In early October, you will receive a ballot in the mail for the November 3, 2020 Presidential General Election. Candidates for President/Vice-President of the United States and your Representatives in Congress will be on the ballot, as will candidates for statewide office including State Senate and State Assembly. Also, on the ballot there will be candidates for Municipal Nonpartisan Offices, Special Districts, and state and local measures. Details about state measures are found in the state voter information guide. This County voter information guide is designed to impart information to help you make informed decisions. It includes text of measures, impartial analyses, fiscal impact statements, arguments for and against the ballot measures, candidate’s statements of qualifications, guide to accessible voting, list of Vote Centers in Nevada County, list of ballot Drop Boxes in Nevada County and other important information. Please take the time to read the information in this guide carefully. If you would like information on who is financing campaigns, you may search campaign finance information at http://nf4.netfile.com/pub2/?AID=nev for local campaigns; http://powersearch.sos.ca.gov/ for state campaigns. If you have already registered to vote, you do not need to re-register unless you change your name, change your residential or mailing address, or if you want to change or select a political party. I strongly encourage voters to stay home and vote-by-mail in this election. It is the first General Election to be conducted during a dangerous pandemic of this magnitude. If you use the USPS to return your ballot, I urge voters to put their completed ballots in the mail by October 27, 2020, seven days prior to Election Day on November 3, 2020. News reports indicate the postal service may be stretched to accommodate a large surge of mail-in ballots. Nevada County voters have a ready alternative: 22 election ballot drop boxes located across the county. If you do not use one of our drop boxes, you may use any official drop box in . You have the right to:

The right to vote if you are a registered voter. You are eligible to vote if you are:

• a U.S. citizen living in California • at least 18 years old • registered where you currently live • not currently in state or federal prison or on parole for the conviction of a felony • not currently found mentally incompetent to vote by a court

The right to vote if you are a registered voter even if your name is not on the list. You will vote using a provisional ballot. Your vote will be counted if elections officials determine that you are eligible to vote. The right to vote if you are still in line when the polls close. The right to cast a secret ballot without anyone bothering you or telling you how to vote. The right to get a new ballot if you have made a mistake, if you have not already cast your ballot. You can:

• Ask an elections official at a polling place for a new ballot, • Exchange your vote-by-mail ballot for a new one at an elections office, or at your polling place, or • Vote using a provisional ballot.

The right to get help casting your ballot from anyone you choose, except from your employer or union representative. The right to drop off your completed vote-by-mail ballot at any polling place in California. The right to get election materials in a language other than English if enough people in your voting precinct speak that language. The right to ask questions to elections officials about election procedures and watch the election process. If the person you ask cannot answer your questions, they must send you to the right person for an answer. If you are disruptive, they can stop answering you. The right to report any illegal or fraudulent election activity to an elections official or the Secretary of State’s office. Every registered voter will receive a vote-by-mail ballot. Ballots will be mailed on October 5, 2020. When you receive your vote-by-mail ballot mark your choice and put your ballot in the postage- paid return envelope. Be sure you sign the back of the return envelope. You can mail it back, put it in a secure ballot drop-box, or drop it off at any vote center.

How to vote your vote-by-mail ballot

Follow the instructions on the official envelope to sign and seal your ballot.

Mail your ballot, so that it is postmarked on or before Election Day, November 3, 2020. Make sure your post office is open to receive and postmark your ballot. The Elections Office must receive your postmarked ballot no later than seventeen days after the election date, November 20, 2020.

Hand deliver your ballot to any official ballot drop-box no later than November 3rd at 8pm. A list of secure drop-boxes can be found in this guide. They are also listed on our website at https://mynevadacounty.com.

Vo Nevada County offers early voting 29 days before Election Day. The Elections Office will open for early voting on Monday, October 5, 2020, Monday - Friday 8am to 5pm, Election Day 7am to 8pm.

How to vote early

To vote for a qualified write-in candidate, write his or her name on the line at the end of the list of candidates. Then darken in the rectangle next to the name.

At the vote center, you can choose to vote on the new accessible touch-writer voting equipment

With accessible voting equipment, all voters can vote privately and independently.

1. Tell vote center staff you would like to vote on the touch-writer • Vote center staff will give you a ticket to take to the staff member at the voting equipment. • When it is your turn, give your ticket to the vote center staff member. • The staff member will pull up your ballot for you and verify that you have been given the proper ballot type based on your residential address.

2. Ready, Set, Vote • The Verity touch writer accessible ballot marking device allows for audio only voting, audio and touchscreen or touchscreen only. • You can adjust the contrast colors and text size of the screen. • You may also attach sip & puff devices if needed. • Follow the screens which will orient you to voting with the touch-writer or select Skip instructions.

3. Mark Your Ballot • Before you begin voting you will have the option to learn to mark the ballot and view the contests on the ballot. • You can mark your ballot choices by using the touchscreen, or by using the Move wheel and Select button. • A selected choice will display a green box with a check mark to the left of the choice. • You can review your ballot choices by selecting “Review your choices” in the bottom left corner of the screen. • The Next or Skip button advances to the next contest on the ballot.

4. Review Your Ballot • When you have reached the end of your ballot, the “Review your ballot” screen appears. You can select a specific contest to return to that contest or select “Return to ballot” to go to the last contest visited.

