BATTLE OF BRITAIN AIR DISPLAY (JERSEY) ORDER 2005

Made 25th July 2005 Coming into force 25th July 2005

THE ENVIRONMENT AND PUBLIC SERVICES COMMITTEE, on the application of Jersey International Air Display a.r.l. and after consultation with the Connétables of Saint , Saint Lawrence and Saint Peter, in pursuance of Article 2 of the Entertainments on Public Roads (Jersey) Law 1985,1 orders as follows –

1 Battle of Britain Air Display (1) If Jersey International Air Display a.r.l. (in this Order called “the promoter”) complies with the requirements as to insurance cover and public notice in Articles 2 and 3, it may on 15th September 2005 use the public roads specified in paragraph (2) for the purposes of the viewing of the Battle of Britain Air Display. (2) The public roads to which paragraph (1) refers are – (a) People’s Park car park; (b) the parking lay-bys lying first and second on the promenade, when proceeding westward from West Park; (c) Victoria Avenue, between Bel Royal and the Esplanade; (d) Paris Lane; (e) Tyneville Lane; (f) the spur road that leads from Victoria Avenue into St. Aubin’s Road at First Tower; (g) Farley’s Lane; (h) Rue du Galet; and (i) the beach in St. Aubin’s Bay, between the western wall of Elizabeth Marina and the Gunsite slipway, which are collectively called “the site” in this Order.

2 Insurance cover The requirement as to insurance cover to which Article 1 refers is that the promoter shall produce to the Environment and Public Services Committee, not later than 7th September 2005, satisfactory evidence that the promoter is covered by insurance in a manner and to the extent required by the Committee against all liability that may be incurred by – (a) the promoter; (b) any official, agent or servant of the promoter; or (c) any person taking part in the air display, in respect of damage to property, or in respect of the death of or bodily injury to any person, resulting from the holding of the air display or any arrangements made by the promoter in connection with the air display or this Order.

3 Public notice of restrictions (1) The requirement as to public notice to which Article 1 refers is that on 2 occasions during the 5 days immediately preceding 15th September 2005, the promoter shall publish in the Jersey Gazette a notice of its intention to close each part of the site under Article 4. (2) The notice shall specify – (a) the parts of the site that are to be closed; (b) the dates on which and the times between which they will be closed; (c) the restrictions that are imposed by Article 6; and (d) any incidental arrangements that will apply. (3) The notice shall also be certified by the of the States as a notice that is being published in pursuance of this Article.

4 Closure of roads to vehicular traffic (1) The promoter may between 6 p.m. on 14th September 2005 and 6 p.m. on 15th September 2005 close People’s Park car park to all vehicular traffic and vehicles. (2) The promoter may between midnight on 13th September 2005 and 5.30 p.m. on 15th September 2005 close to all vehicular traffic and vehicles the parking lay-bys lying first and second on the promenade when proceeding westward from West Park. (3) The promoter may between 12.30 p.m. and 5.30 p.m. on 15th September 2005 close to all vehicular traffic and vehicles the following public roads – (a) Victoria Avenue, between Bel Royal and the Esplanade; (b) Paris Lane; (c) Tyneville Lane; (d) the spur road that leads from Victoria Avenue into St. Aubin’s Road at First Tower;

(e) Farley’s Lane; (f) Rue du Galet.

5 Closure of beach (1) The promoter may, between 12.30 p.m. and 5.00 p.m. on 14th September 2005 and 12.30 p.m. and 5.30 p.m. on 15th September 2005, close to all vehicular traffic, vehicles and members of the public the beach in St. Aubin’s Bay, between the western wall of Elizabeth Marina and the Gunsite slipway. (2) The promoter may, between 12.30 p.m. and 5.00 p.m. on 14th September 2005, admit vehicular traffic, vehicles and members of the public to the beach in St. Aubin’s Bay, between the western wall of Elizabeth Marina and the Gunsite slipway, although the beach has been closed to such access under paragraph (1).

6 Other restrictions Notwithstanding any other enactment, a vehicle shall not wait on either side of St. Aubin’s Road, between West Park and Bel Royal between 9 a.m. and 5.30 p.m. on 15th September 2005.

7 Admission of vehicles to view display Notwithstanding Article 4, the promoter may between 12.30 p.m. and 5.30 p.m. on 15th September 2005 admit to the parts of the site to which that Article refers vehicles carrying persons wishing to view the air display.

8 Access (1) Notwithstanding Article 4(2) of the Road Traffic (Saint Lawrence) (Jersey) Order 19902 or Part II of the Second Schedule to that Order, a vehicle may be driven – (a) into St. Aubin’s Road from Route de la Haule; or (b) into Route de la Haule from St. Aubin’s Road, between 12.30 p.m. and 5.30 p.m. on 15th September 2005. (2) Nothing in this Order shall have the effect of preventing access that is reasonably required for vehicles of any class or description to premises (other than Elizabeth Castle) situated on or adjacent to the site.
