BREAKING FREE FROM INSANITY: A WHITE-COLLAR CRIME APPROACH TO DRUG WAR POLICY By Brian Harrison* I. INTRODUCTION Preventing crime should be a top priority for law enforcement. A victim of crime would readily agree that never having been a victim at all is preferable to suffering at the hands of a criminal. Even if the criminal is later caught and pun- ished, a victim remains a victim. Despite this simple truth, current drug policy does not place a top priority on preventing the laundering of drug-tainted money. As a result, the United States remains a victim in the War on Drugs.' As will be discussed, the crime of money laundering can be prevented in many instances by prosecuting banks that fail to keep drug-tainted money out of the financial system. The highest levels of law enforcement agree that illegal trafficking of con- trolled substances - drug dealing - is big business.2 Our country is a victim every time a drug trafficking organization successfully launders money for its business.3 Yet, tracing laundered money after it has made its way into the financial system should not be the focus of anti-money laundering efforts because it focuses on detection of a crime after it has occurred; our country remains a victim in this * J.D., Baylor University School of Law. Anti-money laundering policy should focus on prevention - stopping money from entering into the financial system. Focusing policy on the prevention of money laundering instead of after-the-fact detection is consistent with well- founded principles of white-collar crime that should be applied to drug trafficking organizations as big businesses.4 Only when this policy shift occurs will the United States be effective in combating drug-trafficking organizations. A radical change of perspective is required: the United States must be placed in the role of a business. Then, drug trafficking organizations must be treated like employees engaged in crimes against their employer, in this case the United States.5 The United States, as the employer, would quite naturally want to prima- rily focus on preventing the drug-trafficking organizations, as the employee, from committing any crime in the workplace. Good business practices dictate that pre- vention of internal crime must be a high priority.6 Every chief executive officer ("CEO") knows that embezzlement is a reality of running a business.' Imagine the absurdity of a CEO standing up at a meeting and announcing to managers that they need not worry about embezzlement by employees because it will be discovered at some point in the future. The reality is that the CEO tells his man- agers to create policies that discourage and strive to prevent embezzlement, illus- trating that those who violate this preventative policy will be severely punished.' In order to truly combat drug trafficking organizations in our country, policy must do more than just call drug dealing a business. Instead, white-collar crime principles must be applied to the drug trafficking organizations as businesses. An- alyze the problem as if it were white-collar crime, with the United States in the role of a business and drug trafficking organizations as the employees of that business. This approach, while unorthodox, demonstrates why current anti- money laundering policy primarily focused on detection is flawed drug policy. This article argues that prioritizing prevention ahead of detection would deter the drug business more effectively than continued or increased efforts focused on tracing and seizing laundered money. BREAKING FREE FROM INSANITY 131 detect money laundering will produce the same result, and our country will con- tinue to be victimized by drug trafficking organizations. The second part of this article explains the white-collar crime principle of prioritizing prevention before detection. The third part of the article discusses shifting the focus of anti-money laundering policy to prevention by aggressively prosecuting banks that violate current laws designed to prevent money laundering. II. PREVENTION BEFORE DETECTION A basic principle of white-collar crime is that prevention of internal crime is more effective than detection.9 The earlier example of the CEO, while simplistic, demonstrates why this not only makes sense, but is true. Preventing crime within a business is accomplished through internal policies that discourage employees from engaging in the activity.' 0 Where prevention fails, internal policy shifts fo- cus to detect those employees who defy the policy designed to prevent internal crime." The United States should align priorities with this basic principle of white-collar crime so that prevention of money laundering is at the forefront of efforts to disrupt drug businesses. Successful internal policies implement what are commonly referred to as inter- nal controls. 12 Internal controls can be thought of as checks-and-balances within a business.' 3 These checks-and-balances properly place emphasis on prevention rather than detection in a successful business. As an example, imagine a fruit stand that receives fresh fruit each morning from a supplier. At the end of each business day, any fruit that has spoiled is discarded at a loss to the owner. The owner only has one employee who is re- sponsible for receiving the fresh fruit each morning and also responsible for dis- carding spoiled fruit at the end of each day. In some cases, the caller may even be asked for a wired payment or credit card information. Lottery Scams In foreign lottery scams, you receive an email claiming that you are the winner of a foreign lottery. All you need to do to claim your prize is send money to pay the taxes, insurance, or processing or customs fees. Sometimes, you will be asked to provide a bank account number so the funds can be deposited.

