Santiago, Nueve De Enero De Dos Mil Quince. Vistos Santiago, nueve de enero de dos mil quince. Vistos: Que, se inició este proceso a fin de investigar la existencia de dos delitos de homicidio calificado, previstos en el artículo 391 N° 1, circunstancia primera, del Código Penal, en las personas de las víctimas Charles Edmund Horman Lazar y Frank Randall Teruggi Bombatch, respectivamente; y, asimismo, a fin de indagar la concurrencia en ellos en calidad de cómplice de Rafael Agustín González Berdugo, determinadamente, en el delito de homicidio calificado en la persona de Charles Edmund Horman Lazar; y en calidad de autor de Pedro Octavio Espinoza Bravo, este último, en los delitos de homicidio calificado en las personas de Charles Edmund Horman Lazar y de Frank Randall Teruggi Bombatch, respectivamente. Tomo I La investigación penal comienza con la querella de fojas 49, interpuesta por la señora Joyce Hamren Horman, por los delitos de secuestro, homicidio calificado, torturas, inhumación y exhumaciones ilegales y asociación ilícita, cometidos en la persona de su cónyuge Charles Edmund Horman Lazar; según expresa la querella Charles Edmund Horman Lazar fue ejecutado extrajudicialmente por militares del Ejército de Chile, en el mes de septiembre de l973, en el Estadio Nacional en la ciudad de Santiago de Chile. A fojas 107, rola traducción auténtica de certificado de nacimiento de Charles Edmund Horman; A fojas 118, rola traducción auténtica de informe preliminar de defunción de Charles Edmund Horman; A fojas 128, rola traducción auténtica correspondiente a informe de autopsia de la misma persona; A fojas 204, rola fotocopia de oficio del Ministro de Justicia Subrogante, por el cual se adjuntan documentos encontrados 1 en el Archivo General Histórico de esa Secretaría de Estado, respecto a los ciudadanos norteamericanos Charles Edmund Horman y Frank Teruggi; A fojas 248, rola documento “desclasificado” por el Departamento de Estado de los EE.UU., en el que es mencionado “González” como la persona que acompañó a James Anderson al cementerio, para exhumar los restos de Charles Horman; A fojas 252, rola documento “desclasificado”, del mismo origen que el anterior, de octubre de 1973, en el que se indica que el 12 de octubre de ese año, el embajador de EE.UU. señor Nataniel Davis con Pinochet discutieron acerca de la moción parlamentaria de Kennedy, los casos Teruggi y Horman y los problemas de los Derechos Humanos; A fojas 267, rola certificado de defunción de Charles Edmund Horman Lazar, el que señala que la causa de su muerte fue heridas múltiple de bala; A fojas 269, rola copia legalizada de exhumación y traslado de cadáver, de fecha 19 de octubre de 1973, de Charles Edmund Horman Lazar; A fojas 277, rola oficio del Servicio de Registro Civil e Identificación, en el que el Jefe del Departamento Archivo General certifica que Charles Horman falleció el 18 de septiembre de l973, según consta en la inscripción de defunción Nº 1.018, Registro E1, del año l974, de la circunscripción de Independencia; Tomo II A fojas 288, rola declaración de Joseph Francis Doherty Mac Gregor; A fojas 303, y 3.177 de autos, rolan dichos de Isabella Angela Rastello Muzio; 2 A fojas 326, rola documento traducido al español desclasificado del Departamento de Estado de los EE.UU., en el que se asevera que Charles Horman y Frank Teruggi fueron ejecutados extrajudicialmente poco después del golpe por fuerzas chilenas de seguridad. El que agrega en lo atinente que estos casos fueron de muy alto perfil y tuvieron implicaciones graves para las relaciones bilaterales con Chile en los años 1970; que uno de los principales motivos detrás del Proyecto de Desclasificación de Chile fue apoyar a las familias de ciudadanos norteamericanos que fueron víctimas en obtener toda la información en sus archivos que sea relevante a sus casos; A fojas 338, rola documento desclasificado del Departamento de Estado de los EE.UU. que refiere que el Tema: Caso Charles Horman, sigue siendo molestoso. Las implicancias para el ejecutivo no son buenas. En el congreso, comunidad académica, la prensa y la familia Horman, se sugiere negligencia de su parte, o peor, complicidad en la muerte de Horman. (El enfoque de este memorándum es Horman, pero lo mismo se aplica el caso de Frank Teruggi). Agregan que tienen la responsabilidad de negar categóricamente insinuaciones para defender las autoridades de los EEUU.; proceder en contra las autoridades de los EEUU si se justifica. The Case of Charles Horman Revisited: Complication and Conflict within Declassification Jacob Jose Honors Thesis April 13, 2015 1 2 On September 11, 1973, a military junta led by General Augusto Pinochet seized power in Chile, overthrowing the government of socialist president Salvador Allende. In the days that followed, agents of the Chilean junta rounded up, detained, imprisoned, and in many cases executed those perceived to be sympathetic to the former government. In the first two weeks following the coup, the Central Intelligence Agency (CIA) estimated that the military government executed nearly 2,000 people.1 One victim of this repression was a U.S. citizen, Charles Horman.2 Horman was a journalist and filmmaker who, along with his wife, had settled in Chile in 1972 to witness socialism first-hand.
