Statements by the president and leaders in Congress questioning the authority of the Supreme Court in relation to martial law, and supporting constitutional revision put into question the future of the current Philippine political system. * Malcolm Cook is Senior Fellow at the Regional Strategic and Political Studies Programme at ISEAS - Yusof Ishak Institute. 1 ISSUE: 2017 No. 44 ISSN 2335-6677 INTRODUCTION After his clear and surprise victory in the 9 May 2016 election, many observers, both critical and sympathetic, argued that Rodrigo Duterte would face a steep learning curve when he took his seat in Malacañang (the presidential palace) on 30 June 2016.1 Being president of the Philippines is very different than being mayor of Davao City in southern Mindanao. Learning curve proponents argue that his success in mounting this curve from mayor and local political boss to president would be decisive for the success of his administration and its political legacy. A year into his single six-year term as president, it appears not only that President Duterte has not mounted this steep learning curve, he has rejected the purported need and benefits of doing so.2 While there may be powerful political reasons for this rejection, the impact on the Duterte administration and its likely legacy appears quite decisive.

Just in the past two weeks, several homes and private offices were attacked by Duterte security forces. Dozens of individuals, including minors, were arrested and detained on spurious charges of illegal possession of firearms and explosives. A human rights defender from southern Philippines has been missing since 2 November. A labor leader was killed south of the capital Manila on 4 November. A radio broadcaster was killed in Negros island on 7 November. On 5 November, the Armed Forces of the Philippines revealed a new list of ’18 communist front organizations’ – a warning that they will be the next targets of intensified repression. Members and officials of activist organizations are constantly subjected to surveillance and death threats. The Duterte government calls its strategy the ‘whole-of-nation approach’ in order to end what it calls ‘the local communist armed conflict’. Instead of resolving the roots of the armed conflict however, it has instead targeted individuals and their groups ‘guilty’ of helping the poor and powerless. Spearheaded by murderous conspirators such as generals Hermogenes Esperon, Delfin Lorenzana, Eduardo Año and Carlito Galvez Jr., this strategy is doomed to fail.

Rather than ushering in an era of sincere cooperation and strategic benevolence, the world has instead witnessed China’s brazen remorselessness (for the rapid spread of the pandemic amid blatant lack of international travel restrictions in December and through January) and, even worse, unabashed opportunism in the adjacent waters. As soon as Beijing contained the crisis at home, it ruthlessly exploited distracted neighbors and rivals, who were now desperately scrambling for humanitarian assistance amid massive outbreaks at home. Beginning in March, China doubled down on its excessive and expansive claims in the South China Sea in violation of international law and regional principles: launching large-scale naval drills, deploying coast guard and para-military vessels to disputed areas, challenging US military assets, and harassing smaller claimant states, particularly Vietnam, Malaysia and the Philippines. With the pandemic hammering their economies, many regional governments will look to China for economic relief as the region slides into coronavirus-driven recession. China may soon move from Belt and Road Initiative (BRI) projects to all-out ‘bargain hunting’ among besieged neighbors, who are desperate to shore up their coffers and may, accordingly, consider opening up strategic state assets.
