1.0 Introduction

1. I have been asked by Paul Bowe of Terraco on behalf of Jing Ying Pty Ltd (Submitter 12), the owner of the above property, to prepare a statement of expert evidence which addresses the heritage aspects relating to the proposed inclusion of part of the broader place in a Heritage Overlay. The inclusion of the Alistair Knox house in the Heritage Overlay is not opposed and therefore this evidence is in respect of the proposed heritage curtilage.

2. Amendment C234, proposes to include in the Schedule to the Heritage Overlay (HO915) the dwelling and a surrounding curtilage at 40 Harley Street, Strathdale. “Nanga Gnulle”, mud brick and reclaimed materials house. External paint controls are proposed and the place would be subject to an Incorporated Plan under Clause 43.01-2 i.e. Greater Bendigo Heritage Incorporated Plan – Permit Exemptions, August 2015.

3. The Greater Bendigo Planning Scheme Amendment C234 Explanatory Report states, inter alia,

The main dwelling, constructed of mud brick and reclaimed materials is considered of heritage significance for its association with architect Alistair Knox, and use of recycled materials which provide a unique architectural style. The overlay is proposed to be applied to the dwelling and a 5 metre curtilage around it (approximately 650m2). (p.1.) 1.2 Reference Materials

5. I have undertaken an inspection of the site. 1.3 Qualifications and Expertise

6. I am a director of Anthemion Consultancies and am also an architectural historian, an interior designer and a heritage consultant. I am a graduate architect member of the Royal Australian Institute of Architects, was a Deputy Chair of the Institute’s (Victorian Chapter) Heritage Committee and a member of the AIA Awards Jury in the Conservation Section for the years 2000-01. I was at Lovell Chen, architects and heritage consultants for approximately 18 years and most of that time as an associate director. Within that practice and presently my responsibilities include the co-ordination and preparation of conservation management plans, heritage assessments, preparation of expert evidence, development of site interpretation and the restoration of historic interiors.

7. I am also a Past President of Australia ICOMOS (International Council on Monuments and Sites), previously the Secretary, of the ICOMOS International Scientific Committee on Risk Preparedness (ICORP) and presently the Treasurer; past Secretary-General of the ICOMOS Scientific Council; inaugural convenor of Blue Shield Australia and past member of the Board, and past Board member of Blue Shield (The Hague) and current Board member (Secretary) of AusHeritage. I am also a member of the Local Government Advisory Committee which is a committee of the Victorian Heritage Council. I have been a heritage adviser in Monash and Bayside and am presently a member of the Yarra Heritage Panel. In the past I have been a long-standing councillor of the National Trust of Australia (Vic.).

8. I have provided expert witness statements on similar matters on numerous occasions at Heritage Victoria, VCAT, the Building Appeals Board, independent panels and other similar forums on behalf of councils, objectors and developers. My Curriculum vitæ is appended.

1.3 Summary of Opinions

9. The only element of any heritage significance which has been found on the site is the Alistair Knox mud-brick dwelling and a Heritage Overlay over the dwelling is not being challenged.

10. The heritage imperative is to retain the dwelling and to provide an adequate setting for it. A heritage curtilage which generally follows my suggestions, based on the reasons set out below, would be appropriate to retain an appropriate setting for the dwelling.

11. There is no justification to extend any heritage curtilage further to cover any other part of the garden or any outbuildings or structures. 2.0 My Response to the Proposed Heritage Overlay

12. In summary, Council’s reasons for including the place in a Heritage Overlay are derived from the place citation prepared by Built Heritage, and are principally:

 It is a rare surviving example of a mud brick and reclaimed residence designed by Alastair Knox, built in 1973-74.

 The reclaimed building materials were salvaged from various structures in the Bendigo area and have the potential to yield information that contributes to an understanding of the region’s rich history.

 The house has a distinctive aesthetic style associated with the self-building subculture, characterised by use of reclaimed or scratch built (mud brick) materials. It is one of the earlier built dwellings of the era, which is important in exhibiting particular aesthetic characteristics of this dwelling style.

 The house is significant as an excellent and notably intact example of the work of Alistair Knox, residential architect, who specialised in mudbrick construction, reclaimed materials use, and self-building construction. This is one of two examples in the Greater Bendigo area, and notably the earliest, largest and best example in the municipality. (Explanatory Report, p.2)

13. Under “What is significant?” the Built Heritage citation states:

Built in 1973-74 to a design by Alistair Knox, Nanga Gnulle at 40 Harley Street, Strathdale, is a split-level timber and mudbrick house incorporating skillion roofs clad in corrugated steel, clerestory windows and reclaimed brick chimneys. The house was designed to incorporate a vast amount of material that owners Rob & Peg Green salvaged from demolished structures around Bendigo, including (but not limited to) huge timber members from a railway bridge, handmade bricks and items from the ANA Hall.

The significant fabric is defined as the exterior of the entire house (including verandah, carport and brick paving), with a nominal curtilage (minimum five metres to all sides) to preserve its immediate setting. The mudbrick outbuildings, of relatively recent date and far more conventional in their expression, are not considered to be significant. Although of some interest, the brick shed and landscaping (with which Alistair Knox had no involvement) are similarly not considered to be crucial to an understanding of the cultural significance of the house. [Emphasis added.]

14. Under “Why is it Significant?” the Built Heritage citation states, inter alia, viz.:

While the property has associations with its use for wedding receptions, this is not deemed to equate with social significance at the local level, as such associations are typical of any local wedding reception venue.

15. In relation to the broader garden, the Context report acknowledges that the place has aesthetic qualities, viz.:

While there is a defined sense of place, and an aesthetic value to Nanga Gnulle gardens, this aesthetic value is not the aesthetic value defined in HERCON Criteria used for assessment of heritage values. Rather, it is an aesthetic amenity value.

