RCI was asked to verify and augment (if necessary) the Vegetation and Wildlife sections of the 1995 Bluffs Environmental Impact Report (EIR) for inclusion in the Initial Study for the Project. The Town requested site-specific analyses to: 1) Review and determine the applicability and conformance with the impact analysis and mitigation measures specified in the 1995 Bluffs EIR, and 2) Conduct additional site reconnaissance of the VTPM/UPA Project Site (approx 4.3 acres) as well as the two additional parcels (labeled LLA 08-001 Parcels 1 and 2) and the Parcel A, as shown on the attached Sheet 1. On September 8, 2010 two RCI Biologists completed an inspection and site assessment of the VTPM/UPA Project Area and reconnaissance of the 1995 Bluffs EIR Project Area. -

Rose Highway / Reno, NV 89511 775.849.3223 1 1.0 INTRODUCTION Sensitive plant species and Stream Environment Zone (SEZ) surveys were conducted in late July and August 2005, beginning from behind the Road Runner gas station in Meyers, California to Pioneer Trail near Ski Run Boulevard, for the proposed CTC bike path. These surveys augmented those conducted in 2002 and 2003 and were along proposed new bike path alternatives. Surveys were not conducted where the proposed bike path followed hard surfaces (asphalt). Surveys also included noxious weeds. The survey findings will be utilized to assess pre-development conditions and constraints to future land use. The survey included approximately 9 miles, crossing properties owned by the California Tahoe Conservancy (CTC), U.S. Forest Service (LTBMU), the State of California, and the City of South Lake Tahoe. Private property was not surveyed. The proposed bike path alignment is located on the South Lake Tahoe, and Freel Peak USGS 7.5-minute quadrangle maps, within an approximate elevation range of 6,300 to 6,400 feet above mean sea level (msl). SEZs are defined by the Tahoe Regional Planning Agency “…if any one of the following key indicators is present or, on the absence of a key indicator, if any three of the following secondary indicators are present” (TRPA 1988). -

Intro 1996 National List of Vascular Plant Species That Occur in Wetlands The Fish and Wildlife Service has prepared a National List of Vascular Plant Species That Occur in Wetlands: 1996 National Summary (1996 National List). The 1996 National List is a draft revision of the National List of Plant Species That Occur in Wetlands: 1988 National Summary (Reed 1988) (1988 National List). The 1996 National List is provided to encourage additional public review and comments on the draft regional wetland indicator assignments. The 1996 National List reflects a significant amount of new information that has become available since 1988 on the wetland affinity of vascular plants. This new information has resulted from the extensive use of the 1988 National List in the field by individuals involved in wetland and other resource inventories, wetland identification and delineation, and wetland research. Interim Regional Interagency Review Panel (Regional Panel) changes in indicator status as well as additions and deletions to the 1988 National List were documented in Regional supplements. The National List was originally developed as an appendix to the Classification of Wetlands and Deepwater Habitats of the United States (Cowardin et al.1979) to aid in the consistent application of this classification system for wetlands in the field.. The 1996 National List also was developed to aid in determining the presence of hydrophytic vegetation in the Clean Water Act Section 404 wetland regulatory program and in the implementation of the swampbuster provisions of the Food Security Act. While not required by law or regulation, the Fish and Wildlife Service is making the 1996 National List available for review and comment. -

DATE: November 2009 APPROVED BY: DATE: _____________ Name, Forest Botanist, Lake Tahoe Basin Management Unit SUMMARY OF EFFECTS DETERMINATION AND MANAGEMENT RECOMMENDATIONS AND/OR REQUIREMENTS One population of a special-status bryophyte, three-ranked hump-moss (Meesia triquetra), was observed in the survey area during surveys on June 30, 2008 and August 28, 2008. The proposed action will not affect the moss because the population is located outside the project area where no action is planned. The following species of invasive or noxious weeds were identified during surveys of the Project area: cheatgrass (Bromus tectorum); bullthistle (Cirsium vulgare); Klamathweed (Hypericum perforatum); oxe-eye daisy (Leucanthemum vulgare); and common mullein (Verbascum Thapsus). The threat posed by these weed populations would not increase if the proposed action is implemented. An inventory and assessment of invasive and noxious weeds in the survey area is presented in the Noxious Weed Risk Assessment for the Upper Truckee River Sunset Stables Restoration Project (ENTRIX 2009). Based on the description of the proposed action and the evaluation contained herein, we have determined the following: There would be no significant effect to plant species listed as threatened, endangered, proposed for listing, or candidates under the Endangered Species Act of 1973, as amended (ESA), administered by the U.S. -