5. Print Your Ballot • When you are done voting, select the Print button in the lower right-hand corner of the screen using the move wheel or touch the screen. • You will then be prompted to select “Yes, print my ballot” or “No, go back”. • Your ballot will print on the laser printer next to the touch-writer. • Retrieve your ballot from the laser printer and take it to the scanner to be scanned. • Your ballot has been scanned and counted when you see the American Flag.

Remote Accessible Vote-By-Mail Ballot • A digital vote-by-mail ballot can be sent to you directly by email by contacting the Nevada County Elections Office: (530) 265-1298 or [email protected]. You may mark the ballot on a computer and then print it or mark it after it has been printed. • Place your completed ballot in the envelope provided with your vote-by-mail packet, or print the envelope included with the digital ballot you received via email. • The ballot must be returned by mail or in person to the Nevada County Elections Office at 950 Maidu Ave., Suite 210 Nevada City, CA 95959 or dropped off at any of the 22 drop boxes throughout the county. • You may fill out the post card on the back cover of this Voter Information Guide to request a ballot.

At the Vote Center Each vote center and ballot drop-box location are surveyed to confirm that they are ADA accessible. Vote centers may use temporary thresholds, ramps, signage, cones, and door props to improve access to the facility. Handheld 10x lighted magnifying glasses are also available at each vote center.

Curbside Voting If a vote center is not accessible to you, or if you need in person assistance, you may vote a paper ballot from your car. A vote center staff member will qualify you to vote and return the voted ballot back to the vote center. To request curbside voting assistance, you can: • Call in advance to coordinate a time and place • Have an assistant make the request inside the Vote Center • Press the button on the call bell outside the vote center to inform the vote center staff that you need assistance

Accessible Voting System Each vote center in the county has a minimum of 3 accessible ballot marking devices called touch-writers. Touch-writers can accommodate tactile switches and sip and puff devices. Each touch-writer features: • Audio options that read the ballot to you, with volume controls as well as 3 settings for the speed at which the ballot is read to you • 3 different screen contrast options: full color, high contrast black with white text or high contrast white with black text • A variety of text sizes • The option to use the touch screen only or the touch screen and audio

Twenty years ago, I acquired my home at 320 Park Ave and was excited to live here full time, restore the house and make new friends. I also managed the Grass Valley Airport, helped reorganize Nevada County government, and worked on the local United Way Community Report Card. In 2005, I relocated to Monterey County to take employment with the City of Salinas. For Salinas, I reorganized the Permit Center, operated the Salinas Municipal Airport, and became Public Works Director. I also produced one of the first Groundwater Sustainability Plans in California, completed innovative energy and water programs and dealt extensively with neighborhood viability, homelessness and racial equity. My wife Christine Bottaro (Retired RN) and I met in Monterey and have been married nearly 12 years. We are both thrilled to live in Nevada City, back home since 2018. I’m a full-time Truckee (Prosser) homeowner. I have a small airplane hangared at our airport that I use to fly volunteer animal rescue missions. I have directed marketing for international firms, authored books, and co-founded the band, Berlin (Take My Breath Away/Top Gun). MEASURE K – TOWN OF TRUCKEE

Measure K has been placed on the ballot by the Truckee Town Council. If approved by a majority of those voting, it would increase the transient occupancy tax (TOT) rate in Truckee from 10% to 12% for a period of 20 years. This tax is paid only by people renting lodging in Truckee for a period of 30 consecutive nights or less. The tax is not paid by long-term renters or property owners, except to the extent that owned or rented property is rented out on a short-term basis.

Based upon the Town’s existing TOT revenues, it is estimated that if passed, Measure K would generate approximately $700,000 in new revenue annually. This revenue cannot be taken by the State of California or County of Nevada. Like all Town funds, Measure K revenue would be required to be audited every year by an independent outside auditor.

The increased revenue provided by Measure K could be spent at the direction of the Town Council for any legal purpose, such as providing housing, protecting open space, wildfire preparedness, public safety, code enforcement, sustainability efforts, road maintenance, or any other services provided by the Town. Measure K is unrelated to the Truckee Tourism Business Improvement District (TTBID) and Measure K revenue is not earmarked for tourism promotion.

MEASURE L – CITY OF NEVADA CITY

State law requires all general law cities, like the City of Nevada City, to have a clerk and treasurer. The positions may be appointed or elected. In the City of Nevada City, the offices of City Clerk and City Treasurer are elected by the City voters to a four year term. The term of the current City Clerk ends in March 2024. The term of the current City Treasurer ends in March 2022. Pursuant to state law, there are three qualifications for the positions of elected clerk and elected treasurer: 1) the individual must be a resident of the City, 2) the individual must be registered to vote in the City, and 3) the individual must be at least 18 years old. As an elected position, there are no minimum educational requirements or professional qualifications.

The City Clerk keeps records of the City Council meetings, ordinances, and resolutions, manages city elections, causes collection, publication and updating of the City's municipal code, and maintains custody of and preserves city records. The City Treasurer is the custodian of and responsible for all moneys, bonds, and securities of the city, and keeps the accounting of receipts and disbursements pertaining to all funds and other property in his or her custody. In Nevada City, the elected City Clerk and City Treasurer do not actually perform these services; the duties of City Clerk and City Treasurer are currently performed by administrative staff.

