    Gaining insight into the magnitude of and factors influencing child marriage and teenage pregnancy and their consequences in Pakistan Baseline Report February 2018 by Madeleen Wegelin, Dinu Abdella Dr. Naghma Rehan Dr. Farkanda Ather, Tasneem Kakal Dr. Maryse Kok Preface YES I DO. is a strategic alliance of five Dutch organizations which main aim is to enhance the decision making space of young people about if, when and whom to marry as well as if, when and with whom to have children. Funded by the sexual and reproductive health and rights policy framework of the Ministry of Foreign Affairs of the Netherlands, the alliance is a partnership between Plan Nederland, Rutgers, Amref Flying Doctors, Choice for Youth and Sexuality, and the KIT Royal Tropical Institute. Led by Plan Nederland, the alliance members have committed to a five-year programme to be implemented between 2016 and 2020 in seven countries: Ethiopia, Indonesia, Kenya, Malawi, Mozambique, Pakistan and Zambia. The YES I DO Alliance partners and the Ministry of Foreign Affairs of the Netherlands acknowledge that child marriage, teenage pregnancy and female genital mutilation/cutting are interrelated issues that involve high health risks and human rights violations of young women and impede socioeconomic development. Therefore, the YES I DO programme applies a mix of intervention strategies adapted to the specific context of the target countries. The theory of change consists of five main pathways: 1) behavioural change of community and ‘’gatekeepers’’, 2) meaningful engagement of young people in claiming for their sexual and reproductive health and rights, 3) informed actions of young people on their sexual health, 4) alternatives to the practice of child marriage, female genital mutilation/cutting and teenage pregnancy through education and economic empowerment, and 5) responsibility and political will of policy makers and duty bearers to develop and implement laws towards the eradication of these practices.

It shows the obligations to be followed on the side of man and the women as a husband and wife in order to have a blessed matrimonial home. These highlighted the major requirement before the marriage contract and after the contract have been fully consummated. These include the right of the husband and wife, the role of the family and their relatives, the role of the entire community. Also the right of the children on the parents is highlighted. Apart from the differences of opinion between the sunni and syiah groups, the writer has viewed it is urgent to temporary marriage as an alternative solution to avoid adultery. This paper will discuss the practice of temporary marriage from the perspective of human rights shari'ah with the aim of seeing the reality of the prevailing laws and regulations in Indonesia and the perspective of maqashid shari'ah to analyze the concept of temporary marriage. This paper is a qualitative research with a library research study approach with an explanative research nature and an evaluative research form. This study aims to identify the problem of temporary marriage, then offers a solution through the application of basic research using the post positivism paradigm. The findings of this study explain that the relationship between the concept of temporary marriage with legislation in Indonesia and maqashid shari'ah is not contradictory, even the practice of temporary marriage is in line with the spirit of Human Rights and does not violate from maqashid shari'ah. Allah distinguished her from the male species giving her a separate realm in which she should be dealt with: “And the male is not like the female” (3:36) It is imperative for men to understand this so that they fall into trying to change the woman into something that she is not. Event the Sharee’ah (legislation) of Islam has adjusted some of the religious tenets and obligations to accommodate the feminine nature of the woman such as; One: Placing the financial burden of the family on the shoulders of the man, as Allah says: “The men are the protectors and maintainers of the women because of the strength which Allah has given one of them over the other and because the men spend from their wealth…” (4:34) Two: Alleviating the physical burden of jihad from the women and directing their attention and energy to more important aspects of the religion that are commensurate with her delicate nature.
