Overview

Ontario Power Generation Inc. (OPG) currently holds the Nuclear Power Reactor Site Preparation Licence (PRSL) 18.00/2022 (hereinafter “the Licence”) to prepare the site for the future construction and operation of a new Nuclear Generating Station (hereinafter “the new nuclear facility”) at Darlington New Nuclear Project (DNNP) site located in the Municipality of , in the regional municipality of Durham, in the province of Ontario.

The Licence is valid from August 17, 2012 to August 17, 2022 and allows OPG to conduct the following site preparation activities for the future new nuclear facility:

a) Construction of access control measures; b) Clearing and grubbing of vegetation; c) Excavation and grading of the site; d) Installation of services and utilities; e) Construction of administrative and physical support facilities inside future protected area; f) Construction of environmental monitoring and mitigation systems; and g) Construction of flood protection and erosion control measures.

In 2013, the Government of Ontario deferred the construction of the new nuclear facility at DNNP site but requested OPG to maintain the Licence.

To date, OPG has not received further direction to proceed with the project, hence none of the site preparation activities, listed above, have been carried out and no Engineering Procurement and Construction Company (EPC Co.) has been contracted.

Licence Condition 4.3 of the Licence requires OPG to submit an annual report to the Canadian Nuclear Safety Commission (CNSC) on the licenced activities and information as listed in Section 3.4.3 of the Licence Conditions Handbook. This 2019 Annual Report for DNNP fulfills the above requirement for the reporting period from March 1, 2019 to March 1, 2020.

Highlights of performance and activities associated with the Licence for the reporting period include:  No reportable events related to security, fire and emergency, occupational health and safety, and environmental excursion.  The DNNP Commitments Report was updated, the revision R003, has been accepted by the CNSC (Reference 1).  Progress on the following long lead time commitments continue to advance: o Mitigation measures for the potential loss of Bank Swallow nesting habitat (commitments D-P-3.8 and D-P-12.5): Bank Swallow monitoring studies continued in the reporting period. OPG has removed the earthen mound artificial Bank Swallow nesting habitat at the DNNP site following six

consecutive years of Bank Swallows nesting absence. OPG continues to explore other artificial nesting structure options. o Deep Water Aquatic and Fish Community Characterization (Commitment D- C-1.2). The 2019 characterization reconfirmed the 2018 study conclusion that having the intake and diffuser at depths beyond 15 meters does not appear to be advantageous with respect to reducing potential fish impingement. This conclusion stands. Similarly, it also concluded that siting of the intake and diffuser at depths beyond 15 meters does not appear to be advantageous with respect to reducing potential fish entrainment. o Baseline Updates (Commitments D-P-12.3 to D-P-12.6): Sediment and surface water sampling, adult fish community surveys, Least Bittern and Bobolink surveys and base flow monitoring at Darlington Creek were conducted to support the future completion of deliverable of their respective commitments.

OPG has also submitted to the CNSC (Reference 2) a notice of intent for early renewal of the Licence. OPG is progressing the Licence renewal activities as per the licence renewal plan, submitted to the CNSC in Reference 3, and concurred by the CNSC in Reference 4.

OPG continues to advance the initiatives that will enable future implementation of a new nuclear facility at DNNP site.

1.0 MANAGEMENT SYSTEMS

1.1 Management System Implementation

This section provides a summary of the implementation of the management system including any changes to the organization and any improvements that have been made to the management system documents.

It provides a summary of any regulatory inspections of the management system or its implementation and the corrective actions that have been taken, and a summary of any safety culture evaluations that have been performed, and any actions that have arisen from such evaluations.

No site preparation activities under the Licence took place in the reporting period. Also no regulatory inspections of the DNNP Management System and safety culture evaluations have been performed in the reporting period.

OPG has continued to maintain the Licence and the preparation of the re-licensing documents in accordance with the OPG Nuclear (OPGN) Management System. Section 3.2.1 of the Licence Condition Handbook LCH-PRSL-DNNP-R001 allows the project to make use of OPG Management System documents and Nuclear Line of Business Management System Documents where practical.

2.0 HUMAN PERFORMANCE MANAGEMENT

2.1 Personnel Qualifications and Competencies

This section provides a summary description of progress made to ensure workers are competent to do the work assigned to them founded on the competency criteria which are based on the work to be performed.

This section also provides a summary of the training programs, including improvements to the programs.

No site preparation activities under the Licence took place and no work was undertaken to develop and implement a DNNP specific training program in the reporting period. OPG continues to use qualified personnel to perform work activities to support maintaining the Licence and the preparation of the re-licensing documents.

3.0 OPERATING PERFORMANCE

3.1 Conduct of Site Preparation Activities

This section provides a summary description of project status, and any progress made on the site preparation licensed activities.

OPG did not commence any of the site preparation activities under the Licence in the reporting period, and as such, has not engaged an EPC Co.

3.2 Summary of Permits or Authorizations Applied for, or Obtained from Other (Non-CNSC) Regulatory Authorities

This section provides a listing of any permits or authorizations applied for, or obtained from regulatory authorities, other than the CNSC, for project activities.