The City of Nevada City has placed a Measure on the ballot asking voters to decide whether these positions should be appointive. This Measure asks the following question:

MEASURE L Shall the offices of City Clerk and City Treasurer be appointive?

If a majority of voters vote yes on the above Measure, then the offices of City Clerk and City Treasurer will become appointive offices and such offices will no longer be elected by the City voters. As appointive offices, the City Council would appoint a person to such offices at the expiration of the term of the officer now in office, which is March 2024 for the City Clerk and March 2022 for the City Treasurer, or upon a vacancy in either office. As appointive offices, the City Council may, by ordinance, vest in the City Manager its authority to appoint such officers. Otherwise, the appointed individuals will hold office at the pleasure of the City Council. As appointed officers, the City Clerk and City Treasurer would not be required to be City residents or electors but may be required to satisfy minimum educational or professional qualifications.

Nevada City currently has an elected City Clerk and City Treasurer. Over the past 55 years, most California cities have moved from elected City Clerks and Treasurers to appointed staff. More than 75% of California cities have an appointed City Clerk and more than 65% have an appointed City Treasurer.

Today, municipal government and regulations have become more complex. Independent audits and internal controls provide necessary oversight and accountability for the City’s administration and finances.

City Clerk responsibilities require professional skills and expertise in Election and Fair Political Practice Laws, the Brown Act and Records Retention Management. The City Treasurer function requires professional skills and expertise in municipal fund accounting, government report requirements, investment regulations and debt management.

The essential and important tasks of the Clerk and Treasurer are often time-sensitive and require daily attention. The City does not have a Clerk and Treasurer that are present in City Hall on a daily basis. Hence, staff that have been deputized to perform duties have already absorbed the primary functions of the Clerk and Treasurer. These functions are intermeshed with other City day- to-day operational duties that fall within the prevue of the Finance and Administration Department accountable to the City Manager. This has proven to be the most effective and efficient structure.

The public expects and deserves that the duties of the Clerk and Treasurer will be performed with professionalism and efficiency. This can best be accomplished by selecting persons to serve based on technical skill, education and relevant experience.

A yes vote guarantees that minimum qualifications are established, ensuring that qualified professionals with the required expertise are selected as City Clerk and Treasurer with daily accountability to the City Manager for performing these functions.

BALLOT QUESTION

Shall the measure that, exclusively for the purpose of improving and maintaining Nevada City's streets, sidewalks, pathways, drainage, water distribution and sewer collection systems, allows the City of Nevada City to continue to impose and collect, as it has since 2006, a one-half cent per one- dollar retail transactions and use tax (sales tax), providing approximately $550,000 annually until repealed by the voters, and monitored by a citizens' oversight committee, be adopted?

IMPARTIAL ANALYSIS

MEASURE M – CITY OF NEVADA CITY

In 2006, Nevada City voters approved a half-cent local transactions and use tax that funds the City's streets, including sidewalks, pathways and street drainage.

This tax is collected along with other state and local sales and use taxes. Because the rate of the tax is 0.5%, the tax on a $1.00 taxable purchase is one-half cent. The tax will expire on March 31, 2023

Measure M would replace the existing tax and remove the 2023 sunset date. Proceeds of the new tax could be used by the City only to improve and maintain Nevada City's streets, sidewalks, pathways, drainage, water distribution and sewer collection systems and for no other purposes. The rate of the tax would not change.

If Measure M is approved, the existing tax will not be collected after December 31, 2021 and the new tax will start being collected on January 1, 2022.

The combined rate of all state and local sales taxes on a one-dollar purchase in Nevada City is 8.375 cents. Of this, the City levies only: (i) the half-cent tax that would be replaced by this measure; (ii) a 0.375 cent "fire and police" tax; and (iii) a one cent tax known as the Bradley-Bums Tax that is imposed by each city in California.

These taxes levied by Nevada City total 1.875 cents. The remaining 6.5 cents of sales taxes are levied by the State of California and by Nevada County. Measure M would not increase the overall tax rate above the rate currently in place.

Purchases in Nevada that are exempt from the statewide sales tax are also generally exempt from the local sales tax. For example, most groceries, prescription drugs and payments for services are exempt from the tax.

Proceeds of the tax, less administration costs, would continue be controlled locally by the City Council. The new tax would continue until repealed. The tax is expected to generate approximately $550,000 annually for the City.

Measure M requires that an annual report be prepared regarding the proceeds of the tax and the use of those proceeds. The measure also requires that the City Council create a Citizen's Oversight Committee to review the annual report and make recommendations to the City Council. The annual report is a public document. All of the City's revenues and expenditures are annually audited by an independent certified public accountant.

This measure was placed on the ballot by the City Council of Nevada City. It must be approved by a two- thirds vote at the election to go into effect.

In 2006 Nevada City’s roads and sidewalks were in dire need of replacement. Voters passed a ½-cent sales tax increase for road repair. It expires 12/31/22. To date the City has repaired and rebuilt 22 miles of roadways and sidewalks. $9 million in improvements have been completed.

Nevada City’s roads and sidewalks are in continual need of maintenance and replacement. Our sewer and water pipes are breaking and leaking. Nevada City has ongoing funding needs of $300k annually for streets/sidewalks and is $33 million behind in critical sewer and water pipe replacement. Continuing the ½- cent sales tax would provide $550k annually for streets, sidewalks sewer and water repair and replacement.