The 62-count indictment, returned by a federal grand jury in Newark, New Jersey today, alleges that the 19 individuals from across the United States and in several foreign countries conspired with others to operate "Shadowcrew," a website with approximately 4,000 members that was dedicated to facilitating malicious computer hacking and the dissemination of stolen credit card, debit card and bank account numbers and counterfeit identification documents, such as drivers' licenses, passports and Social Security cards. The indictment alleges a conspiracy to commit activity often referred to as "carding" -- the use of account numbers and counterfeit identity documents to complete identity theft and defraud banks and retailers. Executive Summary Money laundering is a critical step in the cyber crime process which is experiencing some changes as hackers and their criminal colleagues continually alter and optimize payment mechanisms. Conducting quantitative research on underground laundering activity poses an inherent challenge: Bad guys and their banks don’t share information on criminal pursuits. However, by analyzing forums, we have identified two growth areas in money laundering: Online gaming—Online role playing games provide an easy way for criminals to launder money. This frequently involves the opening of numerous different accounts on various online games to move money. Micro laundering—Cyber criminals are increasingly looking at micro laundering via sites like PayPal or, interestingly, using job advertising sites, to avoid detection. Moreover, as online and mobile micro-payment are interconnected with traditional payment services, funds can now be moved to or from a variety of payment methods, increasing the difficulty to apprehend money launderers. Micro laundering makes it possible to launder a large amount of money in small amounts through thousands of electronic transactions. One growing scenario: using virtual credit cards as an alternative to prepaid mobile cards; they could be funded with a scammed bank account – with instant transaction – and used as a foundation of a PayPal account that would be laundered through a micro-laundering scheme. Globalization and technological innovation have fostered the expansion of both legitimate and criminal operations across physical borders as well as throughout cyberspace. "That's heat right there," he told his two passengers -- 29-year-old girlfriend Bridget Trevino, and his crime partner Kim Marvin Taylor, a balding, middle-aged master of fake identities he'd met on the internet. It was November 2002, and Thomas, then a 44-year-old Texan, was in Washington to collect more than $30,000 in merchandise that a Ukrainian known as "Big Buyer" ordered from Outpost.com with stolen credit card numbers. His job was to collect the goods from a mail drop, fence them on eBay and wire the money to Russia, pocketing 40 percent of the take before moving to another city to repeat the scam. But things didn't go as planned. Ignoring Thomas' suspicions, Taylor walked into the Meadow Creek Professional Center to collect the Outpost shipment, and found the cops waiting for him. Thomas and his girlfriend tried to escape in the Cadillac but were caught half a mile away. An ID badge that Taylor wore when he was arrested indicated that he worked for Microsoft.

    DATA BREACHES: WHAT THE UNDERGROUND WORLD OF “CARDING” REVEALS Kimberly Kiefer Peretti U.S. Department of Justice Computer Crime and Intellectual Property Section Forthcoming in Volume 25 of the Santa Clara Computer and High Technology Journal Data Breaches: What the Underground World of “Carding” Reveals Kimberly Kiefer Peretti1 “Cyber-crime has evolved significantly over the last two years, from dumpster diving and credit card skimming to full-fledged online bazaars full of stolen personal and financial information.”2 Brian Nagel, Assistant Director, U.S. Secret Service Individuals have been at risk of having their personal information stolen and used to commit identity-related crimes long before the emergence of the Internet. What the Information Age has changed, however, is the method by which identity thieves can access and exploit the personal information of others. One method in particular leaves hundreds of thousands, and in some cases tens of millions, of individuals at risk for identity theft: large scale data breaches by skilled hackers. In this method, criminals remotely access the computer systems of government agencies, universities, merchants, financial institutions, credit card companies, and data processors, and steal large volumes of personal information on individuals. Such large scale data breaches have revolutionized the identity theft landscape, in particular as it relates to fraud on existing accounts by use of compromised credit and debit card account information. Large scale data breaches would be of no more concern than small scale identity thefts if criminals were unable to quickly and widely distribute the stolen information for subsequent fraudulent use (assuming, of course, that the breach would be quickly detected).