OPG has not applied for any permits or authorizations from regulatory authorities in the reporting period.

3.3 Summary of Reportable Events and Actions Taken to Prevent Recurrence

This section provides a list of any reportable events in the period, including the status of any actions taken to prevent recurrence. This list includes events reportable to all regulatory agencies.

There were no reportable events related to DNNP site and any DNNP related activities in the reporting period. OPG continues to monitor the DNNP site conditions, any adverse and potentially adverse conditions are documented in OPG’s Station Condition Record database.

4.0 CONVENTIONAL HEALTH AND SAFETY

4.1 Occupational Health and Safety Performance

This section provides a summary description of the occupational health and safety performance of the project including any lost time injuries or fatalities, and actions that have been taken to prevent recurrence.

This section also provides a summary of any Ontario Ministry of Labour (MOL) investigations or orders.

For this reporting period, there have been no occupational health and safety events and no MOL investigations or orders related to the DNNP.

5.0 ENVIRONMENTAL PROTECTION

5.1 Environmental Excursions

This section provides a summary description and implementation status of the monitoring activities (if any) as described in the Environmental Monitoring Plan. Detailed results are provided by reference to independently submitted reports. This section also provides a summary of any environmental excursions that have occurred

This section also provides a summary of the results of regulatory assessments of compliance with legal or other requirements, communications or complaints from interested parties, and the status of any corrective and preventive actions.

No site preparation activities under the Licence were undertaken in the reporting period that would require the monitoring of emissions, effluent, or wastes. There have been no environmental excursions related to DNNP activities during this reporting period.

6.0 EMERGENCY MANAGEMENT AND FIRE PROTECTION

6.1 Emergency Response and Fire Prevention Provisions

This section provides a summary description and implementation status of the emergency response provisions for emergencies and for non-routine conditions.

This section provides a summary description and implementation status of the fire prevention and response provisions. This section also provides a summary of any fires or emergency events that have occurred, and actions taken to prevent recurrence.

There have been no fires or emergency events reportable for the DNNP during this reporting period.

7.0 WASTE MANAGEMENT

7.1 Hazardous Waste Management

This section provides a summary description of the quantity of hazardous waste produced, stored on site, and transported to a licensed waste management facility.

This section also provides a summary of any inspections performed by regulatory agencies respecting generation, storage, handling or transport of hazardous waste.

During this reporting period there have been no DNNP activities undertaken that generate hazardous materials, or require management of hazardous wastes.

8.0 SECURITY

8.1 Security Events

This section provides a summary of any security events that have been independently reported to the CNSC in accordance with requirements. Due to the sensitive nature of

No reportable security events have occurred with DNNP during this reporting period.

9.0 SITE SPECIFIC REQUIREMENTS

9.1 OPG Commitments Status for Power Reactor Site Preparation Licence

This section provides a high level description of progress on deliverables as set out in the Darlington New Nuclear Project Commitments Report, for which OPG is required to take action.

All regulatory commitments that OPG made during the Joint Review Panel process, as outlined in the Joint Review Panel Recommendations, in accordance with the Government of response, have been consolidated into specific commitments with specific measureable deliverables. For ease of reference, each commitment was assigned a unique number and listed in the DNNP Commitments Report. The revision R003 of this report has been accepted by CNSC (Reference 1).

During this reporting period the following work activities were conducted to support the future completion of committed deliverables: a) Deliverable D-P-1:  OPG is progressing the required activities to support transition of DNNP Management System to OPGN Management System. The CNSC was notified about this transition in Reference 5. b) Deliverables D-P-3.8 and D-P-12.5:  Bank Swallow monitoring studies were conducted to support the future completion of deliverables D-P-3.8, Engineering, Procurement and Construction (EPC) Bank Swallow Mitigation Measures and Plans, and D- P-12.5, Terrestrial Environment Monitoring and Follow-Up.  The earthen mound artificial Bank Swallow nesting habitat at the DNNP site was demolished in 2019 as there were no nesting Bank Swallows observed in six consecutive years of monitoring (2013-18). OPG continues to explore other artificial nesting habitats in support of deliverables D-P-3.8 and D-P- 12.5. c) Deliverable D-P-12.3:  Sediment sampling and surface water sampling were conducted to support the future completion of deliverable D-P-12.3, Surface Water Environment Monitoring and Follow-Up. d) Deliverable D-P-12.4:  Adult fish community surveys were conducted to support the future completion of deliverable D-P-12.4, Aquatic Environment Monitoring and Follow-Up.

