CONVENTION DE PARTICIPATION MODIFIÉE ET REFORMULÉE (modifiée et refondue le 1er septembre 2017) CONVENTION DE PARTICIPATION MODIFIÉE ET REFONDUE, conclue et prenant effet le 1er septembre 2017 (la « date d’entrée en vigueur ») ENTRE : COMMISSION DES PLAINTES RELATIVES AUX SERVICES DE TÉLÉCOM-TÉLÉVISION INC./COMMISSION FOR COMPLAINTS FOR TELECOM-TELEVISION SERVICES INC., une Corporation constituée en vertu des lois canadiennes (ci-après appelée la « Corporation ») - et - LES FOURNISSEURS DE SERVICES PARTICIPANTS (tels que définis ci-dessous) ATTENDU QUE la Corporation est une corporation sans capital-actions constituée en vertu de lettres patentes datées du 10 juillet 2007 aux termes de la partie II de la Loi sur les corporations canadiennes et prorogée le 29 janvier 2014 sous le régime de la Loi canadienne sur les organisations à but non lucratif; ATTENDU QUE la Corporation a été mise sur pied en application du décret du Conseil privé no 2007- 533, dans lequel est envisagée la possibilité, entre autres, que la Corporation soit un organisme indépendant ayant pour mandat de régler les plaintes des particuliers et des petites entreprises clients au détail des fournisseurs de services de télécommunications, et que tous les fournisseurs de services de télécommunications devraient participer au financement de la Corporation et y contribuer. ATTENDU QUE la structure et le mandat de la Corporation ont été approuvés par le CRTC dans sa décision de télécom CRTC 2007-130, sous réserve du respect de certaines conditions qui y sont énoncées; ATTENDU QUE certains aspects de la décision de télécom CRTC 2007-130 ont été modifiés par le CRTC dans la décision de télécom CRTC 2008-46; ATTENDU QUE la décision de télécom CRTC 2007-130, modifiée par la décision de télécom CRTC 2008-46, stipule que pour pouvoir fournir des services de télécommunications, certains fournisseurs de services de télécommunications sont tenus d’être des fournisseurs de services participants de la Corporation; ATTENDU QUE dans la politique réglementaire de télécom CRTC 2011-46, le CRTC a déterminé que tous les fournisseurs de services de télécommunications qui offrent des services visés par le mandat de la Corporation doivent être des fournisseurs de services participants pendant une période additionnelle de cinq ans; ATTENDU QUE dans la décision de télécom CRTC 2011-702, le CRTC approuve le Code sur les politiques de débranchement et de dépôt pour qu’il soit administré par la Corporation. ATTENDU QUE dans la politique réglementaire de télécom CRTC 2013-271, le CRTC demande que la Corporation administre le Code sur les services sans fil; ATTENDU QUE dans la politique réglementaire de radiodiffusion CRTC 2015-104, le CRTC indique qu’il publiera un Code des fournisseurs de services de télévision et détermine que la Corporation serait la partie idoine pour administrer ce code; ATTENDU QUE dans la décision de télécom CRTC 2015-478, le CRTC prolonge, de manière provisoire, la période d’application de l’exigence voulant que tous les fournisseurs de services de télécommunication offrant des services visés par le mandat la Corporation soient des fournisseurs de services participants; ATTENDU QUE dans la politique réglementaire de radiodiffusion CRTC 2016-1, le CRTC publie le Code des fournisseurs de services de télévision; ATTENDU QUE dans la politique réglementaire de radiodiffusion et de télécom CRTC 2016-102, le CRTC détermine, entre autres, que (i) la Corporation administrera le Code des fournisseurs de services de télévision; que (ii) tous les fournisseurs de services de télécommunications qui offrent des services visés par le mandat de la Corporation sont tenus d’être des fournisseurs de services participants; que (iii) tous les fournisseurs de services de télévision autorisés et les fournisseurs de services exemptés liés doivent devenir et demeurer des fournisseurs de services participants, conformément à l’échéancier indiqué dans la politique; et que (iv) les fournisseurs de services de télécommunications qui poursuivent leurs activités de concert avec un fournisseur de services de télévision ou sont affiliés à un tel fournisseur doivent devenir et demeurer des fournisseurs de services participants en ce qui concerne leurs activités de télécommunications, conformément à l’échéancier précisé dans la politique; ATTENDU QUE les fournisseurs de services de télécommunications et les fournisseurs de services de télévision sont tenus de signer et retourner la présente convention, afin de devenir des fournisseurs de services participants; EN CONSÉQUENCE, LA PRÉSENTE CONVENTION ATTESTE qu’en contrepartie des avantages accordés et des engagements et ententes mutuels prévus aux présentes, dont la réception et la suffisance sont par les présentes reconnues, les parties conviennent de ce qui suit : INTERPRÉTATION 1. Définitions. Tous les termes en majuscules utilisés dans la présente convention, préambule compris, qui ne sont pas définis aux présentes ont le sens qui leur est donné dans les règlements généraux. Sauf si le contexte prévoit expressément le contraire, les termes et expressions ci-après ont