If Measure M passes, there will be no new taxes, revenue will pay for repair and maintenance of roads, sidewalks, sewer and water only, the City will have a ten-year infrastructure improvement plan to be updated every ten years with an oversight committee will monitor improvements, collection and expenditures of the ½-cent sales tax.

If Measure M fails, our recently restored roads and sidewalks will fall to disrepair, there will be continued emergency repairs to replace 130 year-old pipes requiring the City to dig up recently restored roadways and failing sewer pipes could trigger costly State and Federal fines.

Measure M will maintain our roads, sidewalks and pipes and will spread the cost of repair fairly for everyone that uses Nevada City’s infrastructure. Non-City residents contribute 60% of the sales tax. If we do not pass this sales tax, you, as a City Resident, will pay 100% of the repair and maintenance costs. We respectfully ask that you vote yes to continue to maintain Nevada City’s streets, sidewalks and replace our 130 year-old pipes.

Be it ordained by the People the City of Grass Valley as follows:

SECTION 1. Code Amendment. Chapter 5.06 of Title 5 of the Grass Valley Municipal Code is hereby adopted to read as follows: CANNABIS BUSINESS LICENSE TAX 5.06.010 - Purpose.

This ordinance is adopted for the following purposes and shall be interpreted to accomplish them:

A. To impose a tax on the privilege of conducting cannabis business in the city, under the state Medicinal and Adult-Use Cannabis Regulation and Safety Act, California Business and Professions Code section 26000, Proposition 64, approved by the voters in November 2016 and as amended to date (“MAUCRSA”), which legalized and regulates adult use of cannabis in California, and other applicable law as it now exists or may hereafter be adopted; B. To impose a general tax that generates revenues which may be used for any lawful purpose of the city in the discretion of the city council; C. To specify the type of tax and rate of tax to be levied and the method of collection; and D. To comply with all requirements for imposition of a general tax.

It shall apply to all persons engaged in cannabis business in the city. The tax imposed by this chapter is a general tax under Article XIII C of the California Constitution.

5.06.020 - Definitions.

For the purposes of this chapter, the following words shall have the meanings ascribed to them by this section unless the context makes apparent another meaning was intended. “Cannabis” means all parts of the plant Cannabis sativa Linnaeus, Cannabis indica, or Cannabis ruderalis, or any other strain or varietal of the genus Cannabis that may exist or hereafter be discovered or developed that has psychoactive or medicinal properties, whether growing or not, including the seeds of such plants. “Cannabis” also means cannabis as defined by Business and Professions Code section 26001, subdivision (f), the Health and Safety Code section 11018, and by other state law.

“Cannabis accessory” means any device intended to aid in the use of cannabis or cannabis products which does not itself consist in all or part of cannabis or cannabis products and includes, without limitation, “cannabis products” as defined in Health and Safety Code section 11018.2 and by other state law.

“Cannabis business” means the activity of any person in the city relating to cannabis whether or not lawful, including but not limited to cultivation (including nurseries), transportation, distribution, manufacture, compounding, conversion, processing, preparation, testing, storage, packaging, delivery and sales (including both wholesale and retail sales) of cannabis, cannabis products, or cannabis accessories, whether or not carried on for gain or profit, whether for medical or adult use, and whether or not such business is licensed by the State. A cannabis business does not include any business the only relationship of which to cannabis or cannabis products is the production or sale of cannabis accessories.

“Cannabis cultivation area” means the total aggregate area(s) of cannabis cultivation on one or more parcels in the city by a cannabis business as measured around the outermost perimeter of each separate and discrete area of cannabis cultivation at the dripline of the canopy expected at maturity and includes, but is not limited to, space between plants within a cultivation area, the exterior dimensions of garden beds, garden plots, hoop houses, green houses, and each room or area where cannabis plants are grown, as determined by the city manager. The city manager may, but is not required, to determined cannabis cultivation area from the area described in a cultivation license issued by the City whether or not the licensee actually cultivates that entire area.

“Cannabis product” means any product containing cannabis or its derivatives, including, but not limited to, flowers, buds, oils, tinctures, concentrates, extractions, edibles and products described in Section 11018.1 of the Health and Safety Code.

“Canopy” means the designated area(s) at a licensed premises that does, or is proposed to, contain mature plants at any time. If mature plants are cultivated using a shelving system, the surface area of each level shall be included when calculating canopy area. Canopy area shall be expressed in square feet and measured using clearly identifiable boundaries of all areas that will contain mature plants at any time, including the entire area with those boundaries. Canopy may be noncontiguous, but each noncontiguous area shall be defined by an identifiable boundary such as an interior wall or by 10 feet or more feet of open space. The city manager may, but is not required, to determined canopy from the area described in a cultivation license issued by the city whether or not the licensee actually cultivates that entire area.

“Commercial cannabis cultivation” means cultivation conducted by, for, or as part of a cannabis business. Commercial cannabis cultivation does not include personal medical cannabis cultivation, or cultivation for personal adult use as authorized by the MAUCRSA, including Health & Safety Code section 11362.1 et seq., for which the individual receives no compensation whatsoever.

“Cultivation” means any activity involving the planting, growing, harvesting, drying, curing, grading, or trimming of cannabis.

“Delivery” means the transfer for any form of compensation of cannabis or cannabis products to a customer or caregiver at a location that is not a dispensary.

