Birds of many species have been noted in the Glengarry land. Glen Eden is becoming very developed with housing and intensification of infill. It also provides a much-needed corridor from the suburban Parrs Park through to the Waitakere Ranges, for keystone species such as kereru, which are essential for regeneration of native bush, and the entire New Zealand forest ecosystem. As an active member of the Glen Eden community, I believe that the community would benefit more from keeping the space as a reserve, and also looking at including a community garden, growing native trees, and keeping the access from Milan Reserve to Glengarry Road; as opposed to rezoning this narrow strip of land for housing.

The reason for my or our views are: Needing to maintain green space, the Waitakere Ranges and areas surrounding are the lungs of Auckland. Also, biodiversity - this space has a LOT of biodiversity. We can't keep relying on other areas or pieces of land for this. IF this space is zone changed, continues the 'death by a thousand cuts' to our beautiful part of Auckland. Turn into an accessible, or educational reserve or plant a neighbourhood garden - these are what is needed for our community. Also if zoning changed, will add more cars to Glengarry Road, already are more than enough incidents on this road causing serious injury, especially at West Coast Road intersection. Please keep the existing zoning status. Thank you.

The reason for my or our views are: The proposed zone change by Council will allow for the development of this land for housing. This is a narrow strip of land (at 315A Glengarry Road), that is currently well utilised by many native birds such as tui, waxeye, grey warbler, kereru, fantail, kingfisher, thrush, blackbird, starlings, moreporks and herons. It also has many old trees (although currently not many of them are native - YET). The sale of this land for a housing development which would destroy this wildlife link between Parrs Park and the Waitakere Ranges for our birds (and all future generations) forever. It would be much better utilised as a reserve or current and future generations, to retain the birdsong, teach our families about our wildlife, to plant native trees, and even build a community garden. We all need some green space in our growing metropolis, for our health (physical and mental) and for our community. Once, all this land was home to trees and birds ... this is one of the last strips left. All too quickly the Council it doing away with land that provides food, shelter and linkages for wildlife to other areas of bush that they

need for food and shelter. Having green spaces like this in amongst our residential areas is one of the key things that soften the concrete jungle that expands without restraint across our city. How will Auckland ever become the worlds most liveable city if our natural green spaces (however small) are destroyed like this? These are the very things that make our communities pleasant and livable. This zone change should not proceed and the land use should remain as it is.

The reason for my or our views are: The Glen Eden Residents Association is concerned about the land that is to be rezoned for single house use. This is presently an informal reserve and has been home to hundreds of birds including tui, waxeye, grey warbler (ririoriro), wood pigeon (kereru) Fantail, kingfisher, thrush, blackbird, starlings, moreporks and even white faced herons (matuku, matuku moana). We strongly feel that this areas is used as a green corridor for native birds and we feel that this needs protection. There are other uses that would benefit the wider community to enhance their quality of life. Planting native trees and adding a community garden would be an enhancement for the community. Glen Eden is a mixed socio economic area and we have seen recent extensive growth in the number of community larders set up to meet the needs of our most vulnerable population. A community garden would provide the space for people to grow the produce for these larders and for wider community to use. The area is seeing a significant expansion of housing already and the infrastructure is lacking to support this expansion in a meaningful way that will benefit the quality of life for its residents, taking

away this opportunity will not benefit the local residents and once lost this green space cannot be replicated.

The reason for my or our views are: This is a large 4,000 sq mtr Reserve that creates a great green corridor for wildlife and native birds and provides them with feeding, nesting and roosting areas. We border this area and everyday see fantails and tui and hear Ruru. We also see other birds such as kingfishers, grey warbler wood pigeon, rosella, heron etc. We need to protect mature trees such as those here as we are losing them more and more. The Reserve could be planted in more natives with a path, as we need to encourage people to exercise and enjoy the healthy benefits of nature. The reason for my or our views are: As a resident and scientist I have spent years monitoring bird life in the Waitakere Heritage Area and have seen declines in native and endemic biodoversity almost every year. This is more prominent in the buffer zone. I believe these fragments of urban tree life is vital to supporting the Native bird population within the heritage area. This site in particular is council owned and therefore one of the few chances we have to save remnant urban tree stands. Glen Eden is doing a lot to help the housing crisis - a 10 story block is being erected int he town centre with a lot more intensification to come, however it appears we are also losing our trees in the process at other sites like this one. This site would make for a great park, community garden etc and plays an important role in providing habitat for bird and invertebrate life.

