Bryant, City Administrator Date: June 28, 2018 Subject: City Council Meeting of July 2, 2018 MAYOR’S MESSAGE This is the Mayor’s appointment of Kristen Spiller, 16 Cheverus Road, Cape Elizabeth, an employee of Westbrook Housing Authority, as a Constable for the City of Westbrook. ORDERS OF THE DAY 2018-90 This is an award of bid to Green Mountain Pipeline Services of Bethel, Vermont, low bidder in the amount of $90,658 for the rehabilitation (relining) of sewer lines on Church, Lamb, Lyman, Lincoln and Bernadette Streets. Whenever the necessary conditions exist, the city looks to utilize this relining technology to realize a reduction in cost, construction time and the disruption caused by the excavation of city streets. This is a proven technology that has been successfully utilized throughout the city. The city received two bids for this work, which is funded in the Sewer User Account. Wastewater Division Manager Katherine Kelly (formerly Gray) will be at Monday’s meeting to respond to any questions. This award of bid is supported by the Administration and is in order for second and final reading. 2018-91 This is the approval of a contract with Autotronics of Bangor for the purchase of a re-mounted ambulance for the Westbrook Fire & Rescue Department, at a total purchase price of $127,050. This vehicle will include a new, 2018 Ford E-450 cab and chassis, with a remounted Braun Ambulance Module. This purchase replaces a 2008 ambulance that has become a recurring maintenance issue and is being traded in toward this purchase. The department has successfully utilized the remounting of ambulance modules onto new chassis as the functional life of the modules is two to three times longer than the chassis. The remount represents Page 3 of 97 a significant savings and we have had excellent experience with our remounted units. This ambulance replacement is funded in the 2017-18 Capital Improvement Program. This purchase is supported by the Administration and is in order for second and final reading. 2018-92 This authorizes the purchase of fifty-two (52) new and replacement parking signs for the downtown to Perma-Line Corp, Easton, Massachusetts at a total cost of $6,418.86. This new signage is a key part of our enhanced parking management program for the downtown, which was initiated by downtown businesses and facilitated through the efforts of Discover Downtown Westbrook and the Westbrook Gorham Chamber of Commerce. Perma-Line is a company utilized by the Public Services Department and provided very aggressive pricing for this project. This project is funded through the Economic Development portion of the Mayor’s Budget. A sample sign will be on display at Monday’s City Council meeting. Both Economic Development Director Dan Stevenson and Planning & Code Enforcement director Jennie Franceschi have put in a lot of effort to pull this program together. This authorization is supported by the Administration and is in order for second and final reading. NEW BUSINESS Business Licenses 1. This is an update on the Food Service License for Don’s Lunch, operated at 925 Main Street. This license renewal was approved on May 7, 2018, contingent on the following conditions: (1) Don’s Lunch (Mobile) would erect an eight (8) foot high solid panel fence to serve as a buffer along the easterly property boundary of 925 Main Street, not later than June 21, 2018, and (2) the business would close not later than 10pm Monday – Thursday, and 1am on Saturday and Sunday mornings. The deadline for erecting the fence has passed and the licensee is now in violation of the conditions placed on his Food Service license approval by the City Council. The business has not been operating since early last week. Craig Bernier, owner of Don’s Lunch, and the three residential neighbors at 917 Main Street, have all been notified that this matter is on Monday’s city council agenda for an update. This is an informational update and does not require any action by the City Council. 2. This is a Public Hearing on an application for a new State Liquor License from Top Kabab, 888 Main Street. This is an existing business which is seeking permission to add liquor to its current food service establishment services. The Police Department finds no reason for denial of this new application for a State Liquor License, which is in order for final council action. 3. This is an application for renewal of State Liquor Licenses from BreaLu Cafe, 9 Cumberland Street. The Police Department finds no reason for denial of the Page 4 of 97 renewal applications for State Liquor Licenses, which are in order for final council action. Resolves 2018-10 This resolve confirms the Mayor’s reappointment of Bonnie Molten, 30 Liza Harmon Drive, Rene Daniel, 23 Beechwood Avenue, and Thomas Perrey, 8 Merrill Road to the Westbrook Housing Authority Board of Commissioners. Conformation of this Mayor’s appointment is in order for council action. 2018-11 This confirms the Mayor’s appointment of Finance Director Suzanne Knight as interim Tax Collector, effective July 20, 2018, temporarily replacing Jordan Shelburne who has accepted the position of Controller for the City of South Portland. The Certificate of Settlement and Recommitment of Taxes will be prepared for approval at the July 16, 2018 City Council meeting. We have already begun our recruitment of a new Tax Collector. This confirmation is in order for council action. Two-Reading Orders 2018-93 This is the approval of the annual vendor list for General Fund accounts. This provides pre-approval for vendors that are utilized on a regular and recurring basis, such as utilities, suppliers and maintenance contractors. These approvals are tied to budget appropriations for the specific categories of expenditures, which cannot be exceeded without prior approval of the City Council. These vendor approvals are presented at the outset of each budget year. These approvals are supported by the Administration and are in order for first reading. 2018-94 This is the approval of the annual vendor list for Recreation Fund accounts. As with the previous item, this provides pre-approval for vendors that are utilized on a regular and recurring basis, such as utilities, suppliers and maintenance contractors. These approvals are tied to budget appropriations for the specific categories of expenditures, which cannot be exceeded without prior approval of the City Council. These vendor approvals are presented at the outset of each budget year. These approvals are supported by the Administration and are in order for first reading. 2018-95 This is the approval of the annual vendor list for Parking Garage Fund accounts. As with the previous item, this provides pre-approval for vendors that are utilized on a regular and recurring basis, such as utilities, suppliers and maintenance contractors. These approvals are tied to budget appropriations for the specific categories of expenditures, which cannot be exceeded without prior approval of the City Council. These vendor approvals are presented at the outset of each budget year. These approvals are supported by the Administration and are in order for first reading. Page 5 of 97 2018-96 This is a proposed amendment to the Land Use Ordinance, Chapter VIII, Penalty Provisions, Section 805- Stop Work Order, authorizing the Code Officer to issue Stop Work Orders when it is determined that there has been a violation of the Land Use Ordinance or any other provision of this Code of Ordinances or State Statute.