“Dispensary” means a place at which cannabis, cannabis products, or accessories for the use of cannabis or cannabis products are offered, either individually or in any combination, for retail sale, including, without limitation, a dispensary that engages in delivery.

“Distributor’’ means a person engaged in procuring cannabis and/or cannabis products for sale to a dispensary or other point of retail sale. “Distribution” means engaging in that conduct and a “distribution facility” is any real estate, whether or not improved, used in such conduct.

“Gross receipts” means the total consideration actually received or receivable from all sales, for the performance of any act or service, of whatever nature it may be, for which a charge is made or credit allowed, whether or not such act or service is done as part of, or in connection with, the sale of materials, goods, wares or merchandise; and gains realized from trading in stocks or bonds, interest income, carrying charges, rents, royalties, fees, commissions, dividends, or other emoluments, however designated. Included in “gross receipts,” are all receipts, cash, credits, and consideration of any kind or nature, without any deduction on account of the cost of the property sold, the cost of materials used, labor or service costs, interest paid or payable, or losses or other expenses whatsoever, except that the following shall be excluded from them:

A. Any tax required by law to be included in or added to the purchase price and collected from the customer or purchaser; B. Cash discounts allowed and taken on sales; C. Such part of the sale price of property returned by purchasers upon rescission of the contract of sale as is refunded in either cash or by credit; D. Amounts collected for others where the business is acting as an agent or trustee, to the extent that such amounts are paid to those for whom collected; provided, that the business furnish the collector with the names and addresses of the others and the amounts paid to them; E. Receipts of refundable deposits, except that refundable deposits forfeited and taken into the income of the business shall not be excluded; F. Amounts received or receivable by persons having a fixed place of business within the city for acts or services performed outside the city, but only to the extent a business tax has not been paid to the city or cities in which the acts or services were performed.

“High potency” cannabis or cannabis product means cannabis flower containing more than 17% tetrahydrocannabinol (THC), or a cannabis product containing more than 50% THC, excluding edibles containing ten 10 mg or less of THC per packaged and labelled dose.

November 3, 2020 General Election – Nevada County SECTION 4 “Manufacturer” means a person who engages in the production, preparation, propagation, or compounding of cannabis or cannabis products either directly or indirectly or by extraction methods, or by means of chemical synthesis, or by a combination of extraction and chemical synthesis.

“Person” means any individual, firm, partnership, corporation, company, association, joint stock association; city, county, state, or district; and includes any trustee, receiver, assignee, or other similar representative thereof.

“Sweetened cannabis beverage” is a liquid cannabis product containing natural or artificial sweeteners sold in units intended for consumption exceeding one ounce.

5.06.030 - Cannabis business tax.

A. Beginning January 1, 2021, there is imposed upon each person who is engaged in business as a cannabis business a cannabis business tax. B. The initial rate of the cannabis business tax shall be as follows: 1. For every person who is engaged in commercial cannabis cultivation in the City: a. Four dollars ($4.00) annually per square foot of canopy space in facility that uses exclusively artificial lighting. b. Three dollars ($3.00) annually per square foot of canopy space in a facility that uses a combination of natural and supplemental artificial lighting. c. One dollar ($1.00) annually per square foot of canopy space in a facility that uses no artificial lighting. d. Fifty cents ($0.50) annually per square foot of canopy space for any nursery. Should a City permit be issued to a business which cultivates only for certain months of the year, the City shall prorate the tax as to sufficiently reflect the period in which cultivation is occurring. In no case shall canopy square footage which is authorized by the City commercial cannabis permit but not utilized for cultivation be deducted for the purpose of determining the tax for cultivation, unless the collector is informed in writing before the period for which the space will not be used that such space will not be used and authorizes relief from the tax. 2. For every person who operates a testing laboratory: two percent (2%) of gross receipts. 3. For every person who operates a dispensary or delivery business: four percent (4%) of gross receipts. 4. For every person who engages in a cannabis manufacturing, processing, distribution or any other cannabis business not described in subdivisions (B) (1), (2), or (3) above: two percent (2%) of gross receipts. C. The City Council may, by resolution or ordinance, adjust the rate of the cannabis business tax up to the following maxima: 1. For every person who is engaged in commercial cannabis cultivation in the City: a. Through June 30, 2021, the maximum rate shall be: i. Seven dollars ($7.00) annually per square foot of canopy space in a facility that uses exclusively artificial lighting. ii. Five dollars ($5.00) annually per square foot of canopy space in a facility that uses a combination of natural and supplemental artificial lighting. iii. One dollar ($1.00) annually per square foot of canopy space in a facility that uses no artificial lighting. iv. Fifty cents ($.50) annually per square foot of canopy space for any nursery. b. On July 1, 2021 and on each July 1 thereafter, the canopy tax shall be adjusted (and rounded to the nearest cent) based on the year-over-year percentage change in Bureau of Labor Statistics Consumer Price Index, West Region – All Urban Consumers (CPI-U) April to April comparison, or if such index is discontinued, a comparable or successor consumer price index designated by the collector. However, no CPI adjustment shall reduce any tax imposed by this section.