The hard landscaping and built elements have been well executed, with quality materials, and are attractive and inviting but do not have any design interest beyond that of a large residential garden. Similar design elements, planting, features and materials could be found in a similar composition and form in many other gardens.

Many private gardens have been re-purposed for semi-commercial purposes, such as use as part-time function centres and exhibit a similar design aesthetic, but very few are considered to have heritage value. Similarly, there are numerous beautiful and attractive residential gardens, including those which were invited to participate in the Open Garden Scheme. Very few are considered to have heritage value. (p. 6)

16. In making an assessment against the HERCON Criteria, the report did not find that the garden of Nanga Gnulle met any of them and concluded:

… the Nanga Gnulle gardens at 40 Harley Street, Strathdale do not meet the threshold for local (or state) cultural heritage significance, either as an individual place or as a

contributory element of the larger place, Nanga Gnulle (also known as The Green House, c.1973). (p. 11)

17. In relation to “Criterion G: Strong or special association with a particular community or cultural group for social, cultural or spiritual reasons,” the Context report acknowledges that the place might have personal significance for some individuals who have celebrated life events there but notes that this does not equate to significance as might be appreciated or valued by a community group and as required by Criterion G. This accords with the Built Heritage assessment I agree with both assessments.

18. A mature Corymbia citriodora (Lemon scented gum) and a Eucalyptus tricarpa (Ironbark) are the only named trees, or plants, which have been identified by any consultant as having any individual aesthetic or environmental value.

19. In summary, no consultant has found any significance, aesthetic, historical or social, in the garden and a recommendation has been made to retain one particularly striking tree. In my opinion there are insufficient heritage reasons to include a large curtilage in the Heritage Overlay as the only assessed significance is in the Alistair Knox dwelling. What is essential therefore, from a heritage perspective, is to provide an adequate setting for the dwelling.

20. Part of the significance of a heritage place is its setting. The Australia ICOMOS Burra Charter, 2013, which sets out universally accepted heritage principles and which underlie heritage policies, gives a definition, viz.:

Article 8. Setting

Conservation requires the retention of an appropriate setting. This includes retention of the visual and sensory setting, as well as the retention of spiritual and other cultural relationships that contribute to the cultural significance of the place. New construction, demolition, intrusions or other changes which would adversely affect the setting or relationships are not appropriate.

Explanatory note: Setting is explained in Article!1.12

1.12 Setting means the immediate and extended environment of a place that is part of or contributes to its cultural significance and distinctive character.

Explanatory note:

Setting may include: structures, spaces, land, water and sky; the visual setting including views to a setting such as smells and sounds. Setting may also include historical and contemporary relationships, such as use and activities, social and spiritual practices and relationships other places, both tangible and intangible.

21. The Built Heritage citation states that:

The significant fabric is defined as the exterior of the entire house (including verandah, carport and brick paving), with a nominal curtilage (minimum five metres to all sides) to preserve its immediate setting.

22. Given the nature of the site and the dwelling, a nominal curtilage as suggested would not be sufficiently respectful of the physical attributes of the dwelling and which are considered to be of local heritage significance. For the following reasons I would propose a different heritage curtilage.

23. It is clear that the dwelling and the “function centre” elements form two distinct parts of the site, i.e. the private dwelling and the public function area and elements both being connected by a brick path. The dense planting abutting the verandah reinforces the sense of privacy and the verandah and front door beneath it also confirms the orientation of the house to the north-east. In my opinion these are the principal heritage attributes which any curtilage should address.

24. In addition, the curtilage also should make sense on the ground rather than being an arbitrary dimension out from the dwelling without any specific reference to on-ground features. In this regard, and noting that there is a proposal to subdivide the site, any curtilage should also factor in the requirements and practicalities of lot sizes and locations, the access road and any public footpath. While these can be located variously the actual steep terrain on parts of the site poses a degree of constraint with regard to the future construction of dwellings. Further there are no particular requirements for all lots to be square or rectangular, or similar, in shape, or all of the same size.

25. The existing dwelling is proposed to be on Lot 10 which will be of a somewhat irregular shape. I was advised that at the south-east end, a distance of 7 metres from the dwelling’s verandah is required for vehicle access from the proposed internal road although I am advised that 6 metres would be adequate. At the north-east (front) a 5 metre curtilage would be beyond the far side of the brick path and would exclude the gully. On the south- west side there is a concrete path and immediately beyond that the land rises steeply and for that reason it is of limited use for any built form. On this rear side, the heritage curtilage could extend to the rear boundary, or not, as there would be limited future impact on the setting of the dwelling from this aspect. At the north-west end (side) the dwelling is in proximity to some sleeper steps rising from the brick path to the elevated bench on which the dwelling sits. The steps abut the office/toilet block of the function centre and this building has no heritage significance and should be excluded from any heritage curtilage. At this end of the dwelling a boundary which retains the steps or a new accessway on the dwelling lot would suffice.

26. In my opinion, a heritage curtilage which generally followed these dimensions would enable an appropriate setting for the dwelling to be retained. 3.0 Conclusions

27. The only element of any heritage significance which has been found on the site is the Alistair Knox mud-brick dwelling and this is not being challenged. Therefore the heritage imperative is to retain it and to provide an adequate setting for the dwelling.

28. In my opinion, a heritage curtilage which generally follows my suggestions, based on the reasons set out above, would be appropriate.

29. There is no justification, based on the reports of two heritage consultants, Council’s own investigations and my site inspection, to extend any heritage curtilage to cover the garden or any outbuildings or structures in it. 4.0 Declaration

30. I have made all the inquiries that I believe are desirable and appropriate and no matters of significance which I regard as relevant have to my knowledge been withheld from the Panel.
