Nicks had been scheduled to headline one day each of BottleRock Napa Valley in California and the Jazz Aspen Festival in Colorado in September. In Octo- ber, she was to have played two days of the Austin City Limits Music Festival and one day of the New Orleans Jazz and Heritage Festival. The dates were all the shows she had planned for 2021. “These are challenging times with challenging decisions that have to be made. I want everyone to be safe and healthy and the rising Covid cases should be of concern to all of us,” the 73-year-old singer said in the statement. “While I’m vac- cinated, at my age, I am still being extremely cautious and for that reason have decided to skip the 5 performances I had planned for 2021.” Most of the festivals them- selves are moving forward Nicks with replacement headliners. I don’t usually watch cable news, but I felt stunned, uncomprehending—almost embarrassed by the intensity of my own bereavement—it was almost as if I were looking for permission to grieve. But cable news ain’t no fireside chat. The first hours after Jackson’s death were awful, as the network anchors scrambled vainly for newsy details while stumbling through awkward, ad libbed panegyrics. They obviously hadn’t come to work prepared to bury the King of Pop. It must have been like trying to eulogize Santa Claus. It was the Rev. Al Sharpton who ultimately came to their rescue with a hastily-called press conference on the steps of the Apollo Theater in Harlem. With that landmark of African-American music as a backdrop, Sharpton offered up a consumable context for Jackson’s life and work, and the networks gratefully ran with it. This is likely when Sharpton earned his own show on MSNBC. And it’s also Copyright Eric Busch 2008 2 when Michael Jackson, who spent his whole life dancing just beyond the defining grip of race and gender, finally began receiving his due as a racial pioneer. But making Jackson a “race man” also downplays his gendered significance. At Jackson’s memorial service a week or so later, Rev. Sharpton and others credited him for doing the intensely personal work of human relations—of “creating a comfort level” that allowed children from all over the world to connect with one another. -

Frye* In his iconic song, “Scenes from an Italian Restaurant,” Billy Joel uses a series of vignettes to describe an encounter between two former classmates, meeting again after many years.1 The song begins as a ballad as they exchange pleasantries, segues into jazz as they reminisce about high school, shifts to rock as they gossip about the decline and fall of the former king and queen of the prom, then returns to a ballad as they part.2 The genius of the song is that the banality of the vignettes perfectly captures the subjective experience of its protagonists. This essay uses a series of vignettes drawn from Joel’s career to describe his encounters with copyright law. It begins by examining the ownership of the copyright in Joel’s songs. -