For every person who engages in the operation of a testing laboratory, the maximum tax rate shall not exceed two percent (2%) of gross receipts. 3. For every person who engages in the retail sales of cannabis as a dispensary or delivery business, the maximum tax rate shall not exceed eight percent (8%) of gross receipts. 4. For every person who engages in a cannabis manufacturing, processing, distribution, or any other type of cannabis business not described in Section (D) (1), (2), or (3), the maximum tax rate shall not exceed six percent (6%) of gross receipts.

D. In addition, the following taxes are imposed on each cannabis business in the city: 1. An additional tax of up to one percent (1%) of the gross receipts from high potency cannabis and each high potency cannabis product cultivated, manufactured or sold by the taxpayer, multiplied by the percent of tetrahydrocannabinol (THC) content of the product above 17%; and, 2. An additional tax of 20% of gross receipts from sweetened cannabis beverages. E. The city council may, by resolution, implement a tax rate lower than the maximum rate established in subsections (B) through (D) of this section for all persons engaged in cannabis business, or establish differing tax rates for different categories of cannabis business. The city council may, by resolution, also decrease or increase such tax rates provided that the tax rate is not above the maximum tax rate established in subsection (C) of this section.

5.06.040 - Registration of cannabis business.

A. Each person engaging in a cannabis business shall register with the collector’s office by the later of: 1. Before commencing operation, or 2. January 1, 2021. B. Registrants shall submit the following information to the collector in writing: 1. Every name under which the business engages in commercial cannabis activity in the city; 2. The names and addresses of every person who is an owner, principal or manager of the business; 3. The nature or kind of all business activity to be conducted; 4. The place or places where such business is to be conducted; and 5. Any further information which the collector reasonably requests to aid the administration of this chapter. C. The collector may establish a form for registrations under this chapter and, if so, use of that form shall be mandatory. D. Registrants shall annually renew registration by the anniversary of the initial registration for that business by providing the collector the information described in subsection (B) of this section. E. The city council may establish fees under Chapter 3.62 of this Code to recover the city’s cost to register and re-register cannabis businesses and to otherwise enforce this chapter.

5.06.050 - Payment obligations.

Each person subject to a tax under this chapter shall pay that tax regardless of any rebate, exemption, incentive, or other reduction elsewhere in this code, except as required by state or federal law. Failure to pay such a tax shall be subject to penalties, fines and interest charges established under this chapter. Further, any person violating any of the provisions of this chapter or knowingly or intentionally misrepresenting to the city any material fact in registering under this chapter shall be deemed guilty of a misdemeanor punishable under Chapter 1.12 of this Code, provided, however, that any violation or offense may be deemed an infraction punishable under Chapter 1.12 of this Code and charged as such in the discretion and at the election of the prosecuting attorney, in which event the punishment therefor shall not be imprisonment but a fine not to exceed the amounts specified by Chapter 1.12 of this Code as then in effect. Every day a violation of any provision of this chapter continues constitutes a separate offense.

November 3, 2020 General Election – Nevada County SECTION 4 5.06.060 - Tax payment does not authorize activity.

The payment of a tax imposed under this chapter shall not be construed to authorize the conduct or continuance of any illegal business or of a legal business in an illegal manner. Nothing in this chapter authorizes or implies the lawfulness of any activity connected with the distribution or possession of cannabis unless otherwise authorized and allowed in strict and full conformance with this code. Nothing in this chapter shall be applied or construed as authorizing the sale of cannabis. 5.06.070 - Cannabis tax is not a sales tax.

The tax imposed by this chapter is upon the privilege of doing business in the city. It is not a sales or use tax.

5.06.080 - Returns and remittances.

The tax imposed by this chapter shall be due and payable as follows: A. Each person owing tax under this chapter shall provide a tax return to the collector by the last business day of each month stating the tax owed for the preceding month and the basis of its calculation. The taxpayer shall remit the tax owed to the collector when the return is due. B. The collector may establish a form for tax returns submitted under this section and, if so, use of that form shall be mandatory. C. Tax returns and payments for all outstanding taxes, fees, penalties and interest owed the city are immediately due upon cessation of business for any reason. D. Whenever a payment, statement, report, request or other communication is received by the collector after the time prescribed by this section for its receipt, but is in an envelope postmarked by the date prescribed by this section for its receipt, the collector shall regard such payment, statement, report, request, or other communication as timely. If the due date falls on a day when city offices are not open for business, the due date shall be the last business day before that due date. E. Unless otherwise provided by this chapter, the taxes imposed by this chapter shall be delinquent if not paid by the due date specified in subsection (A) of this section. F. The city collector need not send a delinquency or other notice or bill to any person subject to a tax or fee imposed by this chapter and failure to send such notice or bill shall not affect the validity of any tax, fee, interest or penalty due under this chapter.

5.06.090 - Audits.

The collector shall arrange for an annual independent audit of the receipts and expenditures of the taxes imposed by this chapter. He or she shall share that audit report with the city council and make it available for public inspection

5.06.100 - Refunds.

A. The City shall refund no tax collected under this chapter, except as provided in this section. B. The City shall refund no tax collected under this chapter because of the discontinuation, dissolution, or other termination of a cannabis business. C. Any person entitled to a refund pursuant to subdivision D. below may elect to have such refund applied as a credit against future obligations under this chapter. D. If a tax, fee, penalty, or interest under this chapter has been overpaid, paid more than once, or has been erroneously or illegally collected or received by the city, such amount shall be refunded to the person who paid the tax upon a timely written claim for refund filed with the city manager. E. The collector may examine and audit all the books and business records of the claimant to determine eligibility to the claimed refund. No claim for refund shall be allowed if the claimant refuses to allow such examination of the claimant’s books and business records.

