Wise, President 930 Fifth Avenue Corp. c/o Douglas Elliman Property Mgmt. 675 Third Avenue New York, NY 10017 Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of March 8, 2011 following the Public Meeting of November 16, 2010 and the Public Hearing of November 9, 2010, voted to approve a proposal for a window master plan at the subject premises, as put forward in your application completed February 25, 2011.

The proposed work, as approved, consists of establishing a Master Plan governing the replacement of windows on the Fifth Avenue and East elevations, featuring single, paired and tripartite aluminum windows and paired, tripartite and quadruple aluminum doors and windows at the setback terraces, all with a beige finish (Benjamin Moore #HC-33 "Montgomery White"); as shown in the presentation boards showing existing condition photographs, context photographs of the proposed windows, existing and proposed building elevation drawings, original steel casement drawings, 1985 master plan drawings and proposed master plan window drawings, all labeled A-01, A-02, A-03, A-04, A-05 and A-06, dated March 1, 2011, and submitted as components of the application, and presented at the Public Meeting and Public Hearing. The proposal, as initially presented to the Commission, consisted of installing the original steel casement windows at the first, second and third floors and single-pane tilt-and-turn aluminum windows in single, paired and tripartite configurations at the upper floors on both the Fifth Avenue and East 74th Street elevations.

In reviewing this proposal, the Commission noted that the Upper East Side Historic District designation report describes 930 Fifth Avenue as a Classicizing Modern style apartment building designed by & Sons and built in 1940; and that in terms of its style, scale, materials, and details it contributes to the special architectural and historic character of the Upper East Side Historic District. The Commission also notes that this Certificate of Appropriateness supersedes the previously issued window master plan issued under Certificate of Appropriateness 85-0080 issued on February 26, 1985. With regard to this proposal, the Commission found that the proposed simplified window configuration will maintain the character and proportions of the historic fenestration of this Classicizing Modern style apartment building; that the slender and flat profile of the aluminum window framing details will more closely recall that of the historic steel casement windows; that the proposed window finish is in keeping with the historic color palette of buildings of this type, style and age; that the configuration of the setback terrace doors and windows will relate well to the other windows and will replicate the profiles, details and finish of the windows; and that the implementation of the revised Master Plan will ensure overtime a return to a consistent fenestration and is supportive of the special architectural and historic character of the building and the Upper East Side Historic District. Based on these findings, the Commission determined the proposed work to be appropriate to the building and the Upper East Side Historic District, and voted to approve it.

The drawings labeled A-03 and A-05, dated issued March 1, 2011, prepared by Bone / Levine Architects, have been marked approved by the LPC with a perforated seal, and Certificate of Appropriateness 11-7494 (LPC 11-3302) is being issued.

This Master Plan sets a standard for window replacement and specifically identifies drawings which describe the approved Master Plan in detail. If the owner wishes to move forward with a portion of the work covered by the Master Plan, a completed application form is submitted to the Commission with a copy of the approved elevations, indicating the proposed window type and location. The staff of the Preservation Department will review the application to ascertain that all proposed work is covered by the Master Plan, and will then send the owner an "Authorization to Proceed" letter. The Authorization to Proceed is sent prior to the commencement of the work and is contingent on adherence to the approved Master Plan.

This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently displayed at the site while work is in progress. Please direct inquiries to Lisbeth Schwab.
