(A Revisionist History) Kevin Jon Heller* The question “what is an international crime?” has two aspects. First, it asks us to identify which acts qualify as international crimes. Second, and more fundamentally, it asks us to identify what is distinctive about an international crime. Some disagreement exists concerning the first issue, particularly with regard to torture and terrorism. But nearly all states, international tribunals, and ICL scholars take the same position concerning the second issue, insisting that an act qualifies as an international crime if—and only if—that act is universally criminal under international law. This definition of an international crime leads to an obvious question: how exactly does an act become universally criminal under international law? One answer, the “direct criminalization thesis” (DCT), is that certain acts are universally criminal because they are directly criminalized by international law itself, regardless of whether states criminalize them. Another answer, the “national criminalization the- sis” (NCT), rejects the idea that international law directly criminalizes particular acts. According to the NCT, certain acts are universally criminal because international law obligates every state in the world to criminalize them. This Article argues that if we take positivism seriously, as every international criminal tribunal since Nuremberg has insisted we must, the NCT provides the only coherent explanation of how international law can deem certain acts to be universally criminal. 63 Section 7: Criminal Offense, Criminal Responsibility, and Commission of a Criminal Offense Article 15: Criminal Offense A criminal offense is an unlawful act: (a) that is prescribed as a criminal offense by law; (b) whose characteristics are specified by law; and (c) for which a penalty is prescribed by law. Commentary This provision reiterates some of the aspects of the principle of legality and others relating to the purposes and limits of criminal legislation. Reference should be made to Article 2 (“Purpose and Limits of Criminal Legislation”) and Article 3 (“Principle of Legality”) and their accompanying commentaries. INTRODUCTION Ever since Herbert Packer published "Two Models of the Criminal Process" in 1964, much thinking about criminal justice has been influenced by the construction of models. Models pro- vide a useful way to cope with the complexity of the criminal pro- cess. They allow details to be simplified and common themes and trends to be highlighted. "As in the physical and social sciences, [models present] a hypothetical but coherent scheme for testing the evidence" produced by decisions made by thousands of actors in the criminal process every day.2 Unlike the sciences, however, it is not possible or desirable to reduce the discretionary and hu- manistic systems of criminal justice to a single truth. -

The objective of this study was to identify homicide characteristics from behaviors carried out on the crime scene and victim characteristics associated with those of the perpetrators of these crimes in Spain. The sample consisted of 448 homicide cases from the database of the Homicide Revision Project led by the Office of Coordination and Studies of the Secretary of State and Security. After creating six classification tree models, it was found that the modus operandi of the aggressor and the victim characteristics may permit hypothesizing about the demographic characteristics of the perpetrator (gender, age, and country of origin), his/her criminal record, and the type of relationship with the victim. Furthermore, the importance of the study of victimology during a criminal investigation is highlighted, as it may indirectly offer information about the potential perpetrator. -

VICTIMOLOGY – PAST, PRESENT AND FUTURE John P. J. Dussich* I. HISTORICAL OVERVIEW OF VICTIMOLOGY A. The Early Roots The word “victim” has its roots in many ancient languages that covered a great distance from north- western Europe to the southern tip of Asia and yet had a similar linguistic pattern: victima in Latin; víh, wéoh, wíg in Old European; wíh, wíhi in Old High German; vé in Old Norse; weihs in Gothic; and, vinak ti in Sanskrit (Webster’s 1971). Victimology as an academic term contains two elements: • One is the Latin word “Victima” which translates into “victim”. • The other is the Greek word “logos” which means a system of knowledge, the direction of something abstract, the direction of teaching, science, and a discipline. Although writings about the victim appeared in many early works by such criminologists as Beccaria (1764), Lombroso (1876), Ferri (1892), Garófalo (1885), Sutherland (1924), Hentig (1948), Nagel (1949), Ellenberger (1955), Wolfgang (1958) and Schafer (1968), the concept of a science to study victims and the word “victimology” had its origin with the early writings of Beniamin Mendelsohn (1937; 1940), these leading to his seminal work where he actually proposed the term “victimology” in his article “A New Branch of Bio-Psycho-Social Science, Victimology” (1956). It was in this article that he suggested the establishment of an international society of victimology which has come to fruition with the creation of the World Society of Victimology, the establishment of a number of victimological institutes (including the creation here in Japan of the Tokiwa International Victimology Institute); and, the establishment of international journals which are now also a part of this institute. -

CRIN takes full responsibility for any errors or inaccuracies in the report. I. What is the legal status of the Convention on the Rights of the Child (CRC)? A. What is the status of the CRC and other relevant ratified international instruments in the national legal system? The CRC was signed by Mexico on 26 January 1990, ratified on 21 November 1990, and published in the Federal Official Gazette (Diario Oficial de la Federación) on 25 January 1991. In addition to the CRC, Mexico has ratified the Optional Protocols relating to the involvement of children in armed conflict and the sale of children, child prostitution and child pornography. All treaties signed by the President of Mexico, with the approval of the Senate, are deemed to constitute the supreme law of Mexico, together with the Constitution and the laws of the Congress of the Union.1 The CRC is therefore part of national law and may serve as a legal basis in any proceedings before the national courts. It is also part of the supreme law of Mexico as a whole and must be implemented at federal level and in all the individual states.2 B. Does the CRC take precedence over national law The CRC has been interpreted to take precedence over national laws, but not the Constitution. According to doctrinal thesis LXXVII/99 of November 1999, international treaties are ranked second immediately after the Constitution and ahead of federal and local laws.3 On several occasions, Mexico’s Supreme Court has stated that international treaties take precedence over national law, mainly in the case of human rights.4 C. -

82 — Elon Journal of Undergraduate Research in Communications, Vol. 9, No. 1 • Spring 2018 A Content Analysis of Crimes Posted on Social Media Platforms Alessandra Brainard Strategic Communications Elon University Submitted in partial fulfillment of the requirements in an undergraduate senior capstone course in communications Abstract With an increasing rate of violent crimes across the country as well as an uptick in crime in the news, perpetrators have turned to social media to gain attention, posting their crimes online. This study analyzed the motives of individuals who post their crimes on social media. By incorporating Sigmund Freud’s theories on guilt and utilizing a narrative criticism of testimony, the findings demonstrate a lack of remorse and guilt on the part of criminals who conduct unlawful acts, such as drunk driving, gang rape, and murder. The study concluded that the rationale behind committing the crime and posting evidence of the illegal activities on social media outlets stems from the drive of human beings to be recognized by others in their environment and social media communities. I. Introduction Historical Context With a skyrocketing presence of violent crimes across the country as well as an increase in crime in the news, perpetrators are turning to social media to gain attention by posting their crimes on social media platforms. The FBI’s Uniform Crime Report showed an increase in violent crime in 38 out of 50 states in 2016 (FBI, 2016). Attorney General Jeff Sessions, who has attempted to raise awareness around this issue, has declared, “The Department of Justice is committed to working with our state, local, and tribal partners across the country to deter violent crime, dismantle criminal organizations and gangs, stop the scourge of drug trafficking, and send a strong message to criminals that we will not surrender our communities to lawlessness and violence” (The United States Department of Justice, 2017).