November 3, 2020 General Election – Nevada County SECTION 4 F. A sum erroneously paid under this chapter due to an error of the city shall be refunded to the claimant in full upon a timely claim. If an error is attributable to the claimant, the city may retain an amount established by resolution of the city council to recover the city’s cost to process the claim and refund the balance.

5.06.110 - Tax administration.

A. The collector shall administer this chapter. B. The collector may make such rules and regulations not inconsistent with this chapter as may be necessary or desirable to supplement or clarify such provisions or aid in their enforcement and shall give notice of them as required for ordinances of the city council or shall post them to the city’s website or both. C. The collector may take such administrative actions as needed to administer the tax, including but not limited to: 1. Provide information to any taxpayer about this chapter; 2. Receive and record all taxes remitted to the city council as provided in this chapter; 3. Maintain records of taxpayer reports and taxes collected under this chapter; 4. Assess penalties, fines and interest charges to taxpayers under this chapter; 5. Determine amounts owed and enforce collection under this chapter; and 6. Take such other reasonable steps as he or she deems appropriate to enforce this chapter. D. The city council may establish penalties, fines and interest charges related to this chapter by ordinance or resolution.

5.06.120 - Appeals.

Any person aggrieved by any decision of the city under this chapter may appeal to the city council pursuant to the procedures described in Section 5.04.260 of this Code.

5.06.130 - Consistency with business license tax.

The city council intends this chapter to be enforced consistently with Chapter 5.04 of this Code and any rule or regulation promulgated under that chapter except as provided to the contrary in this chapter.

5.06.140 - Constitutionality and legality.

A. This tax is intended to be applied consistently with the United States and California Constitutions, state law, and the city charter. The tax shall not be applied to cause an undue burden upon interstate commerce, a violation of the equal protection and due process clauses of the Constitutions of the United States or the State of California, to constitute a special tax, or to violate any other provision of law. B. Taxes imposed under this chapter are excises on the privilege of engaging in commercial cannabis activity in the city. It is not a sales or use tax and shall not be calculated or assessed as such. Nevertheless, at the option of a commercial cannabis business, the tax may be separately identified on invoices, receipts and other evidences of transactions. C. Under California Constitution, article XIII B, the appropriation limit for the city is hereby increased to the maximum extent over the maximum period of time allowed under law by the amount of the revenues generated by the tax.

November 3, 2020 General Election – Nevada County SECTION 4 SECTION 2. AMENDMENT. This Ordinance may be amended by the City Council without a vote of the People provided, however, that voter approval is required for any amendment that would increase, within the meaning of Government Code section 53750(h), the tax rate beyond the maximum rates authorized by this Ordinance. SECTION 3. CEQA. The City Council has considered all the evidence in the record, including the staff reports, the testimony received, and determines this Ordinance is exempt from review under the California Environmental Quality Act (CEQA). Under section 15061(b)(3) of the CEQA Guidelines, CEQA applies only to projects which have the potential to cause a significant physical effect on the environment. This Ordinance will not result in a significant foreseeable physical environmental impact. Further, under CEQA Guidelines section 15378(b)(4), a tax is not a project because it creates a government funding mechanism that involves no commitment to any specific project that may cause a potentially significant impact on the environment. Before commencement of any project funded by revenues from this Ordinance, any necessary environmental review required by CEQA shall be completed. SECTION 4. SEVERABILITY. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is held to be invalid or unconstitutional by the final decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The People of the City of Grass Valley declare that they would have adopted this Ordinance, and each section, subsection, sentence, clause, phrase or portion of it, irrespective of the fact that any one or more sections, subsections, phrases or portions might be declared invalid or unconstitutional. SECTION 5. EFFECTIVE DATE. This ordinance shall take effect 10 days after certification of its approval by a majority vote (50% + 1) of the electorate voting at the general election to be held on November 3, 2020 under Elections Code sections 9217 and 9222. SECTION 6. CERTIFICATION. The Mayor shall sign, and the City Clerk shall attest to the passage of, this Ordinance upon certification by the City Council of the results of the election approving it.

IMPARTIAL ANALYSIS

MEASURE N – CITY OF GRASS VALLEY

Summary: The Grass Valley City Council has placed a measure on the ballot to adopt a business license tax on cannabis (marijuana) businesses and commercial cannabis growing in the City. If approved by voters, it would allow the City Council to impose the tax, at generally the same tax rates the City of Nevada City applies to these businesses.

Background: In 1996, California voters approved Proposition 215, the Compassionate Use Act, to allow qualified patients to use marijuana for medical purposes. In 2016, California voters approved Proposition 64 to allow adults 21 years old and older to use cannabis without a doctor’s prescription. Proposition 64 also created a state system to regulate cannabis businesses. Proposition 64 and other state law impose sales and other taxes on cannabis and allow cities and counties to regulate and, with voter approval, to tax cannabis businesses. The City has not yet allowed cannabis businesses in Grass Valley, but the City Council is now considering an ordinance to allow it in some non-residential zones on sites separated from residences and child-serving uses, like schools. State regulators allow marijuana sales by mobile delivery and those are likely occurring in Grass Valley but, because the City has not yet adopted a tax, those delivery services pay no taxes to the City.

