Biological and conference opinion: No Jeopardy and no destruction or adverse modification of proposed critical habitat. Incidental take statement: Anticipated take: Exceeding this level may require reinitiation of formal consultation. The Service anticipates incidental take may occur for the Gila topminnow, Chiricahua leopard frog, southwestern willow flycatcher, and lesser long-nosed bat. The Service also anticipates that take may occur for the desert pupfish and aplomado falcon, should they be reestablished as proposed under this plan. Take is anticipated for the Gila chub, should it become listed. Conservation recommendations: Implementation of conservation recommendations is discretionary. Multiple conservation recommendations to further the conservation and recovery of the species and implement the appropriate recovery plans for each species. Your request for formal consultation was dated April 19, 2002, and received by us on April 22, 2002. At issue are impacts that may result from the proposed Las Cienegas National Conservation Area Resource Management Plan (RMP)[File No. 6840(068)] in Pima and Santa Cruz counties, Arizona. You requested formal consultation on the endangered southwestern willow flycatcher (Empidonax traillii extimus), endangered Gila topminnow (Poeciliopsis o. occidentalis), endangered Huachuca water umbel (Lilaeopsis schaffneriana var. recurva), endangered desert pupfish (Cyprinodon m. macularius), endangered Canelo Hills ladies'-tresses (Spiranthes delitescens), and the endangered lesser long-nosed bat (Leptonycteris curasoae yerbabuenae). You also requested a conference on the Chiricahua leopard frog (Rana chiricahuensis) and the Gila chub (Gila intermedia). Only the Gila chub has proposed critical habitat within the planning area, and no other species has designated critical habitat in the area. In your memorandum, you requested our concurrence that the proposed action was not likely to adversely affect the endangered Aplomado falcon (Falco femoralis) and the endangered jaguar (Panthera onca). You determined the proposed action would not affect the endangered cactus ferruginous pygmy-owl (Glaucidium brasilianum cactorum). Discussions between our staffs determined that the pygmy-owl and aplomado falcon should undergo formal consultation. Your letter of July 10, 2002, requested formal consultation for these two species. We concur with the determination for the jaguar, and our rationale is given in Appendix A. 2 This biological opinion and conference opinion is based on information provided in the April 2002 biological assessment, the August 2001 draft resource management plan and environmental impact statement, numerous telephone conversations, field investigations, and other sources of information. References cited in this biological and conference opinion are not a complete bibliography of all references available on the species of concern, the proposed activities and its effects, or on other subjects considered in this opinion. A complete administrative record of this consultation is on file at this office. Because there have been several section 7 consultations completed on actions in the area and the RMP includes all actions proposed to be taken over the next 20 years, the previous consultations are incorporated here by reference. In addition, all reasonable and prudent measures and terms and conditions still outstanding are incorporated here by reference.     THE NATIONAL TRAILS SYSTEM ACT (P.L. 90-543, as amended through P.L. 111-11, March 30, 2009) (also found in United States Code, Volume 16, Sections 1241-1251) AN ACT To establish a national trails system, and for other purposes. Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, SHORT TITLE SECTION l. This Act may be cited as the "National Trails System Act". STATEMENT OF POLICY SEC. 2. [16USC1241] (a) In order to provide for the ever-increasing outdoor recreation needs of an expanding population and in order to promote the preservation of, public access to, travel within, and enjoyment and appreciation of the open-air, outdoor areas and historic resources of the Nation, trails should be established (i) primarily, near the urban areas of the Nation, and (ii) secondarily, within scenic areas and along historic travel routes of the Nation which are often more remotely located. (b) The purpose of this Act is to provide the means for attaining these objectives by instituting a national system of recreation, scenic and historic trails, by designating the Appalachian Trail and the Pacific Crest Trail as the initial components of that system, and by prescribing the methods by which, and standards according to which, additional components may be added to the system. (c) The Congress recognizes the valuable contributions that volunteers and private, nonprofit trail groups have made to the development and maintenance of the Nation's trails. In recognition of these contributions, it is further the purpose of this Act to encourage and assist volunteer citizen involvement in the planning, development, maintenance, and management, where appropriate, of trails.

NO. 001.2 Dixie National Forest, Escalante Ranger District General Description: The Great Western Trail is a continuous trail system that extends from Canada to Mexico and crosses through Arizona, New Mexico, Utah, Wyoming, Montana, and Idaho. The trail is marked by the Great Western Trail symbol and has sections open to hikers, bikers, horseman, and Off Highway Vehicles (OHVs). Approximately 80 miles of the Great Western Trail traverses the Escalante District, utilizing existing trail systems. Mileage: 9.4 miles one way Difficulty: Foot: Easy Bike: Moderate Horse: Easy OHV: Permitted only where this trail follows open roads Trailhead access: Graded dirt road Elevation loss / gain: 400 feet Water availability: Water may be available in South Creek but is not reliable. Bring your own water for day hikes. All water should be filtered or treated before drinking. Hazards / obstacles: Weather can change quickly. Be prepared for cold weather year round. Topo maps: USGS 7.5 minute quads: Pine Lake, Sweetwater Creek The Trailhead: From Tropic drive 7.4 miles west on Highway 12 to the Bryce Canyon / Antimony intersection. Turn north (right) toward Antimony. This is county road 1660 locally know as Johns Valley Road. 10.7 miles down Johns Valley Road turn right on FR 132, signed Pine Lake Campground. Continue on FR 132 for 5.43 miles to the Pine Lake Campground. Turn left and follow the road (still FR 132) east .25 miles to the Pine Lake OHV trailhead.
