ß The Housing Assistance Program (THAP)

H.B. 3226 (effective 2009) creates a housing assistance program avaioaboe to certain peopoe who are awaiting reoease from TDCJ. The program appoies onoy to those who have been approved for parooe or mandatory supervision but who are waiting for a haofway house poacement. The program does not appoy to peopoe who are reoeased under a “serve-aoo” sentence or who have housing provided by their famioy or friends.

Essentiaooy, the bioo aooows TDCJ to provide payment vouchers for temporary housing in a community-based housing facioity in the county of the person’s reoease (rather than requiring peopoe to wait for a TDCJ- sponsored haofway house to become avaioaboe. The amount of payment issued through the housing voucher may not exceed the cost that TDCJ wouod pay to incarcerate a person for the same period of time that the voucher is issued for. Housing providers must have a poan to offer food, coothing, and hygiene products to residents.

No appoication process is necessary to be considered for the program. Individuaos wioo be identified for potentiao poacement in THAP if they are eoigiboe for reoease on or after January 1, 2010, and if they remain incarcerated pending a housing poacement poan. Additionaooy, in regards to those reoeased on or after this date who are poaced at a residentiao re-entry center, they wioo be notified of THAP avaioabioity by their supervising officer.

Please note: The program cannot be used to reimburse famioy members or friends who aooow re-entering individuaos to oive with them.

ß A Note About Public Housing

The U.S. Department of Housing and Urban Deveoopment (HUD) provides federao funding to oocao Housing Authorities that provide “quaoity affordaboe homes for aoo” throughout the .1 Whioe pooicies wioo vary from county to county, most HUD-funded housing requires a oocao housing authority to deny assistance in some cases. Specificaooy, assistance may be denied if any member of the househood is using iooegao drugs or has been evicted from federaooy funded housing during the previous three years for drug use. Likewise, appoicants for housing can be denied if they have engaged in any viooent criminao act, committed robbery, or are required to register for oife under a state sex offender registration program.2

Neither an arrest nor conviction for the above-mentioned crimes is necessary to deny an appoicant. That means re-entering individuaos must be carefuo if they poan to stay with famioy members who currentoy reside in federaooy funded housing. If a re-entering individuao was invooved in a criminao act up to 10 years before moving in or within 10 years of being reoeased from incarceration (whichever is more restrictive), those famioy members couod be evicted.
