RAMAKRISHNAN A/L SUPPIAH (BEKOK) SOALAN B1 Jalan sementara yang dibina untuk tujuan Projek Landasan Kereta Api Berkembar menghubungkan kawasan Bekok dan Paloh. Jalan ini dapat menjimatkan kos dan masa perjalanan Bekok ke Paloh. Maka, dimohon untuk menjadikan jalan sementara ini ditukar kepada jalan kekal bertar. JAWAPAN YB TUAN HAJI MOHD SOLIHAN BIN BADRI Untuk makluman Yang Berhormat Bekok, bagi jalan sementara yang dibina di kawasan Projek Landasan Kereta Api Berkembar menghubungkan kawasan Bekok dan Paloh ini digunakan oleh pihak kontraktor bagi memudahkan kerja-kerja pembinaan landasan kereta api. Apabila projek telah siap, status jalan ini akan dimansuhkan. Tambahan lagi, jalan sementara ini tidak boleh ditukar kepada laluan kekal yang berturap kerana laluan sementara ini berada di dalam rizab Perbadanan Aset Kereta api (RAC) yang akan dibangunkan sebagai laluan kereta api pada masa akan datang. Selain itu, isu kelulusan penggunaan tanah jalan sementara itu di bawah bidang kuasa RAC dan perlu mendapat kebenaran atau kelulusan RAC jika ingin digunakan terus. Untuk makluman Yang Berhormat juga, jalan kekal hanya boleh dipohon kepada Kerajaan Persekutuan dan dibina di atas rizab jalan di atas tanah Kerajaan atau melalui pengambilan tanah untuk maksud tersebut. RAMAKRISHNAN A/L SUPPIAH (BEKOK) SOALAN B2 Terdapat banyak laporan mengenai kes kemasukan binatang liar seperti gajah yang merosakkan hasil kebun durian, kelapa sawit dan pokok pisang terutamanya di kawasan pedalaman Bekok, Mersing dan Kota Tinggi. Dimohon agar memindahkan gajah-gajah liar ini ke tempat santuari gajah. JAWAPAN YB TUAN VIDYANANTHAN A/L RAMANADHAN Masalah konflik hidupan liar terutama spesies gajah adalah disebabkan oleh beberapa faktor, di mana kehilangan habitat merupakan penyumbang utama. Kawasan hutan yang semakin berkurangan akibat pembalakan, pertanian dan penempatan serta pembangunan pesat telah menyebabkan kawasan rayau hidupan liar menjadi semakin terhad dan sumber makanan semula jadi hidupan liar ini semakin berkurangan. Sebagai contoh, seekor gajah dewasa memerlukan makanan sekurang-kurangnya 200 kg dan 200 liter air sehari bagi menampung keperluannya. Gajah juga memerlukan kawasan rayau yang luas antara 25 km2 hingga 100 km2 untuk bergerak. Gajah menghabiskan masa 17 hingga 18 jam sehari bergerak dari satu tempat ke satu tempat sambil mencari makan. Kekurangan sumber makanan telah memaksa hidupan liar ini keluar dari hutan dan menceroboh ke kawasan ladang yang dahulunya adalah habitat gajah. Pada masa yang sama, gajah juga turut terdedah kepada risiko dibunuh, diracun, terjerat atau dicederakan sebagai reaksi tindak balas daripada orang ramai akibat kerugian yang dialami apabila gajah masuk ke dalam kawasan ladang atau penempatan mereka. Pelbagai bentuk usaha telah dilakukan oleh Jabatan PERHILITAN dalam menangani masalah gangguan gajah seperti kawalan dan pemantauan di lokasi aduan, tembak halau dan operasi tangkap pindah. Kewujudan Santuari Gajah Johor (JES) adalah bagi menguruskan masalah konflik gajah terutamanya bagi daerah Kota Tinggi. Anggaran populasi gajah di negeri Johor adalah 120-160 ekor yang bertaburan di empat daerah iaitu Kota Tinggi, Mersing, Kluang dan Segamat. Adalah diharapkan dengan adanya JES, aduan konflik manusia-gajah dapat dikurangkan sehingga 