Pennsylvania Letter to the FDA Regarding Hand Sanitizer

Hahn Commissioner Food and Drug Administration 10903 New Hampshire Ave Silver Spring, MD 20993 Dear Dr. Hahn: We write to request your urgent attention to the matter of allowing U.S. spirit producers to immediately begin production and distribution of hand sanitizer made at their facilities. Spirit producers are uniquely able to switch their production capabilities from their traditional products to hand sanitizer using existing supplies in their facilities. The Alcohol, Tobacco, Tax, and Trade Bureau (TTB) recently issued guidance that relaxed existing regulations to allow distillers to produce hand sanitizer to be used for these purposes through June 30, 2020. While we are aware that current FDA guidance states that your agency will not act against facilities that prepare alcohol-based hand sanitizers, we believe it is imperative that this guidance extends to non- denatured alcohol. During this crisis, it is critical that businesses are given necessary flexibilities to meet demand for critical sanitary products. Local first responders in our district are already suffering from shortages of products necessary to stop the spread of COVID-19. A continued lack of availability of these products puts first responders, and those they are assisting, at greater risk of contracting the disease. The federal government has a duty to respond, and this simple, technical change to regulatory policy will have a significant impact on civilian and first responder efforts to combat COVID-19. We have local producers ready to begin manufacturing now to fill emergency contracts for USPS and other state and local government agencies. We appreciate your attention to this urgent matter and look forward to your response. On June 11, Washington D.C. fully reopened and lifted the restrictions put in place to stop the spread of COVID-19. Unfortunately, the United States Capitol and the People’s House have failed to do the same. The Capitol remains closed to the American people and the House continues to maintain policies that run contrary to science of COVID-19. It is time for you to reopen the House and get back to serving the American people. Weekly case numbers in the United States have reached their lowest point since March of 2020 at the very start of the pandemic, and every day hundreds of thousands of Americans are being vaccinated. This also holds true for the Washington D.C. metropolitan area and the Capitol Hill community specifically. Over the last two weeks cases are down 36% in Washington D.C. and over 40% in both Virginia and Maryland. On Capitol Hill, no congressional staffer is known to have tested positive in weeks and no Member of Congress is known to have tested positive in months. This can no doubt be attributed to the institution’s steady access to vaccinations.

By passing the CARES Act, Congress acted quickly to respond to the health threat we were yet to fully understand and a shutdown with an unknown end date. At the time, December 31, 2020 was believed to be an appropriate expiration date for numerous emergency measures, including Section 4013, the suspension of Troubled Debt Restructuring (TDR) classification of loans. However, with the end of the year quickly approaching and millions of businesses still in need of relief an extension of Section 4013 along with further forbearance for lenders is critical to our recovery and the survival of businesses in every state of the country. The suspension of TDR classifications has alleviated institutions from an onerous process that in this unique environment would unnecessarily drain their capital accounts and ultimately decrease access to credit for consumers and small businesses in the midst of this exceptional economic downturn. The provision has allowed all financial institutions, particularly those holding commercial mortgages, to modify COVID-19 impacted loans, giving businesses the ability to stay afloat, and substantially increasing the capability of financial institutions to work with their customers so they may recover from the shutdowns.

Due to ongoing workforce shortages, American farmers use the H-2A guestworker visa program to fill vacant farm positions. The most recent available data indicates that approximately 5,000 of these valued essential workers originate from South Africa. We appreciate the Administration’s continued efforts to mitigate the spread of COVID- 19, but we ask that supply chain impacts remain top of mind during these discussions. Without an exemption to the recently imposed travel restrictions, South African H-2A worker absences would have limited the ability of American farms to continue production of food, fuel, and fiber for our nation. We thank you for your flexibility and efforts to provide an exemption for South African H-2A workers in light of national interest. That being said, we request that H-2A workers coming to the United States will be provided similar considerations as appropriate and continue to be exempted from any future travel restrictions. We also request that the State Department review current policies and procedures to ensure that the processing of these visas is not delayed due to COVID-19 related U.S. embassy or consulate closures. American farmers stand ready to implement additional COVID-19 safety protocols in the interest of maintaining worker safety and the continuity of production vital to our national food security interests.

The restructuring of Military Treatment Facilities (MTF) was included in the FY17 NDAA and medical billet cuts were proposed in the FY21 Department of Defense (DoD) budget. These cuts were based on military medical end strength requirements conducted before the coronavirus emergency. The COVID-19 pandemic demands that medical readiness requirements be reassessed and updated with lessons learned based on our nation’s response to the coronavirus emergency. And, we believe one of the lessons learned is that there will be future public health emergencies that strain the civilian system and we have an obligation to adequately provide for MTF’s and medical billets within the Department of Defense. Even before the COVID-19 emergency, we had concerns about downsizing the MTFs. Specifically, our constituents raised concerns about how the civilian community will absorb new patients with TRICARE. As the NDAA requires, the Defense Health Agency needs to complete a review on how proposed reductions in care facilities will affect beneficiaries. This review should be completed before there is a reduction in medical billets or reduction in MTFs. The civilian medical system is strained to capacity and is being augmented with Department of Defense (DoD) medical personnel.

Head Start staff have worked tirelessly and creatively to ensure early childhood learning has continued amid complex circumstances. This has ranged from home delivery of educational resources and summer school hours to facility modifications and double-sessions to achieve COVID-19 social distance protocols. As a result of this dedication, the vast majority of Head Start programs have been open for months deploying responsible COVID-19 operational modifications. In fact, in December 2020, the Centers for Disease Control and Prevention (CDC) cited Head Start as a model for implementation of in-person services because of its successful adherence to CDC guidance and ability to mitigate COVID-19 risk. We collectively commend this effort. We also know that these past fifteen months have been particularly difficult for children with limited resources and the impact of this pandemic will be far more emotional and psychological than physical for most young learners and families at the edge. That is why we strongly encourage the Subcommittee to ensure robust Quality Improvement Funding for science-backed trauma-informed care in the FY22 Labor, HHS, & Education Appropriations Bill.

Coalition Letter to PA Congressional Delegation Opposing President
August 20, 2020 Dear Pennsylvania Members of Congress, President Trump’s recent executive order establishing a “Most Favored Nation” pricing model aims to impose severe price controls over the domestic healthcare industry, effectively allowing foreign nations to dictate American drug prices. This order would be devastating to one of the biopharmaceutical industry’s most important contributions – innovation. By imposing top-down mandates like foreign-based price controls, the federal government would limit biopharmaceutical companies’ ability to invest in the research and development of new, innovative treatments and cures. Given the continued presence of COVID-19, this outcome is clearly unacceptable. America’s biopharmaceutical companies are working at a break-neck pace to develop a safe and effective vaccine for COVID-19. At the same time, this executive order would also threaten thousands of American jobs – both direct company jobs and throughout the supply chain. This is an immense concern since the industry directly accounts for more than 811,000 jobs in the United States and supports a total of 4 million jobs. Consequently, we thoroughly oppose the proposed drug pricing executive order and strongly encourage President Trump to abandon this approach. By imposing artificial foreign price controls, the executive order undermines pharmaceutical companies’ capacity to invest in new, innovative solutions that patients need now. If President Trump wishes to effectively combat the COVID-19 infection and prepare for future pandemics, it will abandon this harmful policy. Together with our partners listed below, we urge you to think about the patients who depend on life-saving medicines and treatments and those who would be most affected by policies that thwart medical innovation.