The Measure: If voters approve this measure, cannabis businesses would pay an initial tax of four percent of retail receipts, two percent of other receipts (from sales between growers and dispensaries, testing labs, those who make marijuana food products, etc.), and up to $4 per square foot of grow area. The measure would allow the City Council to increase the tax up to eight percent of retail receipts, six percent of other receipts, and $7 per square foot of commercial grow area. In addition to these tax rates, which are the same as Nevada City’s, the measure also allows higher taxes on sugar-sweetened cannabis-infused

November 3, 2020 General Election – Nevada County SECTION 4 beverages (“canna-pops”) and on very high potency products (those with more than 17% THC) to discourage products with public health risks. This is a general tax to raise revenue for City services such as parks, streets, police, fire, planning and other general City services. The City expects it to raise $250,000 a year. The tax has no expiration date, but voters could reduce or repeal it at any election.

Yes/No Statement: A “yes” vote supports the tax. A “no” vote opposes the tax. A simple majority of votes cast (50% plus 1) will approve or defeat the measure.

Vote YES ON N to maintain Grass Valley’s long-term financial stability WITHOUT more taxes on our residents or property owners. California voters legalized cannabis use without a prescription in 2016 and the State allows mobile sales / deliveries anywhere in California, including Grass Valley. Even though Grass Valley has not yet allowed cannabis businesses, deliveries are happening here and the people making money in this business contribute nothing to the cost of the services they need. Whether we like it or not, cannabis is legal now.

YES ON N permits the City to tax cannabis businesses that deliver here or that the City may allow in the future. Measure N’s tax rates are the same as Nevada City’s and are fair for businesses which use City services like any other and, because cannabis businesses operate entirely in cash, they need public safety services more than others.

YES ON N ensures the cannabis industry pays its fair share for City services we all expect and deserve – parks, street maintenance, police and fire services.

Shall the measure to fund continued necessary road and culvert maintenance by the BLCSD replace the current tax assessment with an annual assessment tax of $300 per parcel per year to raise $19,200 per year, be adopted?

IMPARTIAL ANALYSIS

MEASURE O – BYERS LANE COMMUNITY SERVICE DISTRICT

Measure O is a BEYERS LANE COMMUNITY SERVICE DISTRICT (“District”) special parcel tax measure. If approved by two-thirds of the voters, Measure O would authorize the District to replace an annual special parcel tax on each parcel of taxable real property within the District, beginning with the 2020/21 tax year. In August 2002 District voters approved an annual increase of $100 (to a total $200) per parcel for the purpose of supporting and providing road and culvert maintenance services within the District. The current amount of the annual special parcel tax is $200 per year. Measure O would replace the current annual special parcel tax with a new annual amount of $300 per parcel. Revenue from the special tax will be used solely for the purpose of supporting and providing road and culvert maintenance services within the District.

The new parcel tax will be collected annually on the County of Nevada property tax bill in the same manner and subject to the same penalty as County property taxes are collected, and will continue in effect until the voters repeal or replace it. Measure O also amends the District’s appropriation limit in an amount equal to the proceeds of the special tax, effective in the 2020/21 fiscal year.

The tax will be assessed unless the owner is exempt by law, in which case, the tax imposed will be assessed on the holder of any possessory interest in such parcel, unless such holder is also exempt by law.

All funds collected from the tax will be deposited and held by Nevada County Auditor and shall be expended through warrant(s) issued by the District Board to the Nevada County Auditor.

The District President shall cause to be filed an annual report with the District Board no later than July 1, 2021, and at least once a year thereafter. The report shall state the amount of special tax revenues collected and spent by the District in the previous fiscal year, the status of any project or work authorized to be funded by this tax, and the amount carried over from previous years and to be carried over in future years. Such report will be available for inspection without charge to any property owner in the District. The District President and/or Secretary shall biennially arrange for an independent audit of the accounting for, and expenditure of, the proceeds of the tax.

The BLCSD was formed to provide road and culvert maintenance of Beyers Lane and subsidiary roads within the District; slightly more than 5 miles. The roads within the District are non-asphalted gravel roads of varying conditions. Road maintenance ranges from simple small tractor smoothing to laying and applying gravel to heavy equipment grading for maintenance of the roads base and contour. In addition, as a Special District, the District must conduct biennially audits, carry collision/liability insurance and pay related membership dues and fees. Since 2002 (18 years!), the BLCSD has had an annual budget based on $200.00 / parcel / year for 64 parcels in the District. While the Board, meeting and tractor work done by District members is free or volunteer, the remainder is not. During the 18 years, every commodity that is needed and used by the BLCSD has increased. Fuel cost in 2002 was $1.35 / gallon and in 2020 is $3.15 / gallon ! Road insurance in 2002 was $0.00 and in 2020 is $2,375.00. Audits increased from $1500.00 to $2400.00 . Grading has gone from $1800.00 to $4000.00 plus <122%>! Finally, gravel has increased by 57%. Thus, if BLCSD Voters want to maintain roads in the District at a level of usability; then, tax collection for BLCSD activities must increase to $300.00 (from the current $200.00) . The alternative is reduced road smoothing, gravel and what will become rare road grading events while fixed cost will continue to rise in the coming year. Vote “yes” to support ongoing road and culvert maintenance.