1. Introduction 1.1. Summerset Villages (Parnell) Limited (“Summerset”) is the owner and operator of a number of comprehensive care retirement villages throughout New Zealand. Summerset is the owner of 23 Cheshire Street, Parnell, a 2.4ha ‘Mixed Use’ zoned property located between the Parnell Train Station and Cheshire Street, and has aspirations to develop a comprehensive retirement village facility on this brownfield site to contribute to the provision of aged and care accommodation in the Auckland Region. 1.2. Auckland Council proposes to re-zone the site at 41 Cheshire Street from ‘Open Space – Informal Recreation’ (“Open Space”) to ‘Business – Mixed Use’ (“Mixed Use”) in the Auckland Unitary Plan (Operative in Part), following a process which has confirmed that the land is ‘cleared for disposal’. 1.3. The site at 41 Cheshire Street is immediately adjacent (to the east of), and shares a common boundary with, Summerset’s site at 23 Cheshire Street. 1.4. The property at 41 Cheshire Street (“the site”) has an area of 348m2. The site is a vacant, heavily vegetated, steep land form situated between the cul-de-sac / parking area on Cheshire Street to the east and Summerset’s land to the west. The Summerset land to the north of 41 Cheshire Street is zoned Mixed Use and is occupied by a two- three storey commercial office building. The land to the east (across Cheshire Street) is zoned Mixed Use and is occupied by a two-three storey commercial building. The land to the south is zoned Residential – Terrace Housing and Apartment Buildings (“THAB”) and is occupied by a single storey residential dwelling. 1.5. The Mixed Use zoned land to the north and east of 41 Cheshire Street is subject to a “Height Variation Control”, which provides for buildings up to 27m in height. 1.6. The Mixed Use zoned land to the north, east and west of 41 Cheshire Street is subject to the “Centre Fringe Office Control” which provides for office activities as a permitted activity within the Mixed Use zone (but caps the number of car parking

spaces that can be provided for such an activity) in locations on the fringe of the City Centre.
2. Scope of Submission 2.1. Summerset’s submission relates to: (a) the proposed Mixed Use zoning of the site; and (b) the appropriateness of applying other relevant Unitary Plan controls consistent with the adjacent Mixed Use zoned land.
3. Submission Mixed Use zoning 3.1. Summerset supports Council’s proposal to re-zone the land at 41 Cheshire Street from Open Space to Mixed Use, consistent with the neighbouring landholdings to the north, east and west of the site. 3.2. The section 32 analysis undertaken by Panuku Development Auckland (“Panuku”) explains that the proposed re-zoning “does not represent a loss of public amenity for the region”1 as the site’s reserve status was “removed through the reserve revocation process under the Reserves Act 1977.”2 The land is currently vegetated with a combination of mature trees and low shrubbery (including pest species) and relative to its proportions and contour is not usable or functional for outdoor informal recreation activities and community uses, such as walking, running, cycling, relaxing and socialising, picnics, playing and enjoying the environment. 3.3. Summerset agrees that the land should be rezoned Mixed Use, rather than THAB (being the adjacent zoning to the south) as the size, shape and topography of the site would preclude it from being practically incorporated into the adjacent residential property in the future. Summerset agrees that “the land area, site configuration and topography impose significant constraints on the development of this site either independently or in conjunction with the adjoining site at 45 Cheshire Street”3, such that a THAB zone is not appropriate. Application of the Mixed Use zoning will “ensure that any future development will be consistent with the character of the receiving environment and also allow the site to be amalgamated with the adjoining properties without resulting in split zoning.”4
Other relevant Unitary Plan controls 3.4. In undertaking an assessment to rezone land, it is appropriate to consider whether any other relevant Unitary Plan controls should also apply to the land following its successful rezoning, as opposed to simply considering the rezoning of land in isolation.