50% dalam tempoh 5 tahun selepas projek pembangunan JES beroperasi sepenuhnya dan sebahagian besar gajah yang sering menimbulkan konflik dapat diuruskan secara lebih lestari. Pengayaan habitat seperti penyediaan padang ragut dan penyediaan jenut tiruan akan dijalankan bagi membolehkan gajah-gajah tersebut kekal dalam kawasan santuari dan tidak keluar mencari makan ke kawasan pertanian atau penempatan berhampiran. RAMAKRISHNAN A/L SUPPIAH (BEKOK) SOALAN B3 Lesen Pendudukan Sementara (TOL) yang diberikan kepada penduduk di Kawasan Sungai Sabar haruslah dikaji semula. Penduduk di Sungai Sabar haruslah diberi pemilikan penuh terhadap tanah yang mereka menduduki selama 50 tahun dan ke atas. JAWAPAN YAB MENTERI BESAR Untuk makluman YB Bekok, Lesen Pendudukan Sementara (LPS) ialah satu bentuk pelupusan tanah oleh Pihak Berkuasa Negeri (PBN) iaitu satu cara di mana Pihak Berkuasa Negeri (PBN) membenarkan tanah tertentu diduduki atau digunakan seperti yang diperuntukkan dalam Seksyen 42(1)(c) dan Seksyen 66 Kanun Tanah Negara (KTN) 1965. Permohonan LPS ini boleh dikemukakan kepada Pejabat Tanah Daerah untuk diproses sekali gus berikan pertimbangan PBN. Sehubungan dengan itu, Kampung Sungai Sabar terletak di Mukim Chaah, kira-kira 500 meter dari Pekan Chaah dan kawasan ini juga berada di atas Rizab Sungai Lenek dengan jarak di antara petempatan penduduk dengan sungai dalam lingkungan 15 hingga 60 meter sahaja. Majlis Mesyuarat Kerajaan pada 12.6.2013, telah BERSETUJU untuk tanah-tanah ini dikeluarkan Lesen Pendudukan Sementara bagi tujuan tapak kediaman kepada 62 pemohon. Kawasan perkampungan ini juga telah diduduki sekitar tahun 1970-an lagi dan terdapat kira-kira 44 buah kediaman yang penduduk kampung berkenaan sehingga kini yang terdiri daripada jenis kekal, separuh kekal dan jenis sementara. Selain itu, terdapat juga 2 buah kuil di atas tapak yang telah diluluskan LPS. Berdasarkan kepada rekod semakan di Pentadbiran Tanah Daerah (K) Labis, didapati bahawa masih terdapat tunggakan bayaran LPS oleh pemohon-pemohon yang telah diluluskan pada tahun 2013 yang berjumlah RM32,075.00. Pada 16.2.2020, Pentadbir Tanah Daerah (K) Labis telah mengadakan perjumpaan bersama penduduk kampung berkenaan bagi mengemas kini maklumat penduduk sedia ada bagi permohonan semula LPS sebelum permohonan tersebut dibawa untuk pertimbangan Pihak Berkuasa Negeri (PBN). Walau bagaimanapun, Majlis Mesyuarat Kerajaan di mesyuaratnya pada 25.3.2020 telah BERSETUJU supaya tanah-tanah lapisan pertama berhampiran rizab sungai dan rizab hutan tidak dikurniakan kepada mana-mana individu dan Pentadbir Tanah Daerah boleh menolak permohonan ini tanpa membawa kepada pertimbangan Pihak Berkuasa Negeri (PBN). Di samping itu, MMK pada 26.8.2020 telah memaklumkan bahawa Kerajaan Negeri lebih teliti dalam menimbangkan permohonan-permohonan tanah. Ini termasuk memastikan tanah-tanah yang hendak dikurniakan bukan tanah yang bermasalah seperti terletak di kawasan yang kerap mengalami banjir yang akan menyebabkan pemohon yang diluluskan kurniaan tanah tidak menghargai tanah yang dikurniakan. Sehubungan dengan itu, kawasan ini yang berada di atas Rizab Sungai Lenek dengan jarak di antara petempatan penduduk dengan sungai berhampiran dalam lingkungan 15 hingga 60 meter adalah tertakluk dengan keputusan terkini