It shows the obligations to be followed on the side of man and the women as a husband and wife in order to have a blessed matrimonial home. These highlighted the major requirement before the marriage contract and after the contract have been fully consummated. These include the right of the husband and wife, the role of the family and their relatives, the role of the entire community. Also the right of the children on the parents is highlighted. It is recommended that, all Muslim should have a first-hand understanding of the rights of both couples in order to have a peaceful matrimonial home. 1.0 Introduction Marriage in Islam confers duties on each of the couple. Some of these duties are reciprocal while some are complementary. At the same time, some are unitarily handled by each party. Rodli Makmun4 Doctoral Program State Islamic University Sunan Kalijaga, Yogyakarta1, Islamic State Institute (IAIN) Ponorogo, East Java2,3,4 {[email protected], [email protected], [email protected], [email protected]} Abstract: Temporary marriage or nikah mut’ah is a classic discourse which is still being debated. Apart from the differences of opinion between the sunni and syiah groups, the writer has viewed it is urgent to temporary marriage as an alternative solution to avoid adultery. This paper will discuss the practice of temporary marriage from the perspective of human rights shari'ah with the aim of seeing the reality of the prevailing laws and regulations in Indonesia and the perspective of maqashid shari'ah to analyze the concept of temporary marriage. This paper is a qualitative research with a library research study approach with an explanative research nature and an evaluative research form. This study aims to identify the problem of temporary marriage, then offers a solution through the application of basic research using the post positivism paradigm. The findings of this study explain that the relationship between the concept of temporary marriage with legislation in Indonesia and maqashid shari'ah is not contradictory, even the practice of temporary marriage is in line with the spirit of Human Rights and does not violate from maqashid shari'ah. I openly bear witness that none has the right to be worshiped except Allah alone without any partners and I bear witness that Muhammad is His Messenger. 2 | Page Guardianship INTRODUCTION: The woman in Islam is a very unique and delicate part of the Muslim community. Allah distinguished her from the male species giving her a separate realm in which she should be dealt with: “And the male is not like the female” (3:36) It is imperative for men to understand this so that they fall into trying to change the woman into something that she is not. Event the Sharee’ah (legislation) of Islam has adjusted some of the religious tenets and obligations to accommodate the feminine nature of the woman such as; One: Placing the financial burden of the family on the shoulders of the man, as Allah says: “The men are the protectors and maintainers of the women because of the strength which Allah has given one of them over the other and because the men spend from their wealth…” (4:34) Two: Alleviating the physical burden of jihad from the women and directing their attention and energy to more important aspects of the religion that are commensurate with her delicate nature. -

AL-GHAZALI AND MARRIAGE FROM THE VIEWPOINT OF SUFISM Kaoru AOYAGI* This paper analyzes Abu f:lamid al-Ghazali (d.llll )'s Book on the Manners of Marriage (Kitab Adab al-Nika~) in his The Revival of the Religious Sciences (J~ya' 'Ulum al-D"in}, and examines the relation between the ideal married life and the practices of Sufism. In studies until now, the contents of this book have been often examined from the viewpoint of sexuality and the problem of women in Islam; however, not much attention has been paid to al-Ghazall's evaluation of marriage within Sufism in these studies. Rather, in studies of marriage, women, and sexuality in Sufism, the focus has usually been on the ideas on sexuality of Ibn al-' Arabi ( d.1240), while few studies of al-Ghazali's Sufism analyze his discussion of marriage. Therefore, the main objective of this paper is to examine al-Ghazali's discussion of marriage from the viewpoint of Sufism and to clarify its originality in the history of Sufi thought, comparing it with that of Abu Talib al-Makki (d.998), a Sufi who influenced al-Ghazali considerably and discussed marriage in detail. Al-Ghazali argues that there are many advantages in living with a wife in marriage, and he demonstrates that a man can devote himself to the worship of God and lead an ideal Sufi life with the help of marriage. On the other hand, al-Makki maintains that celibacy is preferable, at least in his time. Most of his discussion is fragmentary and not as developed as al Ghazali's, though he does treat marriage more comprehensively than the Sufis before him. -

Zahidul Islam PhD Candidate, Ahmad Ibrahim Kulliyyah of Laws, International Islamic University Malaysia (IIUM). ABSTRACT: Marriage is a part of life as well as society. This paper seeks to answer the issue pertaining to the practicability of interfaith marriage in Malaysia. The terms ‘interfaith marriage’ denote marital union wherein the partners belong to the different faith or religion. The definition of interfaith marriage as well as its type will be discussed in detail hereinafter. For the purpose of this paper, our main concern will be on the issue of interfaith marriage in which one of the parties to such marriage is professing Islam while another is ahl al-Kitab (people of the Book). I have based my opinion on primary sources of Shari’ah i.e. Al Quran and Sunnah of the Prophet (S.A.W). I also refer the purpose or Objective of Shari’ah (maqasid al sharia) as well as Principle of the law (al qawa’id al fiqhiyyah).