les significations suivantes dans la présente convention : (a) « Client » désigne (i) un particulier ou une petite entreprise qui a reçu, ou passé un contrat afin de recevoir, des services de télécommunications d’un fournisseur de services participant; et (ii) un particulier ou une petite entreprise qui a reçu, ou passé un contrat afin de recevoir, des services de télévision d’un fournisseur de services participant. (b) « Code de procédures » a le sens précisé à l’alinéa 12(a). - 2 - (c) « Convention » désigne la présente convention de participation ainsi que ses annexes, telles que modifiées de temps à autre. (d) « Cotisation annuelle » désigne la cotisation, devant être payée par un fournisseur de services participant dont les revenus de détail admissibles sont de moins de 10 millions de dollars, déterminée de manière ponctuelle par le conseil de la Corporation. (e) « Coût réel » désigne le coût total réel engagé par la Corporation pour la fourniture des services ou relativement à cette prestation, y compris les frais liés aux services, au personnel, à l’équipement et aux installations, les créances en souffrance depuis plus de soixante (60) jours, les taxes et les autres frais. (h) « CRTC » désigne le Conseil de la radiodiffusion et des télécommunications canadiennes, ou toute entité qui lui succède. (i) « Date d’entrée en vigueur » a le sens précisé plus haut. (j) « Date du défaut » a le sens précisé à l’article 32. (k) « Décision » désigne une décision prise par le Commissaire en vertu de l’article 13 du code de procédures. (l) « Défaut » a le sens précisé à l’article 32. (m) « Dossiers de délibérations du Commissaire » désigne les documents, les rapports, les recommandations ou les autres renseignements concernant directement une plainte contre un fournisseur de services participant, mais à l’exclusion des rapports, des sommaires, des documents et des autres renseignements regroupés, modifiés ou résumés de manière à ce que l’identité d’un plaignant ou d’un fournisseur de services participant particulier ne puisse être établie, directement ou indirectement. (n) « Entente annexe » désigne l’entente jointe aux présentes à titre d’Annexe B. (o) « Fournisseurs de services participants » désigne les personnes nommées à l’Annexe A de la présente convention et toutes autres entités qui pourraient devenir des fournisseurs de services participants et qui signent la présente convention, conformément à ses modalités. (p) « Fournisseur de services participant en défaut » a le sens précisé à l’article 32. (q) « Frais fondés sur les plaintes » désigne les frais calculés en conformité avec les modalités de l’Annexe D de la présente convention; (r) « Frais fondés sur les revenus » désigne les frais calculés en conformité avec les modalités de l’Annexe D de la présente convention; (s) « Frais fondés sur les revenus du fournisseur de services participant » a le sens précisé à l’Annexe D; - 3 - (t) « Information confidentielle » désigne, pour une partie, l’ensemble de l’information et des données liées de quelque manière que ce soit aux activités, plans, idées, produits, services, politiques ou intentions de cette partie (y compris l’information d’exploitation, d’affaires ou de marketing et l’information commerciale, financière ou économique), de nature exclusive ou non, qui présentent une valeur pour cette partie, qui sont considérées comme confidentielles par cette partie et ne sont pas généralement connues des concurrents de cette partie ou du public, et qui incluent notamment les dossiers de délibérations du Commissaire. Toutefois, l’information confidentielle ne comprend pas l’information : (i) qui est disponible publiquement sans qu’il y ait divulgation non autorisée; (ii) dont la partie divulgatrice autorise par écrit la divulgation sans restriction ou spécification; (iii) dont la partie réceptrice peut démontrer qu’elle était en sa possession avant sa divulgation; (iv) qui a été divulguée à la partie réceptrice par une tierce partie sans restrictions quant à son utilisation ou à sa divulgation, pourvu que cette tierce partie ne contrevienne elle-même à aucune obligation de confidentialité relative à cette information; (v) contenue dans toute décision du Commissaire en vertu du code de procédures; ou (vi) publiée par la Corporation à partir de son système

Novus confirmed that it would make its VOD program offering available to customers in both official languages. While the programming would be predominantly in English, the applicant made a commitment to offer approximately 5% of all programming in French. In addition, the applicant indicated that approximately 5% of the service’s programming would be in either Mandarin or Cantonese. 5. In its application, Novus indicated that it would abide by the standard requirements for VOD services, set out in the appendix to Broadcasting Regulatory Policy 2011- 59-1, and proposed to abide by an additional condition of licence requiring it to allocate exclusively to the production of community programming all revenues generated by a subscriber fee for the distribution of community programming offered on the service.