3.5. Consideration of other mechanisms that the Unitary Plan offers (in addition to zoning) would provide a comprehensive analysis of the appropriate planning framework for the land. Such an approach is considered best practice and it would be remiss to not consider the suitability of other controls/standards that may be appropriate to be applied to the land coincident with the review of the zoning. 3.6. In the vicinity of 41 Cheshire Street, the balance of Mixed Use zoned land that has frontage to Cheshire Street is also subject to the following additional Controls: (a) Height Variation Control – Parnell 27m (“HVC”) - the HVC is a mechanism contained in the Unitary Plan to enable greater height in areas identified for intensification (or to restrict height in certain circumstances). The standard building height in the Mixed Use zone is 18m (comprised of 16m occupiable height and 2m roof form).5 All of the Mixed Use zoned land that has frontage to Cheshire Street is subject to the HVC. The HVC provides for a building height of 27m (comprised of 25m occupiable height and 2m roof form) on all of these properties. (b) Centre Fringe office control (“Office Control”) - the Office Control provides for office activities to occur within the Mixed Use zone as a permitted activity (irrespective of the gross floor area of the office activity) in locations proximate to the City Centre zone. The Office Control also limits car parking for office activities to 1 space per 60m2 GFA, acknowledging the availability of public transportation in these parts of the City. 3.7. The extent to which these provisions apply to the land surrounding the site at 41 Cheshire Street is illustrated within Attachment 1. 3.8. Summerset’s submission is that that the HVC and Office Controls should also apply to the site (coincident with its Mixed Use rezoning), consistent with the application of these controls to neighbouring Mixed Use zoned land that has frontage to Cheshire Street.
Section 32 analysis 3.9. Attached is an evaluation, consistent with the approach undertaken by Panuku in determining which zoning which should be applied, in accordance with section 32 of the Resource Management Act 1991 confirming the suitability of incorporating a HVC and Office Control coincident with the Mixed Use rezoning of the land.
4. Relief sought 4.1. Summerset seeks the following relief: (a) That the site at 41 Cheshire Street be rezoned Mixed Use. (b) Coincident with the rezoning to Mixed Use, that a Height Variation Control be applied to the site at 41 Cheshire Street to provide for a height of 27m. (c) Coincident with the rezoning to Mixed Use, that the Centre Fringe Office Control be applied to the site at 41 Cheshire Street.

The reason for my or our views are: There are far too few trees left thanks to be detrimental changes made to the Resource Management Act which no longer protects trees. All around us trees are dying from Kauri disease or Mirtle disease yet the Council sees fit to let developers bulldoze down entire areas of still surviving native trees in favour of yet more houses for yet more immigrants. What about the birdlife that uses these trees as a safe haven, what about people who need trees to keep the air clean and provide CO2, what about protecting native trees that has stood the test of time for hundreds of years... does everything have to give way so some miserly developers can make $$ with total disregard for the disastrous concrete jungle they leave behind?

It also has significant leases over the park eg Hoani Waititi Marae, and is mostly made up of playing fields. This parkland would provide a pocket park/ neighbourhood space that could be developed for community purposes. The lifting of the Reserves Act status and sale of the land was opposed by the Waitakere Ranges Local Board.

Many NATIVE birds are nesting and roosting there. The Glen Eden and Waitakere community could also appreciate using this green area for a community garden or suchlike, or further planting of native shrubs and trees. There is currently plenty of residential and commercial building going on in the area generally.

Dear Sir/Madam, first of all humble apologize for delay in filing the submission. Believe that considering long weekend it won't be a problem for filing it. As the owner of 34 Harbour View Rd property we would like to raise our concern with regards to proposed plan change and as the consequence of it building high rice (3 stores) townhouses. This type of construction will create adverse effect on our property by blocking completely sunlight from one side of the house. If building of new properties on this land will go ahead we are sincerely asking you to limit it to one store buildings. Could you please consider our proposal in your planning.
