The Formation of Liberal and Anti-Liberal Islamic Legal Thinking in Indonesia Akh
Akh. Muzakki IS EDUCATION DETERMINANT? The Formation of Liberal and Anti-liberal Islamic Legal Thinking in Indonesia Akh. Muzakki The University of Queensland, Australia Abstract: Liberalism and anti-liberalism are two increasing- ly prominent but staunchly opposing streams of Islamic legal thinking in Indonesia. This article analyses the formation of each of the two through an examination of the role of formal education. It focuses on organic intellectuals during two periods, the New Order and the reformasi. Challenging the strongly-held thesis of the determinant role of education, this article argues that both liberal and anti-liberal Islamic legal thinking in Indonesia is a result of not only the intellectual formation in the sense of academic training and access to education and knowledge, but also the sociological background and exposure in building a new epistemic community in an urban context. As a theoretical understanding of sociolo- gical background and exposure, the concept of epistemic community deserves to be taken as an analytical framework in addition to education for the analysis of the formation of the two contesting bents of Islamic legal thinking in Indonesia. Keywords: Liberalism, anti-liberalism, Islamic legal think- ing, education, epistemic community. Introduction In his controversial speech entitled “The Necessity of Islamic Renewal Thinking and the Problem of the Integration of the Ummah” on 2 January 1970, Madjid argued for a dynamic approach to Islam which requires reinterpretation of Islamic teachings in context with place and time. In more elaborate ways, he further argued that Islamic values move in line with the spirit of humanitarianism which promotes 280 JOURNAL OF INDONESIAN ISLAM Volume 01, Number 02, December 2007 Is Education Determinant? the dignity of Mankind. -
The Literature of Kita Morio DISSERTATION Presented In
Insignificance Given Meaning: The Literature of Kita Morio DISSERTATION Presented in Partial Fulfillment of the Requirements for the Degree Doctor of Philosophy in the Graduate School of The Ohio State University By Masako Inamoto Graduate Program in East Asian Languages and Literatures The Ohio State University 2010 Dissertation Committee: Professor Richard Edgar Torrance Professor Naomi Fukumori Professor Shelley Fenno Quinn Copyright by Masako Inamoto 2010 Abstract Kita Morio (1927-), also known as his literary persona Dokutoru Manbô, is one of the most popular and prolific postwar writers in Japan. He is also one of the few Japanese writers who have simultaneously and successfully produced humorous, comical fiction and essays as well as serious literary works. He has worked in a variety of genres. For example, The House of Nire (Nireke no hitobito), his most prominent work, is a long family saga informed by history and Dr. Manbô at Sea (Dokutoru Manbô kôkaiki) is a humorous travelogue. He has also produced in other genres such as children‟s stories and science fiction. This study provides an introduction to Kita Morio‟s fiction and essays, in particular, his versatile writing styles. Also, through the examination of Kita‟s representative works in each genre, the study examines some overarching traits in his writing. For this reason, I have approached his large body of works by according a chapter to each genre. Chapter one provides a biographical overview of Kita Morio‟s life up to the present. The chapter also gives a brief biographical sketch of Kita‟s father, Saitô Mokichi (1882-1953), who is one of the most prominent tanka poets in modern times. -

The questions that arise in this study are what kinds of nationalism-themed advertisements were produced and the reason behind their production, and by what companies, as well as on what basis were the ads produced? This research uses discourse analysis method from the perspective of history in order to see the relation between the advertisers and the media owner. Olygopoli, Kepemilikan Media Dan Kebijakan Negara
Kata Kunci : Kepemilikan, Oligopoly, dan Negara A. Pendahuluan. -

THE ULAMA in INDONESIA: Between Religious Authority and Symbolic Power
MIQOT Vol. XXXVII No. 1 Januari-Juni 2013 THE ULAMA IN INDONESIA: Between Religious Authority and Symbolic Power Zulkifli Fakultas Ilmu Sosial dan Ilmu Politik UIN Syarif Hidayatullah Jl. Ir. Abstract: This article attempts to examine the relationship between the role of ulama, religious authority, and symbolic power in Indonesian Muslim society by scrutinizing famous literature of ulama in Indonesia. In the study I utilize French sociologist Pierre Bourdieu’s theoretical framework known as theory of practice, hardly ever used in the study of religion (Islam) in Indonesia. The study reveals that the ulama have played a strategic role in the Indonesian society and their role continues to be important in the context of rapid social, political, and economic changes. -

FAR EASTERN SECTION POSTWAR CHANGES IN THE JAPANESE CIVIL CODE KURT STEINER* I. HiSTORICAL OBSERVATIONS T HE FMST great wave of foreign culture to reach Japan came from China by way of Korea. This period, which was landmarked by the comng of priests to Japan, resulted in the creation of a new moral structure, which even today forms an integral part of Japanese social ethics. In the legal field it is characterized by the adoption of the Taiho Code of 701 A.D., an event of first magnitude in Japanese legal history With it Japan entered the family of Chinese law where it was destined to remain for more than 1,000 years.' The Taiho Code did not draw a clear line of demarkation between morality and law or between private law and public law Its aim was not to regulate private intercourse between individuals delineating their respective rights, but to preserve moral order and harmony in human relations. -

The results of the article showed that there are three important thoughts about zakat that are explained in the Maba‟id of Jurisprudence which we can critically analyze as a criticism the extent to which the fiqh of zakat is relevant as applied science both past and present. First, the book only mentions zakat for plants and fruits by only mention the 10% without the 5%. Second, only plants that produce staples, dates and dried grapes, gold and silver are required to pay zakat. Third, the unclear nisab of gold and silver. Law istinbath method used is based on Mazhab Syafi‟i but without a clear nash mention on the book Maba‟id of Jurisprudence. The Maba‟id of Jurisprudence is a work of Malay Jurisprudence that needs to be appreciated. -

Abstract The progress achieved by Western countries in the fields of science, technology and economics is rooted in liberalism, pluralism and secularism. For this reason, some Indonesian Muslim intellectuals want to reform their people accordingly.