Driven primarily by facilities-based competitors, Canada is one of the few countries in the world where almost every consumer across the country enjoys the choice between competing physical broadband networks. This choice in turn has continuously driven network investment, amongst the highest in the world, as the carriers have competed by evolving from twisted pair and co-axial cable to DSL and cable/fibre hybrids to fibre to the home. ES2 Competition has driven facilities-based competitors to invest $69.2 billion over the past 10 years to satisfy consumer demand for faster and higher capacity wireline services. Demand increased ten-fold over the 10-year period. These investments now provide world-leading networks to 92% of Canadian households. At the same time, this level of competition has reduced the price of higher speed services by 3% per year since the CRTC started tracking these plans. In short, the facilities-based providers in Canada have delivered more internet to Canadians for a lower price. ES3 Resellers, on the other hand, while making inroads, have had a very modest impact on the market and industry. Since their inception, they have won a 13% market share of a very capital-intensive industry despite only having invested less than one-half of one percent the investment facilities-based providers have made in new and innovative services. After 15 years of mandated wholesale resale, resellers have not moved up the Ladder of Investment.

The Vuze plug-in measures all network interruptions, and cannot differentiate between reset activity occurring in the ordinary course and reset activity that is artificially interposed by a network operator. While Vuze, therefore, has drawn no firm conclusions from its network monitoring study, it believes the results are significant enough to raise them with network operators and commence a dialog regarding their network management practices. Accordingly, Vuze has sent the attached letters to four of the network operators whose rate of reset activity appeared to be higher than that of many others.     Telecom Regulatory Policy CRTC 2021-239 PDF version Ottawa, 27 July 2021 References: 2019-420, 2019-420-1, 2019-420-2, and 2019-420-3 Public record: 1011-NOC2019-0420 Access to in-building wire in multi-dwelling units The Commission issues a number of determinations regarding access to in-building wire (IBW) in multi-dwelling units (MDUs), following a public proceeding initiated in Telecom Notice of Consultation 2019-420. The Commission finds that access to fibre IBW is not an essential service and will not be mandated. This finding is predicated on, among other things, the evidence that fibre IBW is duplicable. Further, having considered the relevant policy considerations and pursuant to its analysis under subsections 34(1) and 34(3) of the Telecommunications Act, the Commission forbears from regulating access to fibre IBW in all MDUs across Canada. Second, and consistent with earlier findings, the Commission modifies the MDU access condition regarding access to fibre IBW, so that a competitor’s choice to access end-users by means of reselling or leasing fibre IBW would not be mandated but rather subject to a commercial agreement being reached with the owner of the fibre IBW, and without a tariff being required. Under this modification, competitors still have the ability to access the MDU to install their own fibre IBW in an MDU under the MDU access condition. Third, the Commission extends the modified MDU access condition and associated obligations to all carrier Internet service providers (ISPs). All carrier ISPs are to have access to copper IBW on the same basis as local exchange carriers (LECs).

"Set-top Box - Rental" and "Set-top Box - Net Sales" are reported separately starting with the 2013-2014 Broadcast Year. Local Programming Improvement Fund BDUs were required to contribute a percentage of gross revenue from broadcasting activities to this fund. The fund has been discontinued as of 1 September 2014.
