LEGAL OPINION concerning the Decisions of the Republican Broadcasting Agency Council of Serbia on the allocation of broadcasting licenses for Radio and Television stations for the territory of the Republic and for the territory of the Autonomous Province by dr Karol Jakubowicz Director, Strategy and Analysis Department, National Broadcasting Council of Poland Warsaw, 21 May 2006 INTRODUCTION The present legal opinion was commissioned by the Media Department of the OSCE Mission to Serbia and Montenegro on May 17, 2006, in acknowledgment of serious concerns expressed by several interested parties and independent analysts following the publication by the Republican Broadcasting Agency (hereinafter “RBA”) Council of the Decisions on the allocation of national broadcasting licenses for Radio and Television stations.1 The present consultant 2 was instructed to write a legal assessment of: – the Decision on Issuing Broadcasting Licenses for TV Programmes for the Territory of the Republic, and of – the Decision on Issuing Broadcasting Licenses for Radio Programmes for the Territory of the Republic – the Decision on Issuing Broadcasting Licenses for TV Programmes for the Territory of the Autonomous Province The Decisions were to be assessed in terms of their compliance with the Broadcasting Law of the Republic of Serbia, the Broadcasting Development Strategy, the Regulation on Issuing Broadcasting License, Criteria for Issuing Broadcasting Licenses, RBA Statute, as well as with the European Convention on Human Rights, European standards, recommendations and best practices. SERBIA Jovanka Matić and Dubravka Valić Nedeljković porocilo.indb 327 20.5.2014 9:04:47 INTRODUCTION Serbia’s transition to democratic governance started in 2000. Reconstruction of the media system – aimed at developing free, independent and pluralistic media – was an important part of reform processes. After 13 years of democratisation eﬀ orts, no one can argue that a new media system has not been put in place. Th e system is pluralistic; the media are predominantly in private ownership; the legal framework includes European democratic standards; broadcasting is regulated by bodies separated from executive state power; public service broadcasters have evolved from the former state-run radio and tel- evision company which acted as a pillar of the fallen autocratic regime. However, there is no public consensus that the changes have produced more positive than negative results. Th e media sector is liberalized but this has not brought a better-in- formed public. Media freedom has been expanded but it has endangered the concept of socially responsible journalism. Among about 1200 media outlets many have neither po- litical nor economic independence. Th e only industrial segments on the rise are the enter- tainment press and cable channels featuring reality shows and entertainment. Th e level of professionalism and reputation of journalists have been drastically reduced. Th e current media system suﬀ ers from many weaknesses. Media legislation is incom- plete, inconsistent and outdated. Privatisation of state-owned media, stipulated as mandato- ry 10 years ago, is uncompleted. Th e media market is very poorly regulated resulting in dras- tically unequal conditions for state-owned and private media.

Negative trends associated with the media sphere in previous years persist, such as the media’s low level of professionalism, poor protection and conditions for journalists, a weak and oversaturated media market, an unsustainable public media service, a fragmented media scene, and political influence. BOSNIA & HERZEGOVINA 16 EUROPE & EURASIA MEDIA SUSTAINABILITY INDEX 2014 introduction OVERALL SCORE: 2.04 BOSNIA & HERZEGOVINA Bosnia and Herzegovina (B&H) did not show signs of political or economic stabilization in 2013. The governing political parties avoided focusing on substantive reforms and implementing international standards. In April, Ba new political party launched—the Democratic Front, led by Željko Komšić, the Croat member of the B&H tripartite presidency. In the same month, the president of the Federation of B&H, Živko Budimir, was arrested on the accusation of taking bribes to approve amnesties but was released in May due to lack of evidence. In June 2013, public protests in front of Sarajevo’s parliament building and in other cities in B&H highlighted the lack of regulation of citizen IDs for newborns. The citizen initiative across B&H, although holding a promise of revolutionary change, ended as an unsuccessful bid to change politicians’ corruption, inequality, and incompetence. Finally, at the beginning of November, the B&H House of Peoples, in an emergency session and without debate, adopted the proposed amendments and changes to the law on ID numbers. The fact that the protests were organized through online platforms and social media illustrated new media’s growing influence in socially mobilizing the country. However, Serb and Croat parliamentarians framed the protests as an ethnically driven threat to their security and refused to attend parliamentary sessions for several weeks.

INTERNATIONAL ELECTION OBSERVATION MISSION Bosnia and Herzegovina – General Elections, 7 October 2018 STATEMENT OF PRELIMINARY FINDINGS AND CONCLUSIONS PRELIMINARY CONCLUSIONS The 2018 general elections in Bosnia and Herzegovina were genuinely competitive but characterized by continuing segmentation along ethnic lines. Voters were presented with a wide choice of candidates, who were able to campaign freely. Contestants, however, focused more on personal attacks and fearmongering than on discussing political alternatives. Dependence of media on political and business interests often caused biased coverage. Instances of pressure and undue influence on voters were not effectively addressed. Long-standing deficiencies in the legal framework remain and recent reform discussions stalled due to political disagreements, further eroding trust in public institutions. Overall, the upper levels of the election administration ran the elections efficiently. On election day, polling station commissions worked transparently but faced some difficulties with following procedures, particularly during counting. The legal framework is generally conducive to democratic elections. However, important long-standing shortcomings remain, as constitutional and electoral reforms were stalled by political deadlocks. In particular, restrictions on the right to stand based on ethnicity and residence are contrary to OSCE commitments, Council of Europe and other international standards. Judgments of the European Court of Human Rights on this issue remain unimplemented.