pihak kerajaan yang bertarikh 25.3.2020 seperti yang dinyatakan. Pematuhan kepada garis panduan dalam menentukan perkara-perkara yang boleh dibuat Penolakan Ringkas (Summary Rejection) sebagaimana Peraturan 3 Kaedah-Kaedah Tanah Johor (2004) dan surat arahan Penolakan Ringkas oleh Pentadbir Tanah bertarikh UNIT DEWAN PEJABAT JURUTULIS DEWAN NEGERI JOHOR ariff (Soalan Bertulis Sept 2020) 3 SUKJ.DN.600-3/4/1 JLD.3 DEWAN NEGERI JOHOR SOALAN-SOALAN BERTULIS BAGI MESYUARAT KEDUA PENGGAL PERSIDANGAN KETIGA DEWAN NEGERI JOHOR YANG KE-14 MULAI PADA 10 SEPTEMBER 2020 DAN 13 SEPTEMBER 2020 16.04.2008. Berdasarkan kepada rekod di Pentadbiran Tanah Johor sehingga 31.08.2020, sebanyak 226 permohonan tanah yang telah diterima di PTG Johor (pemberi milikan dan juga Lesen Pendudukan Sementara) telah dibuat Penolakan Ringkas ke atas permohonan tanah-tanah lapisan pertama berhampiran rizab sungai dan rizab hutan. Pematuhan kepada garis panduan ini juga dilaksanakan secara teliti dan menyeluruh di seluruh Pentadbiran Tanah Daerah. RAMAKRISHNAN A/L SUPPIAH (BEKOK) SOALAN B5 Jalan yang menghubungkan Yong Peng dan Chaah adalah jalan yang sibuk. Kebanyakan laluan jalan utama dari Yong Peng ke Chaah adalah jalan sehala. Maka, dimohon untuk melebarkan jalan sehala ini kepada jalan dua hala sepanjang Jalan Yong Peng ke Chaah. Walau bagaimanapun, kerja-kerja membaik pulih muka jalan dan melebarkan jambatan telah pun dilaksanakan dari seksyen 134.00 hingga 174.00 (Desa temu jodoh - Kg Kwongsai).     governance, POSITION PAPER MALAYSIA’S AIRPORTS INDUSTRY STRUCTURE DECEMBER 2019 This Position Paper outlines the Malaysian Aviation Commission’s position on an optimal structure for Malaysia’s commercial airports sector. EXECUTIVE SUMMARY The performance of the airports industry in Malaysia is influenced by the behaviour and decisions of the Government of Malaysia (GoM). This is due to the latter’s overlapping roles in the industry as policymaker, shareholder, and provider of capex funding. The structure and implementation of the Operating Agreement (OA) between the GoM and Malaysia Airports Holdings Berhad (MAHB), operator of more than 90% of airports in Malaysia, is emblematic of these overlapping roles. The OA underscores the fact that the airports are GoM’s assets. Meanwhile, Khazanah Nasional Berhad (KNB), a sovereign wealth fund, is a major shareholder in MAHB, which is also a publicly listed company. The GoM also determines the overall policy direction for the development of the airports industry. Therefore, there needs to be a more transparent and structured capex funding model for airports in Malaysia, as well as, to mitigate conflicts of interest which may arise from the GoM’s overlapping roles in relation to the Malaysian airports industry. The industry also faces issues arising from MAHB’s limited commercial behaviour which affects service quality to airlines and passengers. The recent failure of the Total Airports Management System is one of many examples of these. These issues and the lack of clarity in the airport funding model have adversely affected the competitiveness and attractiveness of the airports industry in particular, and the aviation sector in general.

We feel this is an encouraging sign, given business is currently limited to domestic Malaysian tourism.
