Civil Action No. ___________ FEDERAL ELECTION COMMISSION 1050 First Street NE Washington, DC 20463, Defendant. COMPLAINT FOR DECLARATORY AND INJUNCTIVE RELIEF 1. Plaintiff End Citizens United (“ECU”) brings this action against the Federal Election Commission (“FEC” or “Commission”) pursuant to 52 U.S.C. § 30109(a)(8), challenging as contrary to law the FEC’s dismissal of Plaintiff’s administrative complaint against Donald J. Trump for President, Inc. (the “Trump Campaign”), the former president’s campaign committee. 2. On May 7, 2019, the Trump Campaign issued a public statement that criticized the “dishonest fundraising” practices of certain groups and informed potential donors that only five entities were “authorized” or “approved” by President Trump or the Republican National Committee (the “RNC”): four of those entities were official campaign or party organizations, and the fifth was America First Action—a super PAC. 3. The Federal Election Campaign Act (“FECA”) and FEC regulations prohibit campaigns from soliciting contributions to super PACs unless certain critical measures are taken to ensure that the solicited contributions do not come from prohibited sources or exceed federal 1 Case 1:21-cv-01665-TJK Document 1 Filed 06/21/21 Page 2 of 14 contribution limits. See 52 U.S.C. § 30125(e); 11 C.F.R. § 300.61. But the Trump Campaign took no such measures in its May 7 solicitation, instead issuing a blanket endorsement of contributions to the “approved” super PAC—contributions that would include corporate and unlimited funds, also known as “soft money,” which federal candidates are banned from soliciting. -

Nationalization, partisan realignment, and the reapportionment and redistricting of House seats all contributed to a House where Republicans do not necessarily always dominate, but in which they have had an edge more often than not. The Impact of Organizational Characteristics on Super PAC Financing and Independent Expenditures Paul S. Herrnson University of Connecticut [email protected] Presented at the Meeting of the Campaign Finance Task Force, Bipartisan Policy Center, Washington, DC, April 21, 2017 (revised June 2017). 1 Exe cutive Summa ry Super PACs have grown in number, wealth, and influence since the Supreme Court laid the foundation for their formation in Citizens United v. Federal Election Commission, and the decisions reached by other courts and the FEC clarified the boundaries of their political participation. Their objectives and activities also have evolved. Super PACs are not nearly as monolithic as they have been portrayed by the media. While it is inaccurate to characterize them as representative of American society, it is important to recognize that they vary in wealth, mission, structure, affiliation, political perspective, financial transparency, and how and where they participate in political campaigns. Organizational characteristics influence super PAC financing, including the sums they raise. Organizational characteristics also affect super PAC independent expenditures, including the amounts spent, the elections in which they are made, the candidates targeted, and the tone of the messages delivered. The super PAC community is not static. It is likely to continue to evolve in response to legal challenges; regulatory decisions; the objectives of those who create, administer, and finance them; and changes in the broader political environment. 2 Contents I. Joining the World of Journals Welcome to the nation’s first and, to our knowledge, only undergraduate research journal in communi- cations. We discovered this fact while perusing the Web site of the Council on Undergraduate Research, which lists and links to the 60 or so undergraduate research journals nationwide (http://www.cur.org/ugjournal. html). Some of these journals focus on a discipline (e.g., Journal of Undergraduate Research in Physics), some are university-based and multidisciplinary (e.g., MIT Undergraduate Research Journal), and some are university-based and disciplinary (e.g., Furman University Electronic Journal in Undergraduate Mathematics). The Elon Journal is the first to focus on undergraduate research in journalism, media and communi- cations. The School of Communications at Elon University is the creator and publisher of the online journal. The second issue was published in Fall 2010 under the editorship of Dr. Byung Lee, associate professor in the School of Communications. The three purposes of the journal are: • To publish the best undergraduate research in Elon’s School of Communications each term, • To serve as a repository for quality work to benefit future students seeking models for how to do undergraduate research well, and • To advance the university’s priority to emphasize undergraduate student research. The Elon Journal is published twice a year, with spring and fall issues. Articles and other materials in the journal may be freely downloaded, reproduced and redistributed without permission as long as the author and source are properly cited. Most mouths dropped a foot when President George Bush nominated his friend and counsel Harriet Meirs to be a Su- preme Court Justice. His nomination of Meirs to replace retiring judge Sandra Day O’Connor does preserve the gender balance, but with- out any judicial background Meirs may be the first outsider to be nominated to the highest court of the land. Meirs is a corporate lawyer, and a longtime loyal friend of Bush, which makes many conservatives feel she will de- cide cases along the same ideological lines as President Bush would himself given the opportunity to appoint him- self to the high court. Her unknown quantity as a sitting judge gives others wild speculation about how she will address complex cases, and they are nervous because of that uncertainty. We have no illusions that Meirs is anything but a person with true politically conservative leanings. That is a given, but what is interesting is that she would be the first justice who would not have a lot of legal baggage tied up in previ- ous rulings from the bench. To many there is a sense the legal system is a bit inbred now with all the requirements that anyone who is a judge must first be a lawyer.