e) Deliverable D-P-12.5:  Surveys for Least Bittern and Bobolink were conducted to support the future completion of Deliverable D-P-12.5, Terrestrial Environment Monitoring and Follow-Up. f) Deliverable D-P-12.6:  Base flow monitoring was conducted at Darlington Creek to support the future completion of deliverable D-P-12.6, Geological and Hydrogeological Environment Monitoring and Follow-Up. g) Deliverable D-C-1.2:  OPG addressed the CNSC’s comments on the 2018 aquatic study conducted to support the future completion of deliverable D-C-1.2, Engineering, Procurement and Construction (EPC) Condenser Cooling Water Design, as described in the DNNP Commitments Report. The CNSC, in coordination with Environment and Climate Change Canada (ECCC) and Fisheries and Oceans Canada (DFO) found OPG’s responses to be sufficient (Reference 6).  OPG repeated the fish community characterization component of the 2018 aquatic study (Enclosure 2 of Reference 7). The 2019 characterization reconfirmed the 2018 study conclusion that siting the intake and diffuser at depths beyond 15 meters does not appear to be advantageous with respect to reducing potential fish impingement. Additionally, the 2019 study concludes that siting the intake and diffuser at depths beyond 15 meters does not appear to be advantageous with respect to reducing potential fish entrainment.

Appendix A provides the status of all deliverables associated with project activities this year. Table A-1 shows the completed deliverables, while Table A-2 shows the status of active deliverables. The majority of deliverables have had no activity during this reporting period.

9.2 Environmental Assessment Follow-up Results

This section provides a summary description and implementation status of the monitoring activities (if any) as described Environmental Assessment Follow-up Plan.

Detailed results are provided by reference to independently submitted reports.

No site preparation activities under the Licence have taken place and therefore Environmental Assessment Follow-up monitoring for DNNP impacts has not commenced.

9.3 Financial Guarantee/Preliminary Decommissioning Plan

This section provides a summary description of any changes to the proposed financial guarantee relating to site preparation activities after an EPC Co. is selected.

There are no changes to the proposed financial guarantee relating to site preparation activities.

OPG’s position regarding the preliminary decommissioning plan has been reaffirmed in Reference 8 and accepted by the CNSC in Reference 9.

9.4 Public Information and Indigenous Initiatives

This section provides a summary description of OPG’s program, and activities under the program, to inform persons living in the vicinity of the DNNP site about events and developments at the site related to the health, safety and security of persons and the environment, and any other issues associated with site preparation.

OPG continues to update members of the public on the project status through the information provided during station tours, presentations and updates to local stakeholders and Indigenous communities.

9.5 Other Supporting Activities

This section provides a summary description of any supporting activities undertaken during the reporting period. Detailed results are provided by reference or included as an Appendix.

9.5.1 Licence Renewal Activities OPG is progressing the activities, specified in section 3.3 of the licence renewal plan, submitted to the CNSC in Reference 3, to support the Licence renewal application. A summary of these activities is provided below: a) Addressing REGDOC-1.1.1 Requirements and Guidance: OPG conducted the following activities in support of the Licence renewal application:  a review of original application materials against REGDOC-1.1.1 requirements and guidance and addressing any identified gaps.  addressing the passage of time since the original application submission through: o a review of current codes, standards and practices referenced in the Licensing Basis and those associated with REGDOC-1.1.1 o updating or reviewing selected baseline data associated with the site These activities and their results have been captured in the Licence Renewal Activity Reports, which have been submitted to the CNSC (References 10 and 11), except for the Environment. b) PRSL Renewal Indigenous Engagement: OPG submitted to the CNSC the Indigenous Engagement Plan (Reference 12). c) PRSL Renewal Public Engagement: OPG continues to undertake public and stakeholder engagement activities associated with the Licence renewal. d) Management System Review: As part of the Licence renewal activities, OPG conducted a strategic review of the need of the current DNNP Management System for the site preparation phase and decided to adopt the OPGN Management System, compliant with the standard CSA N286-12, Management System Requirements for Nuclear Facilities. OPG has notified the CNSC of OPG’s plan to transition the current DNNP Management System to OPGN Management System for site preparation phase (Reference 5). OPG is progressing the required activities to support this transition. e) Aggregate Assessment Process: OPG is progressing the overall assessment to confirm the validity of the licensing bases. f) Commitments Report Update: No updates of the Commitments Report have been provided in support of the Licence renewal in the reporting period.

9.5.2 DNNP Land Maintenance and Management OPG notified CNSC about termination of temporary use of DNNP land area (site designation ‘F7’) for the dismantling of used Primary Heat Transport Pump Motors (Reference 13). The area has been returned to its original state. OPG continues to maintain DNNP land areas through monitoring and control of their use.

10.0 SUMMARY

OPG is committed to continue maintaining the Licence and following licence requirements as dictated by the Licence. OPG continues progressing long-lead deliverables as required and, as stated the in Licence Condition 4.3, intends on submitting another Annual Report next year to update the CNSC on licensed activities.

Plans  In 2019 OPG continued the Bank Swallow monitoring studies.  The earthen mound artificial Bank Swallow nesting habitat at the DNNP site was demolished in 2019 as there were no nesting Bank Swallow observed in six consecutive years of monitoring (2013-18). OPG continues to explore other artificial nesting habitats in support of deliverables D-P-3.8 and D-P-12.5.

(A-2.1.)  OPG addressed the CNSC’s comments on the 2018 Aquatic Community Characterization for Siting of Intake and Diffuser Final Report on Nov. 15, 2019. (A-2.2.).
