City of Miami City Hall 3500 Pan American Drive Legislation Miami, FL 33133 www.miamigov.com Resolution: R-20-0161 File Number: 7462 Final Action Date: 5/28/2020 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), MAKING PROVISIONS FOR HOLDING A SPECIAL MUNICIPAL ELECTION CONCURRENT WITH THE PRIMARY ELECTION ON AUGUST 18, 2020 FOR THE PURPOSE OF SUBMITTING TO THE ELECTORATE THE FOLLOWING STRAW BALLOT QUESTION, WHICH SHALL HAVE NO BINDING OR OBLIGATORY EFFECT, TO BE KNOWN AS STRAW BALLOT QUESTION NO. 1: “WOULD YOU SUPPORT REQUIRING THE MIAMI-DADE COUNTY MAYOR, WHO HAS AUTHORITY OVER THE MIAMI-DADE COUNTY AVIATION DEPARTMENT, TO START A PROGRAM TO SCREEN ALL PASSENGERS ARRIVING AT MIAMI INTERNATIONAL AIRPORT FOR THE COVID-19 VIRUS?”; CALLING FOR A STRAW BALLOT SPECIAL ELECTION AND PROVIDING THAT THE STRAW BALLOT QUESTION SHALL BE SUBMITTED TO THE ELECTORATE AT THE SPECIAL ELECTION TO BE HELD CONCURRENTLY WITH THE PRIMARY ELECTION ON AUGUST 18, 2020; DESIGNATING AND APPOINTING THE CITY CLERK (“CLERK”) AS THE OFFICIAL REPRESENTATIVE OF THE COMMISSION WITH RESPECT TO THE USE OF VOTER REGISTRATION BOOKS AND RECORDS; FURTHER DIRECTING THE CLERK TO CAUSE A CERTIFIED COPY OF THIS RESOLUTION TO BE DELIVERED TO THE SUPERVISOR OF ELECTIONS OF MIAMI-DADE COUNTY, FLORIDA ("SUPERVISOR") NOT LESS THAN FORTY- FIVE (45) DAYS PRIOR TO THE DATE OF SUCH SPECIAL ELECTION; FURTHER DIRECTING THE CITY MANAGER TO MEET WITH THE SUPERVISOR TO NEGOTIATE A REDUCTION OF COSTS FOR PLACEMENT OF THE CITY OF MIAMI'S QUESTION ON THE AUGUST PRIMARY BALLOT; AND PROVIDING FOR AN IMMEDIATE EFFECTIVE DATE. SPONSOR(S): Commissioner Joe Carollo WHEREAS, on March 23, 2020, Florida Governor Ron DeSantis entered Executive Order 20-80 relating to Emergency Management-COVID-19-Airport Screening and Isolation (“Executive Order”); and WHEREAS, the Executive Order found that many cases of COVID-19 in the State of Florida (“Florida”) were the result of individuals traveling into Florida from international destinations and other states, resulting in increased exposures to Florida residents; and WHEREAS, Florida has seen an increase in individuals fleeing to Florida from states where "shelter-in-place" were implemented including from the New York Tri-State Area; and WHEREAS, the Executive Order directs that the Florida Department of Health (“DOH”) to take any and all steps necessary to ensure the screening, appropriate isolation, and quarantine of individuals covered by the Executive Order; and City of Miami Page 1 of 4 File ID: 7462 (Revision: A) Printed On: 5/29/2020 File ID: 7462 Enactment Number: R-20-0161 WHEREAS, the Executive Order directs that the DOH coordinate with the Florida Division of Emergency Management, each aviation and airport authority in Florida, county and local governments, and law enforcement agencies to effectuate the isolation or quarantine required by the Executive Order; and WHEREAS, the City Commission wishes to call a special municipal election to be held on August 18, 2020, at which the electorate of the City of Miami (“City”) would vote on a straw ballot question that has no binding effect; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. A special municipal election is called and directed to be held in the City on Tuesday, August 18, 2020, from 7:00 A.M. until 7:00 P.M., for the purpose of submitting the following nonbinding, straw ballot question to the qualified electors of the City for their approval or disapproval: "Would you support requiring the Miami-Dade County Mayor who has authority over the Miami-Dade County Aviation Department to start a program to screen all passengers arriving at Miami International Airport for the COVID-19 virus?" Section 3. The Special Election shall be held at the polling places in the precincts designated, all as shown on the list attached hereto and made a part hereof and referred to as Exhibit “A” or as may be designated by the Supervisor of Elections of Miami-Dade County (“Supervisor”) in conformity with the provisions of the general laws of Florida. The Precinct Election Clerks and Inspectors to serve at said polling places on said Special Election date shall be those designated by the Supervisor for such purpose in accordance with the general laws of the Florida. A description of the registration books and records which pertain to Special Election precincts wholly or partly within the City and which the City is adopting and desires to use for holding such Special Election is all voter information cards, registration books, records, and certificates pertaining to electors of the City and established and maintained as official by the Supervisor in conformity with the provisions of the general laws of Florida are hereby adopted and declared to be, and shall hereafter be recognized and accepted as, official voter information cards, registration books, records, and certificates of the City. Section 4. In compliance with Section 100.342, Florida Statutes (2020), regarding any Special Election not otherwise provided for, there shall be at least thirty (30) days' notice of the Special Election by publication in a newspaper of general circulation in the City. The City Clerk is authorized and directed to publish notice of the adoption of this Resolution and of the provisions hereof at least twice, once in the fifth week and once in the third week prior to the week in which the aforesaid Special Election is to be held in newspaper(s) of general circulation in the City which notice shall be substantially in the following form: NOTICE OF SPECIAL ELECTION STRAW BALLOT QUESTION TO BE HELD ON TUESDAY, AUGUST 18, 2020 City of Miami Page 2 of 4 File ID: 7462 (Revision: A) Printed on: 5/29/2020 File ID: 7462 Enactment Number: R-20-0161 IN THE CITY OF MIAMI, FLORIDA A Special Election will be held on Tuesday, August 18, 2020 from 7:00 A.M. until 7:00 P.M. in the City of Miami, Florida at the polling places in the several Special Election precincts designated by the Board of County Commissioners of Miami- Dade County, Florida as set forth herein unless otherwise provided by law and submitting to the qualified electors of the City of Miami, Florida the following non-binding straw ballot question: "Would you support requiring the Miami-Dade County Mayor who has authority over the Miami-Dade County Aviation Department to start a program to screen all passengers arriving at Miami International Airport for the COVID-19 virus?” Straw Ballot Question No. 1 polls the electors of the City regarding whether they would support requiring the Miami-Dade County (“County”) Mayor who has authority over the County’s Aviation Department to start a program to screen all passengers arriving at Miami International Airport for the COVID-19 virus in order to protect County residents from the COVID-19 virus.
