As a result, the CAVC has had one of the highest, if not the highest, case loads per active judge of any federal appellate court in the country. In response, in 2008, the CAVC was authorized to expand --- at least temporarily --- to nine judges, as of January 2010. However, the authorization to increase the number of CAVC judges, which was part of the Veterans Benefits Improvement Act of 2008, was set to expire at the end of 2012 if the positions were not filled. Although the CAVC grew to eight judges with the confirmations of Judges Coral Wong Pietsch and Margaret Bartley in May 2012, no other nomination was pending when the Veterans Law Journal last went to press. William S. Greenberg, the newest member of the CAVC. The White House subsequently acted on November 15, 2012, with the nomination of William S. Greenberg. Judge William S. Federal Judge’s ERA-Expired Ruling Likely to Extend an Unbroken 40-Year Losing Streak For ERA-Resuscitation Legal Claims WASHINGTON – Three Democratic attorneys general today appealed a landmark March 5 ruling by federal Judge Rudolph Contreras, who held that the Equal Rights Amendment expired decades ago, and that the ERA in reality has not been “ratified” by 38 states as has been widely reported (Virginia v. Ferriero). Attorneys general Mark Herring (Virginia), Aaron Ford (Nevada), and Kwame Raoul (Illinois) filed notice in the U.S. District Court for the District of Columbia that they appeal Judge Contreras’ ruling to the U.S. Court of Appeals for the District of Columbia. “The March 5 ruling by Judge Rudolph Contreras, a widely respected judge appointed by President Obama, holding the 1972 ERA expired decades ago, was only the latest in an unbroken, 40-year chain of rejections of ERA-is-alive legal claims by federal judges of all stripes,” said NRLC Senior Policy Advisor Douglas Johnson, director of NRLC’s ERA Project. “Today, three Democratic attorneys general set the stage for the hammering of yet more judicial nails into the ERA’s coffin lid.” Judge Contreras ruled that the deadline included by Congress in the Proposing Clause of the 1972 ERA Resolution was constitutional, and the ERA therefore expired more than three decades ago. Flynn (“Mr. Flynn”), a retired United States Army Lieutenant General and the former National Security Advisor to the President of the United States, pled guilty to willfully and knowingly making materially false statements and omissions to the Federal Bureau of Investigation (“FBI”), in violation of 18 U.S.C. § 1001(a)(2). Mr. Flynn admitted to lying about his conversations with Russia’s Ambassador to the United States (“Russian Ambassador”) during his FBI interview on January 24, 2017. The case was originally assigned to Judge Rudolph Contreras. Judge Contreras accepted the guilty plea, finding that Mr. Flynn—who was represented by experienced attorneys—knowingly, voluntarily, and intelligently entered into the Plea Agreement. Six days later, on December 7, 2017, the case was randomly reassigned to this Court, which scheduled a sentencing hearing Case 1:17-cr-00232-EGS Document 144 Filed 12/16/19 Page 2 of 92 for December 18, 2018. During that hearing, the Court conducted an extension of the plea colloquy in view of statements made in Mr. Flynn’s sentencing memorandum that raised questions as to whether Mr. Flynn sought to challenge the circumstances of his FBI interview. In response to the Court’s questions, Mr. Flynn maintained his plea of guilty upon the advice of counsel.

INTRODUCTION Hoping to secure a place in the Constitution for sex equality, Plaintiffs Nevada, Illinois, and Virginia ratified the Equal Rights Amendment (“ERA”) years after many presumed it was dead. They now challenge the refusal of the Archivist of the United States to publish and certify the amendment as part of the Constitution. Laudable as their motives may be, Plaintiffs run into two roadblocks that forbid the Court from awarding the relief they seek. First, the Archivist’s publication and certification of an amendment are formalities with no legal effect. His failure to perform those formalities does not cause Plaintiffs any concrete injury, so they lack standing to sue. Second, even if Plaintiffs had standing, Congress set deadlines for ratifying the ERA that Case 1:20-cv-00242-RC Document 117 Filed 03/05/21 Page 2 of 37 expired long ago.