Fungi Introduction Part 3.1 of this chapter describes landscape-scale vegetation patterns. Part 3.2 describes the vegetative structure, function, and composition of old forest ecosystems, while Part 3.3 describes hardwood ecosystems and Part 3.4 describes aquatic, riparian, and meadow ecosystems. This part focuses on botanical diversity in the Sierra Nevada, beginning with an overview of botanical resources and then presenting a more detailed analysis of the rarest elements of the flora, the threatened, endangered, and sensitive (TES) plants. The bryophytes (mosses and liverworts), lichens, and fungi of the Sierra have been little studied in comparison to the vascular flora. In the Pacific Northwest, studies of these groups have received increased attention due to the President’s Northwest Forest Plan. New and valuable scientific data is being revealed, some of which may apply to species in the Sierra Nevada. This section presents an overview of the vascular plant flora, followed by summaries of what is generally known about bryophytes, lichens, and fungi in the Sierra Nevada. Environmental Consequences of the alternatives are only analyzed for the Threatened, Endangered, and Sensitive plants, which include vascular plants, several bryophytes, and one species of lichen. 4.6.1. Vascular plants4.6.1. plants The diversity of topography, geology, and elevation in the Sierra Nevada combine to create a remarkably diverse flora (see Section 3.1 for an overview of landscape patterns and vegetation dynamics in the Sierra Nevada). More than half of the approximately 5,000 native vascular plant species in California occur in the Sierra Nevada, despite the fact that the range contains less than 20 percent of the state’s land base (Shevock 1996). -
Terr–3 Special-Status Plant Populations
TERR–3 SPECIAL-STATUS PLANT POPULATIONS 1.0 EXECUTIVE SUMMARY During 2001 and 2002, the review of existing information, agency consultation, vegetation community mapping, and focused special-status plant surveys were completed. Based on California Native Plant Society’s (CNPS) Electronic Inventory of Rare and Endangered Vascular Plants of California (CNPS 2001a), CDFG’s Natural Diversity Database (CNDDB; CDFG 2003), USDA-FS Regional Forester’s List of Sensitive Plant and Animal Species for Region 5 (USDA-FS 1998), U.S. Fish and Wildlife Service Species List (USFWS 2003), and Sierra National Forest (SNF) Sensitive Plant List (Clines 2002), there were 100 special-status plant species initially identified as potentially occurring within the Study Area. Known occurrences of these species were mapped. Vegetation communities were evaluated to locate areas that could potentially support special-status plant species. Each community was determined to have the potential to support at least one special-status plant species. During the spring and summer of 2002, special-status plant surveys were conducted. For each special-status plant species or population identified, a CNDDB form was completed, and photographs were taken. The locations were mapped and incorporated into a confidential GIS database. Vascular plant species observed during surveys were recorded. No state or federally listed special-status plant species were identified during special- status plant surveys. Seven special-status plant species, totaling 60 populations, were identified during surveys. There were 22 populations of Mono Hot Springs evening-primrose (Camissonia sierrae ssp. alticola) identified. Two populations are located near Mammoth Pool, one at Bear Forebay, and the rest are in the Florence Lake area. -

