except with the authority of the Council no person shall affix or cause to be affixed any advertising material to any vehicle left, in a Residents or Residents and Voucher Parking Place.

33. Subject to the proviso hereto, when a vehicle is left in a Residents or Residents and Voucher Parking Place in contravention of this Order, or it is necessary to meet the requirements of an emergency, a person authorised on behalf of the Council or a Police Constable in uniform may remove the vehicle or arrange for it to be removed from that parking place, or may alter or cause to be altered the position of the vehicle in order that its position shall comply with the relevant provision or meet the requirements of that emergency.

34. Any person removing or altering the position of a vehicle by virtue of Article 33 of this Order may do so by towing or driving the vehicle or in such other manner as that person may think necessary and may take such measures in relation to the vehicle as that person may think necessary to enable that person to remove or alter its position.

35. When a person authorised by the Council removes or makes arrangements for the removal of a vehicle from a Residents or Residents and Voucher Parking Place by virtue of Articles 33 and 34 of this Order, that person shall make such arrangements as may be reasonably necessary for the safe custody of the vehicle.

36. Where a vehicle has been removed in accordance with Articles 33, 34 and 35 of this Order the charges as specified in Schedule 3 of the Civil Enforcement of Parking Contraventions (Guidelines on Levels of Charges)(England) Order 2007 shall become payable.

37. The driver of a motor vehicle using a Residents or Residents and Voucher Parking Place shall not sound any horn or other similar instrument except when about to change the position of the vehicle in or to depart from ka parking place.

38. No person shall, except with the permission of any person duly authorised by the Council, drive any vehicle in a Residents or Residents and Voucher Parking Place other than for the purpose of leaving that vehicle in that parking place in accordance with the provisions of this Order or for the purpose of departing from that parking place.

39. No person shall use any part of a Residents or Residents and Voucher Parking Place or any vehicle left in a Residents or Residents and Voucher Parking Place:

a. for sleeping or camping purposes; b. for eating or cooking purposes; c. for the purpose of servicing or washing any vehicle or part thereof other than is reasonably necessary to enable that vehicle to depart from that parking place.

40. No person shall play or take part in any game in a Residents or Residents and Voucher Parking Place.

41. In a Residents or Residents and Voucher Parking Place no person shall:

(a) erect or cause or permit to be erected any tent, booth, stand, building or other structure except with the authority of the Council; or

(b) light or cause or permit to be lit any fire.

42. By conspicuous notices to that effect the Council may suspend parking on Residents or Residents and Voucher Parking Places or part thereof and failure to observe such notices shall be a contravention of this Order.

43. A driver of a vehicle shall not use a Residents or Residents and Voucher Parking Place –

(a) so as unreasonably to prevent access to any premises adjoining the road, or the use of the road by other persons, or

(b) so as to be a nuisance; or

(c) when for preventing obstruction of the streets, or danger or for any other lawful purpose, the Council has closed that Residents or Residents and Voucher Parking Place and exhibited notice of such closing on or near that parking place.

44. Insofar as any provision of this Order conflicts with any previous Order relating to the lengths of road specified in the Schedule to this Order, that provision of this Order shall prevail.

PART IV

REVOCATION

45. The following Order and Notice of Variation will become revoked on the date of commencement of the Order as follows:-

“The Norfolk County Council (Great Yarmouth, Various Roads) (On-Street Resident’s Parking Places) (No 1) Order 2012” – in its entirety;

“The Norfolk County Council (Great Yarmouth, Various Roads)(On-Street Resident’s Parking Places) (No 1) Order 2012 Variation to Permit Charges Notice 2012” – in its entirety.