Hoch TRIBES EPILOBIEAE, GONGYLOCARPEAE, AND ONAGREAE (ONAGRACEAE) IN NORTH AMERICA, BASED ON PARSIMONY ANALYSIS OF ENDEMICITY AND TRACK COMPATIBILITY ANALYSIS1 ABSTRACT Tribes Epilobieae, Gongylocarpeae, and Onagreae, a monophyletic branch in the family Onagraceae, comprise genera endemic to or having their major basal radiation in the Madrean Floristic Region of southwestern North America. Parsimony analysis of endemicity (PAE) and panbiogeography (track compatibility analysis) were performed in order to seek an historical explanation for the patterns of high diversity and endemicity for the group in this region. Twenty- one areas of endemism are delimited, based on previous biogeographic schemes and presence of endemic plant and animal taxa. Based on distributional data on 173 species, a strict consensus PAE cladogram shows four main groups of areas: northern North America, the central Mexican areas, western North America, and eastern North America. Track compatibility analysis resulted in two strongly supported generalized tracks: one includes eastern North America, and the other western North America. PAE and panbiogeographical analyses of the distributional patterns of these taxa suggest a close relationship of eastern and western North America, with both areas more related to the Neotropics than to the Palearctic, and a rather weak association between northern North America and Asia. The discovery of two tracks in eastern and western North America for Epilobieae, Gongylocarpeae, and Onagreae reveal little relationship of North America with Asia or other continents. These tribes display a distinct but contemporaneous biogeographical history that differs from those of the Holarctic. -

IV. ENVIRONMENTAL IMPACT ANALYSIS D. BIOLOGICAL RESOURCES INTRODUCTION This section of the Draft Environmental Impact Report (Draft EIR) provides a description of the biological resources on the Project site, including the vegetation communities, wildlife, special-status species, sensitive natural communities; a discussion of the regulations that serve to protect sensitive resources; an assessment of the potential impacts of the Project; and recommendations to minimize and mitigate potentially significant impacts on sensitive resources. Various technical reports were prepared and reviewed to analyze the potential biological resources impacts associated with the Project. These technical reports are summarized in the Backgrounds and Methods section below and are included in Appendix D of this EIR. ENVIRONMENTAL SETTING Regional Setting The Project site is located within the Town of Mammoth Lakes, Mono County, California. The Town of Mammoth Lakes (Town) is located on the eastern slopes of the Sierra Nevada Mountain Range at an elevation of approximately 7,900 feet (2,410 meters) above mean sea level (msl) within Section 34, Township 3 South, Range 27 East. It is located approximately 168 miles south of Reno, Nevada, and approximately 310 miles north of Los Angeles, California. Neighboring communities of the Town include June Lake to the northwest, Benton to the east, and Tom’s Place to the southeast (refer to Figure II-1 and Figure II-2). Regional access is provided by U.S. Highway 395 and California State Highway 203. Major arterial which provide access to the site include Minaret Road to the north, Fairway Drive and Old Mammoth Road in the central portions of the site, and Sherwin Creek Road to the east. -

Project and Site description 1.1 Description of proposed projects. The projects are known as the Donner Summit Public Utility District’s Wastewater Treatment Plant Upgrade Project and the Soda Springs Irrigation Disposal Expansion Project. Two parcels of approximately 10 acres and 25 acres will be effected by the proposed facilities upgrade and both are located within Section 22 of the Soda Springs USGS 7.5’ quadrangle map in Nevada County, California. Both are within the watershed of the South Yuba River at elevations between 6,500 and 7,000 feet (1,981 to 2,133 meters). The first parcel, APN #47-021-04, is at the location of the Donner Summit Public Utilities District (DS PUD) office at 53823 Sherrit Lane, north of Interstate 80 and the Norden exit road. -

Summary The Santa Ysabel Ranch Open Space Preserve was established in 2001 from a purchase by The Nature Conservancy from the Edwards Family; the Ranch is now owned by the County of San Diego and managed as a Department of Parks and Recreation Open Space Preserve. It totals nearly 5,400 acres and is comprised of two parcels; an "East Ranch” and a "West Ranch". The East Ranch is east of the town of Santa Ysabel (and Highway 79 running north) and is bordered on the east by Farmer's Road in Julian.
